Was on the road yesterday.

Decided to do Friday prayers at the Masjid Ubudiah at Kuala Kangsar, the royal capital of Perak. After going through heavy traffic, managed to be there in time. Use the brief opportunity to see the preparation for the crowning ceremony of His Highness Tuanku Nazrin Ibni Sultan Azlan Shah.

Kuala Kangsar is a quint quiet town but the royal status could certainly be turned into a tourist destination. In fact, the whole of Perak could be turned into an educational local tourist destination by using it's history as the theme.

Serious confidentiality and security breach of Singapore banks!

Singapore financial district

Just an after thought to an earlier posting on Jho Loh here.

With so many bank insiders and Singapore authority [read here] and here] leaking information and documents to Sarawak Report, including the one on alleged fake documents of 1MDB's account, investors and depositers particularly large corporations and high networth individuals should be concern with integrity of Singapore's banks. It is time to take out their money and place it somewhere else.

If Sarawak Report could get hold off so many info, documents and e-mail correspondance, then others like their competitors or wife could do so. The way SR reported Singapore Banks' are no more safe and the authorities is keeping quiet about it.

Although many of the more revealing documents is not published, Singapore authorities should be seriously concern with the endless claimed leaked information, documents, and emails by SR.

But, how come no statement from their authorities? Is there truth so they need to hush hush it up? Or are they condoning it?

Perhaps, as per one of the SR revelation, the information and computer system have been hacked to clean any trace of information. These is more serious security breach. or it is SR pre-empting for a possibility. 

Nevertheless, this is not covering up for 1MDB but calling on SR's endless bluff and for making fools of millions of Malaysians. Dato Najib still has to answer for 1MDB. Jho Loh have to take up the challenge by SR to sue them or he should be screwed together with Paris Hilton and Lindsay Lohan!

GST moment at Permatang Pauh?

Panic strikes as majority win at Rompin by-election reduced from about 15,000 to more than 8,000. Some 10,000 voters or about 10% voters did not come out to vote.

Those familiar with Rompin constituency does not see the drop as significant because past wins had always been between 9-11,000. Yesterday's number is not too far from the natural figure. The huge majority enjoyed under the late Tan Sri Jamaluddin Jarjis had long been seen as unnaturally induced. 

Undoubtedly, the concern was the loss of two Felda voting districts to PAS. The immediate reaction was to blame it on PAS's successful instigation on the drop in FGV shares and implementation of GST.

There is the concern of it's impact on Permatang Pauh as it is the same issue focused by PKR here. In addition, the results in Rompin and Permatang Pauh is being seen as indicators to Dato Najib's premiership survival.

Nevertheless, there was happiness for the BN camp as they won two Chinese voting districts won. An early indication for the return to Chinese votes. Will that be the indicator on the change in Chinese votes for Permatang Pauh?


From the early walkabout, there are signs of frustration and animosity building up against Chief Minister Lim Guan Eng within the Chinese community. They begin to stop tolerating his arrogant and lying ways.

The manner he indiscriminately park his PG1 official Mercedes has been the talk among Penangites.

Within the press community, they are all to familiar with his attitude to refuse to take responsibility and quick to blame others. When asked to reply to issues that seemed detrimental to him, he would refuse or go on a tantrum.

All along the thought is the Chinese business community should be happy with his pro-Chinese stance, no NEP policies and preserving of Chew Jetty. To the contrary, certain segment of the community view him as greedy for monopolising the bulk of contracts and projects in Penang.

Some of the Chinese businessmen, which complained under BN rule, are now saying things are not any better under DAP and they are doing a whispering campaign to boycott the election to send the message to Guan Eng.

They remember his promise that he will only stay for 2 terms. This is already his second term.

It is far fetch that the 23% Chinese voters will boycott but it seemed Chinese bookie are already looking for a lower majority of between 6,000-8,000. There was a rumour that the number was sliding down fast that bookies were rejecting bets but propped up by certain party as to not disrupt the stealth campaign strategy of BN.

Overconfidence


It seemed far fetch to think that BN can retake Permatang Pauh. As far as the sight, sound, smell and touch does not seem to show, thus it is difficult to feel so. It looks like a nighmare for the cybertroopers and propagandist working on the psywar to bring a winning perception.

However, confidence is brimming and the Ketua Bahagian, Cikgu Zaidi was smiling at the BN Command Centre last night.

He said sentiment have changed and the community have moved on from the Anwar issue. Anwar and sodomy is hardly spoken in the campaigns by both UMNO and PKR, except for Nik Nazmi at a relatively subdued rally at Tesco Extra, Seberang Jaya.

One warlord after one warlord were talking of never seeing something like this ever. It seemed everything swarmed into Permatang Pauh and there is a marked seriousness in doing election programs at every PDM.

One former Ketua Bahagian said, "There is the signs of winning. Please write that." He must have been the most optimistic. Early in the campaign he said Suhaimi would lose by between 500 and one opposition party source claim Suhaimi to lose by 1,500-2,000 votes.

GST

He was asked, "How about GST issue?"

One on the table said it could effect between 10-20%. So if PAS actually boycott, the actual gain could be negated by GST.

The former Ketua Bahagian said, "Only few Melayu vote based on issues. To get their votes, one need to touch and win their heart. Kasi bereh, gula, dan tepong!"     

"Itu semua barang tak kena GST Tok", a reply slipped in as everyone burst to laughter. The GST perceived result in Rompin could have impact in Permatang Pauh, said someone on the table.


For the last 1-2 weeks, the public anger on GST has reach to a new height as most of the blame were leveled at Dato Ahmad Maslan and Dato Hasan Malek.

Ahmad confidently made all sort of snake oil claims, particularly prices of goods will not go up and botched the top up issue. Replacement of the 5-11% SST by the 6% GST did not resulted in lower prices. Reasons as explained by Lokman Nor Adam, JAS Pemikir here.

Ahmad must be most paling malang for getting blamed for the top up issue. Telco sources said it was agreed a year or two ago that top-up will have GST. If normal telco service is GSTed, then why value added top-up is not?

He may have just returned for London and mistaken Malaysia as England where there is no VAT for top-up. But, blame must also go to MCMC for commenting on tax matter which is not under their jurisdiction. Nevertheless, a directive came to get Dato Shaberry Cheek to address the issue.

Ahmad also made an idiotic claim that Tun Dr Mahathir did not understand GST.

He forgotten that Tun M's administration had explored the idea of GST but not do it out of concern of prices and maybe politics.

Tun M replied back by saying Putrajaya did not understand GST in a talk in Universiti Sains Malaysia. His expressed concern was on implimentation and monitoring of prices. Putrajaya may have missed out on some issues. [Read Hishamh's Economic Malaysia wrote extensively on the economic issues here]

Politically, GST is a risky move on the part of PM. As Senator Dr Asyraff Wajidi said at the famous Sungai Dua Mi Udang eatery, it took developed countries between 2-3 years for the GST mechanism to stabilise. Ahmad Maslan promised 6 months.

Failed communication


Communication is a problem.

Not only the misinformation by Ahmad Maslan, but also the government officers themselves do not understand and it is made more complicated by too many exceptions. Anyway, to blame Ahmad Maslan alone is not fair. He is merely a Deputy Minister and there are two full Minister in Finance Ministry.  

Ultimately, PM cum Minister of Finance gets the brunt of the blame but why is Dato Husni Hanazlah so silent? Lets us be fair to Ahmad too.

Despite planning for 2 years, it is a surprise that Customs Officers could not answer issues raised by  traders and business people in GST courses. It seemed they admitted to not understand GST themselves.

How could they fail to understand a system they plan, will implement and should anticipate the problems? It is heard Customs switch off their computer system and refuse to answer phones on April 1st out of panic. Then, it is the government servants that is at fault. 

Most politicians including Dato Seri Anwar and many current critics of GST commented that it is a good tax system but worry of communication and monitoring. By right it is an administrative issues that should not be politicise. 

Though it seemed PKR's campaign is facing trouble, GST became their core issue at Permatang Pauh.

Victory?


This time, there is no Kak Wan crying on stage and only her dragging the grandkids on stage. The 1MDB issue is talked about but not many understand. Furthermore, the information blackout by 1MDB does not allow much discussion.

PKR relies on loyalty and it seemed loyalty have got them a pre-campaign assured solid support of 25,000. The list and confirmation have been done. Another 10,000 is already a win.

Despite the open quarrel between PAS Permatang Pauh and Penang PAS Youth, PKR is confident of securing the votes of some 3,000 followers of the late Ustaz Hasan in the PAS state seat area of Permatang Pasir.

It is also the same area Penang PAS have trouble to run ceramah and getting cooperation from locals.
 
PKR see a win as a sure thing but it is a matter of how big a majority. Less than 10,000, Azmin will be smiling as he take up the task of taking of Kajang. For less than 5,000, Lim Guan Eng will be taking care of Permatang Pauh.

A loss will make Guan Eng lonely as it indicates a Chinese turnaround to BN and his failing influence. DAP could not place their puppet as Opposition Chief.

How about an UMNO win?

Sure, it is like trusting the mamak politics in UMNO Penang. But, and there is always the but, ... no puns intended to the sensitive Permatang Pauh citizens.

Does DAP and PKR need PAS?

By now, most newspapers and political analysts would have published their analysis of Permatang Pauh by-election.

In this blog's last posting, most of the possibilities were covered and it is just a matter of waiting the outcome of the by-election.

One point most glaring from yesterday's result that need to be highlighted to all political players is that Datin Seri Wan Azixah won without PAS help.

Despite the boycott, she only had a reduction in majority by 3,000 votes. It could mean PKR and DAP or should it be DAP and PKR does not need PAS election machinery.

There will be those that will argue it is only relevent for Permatang Pauh.

In the two by-elections, BN and PKR retained their respective seats. Both saw majority reduced. 

However, BN saw majority reduced by almost 7,000 in Rompin as compared to PKR by almost 3,000 in Permatang Pauh.

PKR's drop in majority with an old recycled candidate did not fair as bad as Rompin's drop in majority

Due credit to BN's Suhaimi, he was up against an MB, aCM and a party President but yet brought her majority lower.

Will that be a case to feature more young candidates?


PKR popular vote dropped was by mere 1.18% from 37,090 (59.19%) to 30,316 (58.01%) but the numerical drop is more prominent by 6,674.

The factors contributing to the drop are believed to be the PAS boycott and Chinese protest to PKR's stance on hudud and recycling Wan Azizah as candidate.

One must admit that low number of outside voters due to weekdays polling and midweek after long 4 days weekend may have contributed to the low turnout.

Wan Azizah could have achieved more than 10,000. Then PKR and PAS would have showed they were able to hold to their voters.

BN popular vote was affected too as it dropped from 25,369 (40.48%)  to 21,475 (41.09%)

The immediate response by various interested groups was to point finger at ato Najib and family, GST, 1MDB, and latest sabotage bomb by a pro-BN blog on Tabung Haji.


Definitely the voters are sending rather strong messages. It is up to the gods of PWTC to contemplate on the results.

Will PAC be effective and fair?

In 6-days from now, on May 19th, the Public Accounts Committee (PAC) will begin their enquiry on the hottest issue of Dato Najib's administration i.e. 1MDB [read Astro here]. The various stakeholders will be called in to present their case and answer enquiries by the 14-member committee.

It is quite a surprise for PAC to begin convening already. Maybe the public pressure has intensified to the point that there should be some progress made. Najib still refuse to answer various allegations on 1MDB but prefer to wait for Auditor general finding. Pressure is piling by the day and minute thus PAC need to commence to relieve off some pressure.

At the early stage, it was the pro-opposition business publications and portals then interspersed by few journo-blogger and opposition leaders. Tun Mahathir came in with his "questions" [read Jebat Must Die list here] and now call have come in from within UMNO. It was only in early May that Auditor General (AG) said audit had began [read MI here] and it will only be ready by June [read Astro here].

Experience tells that PAC could be mere cover-up [read past 2007 postings here]. But, this is a different administration. The concern now is in the effectiveness and fairness of the PAC process.

PAC

PAC is a committee established under the standing order of Parliament for purpose to "examines public account and responds to the Auditor General report on issues involving misappropriation of public funds, and government efficiency and/or ineffectiveness" [Quoting from a paper by Assoc Prof Dr Zakiah Saleh and Dr Haslina Abu Hassan here].


Looking at the workflow chart extracted above, PAC works closely with National Audit Department (NAD), and Accountant General's Department. In the due process of examining public accounts, the various Ministries and Departments will be involved.

PAC relies on the AG's report to initiate investigation on misconduct. This time they will begin without any report from AG thus presumably PAS will be conducting their own "investigation" by calling up the stakeholders.

It is rather odd because other than a few, PAC members are only politicians and not trained and skilled in undertaking auditing, or any form of investigation. With only 1 adminsitrative staff, PAC is not staffed or budgeted to take in staff to undertake investigations. They could not override the AG and direct the NAD staff but they could use "the NAD staff and expertise for its investigation and reporting tasks".

PAC's roles and responsibilities are to inspect:
1. Accounts of the Federation and the appropriated public expenditure granted by Parliament'
2. Accounts of public authorities or any body handling public money,
3. Reports of the AG, and
4. Any other deemed fit by PAC or Parliament.
So enquiring into 100% government-owned 1MDB is within their scope as to ensure things are accounted for, within approved legislation, specified rules adhered, accounts maintained and things done in accordance with approved provision.

They can called on anyone and request any documents. To refuse, it is an offense. But with all that power, they can only:


Can PAC be effective?

Independence

Experience tells that PAC can and have been manipulated in the past.

They say it is because of BN majority in the PAC membership. In that case, SELCAT in Selangor and Penang should allow BN to be the majority but not so. Thus lets not be politically naive to expect BN to allow it.

By the look of things, PAC Chairman, Dato Nurjazlan Tan Sri Mohamed doesn't play games. He is serious about his role and does not mince his words. A distinct difference between ANSARA product and MCOBA (look up past PAC Chairmen).

Questions on PAC ability to undertake investigation has been posed. Their effectiveness raised. How about their independence?

PAC is mostly politicians and their partisan biasness cannot be ignored. More important, some have already express their stance on 1MDB before participating in the PAC enquiry. The Rakyat Post published this letter from reader TS Kong below:
Can PAC be impartial?

PAC have lost semblance of impartiality to begin a hearing 1MDB since its members have either made allegations or statements about 1MDB and thus they have prejudged the matter.

MANY Public Accounts Committee (PAC) members have either made allegations or statements about 1MDB. They have prejudged the matter.

With PAC going ahead to question 1MDB, it would be against the interest of justice and impartiality for PAC members like Tony Pua, Kamarrudin Jaafar and Dr Tan Seng Giaw to sit on the panel.

As accusers, won’t they become judge, jury and executioners by virture of their role as PAC members? If so, PAC can no longer be seen as impartial panel. After all, Tony has already found 1MDB guilty.

Shouldn’t Tony and all PAC members who have prejudged 1MDB be excused from the PAC panel? Is this not the right thing to do in the same way the Opposition has asked for some judges to be excused for the sake of a hearing being impartial.

Instead, they should be called by PAC as witnesses to produce evidence supporting his allegations. When faced with allegations, wasn’t it Tun Dr Mahathir Mohamad who asked…”where is the evidence?”

Tun M is rightly relying on the rule of law and the principle that one is innocent until proven guilty. Burden of proof lies with the accuser.

So, shouldn’t Rafizi who is Member of Parliament and every other MPs who repeated the allegations, such as Lim Guan Eng and Lim Kit Siang, be called to show proof. Or as lawmakers, it is a privilege to break the law.

The simple fact is PAC members, having made allegations and statements about 1MDB, cannot be seen as impartial. They have prejudged the issue. PAC have lost semblance of impartiality to begin a hearing which Nur Jazlan has said could lead to criminal charges.

Common sense dictates that PAC cannot hear the matter and should leave it to the relevant authorities to investigate, and base on strength on of the evidence, take it to court. Only then can there be a fair hearing.

As it is, it is already an endless trial by media. With all the hostility and political tones as well as under tones, a PAC hearing may become a kangaroo court in action.

Tony Pua is part of the "attacking team" on the 1MDB issue which include Rafizi.

There are a long string of issues on 1MDB raised by himself and Rafizi. If there is anyone that should excuse themselves from the PAC enquiry for prejudging and thus biasness, it will be Tony Pua.

His name have been bandied about in the blogs and social media to represent the interest of YTL. While Rafizi is accused of getting payments in an overseas account.

In the case of Dr Tan Seng Giaw, he showed glimpses of pre-judging 1MDB in his three postings in his blog here, here and here but it is quite arguable. Dato Kamaruddin Jaafar had pre-judged 1MDB in a statement that was reported by Harakah [unfortunately can't find the link yet].

Ketua Puteri UMNO and BN MP for Masjid Tamah, Mas Ermieyati Samsudin recently made statements indicating partisan interest [read Astro here]. Those among pro-Najib suporter see her motivated by power game thus that could put questions on her impartiality.

One can go through the list of PAC members [read here] and google their name with 1MDB for statements they have made.

Yesterday, Minister and Transparency International President, Paul Low was reported to call on all to not prejudge and wait for AG findings [read MI here]. Looks like even PAC cannot wait and is pre-judging.

One interview with Tun Dr Mahathir by Clara in January 2015 [read here, here and here], all the past sins of Sarawak Report towards Sarawak is forgiven.

Everyone including ex-journalists agree with the lies and condone their practise of fabricating pictures, emails and documents. The picture of SR putting a photoshop copy of doctored brown forest to show deforestation is still fresh in the mind from the last Sarawak state election.

Their method is obvious but there was reluctance by Sarawak based bloggers and those familiar with Sarawak to debunk SR. Maybe the Global Witness funded SR serve a purpose for a latter date. A major funder of Global Witness is George Soros. Was SR kept alive by certain invisible hands to launch an attack on 1MDB and Dato Najib?

There is a maxim, "The ends justify the means" but as Muslims or those professing other religions, both the means and the ends must be justifiable and right.

Was 1MDB set up by the Sarawak Report?

Not many Malaysians would have heard of 1 Malaysia Development Berhad (1MDB) six months ago even though it was incorporated in 2009.

The national strategic development company, as 1MDB would like to describe itself, made headlines in the financial pages late last year due to delays in submissions of financial statements to Bursa Malaysia as well as in repayments of its loans to banking institutions.

However only when the Sarawak Report (SR) website published its “The Heist of the Century”, did 1MDB hit the headlines and achieve national and international notoriety.

In that story SR made serious allegations of impropriety and fraud by 1MDB in its short-lived joint-venture with PetroSaudi International (PSI). SR followed up with the story with several more reports detailing further alleged instances of wrongdoings and questionable deals.

At first, Prime Minister Dato Seri Najib Razak denied the charges and defended 1MDB vigorously. However, very quickly the allegations proved to be highly damaging and toxic. Domestically it became the lightning rod for Najib’s critics within and outside the ruling party. Internationally the issue affected investors’ confidence to such an extent that it negatively impacted the economy and the value of our ringgit.

Belatedly realising the seriousness of the consequences, Najib ordered a through audit of 1MDB by the Auditor-General (A-G) Tan Sri Amrin Buang. However allegations continued to fly and speculation only got worse as Malaysians grew impatient with the slow pace of the A-G’s audit.

The aim of this article is to analyse the veracity of SR’s accusations based on the weight of the evidence. In particular I intend to examine three of the most serious allegations,
(1) USD700m was siphoned off by Jho Low,
(2) Jho Low was the main architect behind the Petro Saudi deal, and
(3) 1MDB lied about its money held in its Singapore bank account.
Before we carry out the analysis, let’s do an exploratory review of the evidence presented by Clare Rewcastle-Brown, SR’s founder/editor. Claire has claimed to have “thousands of documents” although she refused to disclose the source or the method the documents were obtained.

According to media reports, PSI had lodged a complaint with the London Police Action Fraud Unit at the National Fraud and Cyber Crime Reporting Centre claiming the “hacking” of its servers. An examination of documents presented in the SR website also indicates that the source is likely to be from PSI. In particular, its Chief Investment Officer (CFO) Patrick Mahony appears to be the target.

Emails published by SR do look authentic and there is no obvious evidence of forgery in terms of timeline, time stamps, content, language, etc. The documents uploaded onto the website also appear to be genuine. As such, we can proceed to examine each allegation in more depth.

Fortunately while the mechanics of the 1MDB-PSI joint-venture is complex, there is no need for us to make sense of these complicated financial transactions to seek out the answers to these three questions.

1. Did Jho Low siphon off USD700 million?

According to the terms of agreement between 1MDB and PSI, 1MDB was required to inject USD1 billion in cash into the joint-venture entity called 1MDB-PetroSaudi Limited. Because of the convoluted way the deal was structured, 1MDB was to pay USD700 million to PSI.

However according to SR [read here], instead of paying PSI, the management of PSI and 1MDB conspired to divert the USD700 million into the account of a Jho Low-owned company called Good Star Limited.

EVIDENCE:
To back its allegation, SR produced a Letter of Demand signed by PSI’s Chief Executive Officer (CEO) Tarek Obaid to 1MDB-PetroSaudi Ltd requesting for USD700 million to be credited to account number 11116073, at RBS Coutts Bank Ltd in Zurich, Switzerland.




However SR claimed that the account number (11116073) belonged not to PSI but to Good Star Ltd. To support this assertion, SR produced three more pieces of evidence. First SR produced an email from Patrick Mahony to Tarek Obaid in which the CIO said that the account number 11116073 at RBS Coutts Bank Ltd belonged to Good Star.




SR further furnished a typed extract showing Good Star Ltd having a registered office at the address: PO Box 1239, Offshore Investment Centre, Mahe, Seychelles with a Seet Li Lin as the Chief Investment Officer. SR claims that Li Lin is Jho Low’s right-hand man.


Finally SR also produced an email in which 1MDB’s ex-CEO Sharol Halmi instructed a Deutsche Bank Malaysia officer to transfer the funds to Good Star Ltd and provided the same bank, account number and address.


By linking all these pieces of evidence together, SR alleged that Jho Low used Good Star Ltd as a vehicle to siphon off the USD700 million from the 1MDB-PSI deal.

ANALYSIS:
The evidence #1 looks certainly authentic as it was produced in PSI’s official letter head, carried Tarek Obaid signature. Also details such as the language, dates, address, signature etc all appear to be correct and proper.

However, the same letter also clearly states the money is to be paid to PSI (the beneficiary) while providing the same bank name and account number. So the question now is whom does the account actually belong to, PSI or Good Star? It cannot be that two different companies share the same bank and bank account number.

So let’s look at SR’s evidence linking the account to Good Star. The evidence # 2 is an email from Patrick Mahony to Tarek Obaid which links the account number to Good Star. However this email doesn’t look authentic as the format doesn’t look like email format at all but rather a typed text / memo. Also the contents – salutation, date, etc. – all do not look authentic and raises several red flags.

Evidence # 3 is also a typed extract from a memo which links Good Star Ltd to the address stated in the account number. It was not taken from any official document and as such it is hard to attach any credibility to it.

Evidence # 4 that shows Sharol Halmi instructing Deutsche Bank also raises red flags as the email looks suspicious and suggests several signs of tampering. The sender’s email address is missing and the time stamp indicates “GMT-4” which is the US Eastern Standard Time Zone which also includes the Eastern Caribbean (a region where offshore financial centres abound). The format of the email also indicates the type that is used by BlackBerry devices and looks very different from other emails SR attributes to Sharol. Since Sharol is based at KL, it is unlikely that he’s conducting business from the US East Coast or some Caribbean Island.

To get to the bottom of this mystery to find out which company is actually incorporated in the location provided, I did some research and established that in fact the address PO Box 1239, Offshore investment Centre, Mahe, Seychelles is the official address of PSI.

This is actually quite easy to prove since it is printed in PSI’s official letter head as a footer. In fact we could have called SR’s bluff had they reproduced evidence # 1 in full rather than showing only the top part of the letter and hiding the footer which had the address. The reader can independently verify this fact since PSI had issued several official statements to the local press using its official letterhead during its acquisition of UBG Bhd shares back in 2010 and which still can be found on the web.

CONCLUSION:
Based on the analysis above, I can conclude that:

(i) There is no evidence that USD700 million was transferred to parties other than as stipulated by the JV agreement

(ii) It appears that there was a deliberate and systematic attempt to tamper with and fabricate emails and documents with an objective to paint 1MDB, PSI, their management team and Jho Low in a negative light for reasons unknown.

2. Was Jho Low the main architect behind the 1MDB-PetroSaudi Deal?

SR charged that Jho Low was the main architect behind the 1MDB-PetroSaudi deal. His right-hand man Seet Li Lin was shown as making all the arrangements with PSI without the involvement and knowledge of 1MDB. Only when the deal was finalised, claimed SR, did Seet bring 1MDB on board to conclude and sign the agreement.

EVIDENCE:
SR provided a series of email conversations between Seet, Jho Low, Sharol and Patrick Mahony as evidence to support their claim.

ANALYSIS:
All emails purportedly from Jho Low and Seet Li Lin were using gmail accounts. It is highly inconceivable that a billionaire negotiating billion-dollar deals would be using an insecure and free email service such as gmail. As these emails were sent using Blackberry phones, it is hard to believe that someone would use a secure communication device such as BB yet communicate using insecure gmail accounts.

Also the timestamp of “GMT+2” or “GMT+0” is another red flag since it indicates the time zones of senders in Europe (London and Central European Summer Time Zone respectively).

Further these emails were sent using the telecom service provider T-Mobile, who at the time (2009) only had a presence in the UK, Germany, the US and several other European countries. It had no presence in Asia. Since Jho Low and Seet were based in HK, it is unlikely that they would have been subscribers of T-Mobile or operating from Europe.

Additionally there were many other obvious mistakes in the emails such as Patrick sending himself emails or someone not in the original email loop appearing out of nowhere in the middle of email conversations.

CONCLUSION:
Based on the above analysis, I can conclude that PSI’s emails were deliberately amended in the header and in some cases, parts of content. It is most likely that the person who amended the emails took genuine emails and made minor changes to “address line” and content to make it support a certain agenda.

3. Did 1MDB lie about its bank balance in Singapore?


SR reported that 1MDB presented false bank statements on the amount held at BSI Bank Ltd Singapore. This was apparently communicated by BSI to Singaporean authorities.

EVIDENCE: None. SR did not provide any evidence.

ANALYSIS: Anyone even with basic understanding of corporate banking practices knows that this accusation simply cannot be true. BSI is a private bank and one of the key selling points of these banks are client confidentiality, discretion and banking secrecy.

There is absolutely no way a private bank or even any international bank would be willing to volunteer transactional and account details of their clients to authorities without a specific court order. In this case it is even more complicated as BSI Singapore is beyond the legal reach of Malaysian law. Furthermore the A-G’s Department is an auditing and not law-enforcement agency.

CONCLUSION: This accusation is not supported by any evidence. Furthermore this allegation does not make the slightest business or logical sense. As such it has to be dismissed as yet another false allegation.

I am certain that when the A-G tables his report in June, he will confirm my findings above as he would have had full access to 1MDB’s actual contracts, emails, bank accounts, etc.

What surprised me most is that even seasoned financial journalists who should be knowledgeable of banking and corporate practices, failed to spot the numerous and major irregularities in SR’s reports. Most of them gleefully reported what SR published on its website without critically examining it or the evidence presented.

As for Clare Rewcastle-Brown, whether she’s party to this elaborate fabrication scheme or not, is certain to face criminal charges after the conclusion of London police’s investigation into PetroSaudi’s report as the hacking and fabrication took place in the UK.

If she truly believes in the authenticity of her evidence, then I challenge her to present them to the UK authorities or an independent forensic agency for authentication or investigation.

But then I am sure she won’t because she knows the evidence was fabricated.

By the way, it has come to our knowledge that Jho Loh has initiated lawsuit against Euromoney and Sarawak Report. There was no words of his mentioning of UMNO. It seemed suing slanders in the UK is not as easy as they are protected under the pretext of public interest.

That was facebooker Azmi Arshad's view on those who believed Sarawak Report's false document lies. Anyone with any knowledge of procedures would know it was a lie from the first minute they lay their eyes on SR's report.

SR could be running out of ideas. Subsequent to fabricate document claim, SR applied the same theme on allegations on Jho Loh's money swindled from 1MDB and alleged false documents to Bank Negara and Deutche bank.

Yesterday Leslie Lau's MMO reported [read here] unconfirmed sources claim that Deutsche Bank Singapore is recalling their loan to 1MDB. So happen it was after Rafizi hinted of RM3.6 billion loan expiring in August which match that of Deutsche Bank Singapore. SR previous report on alleged falsifying of documents was mentioned to substantiate the story, thus it trails from there.

Too busy and malas to debunk till Azmi wrote the stinging posting on his FB. He is son of famous educationist and founding Principal of ITM, Tan Sri Arshad Ayub.

Hopefully those making allegations against 1MDB could substantiate and improve the credibility of their soalan-soalan allegations. If they have access to our Negarawan, advise him accordingly. To fight on principle ground, it must be backed by right fact, not based on non-credible references and purely political spinning which are usually shallow.

1MDB - FALSE FALSE BANK STATEMENT

No, the title is not an error.

First of all, I don't understand why there is such a fuss of why money is kept in Singapore. I’m too lazy to explain why not but so what if it's in Singapore? How does that indicate fraud?

Even more stupid or zombistic is for anyone to think 1MDB said the money was in a Singapore account because then nobody would be able to find out there is actually no money in the account.

Okay, then you may say to me: "Eh podah lah Azmi. Do you know there is no money in the account? 1MDB supplied false bank statements. Come on lah machai…. are you blind or what. Masih nak tegak benang yang basah. You’re too arrogant to admit you’re wrong.” (Do I really sound arrogant? I do? Good. That’s because I’m never wrong. Oh alright, almost never wrong).

False bank statements? Even the auditors were fooled? The auditors were also crooks?

Hmmmm….. No lah zombie, you can’t compare Enron to 1MDB and I’m too lazy again to explain why not but let’s just say that 1MDB isn’t a company issuing tons of sales invoices everyday where forged ones could easily escape audit test samples.

Anyway, when the BSI “false bank statement” news came out, I just rolled my eyes. Zombies will think that the “false bank statements” would be the nail in the coffin for 1MDB and the Prime Minister — it’s clear proof that 1MDB lied (as far as zombies are concerned).


Surely Najib would have to step down. But he didn’t because he must have been briefed by 1MDB and the auditors that Tony Pua and Rafizi were just having another common wet dream.

At that time I didn’t have much time for Facebook because I was taking my beloved wife for treatment on a daily basis (lasting a few hours each time) and that I had promised her no FB after Maghrib. (A story for another day). So I didn’t go trolling on walls of zombies or pick fights with pentaksub you-know-who supporters.

And when PM was being attacked over this I thought serves him right anyway for keeping mum and not fighting back. What irked me a bit though was that even 1MDB and Deloite did not respond.

Not that I blame them too much because for every question that is answered, 10 more will come up giving them only more work to do. (Zombies will only believe Toilet Tabloids).

Okay, now let me tell you how I knew the “false bank statements” was just another one of the Opposition’s wet dreams. It only took me 5 seconds to know, not because I’m smart but because I was once an auditor myself (with KPMG, not Arthur Andersen or Deloite ya) being paid peanuts working more than 10 hours a day and weekends. Tak boleh claim overtime.

Audit standard procedures obviously includes verifying bank balances.

Yes, we review the cash book, bank book / bank account ledger, bank statements and bank reconciliations but the verification does not stop there. Usually on the first day of the audit we send out “Standard Request Letters” to all the banks of the client and do the the rest of the field work while waiting for the replies to come back from the banks.

Now, the client cannot intercept the replies from the banks and change the numbers in the Standard Letter. Why not? Because the return address will be to the audit firm’s office.

What this means is that even the client (such as 1MDB) won’t know the content of the bank’s reply. No bank is going to be so reckless or stupid to reply there is money in the client’s bank account when there isn’t any. The bank’s reply will not only tell the auditor how much money there is but also of any loans (with that bank) that the client might have “forgotten” to tell the auditors about (to hide their liabilities).

In other words, false bank statements concocted by even Tony Pua, Rafizi, the Sarawak Report and reported in Toilet Tabloids (TMI, MKini, MMO, FMT etc) will not fool the auditors about the amount of cash or loans with the bank. 

So if 1MDB’s accounts show they had RM6.6 billion cash on 31/3/2013 and RM3.8 billion cash on 31/3/2014 then that’s truly how much cash there was. THERE IS NO MONEY MISSING. There is no such thing as the DISAPPEARANCE of RM42b or RM27b or RM7b or whatever number you-know-who will mention next [refer to our previous posting here also].

Why can't you just wait for the AG to release his report and then for PAC to do their investigation? Why keep asking the same and obsolete questions over and over again, even questions that have already been answered?

Hasn’t it occurred to you that any Tom, Dick & Harry can create false bank statements and send them to the Sarawak Report who then shows those false statements to BSI knowing fully well that the bank will say they are false.

Why can’t you just trust the statutory auditors over Tony Pua and Rafizi? Don’t you know the track record of spins and lies of Dumb & Dumber?

I must admit though that it can sound somewhat more convincing coming from you-know-who and that’s what made even UMNO supporters turn against 1MDB and the Prime Minister. However, I am pretty sure that you-know-who knew they were false bank statements.

I don’t know how many friends I will lose by the time AG and PAC issue their reports.

Nazir diverting attention from CIMB problem

On Thursday, Dato Nazir Tun Abdul Razak's was reported preaching of Directors responsibilities to the Board of Directors of 1MDB on Thursday [read The Star here and here].

He took the BOD to task for not addressing the growing concerns on the fund and its financials and felt a responsible board should appoint an independent auditor to verify the accounts immediately and deal with the mistrust pertaining to the financial position of 1MDB instead of waiting for the Auditor General (AG) to do the job.

Many were surprised why he made the statement when it is common knowledge that the Auditor-General is already reviewing the 1MDB accounts. Today, the answer seemed obvious. He could be  trying to divert attention from a not so positive development in his own backyard.

KUALA LUMPUR: CIMB Group Holdings Bhd and PT CIMB Niaga Tbk are offering employees in Malaysia and Indonesia a voluntary mutual separation scheme (MSS).

CIMB said the MSS was put in place after looking at the current operating cost structure and desired efficiency levels across the franchise.

The group has over 41,000 employees located in 17 countries.

"This is consistent with return on equity and cost-to-income plans we have outlined for the future," said CIMB Group Chief Executive Tengku Datuk Zafrul Aziz Tengku Aziz in a statement.

He said MSS was also a response to its employees both in Malaysia and Indonesia who have enquired about such schemes.

The MSS exercise received the backing of the Board of Commissioners (BoC) and Board of Directors (BoD) of CIMB Niaga.

To that extent, Zafrul said the BoC and BoD of CIMB Niaga have decided to adopt the MSS and offer it to the staff in Indonesia as this was consistent with the operating strategies of CIMB Niaga.

"This exercise in Indonesia is also timely given no such programme had been offered to staff since the Bank Niaga and Lippo Bank merger seven years ago," he said.

The bank stressed that the MSS was offered strictly on a voluntary basis and all applications were expected to be submitted by May 29, 2015.

Employees who have successfully applied for the MSS would receive packages based on rank and years of service, as well as, options for extended medical cover for three years, and participation in re-skilling and outplacement programmes.

CIMB Group operates its business through three main brand entities, CIMB Bank, CIMB Investment Bank and CIMB Islamic. CIMB Group is also the 97.9% shareholder of Bank CIMB Niaga in Indonesia and 93.7% hareholder of CIMB Thai in Thailand.

MSS is a fancy corporate word for job loss. The common practise would be to cut costs and only retrench staff in desperate situations. Cut cost to save job should be the priority. Nazir took the option to cut jobs to save costs and his annual multi-million bonus.

It could be a typical heartless corporate move or only indicate a desperate situation or hasty decision making.

Since CIMB was appointed by Putrajaya to advise on potential sales of energy arm [read MI here], Nazir has been rather over eager to  clear up the 1MDB issue [read TMI here] and wanting for fast fee to liquidate 1MDB [read MMO here].

Already opposition and their propagandist were successful at railroading the listing plan. As initiated by Sarawak Report's allegation of false documentation, many parties including Nazir seemed to be assisting them to get bankers to pull the rug from under 1MDB.

1MDB has finally realised that it has gone over board and issued a warning:

1. The Board would like to stress that 1MDB accounts are audited by an international audit firm, Deloitte.

2. Deloitte signed off 1MDB’s 2013 and 2014 accounts without qualification. Similarly KPMG signed off the 2010, 2011and 2012 accounts with no qualification.

3. The Board takes malicious and slanderous allegations seriously and reserves the right to undertake legal action.

4. Presently, the Board and Management is co-operating fully with the Auditor-General, the Royal Malaysian Police and the Public Accounts Committee in the conduct of their reviews of the company.

5. In particular, the Auditor-General is conducting an independent review of 1MDB's accounts, as agreed by the Cabinet of Malaysia.

6. We, therefore, seek the patience and understanding of the public and interested parties to wait for the results of these reviews. We request that no one should prejudge the matter without thorough facts ahead of the reviews being made public.

7. We have full confidence in Deloitte and the Auditor-General, as does our 100% shareholder, Minister of Finance Incorporated.

8. The Board gives its undertaking that in the event of adverse findings the Board will take all the responsible measures and actions.
The sabotage propaganda by Opposition and Sarawak Report will benefit CIMB.

They will be the first beneficiery CIMB could start to take up their role as "liquidator" fast and immediately collect their exorbitant fee for their ailing organisation.

Fresh in the mind of market players are the exorbitant fees Nazir collect for the unnecessary plantation tri-merger and many other mergers. It only shows the selfish and self-centered nature of the youngest son of Tun Razak and Toh Puan Rahah.

Off course, he has basis to ask 1MDB Board of Directors to appoint an independent auditors and not rely on audit by the Auditor General.

There is common reservation among accountants and civil servants in the ability of government auditor to verify Deloitte's signed audited annual report for 2014 and in carrying out forensic audit.

However, that view could have been made known through proper channel because it is available to him and it is as easy as a phone call or chat at family gatherings for him.

Nazir's forceful statement on 1MDB Board of Directors has the strong directive tone as someone superior instructing his corporate appointees. That tone should have been more appropriately expressed by his eldest brother, Dato Najib.

Despite being appointed as CIMB Chairman, Board of Director of Khazanah and Chairman of Khazanah's Executive Committee, it was heard to be a mere compromise to his real intention. He has been thinking that himself should be filling the position of Minister of Finance.

He may do a better job in analysing the economy, understanding the mechanics of business and drawing certain type of policy. However he lacks one major element.

Nazir is no politician and does not represent any constituency. thus no locus standi to say he represent the people.

Maybe he could be appointed senator and assume the position, but he does not have the heart to feel for the people.

For instance, when CIMB could not get the job with the fat fee enjoyed by Goldman Sach for the many roles played for 1MDB, Nazir pulled a tantrum to mother, refuse to participate in 1MDB and leaked information to railroad 1MDB.

Does he has the solution to solve the political minefield for the annual RM19 billion legacy subsidy to IPP in which pulling the subsidy would result in rising energy cost and legal implications? Thats about the people.

Why bother eh? Sell off or liquidate and the fee will get paid immediately into CIMB.

Tong-Jho Loh in a deal together?

In the previous posting here, this blog was criticised for attempting to divert attention from 1MDB to Dato Nazir Tun Abdul Razak. There was even such nasty commentators that directed this blog to answer certain issues on 1MDB.

Firstly, they do not own this blog and have no business to determine what should and should not be written. It is the blogger's personal space. As far as commentators, it is demanded upon them to be civil in their comments and stick to the subject of the posting.

Second, Nazir Razak is not a new subject in this blog thus it cannot be deemed as diversion. Back in August 2010 [read here], this blog wrote a critical piece of Nazir for his NEP "bastardised" comment.

That time issue was raised against Dato Najib. The last issue raised against Najib is here. So to say this blog is a pencacai and pengampu is misguided and ignorant.

When the need to criticise arise, it can do so and it has always been able to.

In the case of 1MDB, this blog is concerned with accusations made that are not factual and right. It is ludicrous to base accusation on devious source like Sarawak Report and perpetual liars like Rafizi Ramli.

This blog kept repeating a stand and will repeat again the same stand that questions need be answered and this issue of public concern need to be cleared once and for all.

It is a lonely position taken that could attract attack from both sides of the divide in Malay's feudel blind loyalty politics and sentiment or perception driven public opinion.


Third, not only was Nazir criticised for the NEP "bastardised" statement, this blog had been consistently critical of Nazir's biasness in favour of Air Asia.

CIMB is highly exposed to Air Asia but yet is involved in the MAS restructuring. Nazir had been instrumental in the destructive WAU plan that saw him going to and fro the top floor of MAS building at Jalan Sultan Ismail during the time of CEO TAn Sri Md Nor Yusof.

He was the one that put together the failed collaboration between MAS-Air Asia

Fourth, the previous posting is not the first such posting against Nazir in relation to 1MDB issue. In a February posting here, this blog took a subtle swipe at Nazir. Extract below: 
The man leading the attack on 1MDB through his business media, The Edge, Dato Tong Kooi Ong planned to sue Jho Loh. He was claimed to be the person behind the anonymous blogs that accused Tong as instrumental in weakening the ringgit [details and link here].
Even if Tong could trace the IP, they will have to prove a writer wrote it and not someone else. There-on, Tong must establish the link to Jho Loh and prove many other legal issues. One can expect an interesting wayang (acting) to come to town. 
Now we have third thought on the owner of The Edge and TMI. 
The anonymous blogs also accused Dato Nazir Razak for sabotaging 1MDB. And, Nazir was reported to have given statement of his intention to sue Jho Loh too. It is interesting that Najib's brother collaborating with Anwar's man to sue Jho Loh.
But, Nazir's reaction will endorse the perception that Nazir sabotaged.     
The Edge's PAC questions

One comment from an editor in a WA group is that there is nothing professional and journalistic about the article. What can he expect when their bible (Or Quran or Vedas etc) of reference is George Soros's Sarawak Report [read here, here and here]?

It is known that there is a war between The Edge owner, Tong Kooi Ong and Taek Jho Loh. So the piece is an attack on The Edge boss-owner's enemy.


There is another view that see The Edge article as trying to teach PAC and Auditor General as to how to do their job. PAC will begin investigation on Tuesday May 19th.

One can only expect some of the questions to appear in the PAC enquiry through the opposition MPs which include Tony Pua. By right, Tony should excuse himself from PAC for prejudging? [read here]

AG has began and expected to submit finding by end of June. It should affirm the belief by most Malaysians that Tun Dr Mahathir had studied the accounts and know what everybody did not of accounts rigging ala Enron style [read here].

Nazir's statement looked as though he was trying to protect his brother by diverting the blame from Dato Najib to the BOD.

However, his criticism was unfair since there had been effort by the BOD to engage no less than Tun Dr Mahathir [read Rocky Bru here]. Nazir also found a supporter in allegedly YTL-backed Tony Pua, a major opposition voice in the relentless attack on 1MDB [read MI here]. Has he become spokesman for Nazir?

Tony sounded macho as he said of wanting to see Dato Najib speak up when put to the stand. Sure but he attempted to strike off an earlier 1MDB related defamation lawsuit by Dato Najib.

To dispel the notion that Nazir is trying to help brother, do read below:



It serve to strengthen a long held suspicion that Nazir snitched on his eldest brother for not giving him what he had wanted. He may have shared lots of his grouses with buddy Tan Sri Tony Fernandez and he got a big mouth. Merely suspicion and not accusation.

There is talk in our WA group that Nazir tried to push his way with Arul Kanda but was resisted. When brother refused his request, he can sabar but not to lesser beings like Arul. So he attacked 1MDB.

Arul could not allow Nazir get his way as he fear it will only lead to another MAS and Synergy Drive.


There is another twist in all this.

One corporate source said that Tong and Jho Loh is in a financial transaction or commercial deal together. That opens up a multitude of possibilities and implications. Is their quarrel merely a show? More to come from where it came from.

Never quite trust this Jho Loh fella. More so since he claimed of not done anything illegal. He may have not broken the law but it does not mean it was right. So there was a challenge that he sue NY Times [read here].

Jho Loh did not sue NY Times, but a source reliably informed (an RPK term) that he did initiate lawsuit against Euromoney and Sarawak Report in London. Unfortunately, it is not progressing as media reporting on public interest are saved from civil lawsuit.

There was also doubt with that development. The defamation law in UK never allow newspaper to simply defame anyone. It equally protects the reputation and dignity of private individuals. And, at the same time allow accurate reporting of all issues. There is no reason that UK courts to reject any application for an injunction.

Whether the lawsuit in London is true or not, Jho Loh still has no excuse. Few lawyers said that Jho Loh should sue them on Malaysian soil if he wish to clean up his name. The articles appeared on Malaysian cyberspace.

The most recent progress is 1MDB warned of legal action against any slanderous and malicious allegations.

The latest malicious allegations came in the form of unconfirmed news that Deutsche Bank Singapore pulled the rug from under 1MDB based on rumours generated by Sarawak Report [read here]. Could highly paid, disciplined and regulation fear Singaporean banker leak information [read here]?

At the same time, Dato Najib posted an FAQs to answer allegations against him. [read here]. FMT reported it here. One does not have to believe it but at least read it before making any comments.

Earlier in the year or half a year ago, hardly anyone knows about 1MDB that was known to this blog since 2009.

Suddenly every other person in Semenanjong seemed confident with their opinion. Problem is it is mostly ill-informed, presumptous, and influenced by Sarawak Report lies.

Who is the "30-something Penang-born businessman" that sold TMI?

On June 9th, 2014, TMI CEO Jahabar Sadiq tweeted:
 “Good morning TwitterJaya –> The Malaysian Insider @tm_insider is now part of The Edge Media Group”.
It confirmed the wind Rocky Bru posted something before it was finalised. 

TMI confirmed in their report of their merger with the Edge [read TMI here]. Jahabar told The Star [read here] that said everything remain the same but only a different shareholders.

The Malay Mail Online also confirmed it [read here]. For MMO, it has its relevence because former Executive Director, Leslie Lau, Managing Director for MMO, Joan Lau and core editorial left TMI for MMO on June 2013 [read The Star here]. They claimed there will be a change in direction. 

No mention of the seller.

Back in July 23rd, this blog wrote a posting based statement by JMM's Azwanuddin Hamzah [read here] that a company owned by Dato Kalimullah Hassan financed TMI. The company secured contracts from Inland Revenue Board and the profit was used to finance left leaning TMI. [Read more in AIDC here].

Kalimullah denied it [read Mkini here]. The link and editorial favoured Khairy so much that it is hard to believe. Knowing Azwanuddin is under the payroll of the new Kalimullah for Dato Najib, Kalimullah may have spoken the truth.

Azwanuddin is among the paid mouthpieces for the so-called media strategist Dato Habibur Rahman but lack credential or credibility to speak. Habibur is also owner of Fuel Card Sdn Bhd which was highlighted by this blog several times.

The real owner of TMI can be trailed to a Wikipedia posting on The Malaysian Insider [read here]. The extract reads:
TMI was started in December 2007 by a group of businessmen and journalists close to then Prime Minister Tun Abdullah Ahmad Badawi as a counterbalance against MalaysiaKini, which was deemed to be unfriendly to the Barisan Nasional (BN).

But after Abdullah stepped down in 2009, the group stopped the financing and the TMI top management, after talking to several people, eventually got funding with help from a 30-something Penang-born businessman with close ties to the current BN leadership.[4]
Who could that 30-something Penang-born businessman be? How could he be considered as having close tie with BN leadership when TMI was spinning news against BN and giving voice to the oppositions?

If the person had been Taek Jho Loh, it would be interesting.


In June 2014, Jho Loh had a deal with Dato Tong Kooi Ong. Come February 2015, they are suing each other [read FMT here and Uppercaise here].


By May 2015, Tong turnaround to help divert attention from Jho Loh to the Board of Directors.

Politics is politics but business is business. The Chinese could do that but when angry or emotional, Malays rather see Tabung Haji sell the valuable and strategic TRX land and not see any Malay-Muslim institution own real estate on TRX. [Read Bigdogdotcom here and here].

If it is a question between principle and interest and they chose principle, that is fine.

But to forego interest when the principle is unclear or arguable, it is the ultimate stupidity. Imagine the 1,000 that gathered at Baling to protest against Tabung Haji just for PAS to takeback the Dato Azeez's seat. How naive and ignorant can they be?

The title is just a pun to the title of Frank Capra movie classic, It happened one night.

The movie is about some turn of event that bloomed into a romance between two characters played by Clark Gable and Claudette Colbert. In our case, the turn of event has not bloomed into a romance but was substantial enough.

If not drained out by asthma attack and too much 1MDB, two events attended last weekend and on Tuesday would have been written as postings.

Not about to be lengthy and serious on this Sunday, so we'll just highlight about our trip to Kota Kinabalu last weekend and Santai with IGP last Tuesday.

We were in Kota Kinabalu on Saturday to attend the follow-up second forum to an earlier first forum we posted [read earlier posting, Something positive happened in Sabah here].


The program was called Forum Perjanjian Malaysia 1963 2, and held at Universiti Malaysia Sabah under the auspices of the Foreign Ministry.

What truly impress me was the presence of various political parties, community leaders, and public interest group - without consideration for any alignment to any political party or personalities - to sit and discuss something of mutual interest to Sabah.

The Forum was chaired by a BN leader, Foreign Minister Dato Anifah Aman but dissenting views were allowed to present their case.

The first to start was the controversial Dato Dr Jeffrey Kitingan as he presented his brief presentation on the 20-point agreement. We are not going to repeat it. Most of the arguments are repetitions.

However, he may have drawn on the nerves of quite a few notable people in the crowd. This is the part where we saw as interestingly Sabah and we in the Semenanjung may learn a thing or two about politics from our Sabahan friends.

Immediately after Jeffrey's session, Anifah allowed views from the floor. Of the many exchanges, one particular exchange sticks well in our mind.

One fella by the name of Frank rose to question why did USNO amended the state constitution to make Islam an official religion of Sabah and many other issues. It is understood later that Frank is from SAPP, an opposition party.

Then there was Tan Sri Majid Khan, presumably from BN, rose to later ask why didn't PBS change the state constitution back when they were in power. PBS had the two third majority to even change Sabah to a secular state of have Christianity as the official religion.

This was a frank and open discussion that would have led to boo boys filling up the room in Semenanjung. Things may even get out of hand to see chairs flying and quarrel erupt.

There was nothing of that sort. All speakers were able to finish their presentation uninterrupted by the audience as sometimes occured in some political event in Semenanjung. The views from the floor were allowed without any jeering or any mob pressure.

In one instance, one Wanita UMNO took to task Jeffrey claim on discrimination against Christian as she revealed of her own husband experience of being discriminated by the Christian led PBS government.

Anifah allowed her to express her views but he asked Jeffrey not to answer. He reiterated that dwelling on the past will never reach any finality but it is time to move forward.

Come Dato Yong Teck Lee's turn to take the stage, he defended Jeffrey against what was said against him by SAPP Frank earlier.

When engagement is done and dialogue allowed to take place openly and without the need for propaganda and deception, there is more to gain and mutual understanding could be achieved.

KOTA KINABALU: A special committee will be set up, after receiving public support, to discuss issues pertaining to the rights of Sabah and Sabahans which were brought up at the Malaysian Agreement 1963 Forum.

Foreign Minister Datuk Sen An¬ifah Aman said that the committee, which would be chaired by Datuk Dr Jeffrey Kitingan would be given deadlines to discuss on matters and come up with a report to be sub¬mitted to the relevant authorities.

"Perhaps former leaders such as Tan Sri Herman Luping, Tan Sri Majid Khan or Datuk Ayub Aman can also join in the committee to discuss their understandings on these issues.

"We must submit something to the authorities especially about is¬sues concerning the rights of Sabah," he said when speaking to reporters after the forum organised by the Foreign Ministry at Universiti Malaysia Sabah (UMS), here yesterday.

The idea for the committee was mooted following speeches from the panel of speakers which included former chief minister, Datuk Seri Yong Teck Lee, Datuk Dr Jef¬frey Kitingan, constitutional lawyer, Edmund Bon, academician Dr Ramzah Dambul, Ansari Abdullah and Zainal Ajamain.

Anifah said that the committee would discuss, among others, the review of the 20-Point Agreement and the issue of Borneonisation which were brought up by Jeffrey and Yong.

He also said that the committee would discuss financial issues raised by constitutional lawyer, Edmund Bon which are; a second review of the 40 per cent special grant under Article 112D of the Federal Constitution; a special grant of 40 per cent of the increase in net revenue derived by the Federation from Sabah since 1974; levy of a royalty of up to 10 per cent in respect of petroleum extracted from Sabah; and a proportion of the export duty levied by the Federal Government on such petroleum ex¬ported from Malaysia.

"This is not a question of us as Sabahans going against the Federal Government," said Anifah, who was also the moderator of the fo¬rum, adding that it is important for Sabah to get what it deserves.

"This is not for me or for Jeffrey or any one of us but it is for all of us and our future generation," he added amid thunderous applause.

Anifah added that the issues raised by the speakers were not grievances but rather, these are is¬sues raised by Sabahans on promis¬es which have yet to be fulfilled.

"This is not a confrontational approach. It is something nego¬tiable. This does not mean that whatever decisions we have come up with are 100 per cent true but what is important is that this is a platform for us to raise these issues which would also go through further studies.

"This does not mean that what¬ever we say and come up with have to be complied by the Federal Gov¬ernment. That is why it is important for the committee to be set up to study these issues," he said further.

He also said that if the people find that whatever that will be dis¬cussed as not enough or inaccurate, there would be more reviews of the issues.

"It is also important for history which has been studied carefully to be documented and this is one of our goals.

"If we do not have accurate information, people will have false assumptions and the future gen¬eration will be misled. It is im¬portant for the facts we present to be accurate so as to not confuse oth¬ers," he added.

The forum saw the panelists speaking on various issues such as the review of the 20-Points Agree¬ment, Borneonisation, the In¬ter-Government Committee Report and revenues to the state from the Federal Government.

Also present were former state leaders, Tan Sri Herman Luping, Tan Sri Majid Khan, Datuk Ayub Aman, and state cabinet members.
If they managed to put their case together with the right facts - historical and legal, there is every reason that Sabah will benefit from this unity of mind and purpose, and the maturity and rational of their politics.

The Federal government will have their own view and interpretation of the agreement.

Both Jeffrey and Teck Lee touched on security issue as part of 20-pont agreement and Borneonisation.

Maybe it touched on the nerves of those servicemen and policemen involved in security and risking their lives. Shouldn't be talking about Sabahan wanting to be the boss but have those working on their safety to be subordinate.

However, we should understand that it is not the first time but already the third time. Last week a seafood restaurant was raided by an Abu Sayaf terrorist and one lady abducted.


This leads us to a leisure media session with the IGP on Tuesday.

The Lahad Datu incident was mentioned as he explained the need to cut barter trade ties with the Southern Phillipines. It must have been something the police had wanted.

We got to know the military had wanted that the sea lane be restricted in order to contain them but the decision from the civilian government had been too long. ESSCOM comes under a Minister in charge in the PM's Department.

The organisation structure of ESSCOM need to be resolve once and for all. It is still at a stage of building up capability.

In the session, IGP talked too about terrorist threat as being for real. He shared the number of IS terrorist estimate and it was astonishingly more than one was known to us earlier.

There was a question posed to the IGP.

"Without the ISA and EO, are the current law sufficient to address these threats?"

That was when he came up with a classic answer of significant.

"Forget ISA and EO. Lets be realistic. We will never have it back. We now have POCA and POTA!"

Over tea, he was asked, "Is it better than ISA and EO?"

His answer was "Insya Allah".

Oh yes, IGP wanted to us to highlight that crime rate is on the way down but it somehow did not convince many including Dato Nuraina. [Read her harrowing experience here.]

Someone called us to accuse the KPI was readjusted. Reckon that will come with opposition from Dato Ayub [seen far right in white shirt], the former CPO of Penang and Director for NKRA. Now retired and regularly seen at our neighbourhood Masjid. 

Tan Sri Khalid did say the rise in crime was due to the release of those Simpang Renggam detainee. With POTA, we will gather those ex Simpang Renggam detainees back.

The Star's frontpage yesterday was truly a heartbreaking image.

This week MAS employees will get termination letters from present operating company of Malaysian Airlines. Some will get letter of offer from the newco that will be taking over the operation. Out of 20,000 staff, one third or 6,000 will not get any offer.

In yesterday's report, one could hear staff complaining of MAS management refusal to talk to unions. Union head are trying to seek PM's last minute help because 8,000 will immediately lose their job tomorrow.

Their jobs would have been saved had the union heads been honest in their work and demands in the past. No, we are not about to repeat what past arguments of faulting unions for MAS failure. It is insensitive to do so.

It would be replicating the insensitive behaviour of the nutty and chicken dance Director of HR, Zaharah Zaid. She sent an e-mail to tell the staff to clean up their table from last week but in a subtly insulting manner. It is fair to ask as to what happen to adab sopan Melayu that was hallmark of Malaysian Hospitality?

Some staff complained to the paper that it is unfair to take our job away when it was the mistake of top management. It is sad but the reality of Corporate Malaysia started out by Khazanah Nasional is devoid of human sensitivity and social nation building agenda.

Whatever they did under so-called CSR are for show. There is no heart that came with it.

After having written countless postings over the years to help defend and save MAS, the common denominator in the turnaround of MAS from Binafikir inspired WAU till today, the driver seat of MAS remained with Tan Sri Azman Mokhtar.

Tan Sri Tajuddin Ramli left in 2001 and it is today 2015, thus time to stop blaming him. Also, it is time to stop blaming Tan Sri Mohamed Nor Yusof or Dato Fuad Dahlan or Dato Idris Jala or Tengku Dato Azmil or Ahmad Jauhari.

Only Azman Mokhtar and Khazanah should be blame. Why is merit-based Corporate Malaysia not applying the same chop chop on Azman Mokhtar and Khazanah for their failure at MAS?

This blog kept emphasizing him that the CEO should be an Airliner but till MAS is finished that he finally accepted the idea that only an airliner could manage an airline to put Christophe Mueller as CEO. Can Mueller make the magic he had done with other previous employers?

It is like what Khazanah did with Ahmad Jauhari to do a major collaboration with Air Asia and only brought in a CEO to make a plan that will not work to work.

The collaboration did not work and tanked. Still Azman Mokhtar is still around. Khazanah is still the real CEO running the airline. He is adamant that MAS follow his and only recipe despite it not showing any signs of success ever. 

All along, Khazanah is more concern with Air Asia, another airline in which Khazanah has a little interest but CIMB has large exposure. Now Dato Nazir Tun Abdul Razak is on the Board of Director of Khazanah and chairs the executive committee.

Khazanah had all the while been insistent that the only way to clear MAS out of the rut is through out-sourcing, become low caste no frill airline, and enough of national airline status.

Even critical area is out-sourced to enable the sacking of the 6,000-8,000. MAS will be reduced to a regional based value airline. In another word, a smaller Air Asia.

Will it be cost competitive to compete with Air Asia? The end is already written on the wall.

Over the years, this blog have tried hard to highlight the mistake the leadership had done in handling MAS. We fought for the interest of MAS and its staff by highlighting the problems and weakness of management and stakeholder.

This week confirmed that all our effort had been in vain. People up there are too stubborn and they did not take heed the political implication for not safeguarding MAS.

To all MAS staff, we could only say, "We are sorry for failing you". We apologise for not able to make it happen.

Not only through our writings, we had engaged with various level of people and leadership to highlight MAS problems in which much of it was due to bad high level decisions made at Khazanah and brought forward some of the MAS staff suggestions

Since the top level leadership is inside the Board of Director of MAS, it is hard for them to over ride what was agreed at the Board level. In the place they should not be on the Board and that way, they could screw and remove management for failing in MAS.

We have tried our best but our best wasn't just good enough.

Pray that you all manage to get through this life's ordeal. Some will be given a letter to the CDC to assist them in seeking employment and getting retrained.

Our hope that the compensation is fair and substantial because when Idris Jala retrenched 3,000 before, it was a good compensation. Those left behind are supposed to be the better, dedicated and capable ones. It is only fair that they are compensated equally well for their loyalty.

Having undergone through similar situation before, our advise is to have trust in God and have faith with fate. It is only a small diversion from a bigger journey.

My prayers for all of you.

Till this week, in which letters supposed to be out, there had been no talk inside MAS of the compensation for terminating employment contracts.

For many months, the rumours in MAS on the compensation was a gloomy picture painted. The retrenchment compensation will be peanuts, something like six months last pay.

Some staff believed the rumour was spread to deter the good senior ones from leaving. Someone up there at Khazanah wanted to play into the minds of MAS staff that should they decided to go, it will still be tough as money will run out soon.

Someone up there worry of an exodus of senior and good staff because they have made working condition deplorable.

As it is, morale is low and company has taken away necessary conveniences to make working condition conducive and efficient. For the past few years, management does not care for the staff any more but demand top performance surpassing KPI.

Since the deal is better after Khazanah could not squeeze the staff jewishly, suggest the senior ones take the money and leave. These losers at Khazanah are dealing with peoples' lives and yet they want to play games.

A better MAS layoff deal

PETALING JAYA: In a last minute change of heart, more than a third of the 20,000 Malaysia Airlines (MAS) staff will be getting termination payments according to their collective agreements (CA).

The move reverses earlier reports that the payments would be about half of what is spelt out under the CA, something which left the staff very unhappy.

Some say MAS had bowed to pressure from unions to finally give such terms, but a source close to the matter claims “they had always been working on this suggestion but the unions did not know about it”.

Whoever’s idea it may be, the unions appear to have managed to reach the corridors of power to intervene on the severance package.

Yesterday, the airline’s nine union leaders were told that the staff payout would be according to the CA and this was received with much cheer at a meeting held at MAS with the airline’s parent body Khazanah Nasional Bhd and MAS officials.

A large chunk of MAS employees are unionised.

“It is a welcome move. It is politically and morally the right thing to do, to pay according to the CA. That is what we should get and what we deserve.

“Fortunately, they did not use the MAS Act 2015 to circumvent. Unfortunately, not all of us will be re-hired by MAS Bhd,” said an employee.

Christoph Mueller, the CEO of MAS, was not present at the meeting, but he sent a memo to his staff late yesterday evening disclosing the latest details which were “in line with the Prime Minister’s commitment that MAS restructuring reflect fairness, compassion and transparency”.

MAS is scheduled to axe between 6,000 and 8,000 staff over the next one year as part of its plan to shrink into a smaller airline with regional focus. The remake of the airline involves the migration of assets and liabilities of the existing MAS to a new company known as MAS Bhd, which will rehire two-thirds of the workforce.

Those not offered jobs with MAS Bhd will be given one month basic salary for every year of service for those up to 10 years of service. Those who have served MAS for more than 10 years will get 1.5 months of salary for every year of service.

The memo said senior ­management employees (vice-president and above) and those on contract were not subject to such terms.

Those accepting the offer to join the new MAS Bhd, will be offered a sign-on payment and if they are still with MAS Bhd after 18 months, will get a retention payment.

Khazanah had initially set aside RM1.66bil for staff payouts but since they are now paying according to the CA, the total payout will be higher with some suggesting it may be as high as RM2.4bil.

Due to the change in heart, the 20,000 termination letters that were supposed to be distri­buted today by the airline will not go out as planned. But MAS is working furiously to have the letters sent out over the next few days so the staff will still get them around June 1. Those rehired will have until June 12 to accept the offer.

“The unions have also asked that the retiree benefits of four tickets per year at discounted prices remain but MAS officials said they needed more time to deliberate on it,” said a source.
To be fair and in accordance with Khazanah's so-called meritocrasy culture, the failed top management should not be given anything more but only six month last pay. These losers only deserve it.

Unless MAS staff need badly need the job to survive, the advice to senior staff is to take the deal and leave. Take up the assistance of CDC [read The Star here],

MAS target to get only graduates and below 40. This will only make working condition worse as the working culture of Gen Y are not something to shout about.

They are lazy, not serious and not dedicated to their work. Tendency to be self centered, inexperienced but bossy and obsess with pay despite being the first to leave at 5:00 PM. They have no loyalty, not team player and back stabbing will a norm.

Working condition will be a hell hole. Things will be done in strange ways unlike the glory days of MAS. Many units will be closed and merged. Existing unrealistic workload will be further burdened to carry out function from other units.

Troubled Malaysia Airlines to be completely revamped: new CEO

KUALA LUMPUR: Loss-making Malaysia Airlines is set to undergo a complete overhaul as it is restructured into a new company, with a rebranding that will be unveiled next week and changes planned to its fleet and network strategies.

Christoph Mueller, who joined from Irish national carrier Aer Lingus, said in his first ever interview since taking over as chief executive on May 1 that the new company will be like a “start-up”. A new name and livery are on the cards for Malaysia Airlines (MAS), sources told Reuters.

“I’m hired to run the new company entirely on commercial terms and there’s very little margin for error,” Mueller told Reuters at the downtown Kuala Lumpur office of Malaysian state investor Khazanah, which took MAS private late last year as part of a 6 billion ringgit ($1.66 billion) restructuring.

“It’s not a continuation of the old company in a new disguise, everything is new,” said Mueller, who helped turn around carriers such as Aer Lingus, Belgium’s Sabena, and Germany’s Lufthansa .

Khazanah said on Monday that the chairman of audit firm PricewaterhouseCoopers Malaysia has been appointed to oversee the move of MAS’ assets and liabilities to a new company, Malaysia Airlines Bhd, which is due to start operating by September.

The airline, which has seen successive years of losses, suffered huge damage to its brand after flight MH370, carrying 239 passengers and crew, disappeared in March last year, in what has become one of the greatest mysteries in aviation history.

In July, Malaysia Airlines Flight MH17 was shot down over rebel-held territory in eastern Ukraine, and all 298 aboard were killed.

Apart from the brand, analysts say that the key to a revival will be the management’s ability to reduce costs, deploy capacity more efficiently, create a profitable network that leverages on Kuala Lumpur’s position as a regional hub, and partnerships with other airlines.

Job Cuts

MAS, in the past, was also hindered by disagreements between the management and the unions, which opposed job cuts. The government also interfered in the day-to-day running of the airline, and commercial contracts were often awarded to suppliers with political connections.

MAS has announced plans to lay off about a third of its 20,000 work-force, expected in the coming week, and will also shrink its capacity this year.

Mueller confirmed that the carrier has been trying to sell two of its A380s and will likely have fewer planes overall, but added that the new company will keep all of its current types of aircraft including the Airbus A330s, Boeing 777-200s and 737-800s.

Competition has been intense at home, where low-cost carrier AirAsia has taken much of the short-haul market from MAS and affiliate AirAsia X has provided stiff competition in the medium and long-haul markets.

The airline’s costs are 20 percent above its rivals and Mueller said it will take 3 years to close that gap and return to profitability.

“We are not without our weapons. It’s doable, and it depends on the vigor in which we pursue the cost reduction,” he said.

As far as Khazanah, they prefer to be con by orang putih than get good and sound advise of Melayu and Malaysians. They ask for meritocrasy and cost effectiveness but they squander millions for staff entertainment at 16th floor Mandarin Hotel Club.

Troubled Malaysia Airlines is undergoing a complete revamp under the leadership of its new chief executive, Christoph Mueller, the former head of the Irish airline Aer Lingus. The overhaul will include shedding a third or more of its 20,000-person staff, using a smaller fleet, and possibly adopting a new name and uniform.

“It’s not a continuation of the old company in a new disguise, everything is new,” Mueller told Reuters in his first interview since taking over the airline on May 1. In some ways, Mueller is the ideal person to turn around the Asian carrier, which was already struggling with years of losses before two plane crashes last year that killed 537 passengers and crew. The airline hasn’t made a profit since 2008.

As head of Aer Lingus for five years, Mueller helped the airline compete with as well as fend off takeover bids from domestic rival Ryanair, while trying to placate striking unions. Last year, the airline reported an 18% increase in operating profit, before a one-off payment to unions.

Mueller, the first foreigner ever to lead Malaysia’s national airline, may have more trouble with union members at Malaysia Airlines, where half of the staff is represented by the Malaysian Airline System Employees Union. Some union members have told local media that they will stage a strike once the termination letters are given out within the next few weeks.

Anxiety among the staff is high. “It is a very sad period in our lives. I never thought this day would come when I first joined the airline more than two decades ago…I cannot even think about how I am going to pay for my house and car loans,” one employee told The Straits Times.

Before Aer Lingus, Mueller tried (and failed) to turn around Sabena SA before it declared bankruptcy and reinvented itself into Brussels Airlines. Analysts call him a “battle-hardened veteran,” and say he’ll need that experience as he embarks on one of the “biggest challenges” in the airline industry today.

Under the restructuring plan, Malaysia Airlines is moving assets and liabilities to another company, Malaysia Airlines Bhd, that will start operating in September. Mueller said that it would take three years to make it profitable again.

Understanding irrationality

An Australian social researcher, Hugh Mackay was quoted as saying: "Nothing is perfect. Life is messy. Relationships are complex. Outcomes are uncertain. People are irrational."

That is a pretty strong generalisation of humanity. However, Mackay is not the only one to think in that manner. The author of a book entitled Boiled frog syndrome, Marty Rubin claimed "Man: an irrational being who imagines himself to be a rational one.”

In recent times where every other Malaysians seemed to stress so much on the importance of managing perception beyond the need to understand facts and sound arguments, we wonder how many of these self-professed experts in psychological warfare have heard such a strategy called boiling frog [Read it here].

The interplay of perception and deception has much to do with human irrationality. These days it is so  noticeable that there will be those that attempt to win argument after getting factually quashed by justifying that it is what people out there are saying.

Was there ever any properly held survey to affirm that view or it is merely a random opinion taken from within close proximity of friends? We tend to believe the latter than the former.


As we see it, "Deception and perception play are tools for and by those ill informed and devoid of knowledge.

"It thrives on simplistic argument for the gullible small minds and ignores complex issues in play. These days perception of the ignorant masses is given so much consideration that it destroy good governance and made politics revoltingly shallow."

That view has strained friendship.

However, it is inevitable when one side irrationally expect upon us to blindly agree to some unclear allegations. While, another befriend us but covertly accused us irrationally as still covorting with the aggressively attacking side.

So independent thinking with any attempt of rationality is not welcomed.

A reknowned American psychologist Albert Ellis said, "If something is irrational, that means it won't work. It's usually unrealistic." 

Will that mean it won't work and both sides are unrealitic? At least the reality that we know is best depicted by the Malay proverb, "Menang jadi arang, kalah jadi abu." A no win senario.

We thought yesterday that in our attempt to present information and facts from both side of a divide in current thinking, it could put right to wrong and let disagreement be factual and based on sound and rational arguments.

That attempt to induce rationality was encountered with a rude awakening and only proves Malay feudel psyche that comes with blind loyalty is too well imbedded and made deeply rooted by perception.

Such psyche could override the mental ability of those in professions of expertise that should presumably be of scholastically above average intelligence.

It is time to resign to the words of author of the book "How to Deal with Irrational People: What to do When Common Sense Fails and "Crazy" Behavior Prevails", Paul Colaianni.

He said, "The most important thing to remember about confronting an irrational person is that they are usually attributing an inaccurate meaning to a situation causing them to react irrationally."

"Human irrationality is a Fact, not a fad"reads the title of an article by David Berreby [read here] as he discusses research undertaken on human irrationality.


In the course of surfing to understand human irrationality, we stumble upon this article by science journalist, Tom Siegfriend, "Quantum math makes human irrationality more sensible" in the Science News website [read here].

We had learned a bit or two of Quantum Mechanics in the few Chemistry and Physics courses, including advance ones, taken back as an undergraduate Science student in New York (state not city).

As we understood it, quantum mechanics was a field that attempts to understand the physical world and the universe as a whole by introducing the simple (and presumably rational) mathematical concept of probability into then existing body of knowledge of physics.

The mathematical treatment and application to the theory is so complex that it looks ridiculous and irrational to the unlearned.

The interesting part is that this irrationally perceived body of knowledge is applied in an attempt to understand the irrational psychology of man. It is assumed that "those supposedly irrational choices merely reflect the fact that people’s brains are guided by the mathematical principles of quantum physics."

It was found that quantum probabilities was able to explain as to "why public opinion polls get different results when the same questions are asked in a different order." This are questioning trick of trade often used by Merdeka Centre and later UMCEDEL.

Since quantum mathematics is applied to an unquantifiable aspect of human behaviour. does it mean human thought can be applied quantum mechanics quantification?

Physical phenomenon explained by classical physics has an underlying quantum explanation that is more universal in the explanation of physical state, characteristics and phenomenon. It will imply that the simple ordinary reality has a hidden quantum probabilistic reasons.

The researcher Professor Wang explained in the article as asserting that human judgments “are often not simply read out from memory, but rather, they are constructed from the cognitive state for the question at hand.”


This relates to an article by "activist"George Dvorsky in the Alternet [read here] on the 12 flaws in the brain cognitive process that leads to wildly irrational decision including concluding on mere perception and heresay.

The first among 12 was confirmation bias as in "we love to agree with people who agree with us." Another similar brain flaw is in-group bias or some innate tribalistic tendencies.

So when such tendencies has become too over bearing that it could damage one's cognitive state, the only option to maintain sanity is to leave such tribalism.

Someone told us yesterday that there was a corporate event last Tuesday. During the press conference after the event, one of the company personal express interest for the controversial TRX land.

A reporter asked as to why they wanted the strategically located and said to be the last major piece of land in Kuala Lumpur but controversial land of the currently in a hot soup 1MDB.

The answer given was a classic and worth to be quoted, "We are businessman. We are not politician." Do not expect Sarawak Report or The Edge to highlight that quote.

KUALA LUMPUR: Nexgram Holdings Bhd is eyeing the last available acres of land at 1MDB's Tun Razak Exchange.

"We are in talks with 1MDB and have voiced our interest to participate in the development of the project," its executive director Alan How Han Lun told reporters on Tuesday.

"We will know not too long from now,” he said.

Asked why the company would want to be involved now with the company, How said there was still good potential with the development.

How was speaking at the sidelines of the signing ceremony with the construction company with China’s MCC Overseas (M) Sdn Bhd to develop two projects worth RM1.5mil in Cyberjaya and Putrajaya.

KUALA LUMPUR, May 28 (Bernama) -- Nexgram Holdings Bhd (Nexgram) says it is currently in preliminary discussions with 1Malaysia Development Bhd (1MDB) to potentially acquire land in 1MDB's Tun Razak Exchange (TRX).

In a statement to Bursa Malaysia on Thursday, Nexgram said it has not determined the type of development to be carried out, and whether it will be by the company on its own or in a joint venture with another party.

The statement was issued as clarification to a media report yesterday saying that the property developer "is eyeing the last available acres of land at 1MDB's Tun Razak Exchange" and that it has an "interest to participate in the development of the project."

Nexgram said it will make the relevant announcements in accordance with the ACE Market Listing Requirements of Bursa Malaysia Securities Bhd once the terms of the acquisition have been determined, and an agreement is formalised and approved by the Board.

The ongoing market rate for TRX land for local is heard to be about RM3,150 psf.


Tabung Haji bought at RM2,774 psf at an offer made three years ago but was only recently taken up. An ensuing controversy with 1MDB put the land into a political play with accusations of bailout and unfair low price given to 1MDB.

The explanation that it is a G to G preferential transaction and profit to be earned from the premium on the parcelled prime land will still remain with government albeit a 100% government company still not go down well with the cynical public.

The prejudice built against Chairman Dato Azeez Raheem clouds their business senses.

They refuse to accept explanations on the role 1MDB played as Master Developer to clear logjam, buy adjacent land at market price, address sensitive issues and create value for the parcel out land. For an understanding of the role of Master Developer, read this 2011 presentation here. Examples of Master Developer are Iskandar Waterfront, Kwasa Land, Setia Haruman, etc.

Certain segment of the public refuse to disengage politics from what is purely a business decision. Not even explaining the comparative land price offered to TH was 16% cheaper than the MRCB purchase of German embassy land at RM318 psf could help get them out of the amuk and hysteria mode.

TH had never applied for the piece of land and was only attracted to the deal upon special preferential price and good packaged offer made by 1MDB to local institutions. The 1MDB land was sold with full planning permission as per the masterplan. All TH has to do is complete their building design and off they go.

In addition, 1MDB will be spending over RM2 billion in infrastructure claimed to be the best in KL and surpass any other standard infrastructure being offered by leading developments in KL city centre. The infrastructure components will be delivered by the master developer to the plot boundary.

This infra include:
  • Largest underground MRT Station (Dual Line 1 and 2)
  • Direct connectivity to MEX, SMART, Duke 3, Jalan Tun Razak and Jalan Sultan Ismail First Class Public Realm (20 acres)
  • Pedestrian Links within TRX and connecting to KL Shopping Belt
  • TRX Precinct streetscape enhancements
  • Upgrades to surrounding roads
  • On-site Power Management Unit
  • Waste water treatment Plant
  • District cooling plant
  • CBD Security Measures
  • Digital Backbone for District Management, Traffic and Security
Beat that all you politicians out there!

Unfortunately, TH is dead set on selling it and rumours has it that it is sold. The Malay and Muslim can only regret and find excuses to please themselves or blame on others when Chinese and foreigners fill up the skyline of TRX.

They can thank Benchmark for responsibly scaring the public out of their ignorance of business. It was only short of a bank run on TH.

Otherwise they would have got themselves into the history books of Malaysian banking to join the luminous few like Maybank, MBf, cooperative and few others incidents of bank run that destroyed financial institutions.

The market price of RM3,150 psf is still priced for local institutions and companies but for foreigners, it will be more expensive. 

As an indicator, the highest done land in Kuala Lumpur is on the site of Pelita Nasi Kandar on Jalan Ampang. Priced at slightly more than RM3,300 psf, the land was purchased by Oxley Group of Singapore and come bare without any Development Order or plan. The person destined to be the CEO of the development company is former PKNS GM, Dato Othman Omar.

Obviously no transaction was yet being done at RM7,000 psf.


On May 12, Mulia Group of Indonesia signed a deal to buy the first offered plot of TRX land to TH at RM185 million for land and including the Signature Tower, it comes up to RM665 million. Reuters report here and more details in The Star here.

The land cost works out to slightly more than RM3,200 psf and it comes with goodies available for developer to work on.

There was a tad of regrets as many seemed to change their arguments from questioning TH purchase of the land to why the deal was for full payment. Easy to answer. When a property is so hot, any experienced and season land man knows Master Developer can dictate the term.

Off course this is all business language and not language of politics. The language of politics goes to the extent of questioning a government company buying land from government at preferential rate without knowing that many attempt to apply for the land and develop it earlier had failed. The political language goes to claim Mulia is run by an Indonesian criminal fugitive in which it make no sense since Mulia is based in Indonesia [denial reported by Mkini here]. Even business paper The Edge tries to discredit the transaction by questioning the speed the deal with Mulia.

So the Melayu be them UMNO or PAS or PKR can continue to quarrel and run themselves to the ground. The Cina and businessman does not have time for quarrels that foresaken interest. They are swiftly grab opportunities that present itself.

Heard all the TRX land have been snap up. Kwasa that wanted to ask for 15% discount was to damn slow and end up with nothing.

The Malaysian Insider was trying to give a tad of confidence to the new MAS CEO, Christophe Mueller. With a Mat Salleh, suddenly every other person could have a sense of renewed confidence.

He made one statement on the 180 allowances, which include bicycle allowance that drained MAS financially [read here]. Suddenly, the colonised psyche Malaysians only realised of the financial leakages within MAS. It is as if it never had been said before.

This blog used to expose such examples as engine sent for MRO missing and kueh ordered for VIP lounge are over ordered and over charged. Together with the expose, raised also was the problem of selfish and self centered unions that lead to such ridiculous allowance demands.

Anas Zubedy wrote in TMI of "... beginning to like this Mueller fella" for thinking he is as frugal and responsible on public funds as he is. Dr Tan Eng Bee expressed confidence and thought "... MAS should see better days" should they be able to Manage, Act and Serve (M.A.S.) well.

Unfortunately, TMI made a boo boo in their attempt for giving coverage to so-called NUFAM President Ismail Nasaruddin.

They quoted the sacked, womenising, trouble maker, and vindictive [read his exploits here, here, here and here] former MAS steward trying to bodek to Mueller to get acknowledgement. [read here]

MAS do not acknowledge NUFAM and MASEU had protested to their existence [read JMD here]. NUFAM was not invited to the recent meeting between union and management.

These are among the reasons NUFAM is constantly vocal and hogging the media to the extent of meroyan [a shining example here]. Ismail need NUFAM to cover-up his compromised reputation, moral, family and maybe financial.

Malaysia Airlines's new CEO, Christoph Mueller says the goal to achieve profitability could be difficult given depreciation in the ringgit against the dollar. – IATA pic, May 31, 2015.

New CEO Christoph Mueller's plans for troubled Malaysia Airlines - including a new brand, a smaller fleet and one third less staff - are widely seen as a promising blueprint for a fresh start.

The 52-year old German has successfully restructured Ireland's state-backed Aer Lingus and spearheaded a revamp at Lufthansa. He has also already impressed in his new job with his micromanaging ways, according to one long-time Malaysia Airlines executive.

Even so, many analysts worry that the state-owned carrier's long history of mismanagement and government interference, and its severely damaged brand after last year's two plane disasters will be too much to overcome.

"You can't parachute in someone irrespective of how sterling his previous record shows and expect him to do a job with an airline that's been abused for two decades," said Shukor Yusof, an analyst at Malaysian aviation consultancy Endau Analytics.

In addition to an unprecedented need to build a completely new brand after the disappearance of flight MH370 and the shooting down of MH17, Mueller must slash costs at a time when the airline faces intense competition from other full-service carriers and budget airlines.

Forced to fly to unprofitable destinations to promote Malaysia's foreign policy agenda, keep on more staff than needed due to powerful unions and to hand out contracts to politically connected firms, the airline has been saddled with a cost base 20% bigger than its peers, analysts say.

Little margin for error

Mueller, who speaks directly and concisely, is well aware of challenges.

It is the government who is funding. What they want in exchange is a new national icon, a new national carrier," he told Reuters in an interview last week.

"I'm hired to run the new company entirely on commercial terms and there's very little margin for error," he said.

Mueller, who joined the airline's board early this year and became CEO last month, added that he was aiming for a much smaller network and fleet and a sharper focus on cost-cutting - some of the strategies he pursued at Aer Lingus which was on the verge of collapse when he took over in 2009.

Efforts to rationalise the fleet have, however, hit some early speed bumps with the carrier so far unsuccessful in finding buyers for two A380 aircraft that it has put up for sale.

Mueller was also not shy of resetting some expectations.

Khazanah Nasional Bhd, the majority stakeholder that took the airline private last year in the wake of the plane disasters, said last August it wants to see the carrier profitable by the end of 2017 and to re-list in five years.

Mueller said in the interview, however, that the first goal could be difficult to meet given depreciation in the ringgit against the dollar that has taken place this year.

Some positives

On the plus side, analysts are pleasantly surprised that Malaysia Airlines' owner Khazanah, a state investment firm, has agreed to a clean break from the past - including the dismantling of old labour unions that have stymied change.

Some are optimistic that given time, Mueller has a decent chance of being able to work things out.

"The airline needs to simplify its fleet and network whilst facing many competitive and reputational challenges. But given the growth dynamics of the region and the geography of its KL hub, I believe that success can be achieved over the medium term," said John Strickland, a UK-based independent consultant.

As it confronts those challenges, Mueller's meticulous nature is expected to be a key asset - even if it ruffles some feathers.

"He takes an interest in very minute details," said the Malaysian Airlines executive, declining to be identified as he was not authorised to speak on the matter.

"Some don't like the fact that he is a micromanager, but we badly needed someone who pays attention to everything."– Reuters, May 31, 2015.

Not to fast.

The common factor through out the failed turnaround effort from 2001 to 2015 is and will remain to be Tan Sri Azman Mokhtar and Khazanah. They are still instrumental in preparing the 29 August 2014 document, MAS Recovery Plan. This blog's response then was "Frankly it's the same 'ol shit from Amokh".

They are still at it as "Know-nuts Khazanah gave know-nuts Consultan to stir more shit in MAS".

Basically, Khazanah are too laden with typically "accountant" mindset executives to cut cost and scale down operation at the whim of any problem. They have neither the creativity or ability to develop the revenue side of the business.

Dr Tan Seng Giaw may have meant well to ask Mueller to be given a free hand to do his work [read past posting here] but not when he has to do the same 'ol shit given by Khazanah.

If Khazanah had turned for the better, how come the supposedly already prepared letters cannot be out last week but have to wait till Monday tomorrow?

They incompetently are not aware of the Collective Agreements and quite sure, it is not in their maths when they prepared the Recovery Plan. The new deal only came about after union leaders met PM to highlight the CA.

Despite being reported in the papers, there are still no official announcement by neither MAS nor Khazanah to affirm the report.

As simple as withdrawing FD before maturity

Last week and the week before was quite occupied with various meetings with various level of people on the 1MDB matter.

Many versions and views of the good, the bad and the ugly kind was heard. There was also the beautiful and conspiracies. Not missing also are stories of unfulfilled dreams.

The reason to meet various VIPs and VVIPs is nothing more than to seek truth. One chance meeting with Minister at a secret hideaway outside the city was a useful guide.

The Minister said, "We have to focus on our role and work. Put politics aside and address the problem. So the audit by the Accountant General is useful to understand the situation."

A question arise. "Will the terms of reference for AG identify where the fault lies?"

The Minister's answer was firm.

"Lets leave the politics to politicians. The last audited account was March 2014. It is now end of May 2015. We need to ascertain the financial positions, its liabilities and more important, the financial commitments. Only then can we know what to do next. We have to move forward..."

The Minister is not inside Ministry of Finance, thus does not have access to the full information on 1MDB. However, the Minister is quite aware of the perception from certain relevant segment of the public and there was interesting rumours exchanged.  

Husni's statement

That was before last Friday's presentation to the cabinet on proposals to address 1MDB.

When Dato Husni Hanadzlah issued a statement for the Minister of Finance and as the appointed spokesman for MoF on 1MDB matter, it was in sync with the idea of moving forward in the conversation in that meeting.

The statement below:


However, the following portion of the statement mislead the public and became fodder for the critics to spin: 
Given the above, I am pleased to announce that 1MDB has entered into a binding agreement with the International Petroleum Investment Company (“IPIC”) and its subsidiary Aabar Investments (“Aabar”). As part of this agreement, IPIC will make a payment of USD 1 billion, on or before 4 June 2015. This USD 1 billion payment will be used to repay a USD 975 million (RM3.5 billion) loan, in advance of its due date, to a syndicate of international bank lenders. The agreement will also include further measures to comprehensively address the various financial asset and liability transactions between the parties, further details of which will be announced in due course.
Husni should have explained briefly what the binding agreement was about.

By saying it is an agreement that enable 1MDB to get USD1 billion to pay the USD 975 million, it opens 1MDB to all sort of speculations, new allegations and adding to the existing piles of slanders that need lengthy explanation to the simplistic one liner conclusion and accusations.

TMI twist it as IPIC paying for 1MDB loan. 



This opens up the allegation by Tony Pua and Lim Kit Siang that 1MDB had sought the help of loan shark.

The Sinar Harian frontpage below was twisted by one lost challenger for an UMNO Divisional Leader position as 1MDB borrowed from IPIC to pay a borrowing thus increase 1MDB borrowing.


Not sure how the accounting works out but it is a useful lie to scare off the gullible grassroot.

No bailout

A simple analogy to the "binding agreement" is similar to a 6-month Fixed Deposit that has to be withdrawn before maturity out of some immediate needs for money. It enables the money to be withdrawn before the maturity of the deal.

So it is not a case of new borrowing or loan shark.

Neither is it fresh capital injection which will invite accusation of dilution of Government or rakyat interest in 1MDB. Confidently, it is not a bailout as openly opposed by Khairy. Petronas money is not touched as a bailout piggy bank. 


It is non-sensensical to say that it is new borrowing to cover for expiring loan to Deutsche Bank in which it is claimed that the Deutche Bank borrowing was to invest in IPIC.

This is not a case of  "korek lubang tutup lubang" too. This is an advance payment by IPIC for an agreement that involves settlement of various assets and liabilities between the parties.

Debt reduced by RM16 billion


This swap of USD financial assets with USD liability will efficiently and in a faster way easily reduce debt by RM16 billion.

If that is too complex for majority and easily duped by perception layman, another example is a reverse repo to withdraw money placed under repo (repurchase agreement).

They new reverse repo deal structured with maturity date to match exactly with the original repo. The reverse repo rate will include penalties so the earning from the earlier repo "deposit" will be less or none.

If that is still not comprehensible, butt out of complex corporate deals and talk of more relevant bread and butter issue. One Minister asked a yes or no question last week. "Is this a business issue or government issue?" All present answered, "Business."  

Since the "binding agreement" is linked to earlier deal, it has to be on a new term. FD withdrawn will be forfeited interest or charged penalties.

This IPIC deal will be matched against the much accused US dollar asset from the liquidation of Petrosaudi investment the from the early days of TIA kept at BSI Singapore. It proves that sovereign wealth fund backed "asset" from the PetroSaudi JV and Murabaha has value and not a fake as slandered by many parties. Refer to Appendix A at the end of this posting.

It is only fair for 1MDB to forfeit the asset in BSI Singapore's custody to match this unplanned withdrawal.

And, it is also fair on 1MDB to take that option since detractors of 1MDB have scarred off banks, railroad Edra Energy listing, pressured land buyer Tabung Haji to forcesell, and applied political pressure on KWAP, EPF, PNB and TH from participating in any investment scheme by 1MDB.

Will not be surprised stationary supplier at Jalan Pudu are pressured not to supply papers and computer printer ink to 1MDB by DAP goons.

The different between this "binding agreement" and a simple FD withdrawal is that it is not only a single deal like FD but will involve "further measures to comprehensively address the various financial asset and liability transactions between" IPIC and 1MDB. The list of transactions between them in Appendix B at the end of this posting.   

What can the USD 1 billion from IPIC do?

It could retire the borrowing to Deutsche Bank that is due to mature sometimes in August or early September. And it help free up asset and the restructuring of 1MDB into separate operational entities.

Critics

One critic of this transaction is that it is an acknowledgement that 1MDB is in trouble. Jebat Must Die wrote it here.

Going by the same argument, few commentaries in some news portal asked that the AG report and PAC should be cleared first to identify the problem before the next course of action. This is similar to the Minister's view and it is not wrong.

Maybe and it is still guessing, the situation has been ascertain and to wait for the formal AG report, PAC, and inter- and intra- UMNO political exchanges will be too long. The immediate financial commitment need be met.

As far as the critics by JMD, it is nothing new.

In one of his statement to parliament, Husni acknowledged 1MDB is not financially sustainable. Dato Abdul Wahid Omar told a similar explanation in a closed door Pemuda UMNO event. [read Rocky Bru here]

Dato Najib mentioned his willingness to hear comments against the business model of 1MDB in the TV3 interview. This is something most commentator missed out but not this blogger. Extract from NST report, below:
"We can question (1MDB's) business model and I am prepared to hear different views on that. But I will not condone or accept any instances where funds were "vanished" or siphoned (by other parties), to make a film for example."
The PAC proceeding which has no significance can proceed. The political brickbat can continue till Najib is forced to resign or one faction lost out or UMNO met its demise.

Such cheap spins are going around to implicate Najib's son at Deloitte Consulting, Arul Kanda's absence at PAC, rumour created of 1MDB non-cooperation with auditor, Immigration Director statement on Arul's whereabout, first generation IPP award, CIMB foreclosure on Khairuddin, RM50 billion lawsuit against Tun M, etc.

Which ever side is talking, tell the truth because only the truth should matter. The truth should set us free from the shackles perceived.

Appendix A: Brief on the Petrosaudi deal

1. 1MDB invested a total of USD1.83b with PSI, initially as equity, then subsequently as a Murabaha facility carrying a 8.67% p.a. profit rate.

2. From these investments, 1MDB made USD1.058 billion.

3. In the years 2010 and 2011 , 1MDB received a total dividend in cash of USD265m from the Murabaha facility. This was recorded as RM332m (USD106m) and RM512m (USD159) dividends received in the 2011 and 2012 Audited Financial Statements (AFS) respectively.

4. 1MDB eventually exited its relationship with PSI in 2012 with USD2.318b. This generated a profit of USD488m. This was recorded in the AFS for 2013.

5. The USD2.318b was placed in funds under mgmt custodized with BSI Bank and as at Dec 2014 had received cash dividends from the funds under mgmt totaling USD267m.

6. In the Audited Financial Statement for 2014. it was recorded as a dividend of USD131.70 million as at March 2014.

7. In October 2014, 1MDB redeemed USD1.22b in cash from these funds as reported in AFS 2014.

8. In Nov 2014, it further redeemed USD170m in cash leaving behind funds under mgmt of USD939.9m

9. By June 4, it would have fully redeemed the last USD939.9m in Units towards full early settlement of the Deutsche Bank facility.

10. To summarize, for the initial investment of USD1.83b, 1MDB has fully received USD2.858b in capital gains and dividends.

11. This means, NO MONIES were missing from the PSI deal, and USD1.058m CASH returns (56.2% gross returns) was made from the PetroSaudi-1MDB venture.

Appendix B:1MDB- IPIC

1) USD1.1 billion (RM4 billion) in BSI Singapore
- Held as collateral for a Deutsche Bank USD975m loan and is apparently not cash but Financial Assets in the form of sovereign-guaranteed investment units).
- This asset is supposed to yield returns.

2) USD1.56 billion (RM5.68 billion) invested in a 2013 JV with Abu Dhabi Govt
- The 50-50 JV is called Abu Dhabi Malaysia Investment Company Limited
- JV is with Abu Dhabi government-owned Aabar Investments PJSC and is to jointly invest in energy and strategic real estate.

3) USD1.4 billion (RM5.1 billion) with IPIC

- International Petroleum Investment Co (IPIC) is a sovereign fund wholly owned by the Abu Dhabi Govt and has assets worth USD65 billion
- The money is a part of the USD3.5 billion 2012 bonds that is co-guaranteed by IPIC and 1MDB and appears to be IPIC's share of the funds.

4) USD1.25 billion (RM4.55 billion) refundable deposits with Aabar Investments
- This appears to be a deposit for the options of Abu Dhabi govt Aabar that is tied to the IPO of 1MDB's IPO assets.

In total USD5.06 billion (RM18.43 billion) of the famous RM42b seems to be stuck in various ventures with the Abu Dhabi Govt

Understanding that foreign investment is bi-lateral, it appears that the JV is just not for investments into Malaysia but in both countries.
