Facing up to rising prices

It is the first day at school.

The usual crowd and commotion can only be expected as parents gather at schools to accompany the first time schoolers and settle any payment due. Over the past few days, shopping complexes have been packed with parents getting new school uniforms, shoes, stationaries and various schooling paraphenalia for their children.

Grumbling can be heard of the rising cost. Parents with many children can be heard moaning of the accumulated bill this year. "Some item still not bought but RM2,000 already spent," lamented a parent is with 5 schooling kids yesterday. And, last year's uniform can still be worn.

Rising cost is a real concern and pressure on public daily life. So when Deputy Minister of Trade and Industry, Dato Ahmad Maslan tried to encourage online business but humour it as second job to meet rising prises, no one was laughing.

The public is already in a foul mood with his promises on GST that turned out wrong. Nothing is really wrong with getting another job.

Extra job

Lets not be naive about second job. Lots of teachers do tuition classes on the side and at times, to the detriment of their occupational responsibility. Many professionals use the access from their job to moonlight. It is an Asian ethos to work hard.

If mak and arwah bapak had not got various income from the sides, they could have given away our younger siblings. Even then when cost was still low, no GST, and government could afford to subsidise goods to maintain low labour economy, raising eight children with proper education was no easy task. Not for two government servants on meagre income to survive then.

At one time, father used to run a private school in Singapore and mother taught at a primary school in Jalan Abdul Rahman Andak, Johor Baru. By noon, father would fetch her in his bike to cross back to Singapore for her to do a second job to teach.

On several occasions, they did petty businesses like selling cloth, kain pelikat, batik, munchies and popsicles, cakes and cookies, Pontian coconuts to Singapore, etc. When father was government Imam, he part-timed as magazine distributor, and teaching kelas dewasa to weekend ugama classes for kids.

During bad times, we had done embarassing to mention pursuits in order to survive.  Basically, we've been there, done that. 

Unless one has access to other source of income, there is no other choice than to be frugal in one spending. One Facebooker was complaining of his tight budget but when it was disclosed he spend almost half his money on private transportation, astro and handphone bill, he came under pressure for poorly managing his financial affair.

Some Malaysians are unrealistic in their spending. Despite being VSS-ed, they are still maintaining the same lifestyle and not keeping a tight leash on the use of their compensation.

In fact, it is a puzzle as why the complain on rising prices when airport system got jamned by the  huge number of passengers during the school holidays. ON every weekend, shopping complexes in the urban areas are packed. 

Poverty

Off course, our heartfelt sympathy to the poor in facing the reopening of school and struggling daily to meet ends meet.

Rationally, one wonder how some Malaysians, primarily Malays had to struggle to live in their own homeland. The Indon that came as labourers some 25 years ago could now become sub-contractors and own home repair and renovation business. They have their own home and assimilating into the Malay community.

Poverty can arise for many reasons and usually unexpected. To accuse the poor of lazy, it would be inappropriate. Job opportunities in the rural areas, more so such as the inland areas of Sabah and Sarawak, are limited. However, hard work could still get them through.

The latest Department of Statistics figure as at December 23rd place the workforce figure at 14.4 million of which foreign workers stand at 2.2 million. There are gainfully employed Malaysians and unemployment is at 3.1%.

Job is not scare that foreigners are required to fulfill the vacancies. A recent media report put the number of foreign workers at 4.2 million. The national population is 30 million. They are filling up in sectors where locals are not interested any more. Some 70% of plantation workers are foreign workers

The argument that there is no reason for local to still live in poverty is quite valid. Only insensitive to say it openly.

Policy

For quite sometime, government have been talking about moving up the economic ladder into more knowledge economy, skill-based employment over labour intensive production economy, and moving up the competitive edge in technology.

Come Dato Najib as Prime Minister, he acknowledged the national predicament of the middle income trap. The country cannot sustain an economy still based on cheap labour and cost of living heavily subsidised.

Salary and wages have gone up and Malaysia cannot compete with our neighbours the likes of Vietnam, Thailand, Cambodia etc. It was Dato Idris Jala that alarmed the nation with his statement that Malaysia is doom to go bankrupt should it remain with current high level of subsidy.

Energy is subsidised. The power generators are subsidies and takes up the bulk of energy subsidy. Food, fuel, transport and a long list of items to the point subsidy take up 20% of government budget. 

This blog used to argue that subsidy was one way the rakyat could benefit from the wealth of the nation. However, it has its limits. The limit is financial. The argument then was public finance should be spent more efficiently. The new thinking was social welfare program has to be focus. 

During the days of nation building building - both public and industrial infrastructure, salary and wages was kept low to cover for the shortfall in technology in order to attract multinational companies to set-up factories in Malaysia.

There was even a lid on salary and wages of certain industries. For instance, Bank Negara Malaysia approval is required to determine salary scheme and bonuses of Banks.

That sort of practices was not sutainable. Malaysia kept losing its graduates and skill workers abroad. This blogger remembered encountering a post Gaddafi Libyan that said this country is wealthy but the people are poor because salary and wages too low.

Then came the policy for high income model. The intention was to move away from the low income past so that the higher income can absorb the higher cost of goods and services. Higher income attracts better skilled worker and generate a more productive and efficient economy.  

A finding by one NGO claim that proportion of salary and wages component in this country is too low vis-a-vis private sector revenue. They claim employers are making too high a profit margin at expense of salary and wages.
  
Instead of moving up the learning curve to bring about more automation, apply better management and all to generate a higher revenue per staff, employers and capitalist are generally still stuck in the old ways and resort to hire foreign workers for cheap.

The complain was locals are not hired because they demand higher pay, do not work as hard as foreigners and rather indisciplined. The availability of permit to get foreign labour makes them more reluctant to hire locals.

All these contribute to the restlessness on rising prices. Every time public complain of rising prices, some politicians would make statement of plan to form a fact finding committee. Thought the government had EPU, PEMANDU and KPDNKK at their disposal. 


GST

One reason being heavily blamed on government for the increase in prices was GST.

Good and Services Tax for valued added into the product and services. For a nation of 12.2 million of employed Malaysians, only 1.8 million paid tax. This is another element of the economy that cannot sustain itself.

In the past, there is always Petronas. They contribute to about 65-70% of tax to the government. In any failed project or financial scandal, Petronas is always there to bailout. Now that it is known that the lower oil prices had denied the government some RM30 billion of this revenue, a firm decision had to be made.

RM30 billion is a big dent in public finance that cannot be ignored. The opposition and it's supporter, allies and sympathiser can only politicise the problem.

They blame Najib government for being spendthrift and implicate the Missus to get the desired anger and hate. Expenditure and borrowing have been on the rise under Najib. A favourite political argument is too much corruption.

Malaysians seemed to forget the Opposition's Buku Jingga that had a steep rise in spending but could only offer cutting corruption to fill the budget shortfall. It is ridiculous to do a budget by assuming that spending could be cut by 20% and the saved money used to cover the shortfall in spending.

Why do the roundabout way when they could start with a lower expenditure figure? The reason is politics.

If GST had not been implimented, the public finance would be in disarray. A severely deficit government cannot afford to do any social and welfare program for the people. That is the priority.

GST is the fairest tax regime. There is no issue of having a concumer tax regime.

It should have started at a lower 4% but at 6%, the Malaysian GST is comparatively low. By right personal income tax should brought down lower, so that the rich would pay their taxes in their spending of higher end goods and the poor pay significantly less GST since most basic goods are GST free.

The problem with GST was the reality in the first few months did not meet the public expectation. Retailers and wholesalers up are reluctant to wait for the rebate later but choose to charge the extra 6% on consumers than wait for the "rebate".

One can attribute the problem to Custom Department's inability to educate the retailers. It is heard that they themselves do not understand it enough. On April 1st, when GST commence, it is heard Customs Department switched off their IT system for fear of the unknown.

The Information Ministry too failed to educate and disseminate the right and honest information. Even in developed countries, prices rise for the first few months of GST implementation. It takes three years for system to stabilise and work smoothly.

Apart from the deficit from Petronas, paying taxes is one of the sure things in life including death. Even fakir and poor have to pay their fitrah though they benefit from zakat collection. Recently, oil rich Saudi Arabia have begin to impliment GST as revenue for government. 

The need for tax is not only on spending for goods. There is the other part and for years been ignored. That is the services sector. For instance, stamp duties and legal agreement have by-passed our tax system by stamping it abroad and raising money for Singapore government for deals in Malaysia.

There is more area for government to raise revenue. That should be the focus. That way any reduced revenue or deficit in certain item will not lead to the rakyat having to bear a higher GST in the foreseeable future.

Transition

Rising prices can be seen as transitional but government have to show earnestness in making its policy work. The free flow of foreign labour permit should not be allowed to continue. 


The one way for government to address rising prices is to make the high income model work. Minister in charge of EPU, Dato Wahid Omar spoke recently on the target to increase monthly income. The government must be firm on employers and formulate laws to enforce on employers to respect the minimum wage.

More effort have to be done on unethical business practise that have culminated into incidents like Low Yatt and Kota Raya. Police and corruption buster, MACC need to be given the authority and supporting law to stop these practices including the involvement of money laundering, gangsterdom, and criminal elements in retailing.

The headline in the paper today is on the leakage and smuggling of LPG. After the leakage and smuggling of fuel that eventually lead to removal of subsidy of fuel, such criminals will eventually lead to removal of subsidy on LPG and an expected rise in LPG is definite.    

Something also need be done on monopolistic business practises and the need to break control on supply chain by the few. That runs counter to the free market practises as preached by businessmen and their trade organisation. But, why are they silent?

Presumed "Guilty"

In the movie, Presumed Innocent, Deputy Prosecutor, "Rusty" Sabich (played by Harrison Ford) was chosen to lead the investigation into the rape and murder of a female colleague, Carolyn Polhemus (played by Greta Scacchi).

As Rusty digs deeply into the case, he found Carolyn and the newly elected District Attorney, Nico Della Guardia were linked involved to a bribe to throw out a case. There is politics involved as Nico avoid from being the shortest serving District Attorney.

The legal drama could be titled as Presumed "Guilty" because Rusty had an affair with Carolyn and this led Nico to frame him for the murder. It ends with a court room cliff hanging escape for Rusty. [Watch it online here].

In the real life legal drama, Malaysian version of Harrison Ford, Attorney General, Tan Sri Apandi Ali is being presumed guilty by former Prime Minister, Tun Dr Mahathir. There is also political motivation but a different Nico character.

The scenes are still unfolding but still not the end yet.

Apandi responded by accusing Tun M of playing reverse psychology. It was intended as pressure to follow MACC's recommendation and make cases out of it. Tun M's remark appear as though the investigation paper leaked to him and like in the 1MDB issue, he seemed to make his own conclusion.

Apandi has put it on record to state to the press that he will act without fear or favour and in accordance with the law. He will not be pressured by such political game.

At stake is the good name of the office as it is not AG alone to decide. Other lawyers will be involved to study the 3 investigation papers submitted by MACC on the RM2.6 billion, and two other cases involving RM42 million relating to former 1MDB subsidiary, SRC International Sdn Bhd.

That leaves too much trails to do a cover-up. Tun M used to say conspiracy cannot involve many people. It is unthinkable to do so in these days of documents suddenly appearing on websites and social media. 

MACC

Many questioned why MACC need to make such statement. The submission of investigation paper by MACC, PDRM, BNM and any others bodies to AG Office is a daily affair. Rejection of investigation papers for further investigation and request for more statements and documents are part of any day's work at all these agencies.

AG is expected to request for further investigation since MACC Deputy Commissioner (Operations), Dato Shukri Abdull reportedly admitted the "RM2.6 billion probe is incomplete".

There is always the possibility of the same on the two cases recommended by MACC. AG did so on BNM investigation paper. The moment AG does the usual daily routine, the paid dogs will bark of cover-up.

Media report on the submission was on December 31st, the same day Arul announced the sale of Bandar Malaysia. It as though MACC timed the statement to divert the attention away from the good news.

That led those questioning MACC to suspect them of collaborating with Tun M to set-up Najib and provide the path for the ascension of Tan Sri Muhyiddin. In addition, Tun M made subtle threat on Deputy Prime Minister, Dato Ahmad Zahid Hamidi

The stuff of conspiracy theories that is difficult for the common people to disregard.

More so, Tun M's remark coincided with rumour of a change at the helm of MACC by The Edge. It makes no sense though for current SB Director, Dato Fuzi Haron to be the replacement. The man was never a crime buster!

MACC could have made the statement to dispel any suspicion of cover-up on their part. They were under such pressure following the Malay rulers' statement in October. That was the month MACC was supposed to complete investigation thus came the direction from AG to record statement from Najib before year end.

It does not jive for MACC to be in-cohoot to play politics and collaborate with Tun M. It is as though MACC expects AG to accept their recommendations. All the while, they insisted to maintain the current principle that the one doing the investigation should not be the one prosecuting cases.    

This differs from the American practise in Presumed Innocent. Tun M should know better> It is the same principle applied by ACA, which during his time was under the Prime Minister's Department.

In-cohoot 

Presumed "Guilty"?

If anyone is to be accused of being in co-hoot to presumed guilty on Najib, it should be Syed Akbar. Not because he was a former committee member in MACC, but because he has been relentless in his blog postings to support Tun M's cause to topple Najib.

In his latest blog posting, he wrote a cerita dongeng of a Bugis in a state of panic after unsuccessful meetings abroad to cut deals to save himself from prosecution. Obviously he was referring to Najib as Bugis. The posting could be reproduced in the commentary when he removes his posting.

Maybe out of fear or even guilt, OutSyed remove his postings daily. He stand a better chance to avoid lawsuit or any possible criminal prosecution by double checking his source. On this one, our source say Najib was never in Tokyo during the year-end holiday season. The last time there was in May during a near earthquake incident.  

As a friendly advise, OutSyed should know the limit to his politically motivated mind game. It is improper to question the ibadah of Allah's invited guest to the holy land. Only Allah has insight into a person's intention.

Proof showed Clare had direct dealing with Anwar

The link between Dato Seri Anwar Ibrahim and George Soros is known from the expose on Soros funding of Malaysiakini, Bersih, media NGO, etc. Ex-PKR, now Dato Lokman Noor Adam and Dato Ezam Md Nor exposed his funding of Parti Keadilan Nasional and  movement to free Anwar.    

So when Soros name was traced as behind the NGO funding for early days Sarawak Report, it was presumed that Clare Rewcastle has links to Anwar. SR target then was Pehin Seri Taib Mahmud and the attack indirectly served PKR's objective to make in-road into Sarawak.

In fact in August, MyNation revealed the close link between Clare Brown's brother-in-law, former British PM, Gordon Brown with Soros and Anwar.

Never was it known that Clare had direct dealing with Anwar on matters of SR. The blog Open Source Investigation (OSI) revealed proofs of their dealing.

Two days ago, OSI revealed two e-mails which showed "Clare Rewcastle has long had a relationship with Anwar Ibrahim." She had been "working as a media advisor to Ibrahim, acting as his spokesperson".

The email reveal "how she sought his approval before running stories on her Sarawak Report blog" .   

One of the email dated September 5, 2012, Clare Rewcastle sent an email to Anwar a copy of her email to the Royal Correspondent for the Daily Mail newspaper in London, Rebecca English.

She was acting as Anwar's spokesperson to undermine the planned visit of Prince William and wife, Kate Middle visit to Malaysia in their Asia tour in September 2012. Anwar Ibrahim called Clare as e his “media advisor”:


In another email, Rewcastle e-mailed Anwar on December 12, 2012 to seek permission to run a particular story. His reply was: “Please hold for now.” and Clare immediately complied: “Will do the interviews and then wait.”


This new revelation adds a new dimension to the episode of Anwar's man, Dato Tong Kooi Ong and The Edge offering to pay USD2 million to Xavier Justo for the stolen documents of Petrosaudi, in which they did not after getting the documents.


In Clare's Whass App messsage to Justo on June 16, 2015, she wrote:
We are setting up for one last crack before the state election… I will drink some when Najib is done… I have picked up the story through Anwar’s people… I have used Dr Mahathir to get other sources of information.
In the picture above which looks to be Tun Mahathir's office at Yayasan Kepimpinan Perdana, Clare was seen with Tun M. Picture of her with current hatchet man for Tun M, Dato Seri Khairuddin Hassan can be found all over the Internet. Was Tun M aware of Clare's link with Anwar then?

ABITW's new year posting here mentioned of Azmin being too close with Tun M to the discomfort of a certain faction in PKR. Is there a cooperation going on the premise like the political cliche Malay unity? That could include the role of non political party, Perkasa.

With PKR officially in a coalition with Amanah but in a government with PAS in Selangor, is this the making of a new political party or coalition of party?

By now, believe police have interviewed Justo. And, he has filed a lawsuit against Tong in Singapore. Francis was said to have hired international PR agencies to assist the attack on Najib via foreign media. YTL have been villified as corporate villain for their ventures in IPP, 1Bertari.net and ERL.

Do not overlook this part of the political feud. The conspiracy and intent to topple Najib is undeniable so this is the other side to the issues of 1MDB, RM2.6 billion donation and SRC.

Not only Malaysia, Saudi too is reviewing financials

Too much cheap politics going around these days. The latest being accusations made on the budget adjustment for 2016 to imply bad economic management on the part of government.

During the 1999-2000 financial and political crisis, Tun Dr Mahathir administration too re-look at the budget. Anwar introduced severe austerity measures that affected business and economy. Subsequently, Mahathir had to "intervene" and the rest is history.

Anyway, that is water under the bridge. The point is that it is not only prudent but an honest government to readjust the budget in view of changing economic variables and should it be necessary, bite the bullet.

A government in-denial or opportunistic politics will blame others and talk of past glories to deceive the people from the hard realities of the present.

Budget adjustment is commonly done by any honest government. So it is not only sickening and cheap politics act to take potshot at the budget readjustment but it just shows plain lack of intelligence!

Tighten the belt, plug the leakages

Malaysia is not alone in re-looking at the budget for this year. Saudi Arabia, the world’s largest oil producer is reviewing its financials and also restructuring its economy.

Towards this end, Saudi Arabia is looking at listing Saudi Aramco, a move that would allow the government to monetise its oil reserves and increase transparency on the national oil company.

The listing of Saudi Aramco is estimated to create a company worth trillions, far more than Apple, which holds the coveted position as the most expensive company valued at US$543bil (RM2.4 trillion).

If Malaysia were to follow the Saudi example, we should be looking at listing Petronas. But that is not likely to be on the agenda of Prime Minister Datuk Seri Najib Tun Razak when he handles the revisions to Budget 2016.

Najib is a seasoned hand when dealing with budget revisions. A few months after he was appointed as Finance Minister in September 2008, the world was in a crisis due to the financial meltdown in the United States, threatening a shutdown of the global banking system. Soon, Najib announced some measures in a supplementary budget to stimulate the economy in 2009.

In January last year, Najib announced a revision to the budget when the price of Brent Crude fell 50% from a high of US$115 (RM504) per barrel. He took the knife to the Government’s operating expenditure. He deferred certain programmes such as the National Service, trimmed expenses on items such as air travel and the use of professional service firms.

A year later, Najib is in a similar situation as the price of oil is averaging US$33 (RM145) per barrel, which is way below the government estimates of US$48 (RM211) per barrel in Budget 2016.

At US$48 per barrel, revenue from oil was projected to make up 19.7% of total Federal Government revenue which amounts to RM225.67bil. Now that oil hovers at US$33 per barrel, the revenue is lower. How the Government makes up for the revenue shortfall would become apparent when the Prime Minister makes adjustments to Budget 2016 in the coming days.

At a glance, there aren’t many policy options left for Malaysia. It cannot increase its debt levels very much from the current level. It cannot spend its way out of a slowdown if Malaysia were to keep its target of a fiscal deficit of 3.1%.

An increase in debt levels and raising the fiscal deficit could cause the international rating agencies to downgrade Malaysia.

Collection from the Goods and Services Tax cannot be expanded very much from the target of RM39bil this year unless the tax rate of 6% is revised up. This is something that would not go down well with the people and the Government knows it.

An option left is to tighten the screws further on the operating and development expenditure that amounts to RM260.7bil for this year. This would require close scrutiny on government spending.

Few countries can pride themselves of a system where there is no leakage in handling of public funds.

The criteria in managing public funds would be to undertake measures to minimise the leakage.

For Malaysia, there are no clear estimates on the leakage. The closest indication on the matter was based on a statement by a top government official last month. He was reported to have stated each ministry was instructed to come up with ideas to reduce leakage in public expenditure. This move could save about 30% of the cost, he said.

In our current predicament, even a 10% saving of the RM260.7bil in expenditure would be enough to make up for the shortfall in oil revenue. But, this would require scrutiny in public handling of funds.
Consistent with this blogger's long term view to plug the wastage and holes in public spending. For a start, why do University organise seminar or convention at hotels when they have abundance of lecture halls, classrooms and living quarters?

Saudis unveil radical austerity program


Saudi Arabia on Monday unveiled spending cuts in its 2016 budget, subsidy reforms and a call for privatizations to rein in a yawning deficit caused by the prolonged period of low oil prices.


The Gulf kingdom has kept oil production at high levels in an attempt to force out higher-cost producers, such as shale, and retain its market share. But this year's deficit ballooned to 367 billion Saudi riyals ($97.9 billion,) or 15 per cent of gross domestic product, as oil revenues fell 23 per cent to Sr444.5 billion.

Seeking to ward off future fiscal crises, the ministry of finance confirmed wide-ranging economic reforms, including plans to "privatize a range of sectors and economic activities".

Riyadh would revise energy, water and electricity prices "gradually over the next five years" to optimize efficiency while minimizing "negative effects on low and mid-income citizens and the competitiveness of the business sector," it added.

The first reforms will be effective from Tuesday, including an increase in gasoline prices, a rise in electricity tariffs for the wealthiest consumers, a modest increase in water costs for all, and changes to all energy prices for industrial users.

The government will also seek to implement a plan for the introduction of a sales tax across the six Arab Gulf states.

The success or failure of the reforms will help define the legacy of King Salman bin Abdulaziz al-Saud and his influential son, Deputy Crown Prince Mohammed bin Salman, who is overseeing the program.

The kingdom's austerity and reform program, a reaction to the past decade of profligate spending, has raised alarm among parts of the country's business community, who are already reeling from this year's cuts that have triggered widespread delays in government payments.

Radical reforms to the social contract between Saudi citizens and the ruling al-Saud family also threaten discord at a time when Islamist extremist groups such as Isis have threatened the country.




Real gross domestic product this year is expected to rise by 3.35 percent, with the private sector growing at 3.74 percent.

"We see real GDP growth decelerating sharply in 2016, albeit remaining positive," said Monica Malik, chief economist with Abu Dhabi Commercial Bank. "Non-oil GDP is forecast to moderate with the lower government spending feeding into the wider economy."

The government's austerity measures have been accompanied by extra spending items, such as the Saudi-led war in Yemen and Sr88 billion in bonus payments for civil servants when King Salman ascended to the throne in January.

The 2016 budget envisions spending Sr840 billion in 2016, compared to the Sr975bn that is forecast to have been spent this year and Sr1.14tn in 2014. Actual spending has outstripped projections by as much as a quarter for the past decade, but the government is trying to instil greater fiscal discipline.

Revenues in 2016 are forecast at Sr514bn, down from Sr608bn this year. The budget projects a deficit of Sr326bn in 2016.

The uproar from the rise in prices due to implementation of GST and withdrawal of subsidy such as fuel can only be naturally expected.

It's happening in Saudi too.

If that puts those cheap politic propagandist on the defense, expect more cheap politics as they come with a counter attack with a cheap reply. If Saudi is on financial austerity, how could there be Saudi prince or princes donating RM2.6 billion to PM Dato Najib.

Just say that allegedly happened in 2013 and this is 2016. Saudi were buying US T-Bills then and not selling them now.

Quoting from the website www.npr.org, John Sfakianakis, a Riyadh-based economist who is a former government adviser said, below:
"Over the next year or so, you will see the introduction of a sales tax — a VAT tax — eventually some form of income tax."

Even the price of tobacco and soft drinks could rise through new taxes.

Political in-denial of UK's national debt problem

In a speech in Cardiff last Thursday, the UK Chancellor of the Exchequer, George Osborn expressed concern that the recent heightened tension in the Middle East, sluggish growth in emerging markets, low oil prices and volatility in China could drag back the British economy

In addition, he expressed concern with the possible recurring of a long term phenomenon of the 1930s described by economist as secular stagflation [speech in full here in IBT]. His main concern will be the austerity drive he dubbed as long term economic plan will not be sufficient to turn the economy around.

A column in The Guardian the next day [read here] criticised his plan as merely political and is not addressing the real national issue of debt. He didn't raise these threats in last year's autumn statement.

It is almost similar to some critics to the plan to adjust the Malaysian 2016 budget.

The discussion on UK's colossal debt condition has been a long term concern, especially after the debt failure of Greece, Portugal and Spain. UK's national debt is astronomically equivalent to more than 500% of the economy as compared to the mentioned crisis countries at 267% to 363% of the economy.

The documentary is rather alarming as it claims that the financial collapse is inevitable. No country has ever recovered from such a situation. No country has ever reverse such trend. No emergency action has ever come close to a solution.

Another angle to the argument, former Work and Pensions Secretary to the previous Labour Government, Peter Hain was reported by Wales Online in September 2015 denied Britain was in a debt crisis and public spending was under control under the previous Labour government.

It looks quite the usual public debate on the economy in UK although Hain's statement was politically motivated. He had attacked the Conservatives for their “deceit and demonisation” during campaign and Labour campaign for failure to defend it's own record.

So the motivation in Hain statement is politics. Political preservation or acquisition of power are usually blamed for leading to the state of in-denials to any problems. With UK's colossal debt problem, Hain seemed to be in a state of in-denial.

Morning Star online news portal claimed Osborn too is in a state of denial The responded with an article with the headline, "It's always someone else fault".

Seemed no different here in highly politicised Malaysia as politically driven sentiment peppered with illusion of a romantic past is putting the nation in a state of in-denial to the challenges from economic and global realities looking at us in the face.

Managing the growing economic pessimism

Anyone heard of a market saying: Bullish at the top, Bearish at bottom? That is the typical herd mentality market psychology that happens all the time.

Everyone is worried about the economy these days.

Houses can't sell, business already bad, and hot weather making fish at market expensive to add to the perennial problem of rising prices.

There is graduate unemployment. If that is not bad enough, Harian Metro made a sensational but ridiculous story of University students having no money to buy food.

Yes we concur with Khairy.

Oil has drop to the USD30 per barrel level.

Petronas, that was in the red at negative RM556 million for third quarter compared to RM12.4 billion a year earlier, are more pessimistic. With cash reserve of RM88 billion, Petronas expect to face two to three more tough years. [Read Bloomberg in The Star here]

Since negative news is the fad, the media only worsen further the sentiment with more. Singapore's ST reported: US$20 oil no longer mirage as crude sinks below US$30. Such pessimism favours Singapore's refinery.

No wonder response to stories on politics and conspiracy does not attract much attention. Everyone is worried. Not only is it an economic issue, the highly volatile situation could translate into security.

One keen follower of foreign affair and military told us yesterday that the US is stockpiling on the crashing oil to prepare for war. Whether it is the Middle East or South China Sea, it was them that brought oil by triggering cut loss on shale oil. 

Another worrying news.

It was reported that Moody downgraded Malaysia's rating from positive to stable. Though this blog is sceptical of rating agencies, policymaker require such rating for policy decision. It has an impact on the country's availability and cost of credit.

With all this bad news, what should a government do?


Minister in charge of EPU, Dato Abdul Wahid Omar replied that it is not a downgrade. Quoting from The Star below, he said:
“It’s not a downgrade. The rating remains at A3.

“I think it’s more of the revision in outlook from positive to stable and that’s to take into account the slowing growth in China and the continuate drop in the commodity prices and in particular, the oil prices.”
Of all person, ex-banker Wahid should be familiar in reading into rating agency reports. However, social media are passing comment that he is not working but just defending the government.

It may have been compounded by earlier statement by Wahid on TPPA to reply presentation made at a recent TPPA conference.

There was the opportunity to hear the other side of the story but they refused. It gives the impression the organiser are in a "millitant" mode and have no interest for discussion but only to propagate their point of view.

Anyway the two sides to the story can be read here verbatim without any rephrasing.

Just before the year end, Wahid also made some defensive statement with regard to the current bout of decline in ringgit. Maybe there is quite substantive facts presented but the newspaper gave a usual cliquish headline, Malaysia sedia depani krisis.

It did not pick up the essence of his statement. Sedia or not, Malaysia will be facing a crisis. It's really old school style of headline. The response from sceptics will easily be it was 4.00 then, but it is 4.38 to the dollar this morning.  

If that is the expected response from the public, we doubt public will swallow blogger Captain Seademon's revelation yesterday of an encouraging news from Bloomberg.

He commented:
Despite oil prices dropping 75% from USD110 to around USD30 per barrel, Malaysia is still not going bankrupt or any nearer to becoming a failed state at all.

In fact, we will continue to grow in 2016 – and at 13th highest too.

Or maybe Bloomberg (which was correct in its prediction for Malaysia’s 2015 GDP growth) is a crony too.
Staying cool
Pessimism ...
Having undergone many market crashes and few boom and bust economic cycles, these are ever so familiar reactions of economy moving on a down cycle and market crashing on successive pessimistic news. 

From our past experience as trader in currency, money, stock, bond and whatever market involved and fund manager, we learned something. And it is something useful in life.

Never decide when one is too happy or too sad, too confident or pessimistic, and too worry (even panic) or too cool. Make the important decision when one is calm and rational.

When it comes to dealing with those volatile characters, not to entertain them in the midst of their volatility or tantrum. For those beyond redemption, cut them off and move on. Other than family and true friends, no one is indispensible.

Providing comfort


That is as far as decision making but to Wahid, he has to provide comfort to the public. He need to avoid panic that will only worsen the delicate level of confidence if there is any left.   

The way to do is communicate.

It reminded us of the pointers given by the Ukranian corporate comm lady at a conference held by Wanita UMNO.  She was involved in handling the MH17 crisis in Kiev as her government was accused of shooting down the plane.

In a crisis situation, she said truth does not matter, stories do. Truth is never simple (as Wahid tried to do) but the simpler stories wins. So develop a story and stick to it. Persistently generate newscycle.

Furthermore, she said a crisis can be an opportunity. To make it beneficial, it needs a track record. The pre-crisis track record and PR matters because crisis is not time to do PR, make friends and build network.

For us in Malaysia, crisis is usually tougher to deal with due to a certain strange local phenomenon. Rockybru pointed out in his posting blog here that some Malaysians have a sadistic habit to "rub their hands in glee over the slightest "negative" news they hear on their own country."

Rocky was responding to allegations by the Rafizi we often described as a perpetual liar. He said downgrade is good and lied about federal collected tax from Pahang bauxite mining. Must say he is creative but just will never believe him immediately.

There exist a Ministry "Gula & Tepong"

Do not be surprise if we are to tell you that there exist a Ministry that is empowered only to regulate and control the price of sugar and flour.

In the midst of rising prices for local food, transportation, and other daily need in the economic environment of a global downturn, you will be disappointed to know that the Ministry everyone expect to regulate prices in the market is only empowered to regulate and control the prices of sugar and flour only!

This is not to say that the Ministry KPDNKK is not carrying out their duty to address profiteering as per the Price Control and Anti-Profiteering (PCAP) Act 2011. 

The pressure from media and consumers generally complaining and blaming them for not strict in their enforcement did allow them to be in a state of slumber.

They are trying their level best within the constraint of the law, limited resources, rampant practices, wide network of offenders, and uncooperative public.

Save for alleged corruption, which are individual in nature, KPDNKK under their new Minister, Dato Seri Zainuddin Hamzah have been working and trying out various efforts and measures.

Again, the power to regulate and control prices is spread out under various Ministries and government agencies like Ministry of Agruculture, EPU, MPOC, etc. and not entirely under KPDNKK.

Role

The long name for KPDNKK or the long version Kementeriaan, Perdagangan Dalam Negeri, Koperasi Dan Kepenggunaan gives the impression that they have such a wide reaching power and solely responsible for monitoring, controlling and enforcing prices on practically every item.

Not only they do not, KPDNKK has also a role to play to developed the domestic trade sector and cooperatives.

They are also involved in coordinating the policy, licensing, regulation and safety of the downstream petroleum, petrochemical and gas industry.

In conclusion, KPDNKK is responsible to study and draft policy related to domestic trade, monitor prices of good and undertake enforcement to ensure domestic trade practise are clean and fair.

It involve monitoring wholesale and retail trade, protecting concumers rights, Intellectual property, and registration together with monitoring businesses. [Browse for more accurate info in their website here]

It is heard that KPDNKK was given the responsibility to prepare the policy and regulation with regard to the vape business. It is expected to be put forward to cabinet for approval.

The banning of vape was strongly recommended by the Health Ministry and few state Muftis issued fatwa declaring it as haram on personal recommendation of certain doctors.

However, the issue is not as simplistic as the public debate against it argued. Using the poison substance act to regulate nicotine content in the vape liquid, it would not be fair for the safer and more ligit vape practises.

In fairness to all - non-Muslims, even Muslims and legitimate smokers - using vape as the halfway to kick cigarette habit, the solution is to regulate. 

Off course, it raises back to the issue of weak implementation and enforcement endemic in Malaysia.

On this aspect, the limitation to effective enforcement for the newly established Ministry should be appreciated.

KPDNKK was originally established as Ministry for Domestic Trade in October 1990 and the new name and slightly expanded role was given in June 2009.

There is the limitation of manpower, financial, expertise, and system that need be addressed for effective enforcement. Enforcement need dedicated staff and the integrity to resist temptation.

Consumer

At times, the less than  effective enforcement is not entirely the weakness of government, in this case KPDNKK.

One major problem in making enforcement effective lies with consumer attitude itself.

There are many cases of supermarket or eatery owner getting charged and penalised heavily, but it does not deter consumers from still coming and giving business.

That does not include the problem with consumer indifference and ignorance attitude

Consumer awareness and power is not strong in this country.

When wholesaler and retailers were raising chicken indiscriminately, consumers especially Malay consumers are not willing to sacrifice and band together to boycott and teach errant businesses a lesson.

In some occasion, Chinese consumer could do so but several past incidents suggest the action more skewed towards protecting racial business interest than a genuine consumer action.

In this area, KPDNKK have been doing program like Skuad Pengguna that monitor and report to the authorities whenever profiteering is spotted. The number of counsumers involved in this program is believed in the hundreds of thousand.

They have initiated a FB called Friends of KPDNKK to disseminate information in which much of their efforts and success have not been reported by the mainstream media.

It also serve for engagement and getting feedback from consumers.

One area and it is one big challenge for KPDNKK would be to breakup the cartel of players monopolising on the supply chain.

The monopoly from the level of importer, wholesaler, distributor and retailers are blocking other players from coming in with the intention to protect their profiteering activities.

Knowing so well no competitor can cut in, retailers can confidently tell off complaining consumers to take it or leave it.

The solution to break-up cartel is necessary and it is for the good of both consumers and for a healthier business condition for all races, and individual to be able to proper together.

After all, most of this cartel owners are no more casting vote for ruling government!

Malaysia does not need 1.5 million Bangla

Compared to other immigrant workers, the Bangla Deshi has not been as problematic as compared to other immigrant workers. The current wave of Bangla Deshi worker is not as problematic as the first wave.

They are quick to pick the Malay language and within months are able to speak. Sometimes it is to the embarassment of certain races whose been citizen for few generations.

However, the plan to bring in 1.5 million into Malaysia is unnecessary. Even though it has yet to be decided on and some explanation given is that it is not 1.5 million one go but replacement of existing immigrant workers.

Till it is explained clearer, the idea of bringing in mass number of immigrant workers is not in-sync with the economic plan for high income economy.

Invest

Tun Dr Mahathir was one of the early proponent of the model. He used to highlight an important aspect of the model and that is the high income must come with increase productivity. It is only a fair expectation.

This have been said many times that Malaysia has to move from the low cost producer economic model to high value added economic model.

At the micro level, the thinking must be away from the high labour input to more machinisation and machine, equipment and automation to replace labour.

One can observe the few number of workers used but highly mechanised operation and expansive acreage of agriculture in the US.

In the food retailing side, labour input can be cut by introducing self service, cafetaria style, and use of equipments in the kitchen.

Only restaurants are truly full service and provide high quality service level in which waiters are well trained and fairly well paid. Naturally, it cost more to eat at restaurants.

A matter of time, food outlets in Malaysia will have to live with the reality that they cannot rely on cheap labour anymore but have to look back at their business process and market segmentation. As Malaysians realised cost of makan luar is getting too expensive, they will eat out less.

As happened abroad, people will choose either cheap and efficient fast food outlets or high price and quality full service restaurant.

In a matter of time or maybe closer as we advance further, gerai and hawkers will be a thing of the past. City hall will stop allowing such casual eatery to continue. These operators must upgrade - operate from proper facilities with right business model or be redeployed to work.

The keyword in the transformation to the high income model is to invest. 

Greed, not necessity

When it was first reported by TMI in August last year, Malaysian Trades Union Congress (MTUC) secretary-general N. Gopal Kishnam expressed disagreement to bringing in immigrant workers equivalent to the  population in Kelantan.

He was reported saying, "Local workers have no hope to find jobs as employers like to hire those they can pay cheaply.

"This always happens and Malaysia will not achieve developed nation status by 2020 where one of the goals is to raise workers' salaries."

In TMI's report yesterday, Malaysian Employers Federation (MEF) executive director Shamsuddin Bardan does any evidence or survey that showed Malaysian companies needed as many as 1.5 million new Bangladeshis with the softening labour market, severe drop in business and retrenchment of local workers.

“We currently have 2.3 million legal foreign workers. I doubt that in this economic climate, we can absorb 1.5 million extra foreigners on top of the existing ones. This plan will only work if we deport 1.5 million illegal workers first,” he was quoted as saying.

Malayan Agricultural Producers Association (MAPA) director Mohamad Audong also refuted the sector needs as many. The entire sector only employed between 350,000 and 400,000 workers at any one time. It's shortage is only between 10,000 and 20,000 workers every year whenever workers balik kampong.

MEF and MTUC believed that the so-called need for the so-called 1.5 million new foreign workers is motivated by greed and not necessity. Labour supplier nets in profit between RM3,000 and RM4,000 per foreign worker brought in. Another cashcow is the online services to process the applications.

This looks to be widespread inhumane activity of profiteering from the blood and sweat of poor people.

When the name Malaysia surfaced in international report of widespread human trafficking activites, we were defensive. Many months ago, mass grave of promised immigrant workers and family abandoned by brokers were found in the jungle at the border. 

Have a heart to another fellow man. Lets not allow this act of offering false hope that actually put their life in danger. If we can't absorb them, then do not take them in and result in social problems in the country.

Was told royal not the "jerung" this time

From the days of Tengku Wong exploit of timber in Pahang in the 1980s, we have been prejudicial of the Pahang royalties in the exploitation of natural resource to Chinese taukeh who shows no concern for the environment and public life and health. [read RPK here]

When it was heard a member of the Pahang royal member was involved in the mishap in Cameron Highland that was as a result of environmental neglect, it came as a no surprise to us and in fact, we expect it to be so.

The rumour was Tengku Asmawi was involved. There have been no denial on this widespread rumour. And there have been neither any result of investigation made known nor any action thus far. So figure out yourself.

We were passing through Kuantan several months ago, when the red dust in the air, on the roadside and surrounding oil palm plantation were beginning to be noticeable, it dawn on us as to why no action was taken despite the visible pollution.

It is a far cry from the condition today but the immediate prejudicial assumption made then was the possible involvement of the palace or royal family. 

Upon our return, we bump into a member of the Pahang state exco at a massage therapy session run by the blind. We raised what we saw and his reply was they can't do anything because certain matters fall under the federal government.

He is implying as though state has no power to make federal government department carry out their enforcement work. We didn't argue back though couldn't buy that argument.

We remembered of an environmental incident which involved the then Selangor Director of Department of Environment (DOE), who happen to be a friend. Supposed to have a meeting with him but delayed by an hour and half as he had to coordinate an incident in Port Klang and get the media brief immediately.

When we finally meet up and he had to buy lunch for being late, he said, "Sorry bro, I have to address this before Khir Toyo come after me."
  
So we still believe that the state DOE answers to the MB. If not, Khir Toyo is a better and firmer MB than Tok Nan.

Anyway the Pahang exco member may be in a bind to say anything till matters can be sorted out. Our reply was simply, "Last election Pahang was faced with a fictitious radioactive environmental issue in Lynas and yet you guys can't handle it well. Do you guys wanna face GE14 with another and a real environmental issue?"

We left it at that. His answer definitely could not convince us no Sultan or other member of the royal family involvement.


Tengku Puan of Pahang, Tunku Azizah Maimunah Iskandariah expressed her concern on the Instagram. The report on FMT was taken into consideration but yet we are still not convinced. This is Pahang one is talking about!
  
The former champion of the Lynas slander, Fuziah Salleh has already spoken. It is only political opportunity to be seized upon, It would be dumb of her not to. The Lynas issue raised her profile and with Chinese solid vote, it has helped her win the Kuantan Parliamentary seat in the last general election.

Environmental issue from bauxite mining will help her retain the seat. 

Already, there is a viral video of Joget Pahang 2.0 uploaded last month that implicated the Sultan of Pahang as the concession owner.


It has all the signature and suspiciously could be the work of PKR. They have no fear or shame to get their fact right before spreading such accusation. The video exploited the negative perception on the Sultan.

Politically, they knew it will eventually turned back to make UMNO look bad as they will be perceived to be in co-hoot for submitting to the whim and fancy of the Sultan.

What was known was that the mining was done on private owned plantation land. When PKR is in, there will always be lies and manipulation. It backfired on us as it made us reconsider.

Furthermore, several well informed friends said no Sultan involvement this time. Keyword is this time.

Broken out

Today the issue has broken out.

The mining has been suspended for 3 months. It is known that the mining was allowed despite no proper facility at the Kuantan Port.

Many taukeh investors were in for a quick kill. So the reason they complain on the 3 months suspension. These taukeh have no soul and conscience but only concern for quick money!

Till today, four officers from the Pahang Land and Mines Department (PTG) including a PTD administrative and diplomatic officer have been charged for bribery. [Read The Star here]

After repeating the same mistake as in the Lynas issue, Pahang MB has finally spoken. FMT report below:
Adnan: ‘I made it clear bauxite would be a big problem’

Pahang MB admits state government's failure in trying to resolve bauxite issue.


PETALING JAYA: The Pahang government had its hands partially tied in handling the bauxite saga, Adnan Yaakob revealed, admitting his administration had failed in handling the matter satisfactorily.

“I don’t want to play the blame game, but the fact is that all the enforcement agencies, except the Land and Mines department are under federal jurisdiction,” the Pahang Menteri Besar told the New Straits Times in an exclusive interview.

Adnan maintained he played his role as the MB by contacting stakeholders to resolve the issue and at one point even shouted at transporters in a meeting and threatened stakeholders.

The problem, however, he admitted “was just so big.”

“There was never a time in the state executive council meeting that I did not discuss this issue. I even made it clear that bauxite would be a big problem for the state and this is true,” he told the NST.

Adnan also said he did not seek help from the Federal Government initially as he wanted to resolve the issue himself within the state government’s capacity.

“I didn’t see it pertinent for me to seek help from the federal government. The state government had tried to handle this issue on its own but it was a failure.”

He later said that if the state had control over the sector, like in Australia, Pahang would not be facing the present problem.
Looks like, action was only taken when it came out in the press like in the Cameron Highlands and residents has resort to vigilanteeism.

Despite what Tok Nan said, thus far, only action taken is against officer of Land and Mines under state authority. The perception is state officers will not do anything against the Sultan or member of the royal household.

State officers are well aware that politicians come and go, but the Sultan and Royals stays forever till death only change them with other royal members.

Nevertheless, Tok Nan may have a point.

Why federal enforcement agencies only come in after the media made it into a buzz? Why not when MB has raised the issue repeatedly, DOE?

Why allow?


Royal or not, we are still wondering as to what happens after 3 months when the suspended licenses could resume. Will there be stricter system in place on Bauxite mining? To cover the eye of the "mudah lupa" public, the bureacucrasy is expected to make such statement.

Hope the Kuantan folks not be easily fooled.

Ask as to why it was allowed in the first place. The enforcement agency must investigate that first. Geogologist experts are aware of the adverse impact on the food chain. There have been experience with bad effect of bauxite mining in Johor.

If the authorities are vigilant as happened in Penang to stop illegal tantalum "black gold rush", it could have been avoided. Did anyone interfered in the process of governance?

Who is the jerung or big fish mentioned to be involved as mentioned by MACC Director for Investigation, Dato Azam Baki in the interview with NST? Can't be just any corrupt Tom Dickhead and Hurry PTD officer at the PTG.

And, Azam warned against any rumour of the case "settled". Go MACC, go!

Is it Constitutional or "Koliang" problem?

Sorry for the use of Minangkabau accent. "Koliang" is Minangkabau for the Malay word "Keling".

Calling anyone Keling should not be perceived as derogatory or racist. It is the Malay word to describe Indian. It is usually referred to Tamil, due to their larger presence in Malaya, but it could be expanded to other races from the Indian sub-continent.

The word Keling may have been derived from the Tamil word "Kalinga." It was an early Indian empire, so nothing derogatory but something historical to be proud of there.

Sometime last month, this blog highlighted that Mamak may not be constitutionally Malays. Since some Mamak are not culturally and constitutionally Malay, the Mamak and Islam converted Keling should not involve in UMNO politics.

Bigdog followed up with something positive as he cited an NST report of Prof Shamsul Amri's paper at a conference. The kedai mamak was complimented for helping "cultivate the nature of bringing multi-ethnic Malaysians together.”

FMT published an article by one Fa Abdul entitled, "Yes, I am Keling. So what?" It expressed a sense of confidence in their identity as Keling or Mamak. More the reason to butt out from "subsidy-seeking" UMNO.

Confident they may but unfortunately the Keling and Mamak does not seemed to be able to amicably resolve family issue without quarreling. There is another conversion of children to Islam in the public sphere.

Again, why the need to change the country's Constitution to resolve family issue?

Temperament

Such is the typically observed temperament and uncompromising dispositions of Keling and Mamak. Hate to stereotype any race negatively but it always happen that way.

They tend to be emotional and seldom get branded wrongly as shit stirrer or troublemaker. Often a time they refuse reasons and will not rationally acknowledge facts. Some stubborn putar alam refuse to learn up anything as though they know better and their understanding of information are sufficient.

Again, it is only few and not applicable to all, but Keling and Mamak have been unfairly painted with a single brush as suspicious in their actions, conniving in their dealings and very apt at talking and sliding themselves around a situation.

So this conversion issue may be more emotional than just legal.   

Our family's friend, Pakcik Yunos was a Muslim convert Hokkien Chinese. He converted from Catholicism but did not force his new found religion on his children.

Naturally, his wife was bitter because his conversion means an automatic divorce. However, he remained responsible to the wife and family as he gave away all his savings to his wife and started a new life. Hardly any issue at all.

The singer DJ Dave divorced his Punjabi wife when he converted to Islam. He too did not force on his two children to convert. He remarried and still maintain "family ties" with his Punjabi ex-wife and children. At a concert in Istana Budaya few years ago, the singer invited his ex-wife and children to come up on stage.

He should be classified as Keling but maybe the Punjabi or Sikh faith may not want to be mistaken as Tamil or Hindu.

Personally, we have had Malay friends marrying converted orang putih. When they divorced and the wives return back to their country with the children, there were concerns on the faith of their children. However, it never got emotional and public.

Only Keling and Mamak

Not in the manner that is happening with Keling like the current case of Indira Gandhi. There is the usual outcry from the legal community and left wing NGOs. Some 300 people are planning a walk-in solidarity for Indira Gandhi who lost in her legal dispute to challenge the conversion of her daughter.

This is strictly a simplistic observation. Nothing empirical.

Did we missed anything because other similar publicly emotional and publicised cases like that of Deepa, Subashini and Shamala involved Keling couples?

Noticably the lawyers representing them or vocally supporting them will also be Keling or Mamak like Kulasegaran for Indira, Malik Imtiaz, Dato' Ambiga, Dato Gopal Sri Ram, Harris Ibrahim, and many more.

Even Dato Zaid Ibrahim, the vocal lawyer is a Kelantan Mamak with a humble beginning from Kuala Krai estate. Zaid got his facts wrong in his comment of this case.

The "human rights" activists will be Keling or Mamak like lawyer Harris Ibrahim, Ivy Josiah and including one with an eighth Indian blood, Dato Marina Mahathir. The human rights must come with quote unquote because they tend to be suspiciously bias to a certain insidious agenda, thus not really fighting for human.

G25 is supporting this issue as part of their critique of Islamic authorities, JAKIM and syariah court. Do not be surprise many among the vocal members of G25 are Mamak. Tun Mahathir was seeking this Melayu liberal group for political support.

Prof Shad Faruqi that talked at their forum is Mamak or likely still Keling. They brought over few Keling and Mamak from other countries to speak.  

It will only be complete should there be Keling or Mamak judges presiding these cases.

We heard the retired "cross dressing" Court of Appeal judge, Dato Hishamuddin Yunos on BFM radio yesterday. Strange English accent. For a judge, he is not quite fluent and has a feminine high pitch voice.

Not sure he is Mamak. 

Legally speaking 

As understood from Hishamuddin's BFM interview, at stake is the interpretation of Article 121 (1A) which essentially assign syariah matters to the jurisdiction of Syariah court.

This was the amendment introduced after the Nor Asiah Bokhari incident but it may have other consideration like safeguarding Islamic institution and preserving the sanctity of the religion of the federation.

The judges - Court of Appeal to Federal Court - has thus far decided to refer any issue of conversion to the Syariah court.

As per the precedent set by the Lina Joy case, in which we believe all conversion out of Islam has to be acknowledged by the Syariah Court before the National Registration Department could change the religion on the NRIC. It was said the root of the problem was the new NRIC with religion stated.

We are no lawyer so we hear from the legal minds.

Hishamuddin, who got his judgement on cross dressing at the Court of Appeal overturned by the Federal Court for erroneously making constitutional decision outside his jurisdiction, claimed judges wrongly interpreted the Constitution to ignore fundamental rights   

Here we go again. Same recycle arguments. So it's intention is to be persistent in the effort to remove the power of the Syariah Court and subjugate it to be inferior to the Civil Court.
 
One Punjabi lawyer friend argued that non-Muslim marriage are registered at the civil court. Thus, any matters arising should be handled according to the original civil court marriage contract.

In addition, Hishamuddin interpreted that Syariah court deals with marriage between Muslim and Muslim. For dispute between Muslim and non-Muslim, it should be dealt with at the civil court. 

However, there is also the issue of father's parental right over the children. It is a tough call as to which of the parent have right to determine the children's faith. Culturally, husband is the head of the family.

Does he remain so for couple that have parted ways and one of the party has changed religion? Many non-Muslims do not agree that the issue have to follow the husband's preferred court.

Both Keling parents do not wish to wait out till the children reach 18 to decide on their own faith. That is the reason they drags the whole society and disrupt peaceful co-existence between different faith in their dispute.

However, it is fundamentally wrong to argue that Malaysian Constitution is secular as one Australian wrote in MMO to call the happening as nonsense. In response, a lawyer commented in our Whas App group:
He must be living in a different planet. Our constitution not only recognizes Islamic institutions and courts, it confers jurisdiction to dictate the moral conduct of more than half of the population with penal consequences. When UK is not even regarded secular in the ordinary meaning of the word, our Malaysian constitution which is bias towards Islam can be regarded as secular? He doesn't know what secular means and ignorant of our constitution. Shad faruqi had written many times on this. It's neither secular nor Islamic. It's based on our social compromise.
Prof Shad Faruqi got himself in a controversy for telling judges putting Islam ahead of the Constitution to resign. He is not technically wrong but as politically incorrect as lecturers impregnating own students. Judges are supposed to make judgement based on the law.

Although there will be differences of opinion, judges had their legal basis in their judgement and seemed to have made their interpretation according to the law. Only thing is it is not to the liking of the Hindu.

A reporter interjected in our Whass App group:
The fact that islam is declared as the religion of the federation...shows this is not a secular country. Secular means NO religious basis at all.
A final comment by a legally trained Tun:
The Reid "Constitution" was a recommendation to the 3 parties involved in the Merdeka talks - the Malay Rulers,the British who were in treaty with the Malay Rulers, and the Alliance Party. What our Constitution was, before all the amendments after Aug 31st, 1957, was the result of the post Reid tri-partite discussions among the rulers, the British and the Alliance Party.

The Alliance Party was stubborn on a number of issues but the rulers stood firm for more state rights and a stronger rulers' roles and their reps led by Dato Mustapha Albakri walked out of the talks and threatened to stay away. The British had to tell Tunku snd his colleagues that without the Rulers'  signatures there would be no Merdeka. The Alliance had to concede to the rulers.
The constitution was the wishes of the rulers and the amendments made received royal accent.

Always politics

Not only is the case and issues a recycle from past cases, the Constitutional interpretation arguments seemed to be recycled too.

There is also a pattern. The current case is made loud conveniently before the Sarawak state election. In the past, it occurred few years before the general election.

Indira's case is handled by DAP politician and MP, Kulasegaran. Strangely, Kulasegaran sued the Jabatan Agama Islam Pulau Pinang instead of NRD.

So it was expected to lose because precedent set have sadly not been in favour of Hindu mothers. Hope there is an amicable solution, but it is a tough call between one or the other. Mind you, people die over faith than over race.

Politically, it is an open secret that DAP do not agree with the status of Islam as religion of the federation. They intentionally called it wrongly as official religion. For the record, Teresa Kok expressed her opposition to Islam as religion of the federation in a court proceeding.

The political motive is obvious. The way the public debate is taking its toll, Kulasegaran has successfully dragged it to be a Constitutional issue.

No easy task to flush illegal immigrants

Almost every other person seemed agreeable to the previous posting against taking in 1.5 million Bangla Deshi immigrant workers and profiteering activities to bring in this workers. This ties together with the pressing need to curb the number of illegals already inside the country.

In 2011, government had embarked on a cleansing program dubbed in Malay as 6 P as part of the process leading to flush out illegal workers.

It represented the 6 process to register (pendaftaran), cleanse (pemutihan), forgive (pengampunan), monitoring (pemantauan), enforcement (penguatkuasaan) and eviction (pengusiran). [See Information Department website here.]

More than 500,000 were successfully registered and it was found that about some 350,000 workers will end their contract in 2014 and 2015. Home Affairs Ministry realised that employers still unable to change business process to lesser labour dependence.

Remember what we wrote of employers lazy to transform their businesses?

By sending them back immediately, it could cause shock to certain sectors of the economy. Sizeable number of employers failed to carry out their responsibility to repatriate workers back to their home country.

So Cabinet decided to allow a bit more time and extent the 6P program by another year. [Read Home Ministry statement mid December 2014 here]. That would have ended in December 2015. It is time for action and a new permit registration is in place.

There is no new 3P cleansing program as viral by pro-opposition supporters in the social media. No program was planned to replace it as alleged by certain rumours.

The announcement to take in 1.5 million Bangla Deshi was in preparation for a major repatriation exercise to happen soon. They will be replacing the repatriated workers in accordance to justified requirement and not at one go.

With a softening economy, it may not come to such number.


The cleansing exercise does not mean every illegal who registers themselves are legalised. Only those that met the stringent criteria are allowed to stay and continue working. The rest will have to be deported.

If we are to only do enforcement and deportation as emotionally expressed by certain party, government will be burdened with tons of legal cases, most costly and problems will pile-up. The cleansing process help to up-date database and keep it regularly up-dated.

During the cleansing exercise, the immigration office was swarmed with people doing registration and they could not cope. To lighten the burden, it was reported in February 2015 that the services of Myeg was used for registration role of workers permit renewal.

It was a matter of convenience since Myeg is the government official payment gateway. No doubt there will be the usual teething problem as expressed by this July blog posting here. Myeg would have address it by now.

As far back as February last year, Myeg.com had expanded its services to include six additional types of cleansing cases.

Home Ministry had also instituted a new system for foreign workers work permit registration. This time it will be more comprehensive and strategic than the previous failed exercise in 2011.

It not only involve registering the illegals but ensure their welfare during the remaining period of their stay are taken care off. A sophisticated mechanism will be put in place to monitor their activities thereafter.

Opposition misinformation propaganda campaign

At the time this was happening, opposition were spreading rumours of express approval service to discredit the Deputy Prime Minister cum Home Minister.

The slander campaign by opposition was intended to cover-up their shameful slander on government and election commission on the existence of 42,000 Bangla Deshi illegal voters in the last general election. Anwar had on record made a press statement but later tried to deny saying so.

Unfortunately, some party were influenced by certain vested interest into believing Myeg was making tons of money from the exclusive handling of permit renewal of foreign workers. That is still done by Immigrations. Myeg merely serve to assist the front office work of Immigration and payment gateway.

Certain insider or business competitor maybe behind it as the accusation got venomous to accuse Myeg of monopoly. That is far from the truth as Myeg handle only the online registration, but there is also Bukti Megah Sdn Bhd. Imam Sdn Bhd, and Fokus Mulia Sdn Bhd in the consortium.

Myeg had a brush with Malaysia Competition Commission (MyCC) last year but that is for different services and should be dealt with separately.   

In November last year, there was a wild accusation that resulted in Myeg being probed for employing third parties to register foreign workers. Myeg had denied the accusation and nothing has come out of it. Any such claims, like for instance this link here, is fraudulent.

The same party have been instigating certain media operator to spread accusation that Myeg was charging by few thousands ringgit per head for new registration exercise when government have not announced the pricing.

The malicious lies against Myeg have gotten personal to the point of questioning the faith of a certain Director.

He has converted to Islam for more than 30 years and is more diligent in his practise than even born Muslims. Furthermore, a person's faith and deed is for god to judge and not by gullible mortal like us. [Repeating an earlier advise here].

"Keling" concern for Batu Caves cable car

On Saturday, the Mrs and her sister made a visit to the neighbourhood pet clinic to attend to one of their ill cats. Her sister started small talk with the Keling Hindu vet, "Will you be praying at Batu Caves on Thaipusam day?"

"I already did yesterday. Doesn't have to be on Thaipusam Day," he said. "I'm worried if anything happen. More so, if all of us go (referring to another Keling vet), who will attend the clinic and the sickly animals coming in and already at the clinic."

Such thoughtful and kind-hearted Keling.

These vets really loved animals. One can see just by the gentle and loving manner they handled the animals. Even problematic animals just melt into their hands. Vet learn and trained to handle all animals.

Since Thaipusam was mentioned, the kind-hearted Hindu vet used the opportunity to express and lobby his concern for the planned cable car for Batu Caves. He hope they do not go ahead with the tourism development but justified to assist the old, sickly and handicap.

The vet's concern was for the unique species of monkeys and bats found in the caves. Construction will destroy the fragile environment and their habitat. Bet no one thought of the animals.

As far as security, it was under control. Police did good job in handling securities.

MIC's cable car


Work for the planned cable car was stopped by the local Majlis Perbandaran Selayang (MPS) authorities in June 2014 but MIC hope to continue.

MIC Hopes For Approval On Tourism Development Projects In Batu Caves

KUALA LUMPUR, Jan 15 (Bernama) -- MIC hopes that the Selangor government will soon approve the temple development projects in Batu Caves to help boost tourism sector in the state.

Its president Datuk Seri Dr S.Subramaniam said the two major projects which had been delayed were the construction of a Hindu cultural centre and the construction a 250-metre cable car service.

He said the federal government had approved an allocation of RM2 million for the centre in 2012, but the project was not approved by the Selayang Municipal Council (MPS).

"Meanwhile, works on the cable car project were stopped by MPS on June 6, 2014 as several structural buildings around Batu Caves were said to be built without permits.

"If the state government deny us the approval, they are hindering tourism development in the state," he told reporters after attending Ponggal celebrations at the Sri Subramaniam Temple in Batu Caves here, tonight.

BATU CAVES: The government will not build any cable car facility at the Sri Subramaniam Temple in Batu Caves as the location has been found unsuitable to facilitate the project there.

MIC President, Datuk Seri Dr. S. Subramaniam said, the government is considering to facilitate alternative transportation to cater to the increasing number of people visiting the temple.

He said, the new facility will consider the disabled and sick people to the temple.

“The main objective is to build the cable car, but there are problems involving several quarters, including government agencies at national and state levels which have disapproved the development of the project.

“We will continue discussions and will get reactions on the impact of ecosystem and environment that need to be thoroughly analysed,” he said at a media conference after the 2016 Thaipusam celebration here today.

Prior to this, Selayang Municipal Council has issued a notice of termination for the development of the cable car project worth RM10 million citing unstable soil conditions with adverse impact on safety.

The project was granted to the Calcutta-based company, Damodar Ropeways.

No politics please

If there is the confrontation, the rhetorics will be PKR refuse to help the Keling Hindu. Have no compassion for the old, handicap and sickly. Deny BN to bring development to the Keling community as the collection will go into the maintenance of the Batu Caves temple complex.

Not to mention old issue of PKR government past approval for condominium development next to the temple land will be resurrected.

PKR side will reply with their own environmental justifications. Elizabeth Wong will spread her environmentalist Keling friends to protest. Some creative bloke will cook up allegations of corruption in the contract award.

People are sick with politics. Let the temple people and MPS discuss and plan it out. Politicians should just butt out. The view of stakeholders like the kind-hearted Keling vet should be taken into consideration.

Engage all the stakeholders.

Some purist will want to temple be left alone and the ardous ritual to climb up the hill to remain. By making it easy to climb up, it will defeat the spiritual purpose. Surely it should not be changed for the sake of tourists.

Religous ritual should remain as it is in its purist or archaic form. Does it always happen?

The Kavadi carrying ritual now are not as free for all as before. There are now limits on the length of the spears placed through the tongue and cheeks. Kavadi-bearers are trained and certified for their health and spiritual state.

Haj practises is no more in its purist form of pilgrims walking or going by camel to the field of Arafah, stopover at Muzdalifah and stay over at Mina. They go by buses and there is a speed train built by Malaysian contructor. 

Even the path for 3.5 kilometre to and fro saie walk in the Masjidil Haram was expanded and modified for convenience of the old, handicap and sickly. 

The large number of visitors cannot be ignored. Maybe it could be considered but it is for the Hindu community to decide.

The construction cannot take the sensitive limestone environment of Batu Caves for granted. No risk should be unnecessarily taken in the construction of the various erections for the cablecar. Human lives should not be put at stake for monument building.

Best to have it built away from the existing stairs and at different part of the hill with path created to reach the temple. 

As far as the concern of the good Keling vet, is there any way it can be done as his concern is the noise from the construction will turn away the unique species of monkeys and bats? If there is something spiritual attach to the presence of these animals, it cannot be taken for granted.

In case any Indian readers are annoyed with the reference to them as Keling, should read back this previous posting here, among others. They should be proud of it.

Be firm on latest "bank run" attempt on LUTH

Last Friday, an unnamed black blog appeared to make allegations that Lembaga Urusan Tabung Haji (LUTH) is unable to make dividend payment due to some financial constraint faced.

No specifics were given till a later posting revealed two letters from Bank Negara Malaysia's Governor, Tan Sri Dr Zeti Akhtar Aziz to Minister, Dato Jamil Khir and another to LUTH Chairman, Dato Azeez Raheem with cc to CEO Tan Sri Ismee Ismail.

Judging from the letter produced, it looks to be a usual Bank Negara cautionary letter to LUTH Minister in charge and management. The letter will not be reproduced for fear of breaking BAFIA. Proceed to Outsyed the Box if the postings still not taken off. [The explanatory reply from MyKMU is here].

In what looks like a collaboration to release the sensitive letter in the black blog and subsequently being given publicity and commentary by Dato Abdul Kadir Jasin and Syed Akbar in their blogs, the modus operandi is similar to the blietzkrieg against LUTH on the TRX land many months ago.

Maybe the same set of players are unhappy that LUTH did not follow their expected outcome to sell the land. Possibly the latest effort is to divert attention from the leadership crisis in Kedah and maintain the pressure to revive the dying 1MDB and donation issue.

Co-incidently, AG said today no criminal offense was done on receiving Saudi donation. It tallies with a comment by one adviser to MACC that saw the IP and conclude no criminal intent or offense done. Also disclosed the money was returned to the Saudi.

The current episode raises concern on information leakage happening in government, enforcement authorities and public institutions.

It was the piecemeal leakages by Xavier Justo, players like Clare Brown, WSJ, Tony Pua, etc., and even possibly authorities involved in the investigation that led to the uproar and presumption crime was committed and major hanky panky done in 1MDB.

Thus far no proof has been revealed by critics and detractors of Dato Najib. Authorities too have not found anything wrong done. Bank Negara Governor, Zeti have had a change in attitude as per her CNBC interview recently.  

There have been various leakages on LUTH investments before, which showed possibility that leakage could have happenned from LUTH side, maybe at a certain management level or possibly at the Board of Directors level.

On this latest leakage, it could still come from LUTH but it cannot be discounted that it could have come from Bank Negara.

A source once revealed that Bank Negara could have leaked some of the 1MDB and political donation related documents at WSJ but no proofs available to substantiate.

If the latest leak had come from Bank Negara, it would be sad state of affair. Bank Negara documents and letter are confidential and governed by secrecy under BAFIA but within the authority in charge of BAFIA itself, there are leakages. No accusations but mere concerns.

LUTH and Bank Negara should look at this episode seriously. Such letters leaked and manipulated could cause a "bank run" on LUTH. The panic initiated by the two bloggers and one suspiciously known anonymous blogger could lead into such consequence, as planned or by accident.

It could eventually destroy an important and respectable Islamic institution. Once destroyed, it is difficult to resurrect.

Syed Akbar, who profess to Islam Liberal beliefs, may be against the existence of Institutional Islam but consider the almost 9 million depositers saving money to make their Haj.

LUTH is one of the best saving mechanism for that purpose. Its attractive scheme even attract high networth individuals saving in the millions of ringgit in LUTH.

So such collaboration to instill fear into the naive smaller depositors should not be taken lightly but with a serious and firm hand. More so it is the second such attempt to instill fear. Two consecutive exercises within a short span of time could be devastating.

One of the blogger make no bone about giving "idea" to small depositors to take their money out. This outright economic sabotage is a negative Keling trait which spoil the good name of Keling.

Police and MCMC should be notified and investigation carried out immediately. Hauled up whoever need hauling.    

"Horror! No sharpener ..."

That was Najib's reaction when we told him we couldn't find a sharpener. In preparation for his visit to our home, we had ready papers, pencils, pencil colours and drawing board for him to sketch, but it was a less than perfect situation for him without a sharpener around.

We are talking about our nephew, Najib and not the Prime Minister. Najib is an autistic child or in politically correct term, a child with autism. The negative term is put after the children instead of before.

Children with autism maybe less than perfect, though not physical handicap, but they have keen eye for perfection. In Najib's case, his natural ability is in the arts. The image of his drawing of a city skyline with its fine details is an example.

Wikipedia described autism as "a neurodevelopmental disorder characterized by impaired social interaction, verbal and non-verbal communication, and restricted and repetitive behavior. Parents usually notice signs in the first two years of their child's life".


Permata, the government program under the patronage of Datin Seri Rosmah begin to take up the cause of these children in 2013.

Rosmah saw the need to harness the potential of these children. She realised that it need intervention to ensure every family with children with autism have "access to qualify, affordable health care and services cross the lifespan of a person with autism". 

From their effort, the Prime Minister had announced the setting up of the National Centre for Autism and turning the Permata Kurnia project into a national centre of excellence for autism in April 2014.

Yesterday, Rosmah visited the Permata Kurnia Centre in Sentul that started operation in November. She was reported by Rakyat Post saying the following:
“This centre is our pilot project. It is just the beginning because we don’t want the programme to be stuck halfway.

“What we are doing is good and is the best for autistic children. I understand what parents want, but give us some time,” she told parents at the centre here today.

More such centres need be built all over the country, said Rosmah.

The centre caters for three main areas of autism difficulties; impairment of social interaction, impairment of communication skills, and impairment of imagination.

The centre was designed to understand the sensorial issues pertaining to noise, light, sound and smell.  It protects the dignity and privacy of the patients. Most importantly, this center can improve the lives of children with autism.

It was designed by an Architect who lives in the world of autism. Well we are not going to beat about the bush. It was designed by Najib's mother.

Naturally, she understands fully well that every space, nooks and crannies must be shaped and formed to reduce problems and yet to increase potentials.

The center is specially created to cater for the above issues after taking into account the physical considerations such as security and safety, colors and textures, floorings, coverings, reducing visual distraction, light sensitivity, physical disability, sensory and stimulation, and maintenance.

The design has its own ecosystem for this particular age group and to suit this particular site  Different age group and different location will require a different ecosystem.

An equilibrium must be achieved at different scale as the behavioural pattern of those with autism changes with age.  Imbalance in the design will cause disruption and regression on these highly sensitive children and this has been proven costly.

It complies to the requirement for learning including education, playing, singing, and having fun.

Almost like the cocooned world of autism, the center hugs the activities in a form of 4 physical buildings and an outdoor play courtyard. This allows children to explore inside and outside without any worries.

The "cheese walls" were designed as a beacon and as an icon for easy recognition and visibility.  It also symbolizes as looking through the holes and glimpses into the life of children with autism.

Every children in the spectrum of autism is unique. It is for the people out there to come into their lives, understanding their needs and insecurities without any prejudice.

Najib has grown up and his communication ability has much improved. He is the centre of attention and his absence missed at family gatherings.

Now 10 and in primary school at Jalan Batu Kuala Lumpur. Looking like any normal kid and getting normal by the day. He had his pre-school at a Tamil school near his home.

Language maybe his handicap, but maths and science come as a breeze to him. Off course, his parents are sharpening him in arts and music.

Children with autism have the rights to breath, the rights to live,  the rights to education and have the rights to be given the opportunity.

They too have the rights to realise their potentials and capabilities so that they can be proud of their achievement, and take pride in their work.

Do not let these children cocooned in their world, and do not deny or abuse them. 

The country can be proud of them. In return they can contribute back to the society, and the country. Maybe we could have our very own Bill Gates, Einstein and Thomas Jefferson. Yes, they had autism.

In Malaysia, a boy wonder with autism from Penang received a letter from US President Obama for US record setter's "World youngest savant artist (ASD) to hold a solo exhibition". He is also in the Malaysia Book of Records'"Youngest artist to hold solo visual art exhibition (Autism Spectrum Disorder)."

As for artistic little Najib, his elder sister Soraya said, his immediate wish is to meet Big Najib.

Clang! Clang! Clang!

If the Geng Loceng had call for an emergency retreat to regroup following new revelation from Attorney General that the RM2.6 billion donation was given to Dato Najib by Saudi royal, it would have sounded like that.

The term Geng Loceng was introduced by Rocky Bru to describe a group of anti-Najib bloggers in his posting yesterday.

Wonder why he did not use kompang instead of loceng to describe their modus operandi to create noises of rumours and spins on cyberspace. However, it is not too difficult to guess who are the members.

Not sure if they had a meeting but retreat they did as OutSyed the Box is running for cover as he cowardly restrict his blog to only approved members. Prior to this, he would take off any postings made by the next day. Yesterday, he withdrew a posting within a few hours.

He may seemed panicky but the other members seemed to do a tactical retreat.

Dow Jones vs BBC

Immediately upon AG's statement, the Geng Loceng went about to viral a nasdaq.com news claiming Saudi government official denial and laughably claim the already denied FBI is still investigating.

That only blew open to reaffirm their collaboration with WSJ, NYT, Sarawak Report, The Edge, etc as highlighted in Rocky's and many other blogs' postings before. Nasdaq.com is administered by Dow Jones, whose ultimate shareholder is Rupert Murdoch.

Typical of WSJ, the nasdaq news also did not specifically named their source. The author of the report Bradley Hope is a reporter with WSJ and have been slandering 1MDB and Najib.

Interestingly, the report claimed their source do not have info, refuse to elaborate further on their so-called claim it never happened, and no Saudi royal could be reached for comment. Basically, they had nothing but subjective opinions and doubts, like quite a large segment of the Malaysian public.

So let us not be misled by Geng Loceng. 


The next day BBC report claimed their source confirm it was Saudi Royal's money. Reuters too made similar report.

Among the international media, the reputation and integrity of Rupert Murdoch and his coterie of media brand pales in comparison to BBC and Reuters. WSJ and nasdaq.com news are influential but turned rubbish since it fell to the hands of Rupert Murdoch.

Rocky argued that AG or these international medias will not dare mention the Saudi Royals if it is not true. Lest they are willing to face the consequence of lawsuit.

So what will the Geng Loceng do next?

Arab donation?

They could not sit still and allow logical arguments to percolate and eventually be widely accepted by the public. It must be nip in the bud.

Tun Dr Mahathir came forward to do a blog posting and say it makes no sense for Saudi to give so much. He had all the while claim that he could never get money from the Arabs.

All due respect but that is no quite true.


Arabs do donate a lot of money to Muslim countries. It is also an open secret that Saudi donate any riba received from their investment. 

Saudi have been donating money to educational institutions like UIA, Kolej Islam Klang, and even built an MRSM for MARA. Saudi had channeled humanitarian money through Malaysia for oppressed Muslim minorities in the region.

Few members of the Saudi family can chip in and gather USD700 million easily. Or was it now US1.0 billion cause the amount is no more RM2.6 billion but RM4 billion. AS RPK argued, by changing figure it proves the USD700 million was intentionally cooked up to match the USD700 million payment made by 1MDB to Good Star Ltd. 

One former and retired high official from the Home Ministry recently told us he was aware Tun M himself received political donation from Middle East for general election during his time.

Maybe it is not as much since Tun M did say he only need RM10 million to run a general election. So all these stories of corporate exercises to generate political funding could have been the wild imagination of opposition.

Naturally, opposition would not believe it is not true. Even some UMNO supporters expressed disbelieve in the social media.

Frozen account

While that serve to create doubt on the gullible and naive, Tun M tried another doubt creation tactic. He said how can Najib returned back the money when Singapore had frozen the accounts.

So he may know something we do not know. And he seem to know things we do not know in the past like claiming RM42 billion of money borrowed by 1MDB had disappeared and FBI will arrest Najib when he goes to New York for a UN session.
 
Till he share the proofs and the event actually happen, it will be difficult to take his words when he is on a political warpath and doing purely perception game.


The rumour of Singapore freezing accounts related to 1MDB happened in the midst of hype over the Cayman Island money parked in Singapore. Till today, there have been no development by Singaporean authorities. Is Singapore that inefficient or it's a WSJ propaganda for the Geng Loceng?

Negarawan mudah lupa. If money was returned, it would have been done long time ago.

Nevertheless, should Saudi denied AG's claim that the money was returned, it spells the end for Najib. Otherwise, one can only speculate, doubt and refuse to accept the fact presented. At the same time, the sceptics have nothing firm to hold on to. Only a Saudi denial will confirm their instinct.

Expectedly, there are many that remain in doubt over the latest development which limited few had known all the while, including yours truly.

It is understandable because the issue was not nip in the bud early. Najib decide to do the slow and proper way of getting qualified third party confirmation. He couldn't deny in the heat of the moment. No one will believe him then and doing the expected will put one into a trap set.

From the feedback of sceptics, the impression is the number of sceptics remain the same. It is anybody's guess. However, it is practically end game for Geng Loceng to continue and create new lies and spins, especially when one of their blogger chicken out.

Alahai ... talk of prominent blogger expecting MACC Commissioner on the way out.

That is copy and paste of Tun M's mind game. Tan Sri Abu Kassin had a slip disc surgery and he may not be that well yet. They may have anticipated he will retire thus spin it as Najib dropping him.

The latest development by MACC's Dato Bahri is strange. The power to prosecute lies with the AG. [Read Bigdog here.] It was MACC themselves that refuse to be given the responsibility to prosecute.

Is he getting even for a past incident due to boo boo by KSN and DG for JPA ...? Lets do a solat hajat like the last time around and seek Allah's guidance.The last solat hajat had been good eye opener thus far.

Slandering Azeez


The Geng Loceng did try to create something on Tabung Haji by leaking a BAFIA confidential letters to Minister in charge and Chairman cc to CEO of Tabung Haji. It may be targeted at Chairman Dato Azeez.

Rafizi, the court confirmed slanderer, echoed their attack to call for his resignation. Collaboration also?

Much information and answer have been given in the previous posting but something not quite right about the negative reserve term used by Bank Negara that was repeated by pro-opposition news portal.

If Bank Negara apply the same treatment on Tabung Haji to all the Banks, then all Banks should close shop. Banks operate with loan-to-deposit ratio of about 90% and maintain liquidity ratio of only 10 and 20%. It is has always been living on the edge.

Tabung Haji does short and long term investment. Unlike Banks, they do not lend on borrowed money. Any shortfall due to withdrawal can be addressed by liquidating short term investment. CEO Tan Sri Ismee mentioned Bank Negara did not include and considered all of Tabung Haji's investment.

God forbid should there be a massive withdrawal to Tabung Haji and Banks. If it happens, it is the Banks that will go under easier.

Whatever the prejudice and rumours against Azeez to demand him to resign, it is not easy to swindle money from Tabung Haji.

There are layers and layers of Committee that was instituted by Dato Abdul Wahid Omar when he was called in to address leakages in the investment back in the 90s. If Azeez manage to do so, then he must be a financial wizard.

The Geng Loceng may have forgotten and intentionally forget. To them, politics is everything. Bring Najib down at any cost. Lie if they have too.

Sound argument does not matter. As a result, the quality of their argument have declined. They have resorted to lowdown practices of name calling, bad languages and spewing insults.

If we are to reveal something about them and Tabung Haji, malu nanti kang ... So please leave it alone. Do not destroy an important Islamic institution though some of them hardly have any savings in Tabung Haji and subscribe to deviant Islamic beliefs and practices.

Edra desperation


In the sales of Edra, Geng Loceng resorted to lie that it was sold to China. It was to justify the simpleton spin that 1MDB bought IPPs from local to sell to foreigners. The fact is IWH Berhad of Johor has a majority control in the deal. Give them a chance la...

Subsequently, they tried to confuse the naive public as though the sales figure is not RM7 billion something but RM5 billion something using some public announcement abroad. Announced figure and final figure may differ slightly till execution is completed.

However, 1MDB is not stupid and SPM dropout to do such a lie. They would not be able to pull off a RM2 billion lie. It is already the most investigated and scrutinised organisation.

The shallow argument of jual negara is a simple and great propaganda to instill anger among the common folks. The problem with it is they are not consistent.

TPPA


On one hand, they spin to oppose the sales of Edra to China, but on the other hand, they are against TPPA because of American involvement. Then they say lets join BRIC which has the presence of China instead of TPPA.

Please make up their mind. What are they talking about? TPPA is about international trade, but BRIC is about financial infrastructure. Two different subjects!

There also this interesting argument against TPPA that Malaysia cannot withdraw. If they do, they will get sued. It shows they have not been doing their homework and going through the 6,000 pages document. A summary is available here.    


The final TPPA is not the same as the terms in negotiations that we had opposed. Geng Loceng makes a  big fuzz over TPPA and got their poodle NGO to participate in an opposition rally but why the silent when Tun M allowed Malaysia to go into negotiation by WTO for the GATT Agreement since 1995.

The terms are far worse than TPPA!

There was someone who promoted EAEG or was it EAEC. It was his idea that bloomed into TPP.  Is it a case of hurt ego?



Irrespective of the political outcome to Najib and UMNO, as far as the argument to justify their dissent towards Najib is concern, it is already endgame as Bigdog puts it.

Many may not know of happenings behind the scene, but The Edge realised they erred and that made them U turn to give a glowing interview to Arul Kanda.

And, Tan Sri Zeti Akhtar showed glimpses of realisation that she erred in the CNBC interview.

Did anyone realised that parking attendants shows a greater sense of pride and dedication to their work when provided with uniform that comes with a tie and equipped with whistles than those plainly dressed?

Not only did we realise that, we also realised that providing such attire is most effective at getting the best out of the sons of Kelinga parking attendants.

One can see these Keling parking attendants standing proudly as they take charge to direct moving vehicles and present themselves most authoritatively to ensure everything is running smoothly.

Do take it positively and not be offended. Maybe what the Loceng Geng needs is a whistle to be truly effective in their whistleblowing. Bukanlah dok kelentong dan putarbelit merata macam keling gelecek bola.

Blowing the wrong whistle

It was a sham act to claim their blog was blocked. The image of MCMC notice is not convincing.

If MCMC, had done it, they would have blocked off the two black blogs slandering Tabung Haji.

Then he could have got someone to put the MCMC notice whenever traffic goes to his url.

It is quite pathetic that Outsyed The Box and Din Turtle have to resort to such cheap trick to get traffic to their blog. They copycat the typical act of DAP, PKR and PAN.

Bodoh! Where got such a thing called "negative reserve"???

Suara Rakyat is not opposition but Kedah based BN blogger. They are present in one Telegram group we are in.

It wasn't a smart move to touch Tabung Haji again and by the same people. Our late sifu use to say do not do the same trick twice.

As RPK pointed out in his blog here, the Anti Najib Campiagn (ANC) "has to be very careful with this one (Tabung Haji). And that is because if they start screaming, ranting, raving, moaning, groaning and foaming at the mouth the real story about Tabung Haji might just surface."

They didn't blow the right whistle and RPK revealed an old crap happening at Tabung Haji. He didn't quote media sources they will refute as unreliable but Loceng Geng's friendly Rupert Murdoch media, WSJ:

KUALA LUMPUR — Salmah Mahjid runs a small food stall on the fringes of the financial district here. Each month, she puts 20% of her income into an account at Lembaga Urusan Tabung Haji, a unique government-owned investment fund created to finance Malaysian Muslims’ pilgrimages to Mecca.

The 43-year-old mother of five has just one goal: to create a nest egg for her family to make their pilgrimage, a sacred duty for all Muslims. “I know the money will be there when we need it,” Ms. Salmah says.

But for Mokhtar Hamid, a retired government employee who has put all of his savings into Tabung Haji, the fund was also a steady and lucrative investment. Setting aside money for his pilgrimage is one reason, he says. “The other was the good returns Tabung Haji used to give me.”

For most of the 1980s and early 1990s, Tabung Haji paid annual dividends averaging more than 8.5%, much higher than the interest offered on savings by Malaysian commercial banks in those years.

But the robust dividends are gone and some unhappy depositors like Mr. Mokhtar are blaming Tabung Haji’s management for making ill-advised investments that have eroded the fund’s bottom line. Since Asia’s financial crisis struck Malaysia in 1997, the fund has slashed its annual dividend to barely more than 3%. “This institution is based on religion and the money has been deposited for holy reasons,” Mr. Mokhtar says. “But the management has been a huge letdown.”

Indeed, Tabung Haji’s affairs, long shrouded from public view, are coming under scrutiny.

A report by Malaysia’s Auditor General, which was released in July, says that some of the fund’s big investments were tainted by serious management mistakes, leaving the fund burdened with poor-quality assets. The unusually harsh report has prompted a police complaint against Tabung Haji by an ethnic Malay student group. Government officials also say that the country’s Anti-Corruption Agency is investigating several of Tabung Haji’s investments.

Tabung Haji officials declined to comment on the developments. But several senior executives, who spoke on condition of anonymity, say the Auditor General’s report reflects missteps made in the past. They insist the situation has improved.

After Dato AWO and the Kompleks Kewangan tidied up the operation in the 90s, it was Abu "Juling"'s turn to wrecked it. Who was the Chairman that allowed it to happenned ... hehehe?  

Giving them a whistle

The Loceng Geng have been meeting regularly. Heard they would meet twice if not thrice a week. Operation is now focused on the ground which they think UMNO is most vulnerable.

Since they believe there is a groundswell and the Bantah TPPA demonstration shows their ground operation is not strong. Perkasa could only gather 200 people. One can see it is the same faces.

These people do not look after the welfare of their supporters. Eventually they will tire off.

We anticipate they will use a strategy much favoured by Tan Sri Sanusi Junid to tie the link between the top and the ground. It's old school and non electronic but if able to execute, it will be effective. One person get 5, and each 5 get 5 each and so on. very much like MLM.

Eventually Sanusi can sell his books through this MLM network. Just kidding Akram ... if you are reading, lets go for tea one of these days.

That is one whistle we are giving away.

Now about this ranting by Dato Bahri of MACC. He plus one Dato Rozaid was suddenly seconded to PM Department by KSN and KP of JPA. It was a boo boo and when PM got to know of it, he directed to send them back.

It is highly likely Dato Bahri is angry with Najib. The investigation by MACC is divided up to few people. Dato Bahri was assigned to SRC.

This SRC is difficult to understand and defend. It is no more a subsidiary of 1MDB and now a subsidiary of MOF. No enough sufficient information on SRC except Clare Huxtable's version. Opps sorry, not Bill Cosby's wife in his famous TV sitcom, but Clare Rewcastle Brown.

SRC had several of its management ran off hiding so it only builds up the wrong perception.

According to WSJ, some RM42 million was transfered to Najib's account via two companies and in several transactions.

The pentaksub will standby Sarawak Report and WSJ. Tan Sri Muhyiddin will standby The Edge. But for us, the waiting to be convinced, those are tainted sources.

There is not enough information on SRC. Some information is surfacing from the lawsuit by Najib on Tun Ling Liong Sik. So far he denied the widely believed  information from the mind game.

That is a whistle for Geng Loceng to take authority.

Bahri maybe damn sure he got Najib. So he is unhappy when AG said no case and closed. The man worked damn hard to pin Najib. But he made one mistake. His wife couldn't keep her fooking mouth shut.


Commissioner Tan Sri Abu Kassim had to step in.


So far, some commentators said they do not trust the AG, Tan Sri Apandi Ali. If it is Tan Sri Gani Patail that said no case, they would believe. Aiyooo ... Malaysian not only mudah lupa but they can sometime be a real stupid dumb dumb.

Gani is one of the worst AG Malaysia has ever had. Have heard Tun M himself said so. But we will not elaborate on it.

People will naturally put into question AG's power to decide, which case he wants to charge and which he not want to charge. But that is how the system works, not only in Malaysia but in Britain and many other places. The investigator cannot be the prosecutor.

So we have no answer why AG does not want to charge. More so, one former Appeal Court judge, Dato Mohd Nor Abdullah was reported by FMT to have said no AG will ever prosecute the PM that appointed him or he will face what Gani faced. No sure if it is a spin or for real.

If there is any case on Najib, it must be really serious stuff. Do not accuse him for billion dollar corruption but finally charge him on technical and prosedural issues. Worse still, charge him for trafiic violation.

He is not a common person but the Prime Minister. The bigger consideration not to be taken into consideration. If there is not bad intent, it is not fair for the country to charge the PM. 

Certainly some details from AG as he did on his rejection of IP by BNM will certainly be helpful. He does not need to as he had his team to study the paper. Maybe he will do so upon his return from abroad.

The practical issue is this. Public wants the public prosecutor to prosecute but the public prosecutor see it as no case and they are the one that will argue the case in court.  

MACC had already said they have no case on 1MDB, on RM2.6 billion but made two recommendations on SRC case. It is reported that after AG returned the paper back to MACC, the IP was send back with three recommendation.

So Bahri could be really obsessed to add another one more. 

This issue had many turned obsessed that they forgot something. The RM2.6 billion allegation was initially about it being 1MDB money. Since it is not, they changed the goalpost to the issue of political donation which is a non-issue.

Any opposition leader making it an issue please support our long cause and that of MACC to legislate and clearly define the rule on political funding.     

That will be all. Yes, we gave the Loceng Geng a whistle to blow.

But we are not dumb to give away a weapon and bullet to our political competitor. It is a mistake to see us as just a hard working, industrious and subservient Jawa. There is some Bugis blood from our father's side for the strategic thinking and fighter quality in us.

With a Malaysian, American and British Education, we may have the all rounded deception of our Malaysian SB, American CIA and British M16. Ha ha ha ...

There is also one whistle and believe Tony Pua is blowing it but ineffectively done. The PMO and UMNO machinery may be ill-prepared but as far as the arguments to defend it,  Insya Allah, we are prepared.

If MB Kedah is to be changed, hopefully it be ...

Have not commented on the Mukhriz coup and will not.

Only thing we are will say is Dato Mukhriz knew it was coming. If we could see from afar several of his wrong initial moves and remedial actions that need done but was not done, how come his staff, or inner circle or adviser or elders could not see and advise him?

Many are blaming Dato Ahmad Bashah for organising the coup. Well .. before this there were several attempts already. If is not Bashah, it would have been anyone. The ground have been percolating for quite awhile.   

All arguments and psyop by pro-mukhriz and protun people on the coup have been academic. The reality is he does not have the majority support of UMNO Kedah, BN ADUNs and his appointed exco members. As far as our sources claim, he does not have the support of KCS and Istana too.

It is untenable for him to lead the state.

It could be a sad ending for him as he could have been the next layer of core leaders of this country. If he is insistent of not taking up any federal position, his politics could end here.

While we disagree with Tun M now, it does not mean the same applied for Mukhriz. He remains a friend but whether it is tomorrow or using the state assembly process, he should follow the convention of following party directive.


The talk is there were some names presented but was rejected by the Royal Council. However, such happening was denied. The paper have put up the above name. One rumour going around is the investiture will be Monday tomorrow.

By the look of it, it is not possible but our reliable informer said, the saga is supposed to be short and any resistance will be over in a week or two. We will see ....

What is heard is it is decided that Dato Mohd Rawi of Langkawi will be next MB?

Rawi is a good man and was one of the few trusted people of Mukhriz. As we understand from Kedah politicians, businessmen, civil servants and even the Langkawi folks, he may not be the better choice. There are reasons why he is not appropriate but we are not going to say.

The upstairs need to find out themselves and decide. They are suppose to do the vetting. Furthermore, the process to come to a choice is not so simple. We will butt out.

Given to us and many rational and concerned UMNO Kedah leaders spoken to, the following is our preference:


Kaghut dia ada but no one is perfect.

He is the best choice on paper and experience. Should appease all the various interest groups except the power crazy, mad and manipulative Dato Ahmad Lebai Sudin.

If he is not the answer to Kedah's leadership woes and still cannot stay there long enough, then we'll put it on record that Kedahan does not deserve a good and clever leader. What happened to Mukhriz happened in almost the same manner to Tan Sri Sanusi Junid.

They deserve the predicament they are in because they are not thinking right.

True that leadership is not based on who is the most knowledgeable and the best reciter of the Quran  but on acceptance of the jemaah. However, this is a different thing all together.

It is about politics to put a leader that will institute good governace and bring a better life for the people. Unfortunately, the process towards that as practise by the political jemaah is not so dynamic kampong politics!

Mukhriz is too urban and too much an outsider to them. Pity ....

Days of cheap labour and easy job are over

Malaysia does not need to take in 1.5 million Bangla Deshi. Somebody will be profiteering from it. It was an issue we raised before. However, it is no easy task to flush out the existing illegal immigrants. Any drastic action will affect local industries.

So government gave time to employers and workers to legalise and act accordingly. Government then put in place system to keep track of immigrant workers. The existence of a system to monitor existing workers will lightened the task of addressing the other problems associated with illegal immigrants.

Today's news report is a message that government is moving forward as planned and ignoring irritant noises of business interest or attempt to sabotage, even political interest or rivalry from railroading the scheduled execution.

Government is telling businessmen to  buck-up and adjust to the new environment of higher labour cost. And, students must prepare themselves for challenges in the job market.

Foreign labour levy doubled

SIBU: The levy for foreign workers has been increased, in some cases to double what employers are paying.

Effective today, those in the manu­facturing and construction sectors will have to pay RM2,500, up from RM1,250.

Those in the services sector will be levied the same amount, compared to the RM1,850 previously.

Foreign workers in the plantation and agriculture sectors will have to pay a levy of RM1,500.

The levy for foreign domestic wor­kers remains at RM410.

Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi, who announced this yesterday, said the revised levy would bring an additional revenue of RM2.5bil to the Government’s coffers.

The new rates are in line with the recalibrated Budget announced by the Prime Minister last week, when he said that foreign workers would be categorised under two main tiers from the previous six.

Dr Ahmad Zahid said the restructuring of the levy was done as the 2.135 million registered foreign workers enjoyed many benefits meant for Malaysians, such as food subsidy and other services.

“The restructuring of the levy is also for us to have better control and management of foreign wor­kers in the country,” he told a press conference during his visit to University College of Technology Sarawak yesterday.

Dr Ahmad Zahid said the new rates were in line with the national economic scenario and also that at international level.

“We do acknowledge the vital role they (foreign workers) play in nation-building and our economy,” he said.

Naturally, local businesses are complaining. By hiring locals, they have to pay more, provide other perks and deal with the local workers lackadaisical attitude.

Federation of Malaysian Manufacturers (FMM) president Datuk Seri Saw Choo Boon already complained the increase in levy as “quite sudden”. Masterbuilders Association Ma­­lay­sia (MBAM) president Matthew Tee said it was the wrong timing. [read The Star here]

Foreign labour is an unfair competition practise. Local available labour and expertise are put aside for the cheaper cost at the economic and social expense of the country. Cheap labour is a short cut way to avoid investing on equipment and process. Its a lazy and rent seeking approach to business.

Degree no longer a ticket to jobs, says Chong

PUTRAJAYA: A university degree is not a ticket to get jobs and it may even be a stumbling block at times.

Deputy Education Minister Senator Chong Sin Woon (pic) said some graduates had to use their SPM qualifications to apply for jobs after their degrees literally led them nowhere.

“This is very sad but a reality,” he said.

He added that they do not even dare to reveal that they were degree holders for fear of being deemed “over qualified”, which could reduce their chances of being taken in by prospective employers.

In a interview with The Star yesterday, Chong said there were various factors for graduates failing to get jobs.

Apart from an increasingly competitive job market and a slowing economy, he said other reasons included a mismatch between the supply of the types of graduates and the availability of jobs relevant to their qualifications.

“The trend is to go for prestige-sounding courses like engineering, law and accountancy besides medicine and pharmacy for instance.

“Most parents and their children are either ignorant of the problems of mismatch later or they just follow the trend.

“Some of the graduates also find out later that they just do not make the cut for their chosen field,” he said, with many opting to do all sorts of sales jobs to survive.

While many, if not all parents, want their children to have a university degree, Chong advised them to be pragmatic in their choices.

He pointed out that some people were more suited to be a skilled worker and thus vocational or technical training was suitable for them.

“But sad to say, not many people in Malaysia turn to vocational or technical training.

“They do not see such courses as a choice but a last resort,” he said, advising Malaysians to review their perception on this.

In fact, Chong said vocational and technical training was already very popular in advanced countries, comprising 70% of students in Germany and 60% of students in Taiwan.

“Those with training in a field they have interest in can go far in their career. Opting for a course just because it was trendy could spell the beginning of many disappointments,” he said.
These are the usual growing pain of a country moving up to developed status. We want to develop and development have been the popularly repeated theme for general election for more than half a century. It is too late to say no to development.

Businessmen and students have no choice but to prepare themselves for the challenges of the different environment. It's time to move on and forget the past ways of doing thing.

Geng Loceng deserve hell for sabotaging Tabung Haji again

First time, it was Geng Loceng revealing document and manipulating public perception as though buying the TRX land was a wrong deal, overpriced and accuse it as bailout.

The source of the leak is suspiciously known. One member of the Board of Director leak to a family member, then to a friend, and finally to The Benchmark. However, Tabung Haji people are not out there for revenge. They are good and god fearing people.

Thanks to Allah, they heed the advise of many and did not sell the land. Geng Loceng would have gone to town and ring their bell of victory while accusing TH sold the land at a loss and blah blah blah ... clang clang clang pilgrim fund.  

Subsequently, they came back to get even by leaking Bank Negara letters without realising the content is more cautionary and had it's shortfall.


Maybe it was to get even with Dato Azeez that have been conveniently accused for forcing certain exco members and ADUNS to sign Statutory Declaration to call for change of Kedah MB.

It is also a part of well coordinated blitzkrieg from all angle together with Swiss authorities and international media to bring down the Malaysian government through unconstitutional mean, same accusation made by pro-Mukhriz cybertroopers.

The latest announcement by Ketua Audit Negara confirms caution by Bank Negara is wrong and naturally Geng Loceng is wrong. Below the statement:

Some six days ago, PAS Secretary General, Dato Takiyuddin Hasan was reported by FMT here expressing confidence with the management of Tabung Haji.

Kunjungan ke Tabung Haji oleh PAS Pusat hari ini berlangsung dengan baik. Menerajui budaya politik matang dan sejahtera, PAS hadir untuk mendapatkan maklumat langsung dari pihak Tabung Haji sebelum memutuskan sikap disamping turut mengemukakan pandangan serta penambahbaikan kepada pihak Tabung Haji selepas pelbagai isu kontroversi melibatkan Tabung Haji tercetus.
 

PAS turut bertanggungjawab menjelaskan kepada rakyat sesuatu isu yang berkait rapat dengan kepentingan dan kebajikan umat Islam berdasarkan maklumat yg benar dan tepat.

Presumed "Guilty" II

In early January this year, this blog published a posting, Presumed "Guilty". The latest happening see the need for a sequel. It is a long one. So read it on your free time patiently. They will be no updates for few days. 

In late November, this blog posted a posting and predicted or better still, expose the proTun plan to hit Dato Najib continuously till UMNO General Assembly that begin on December 8th. It was to pressure for a party election.

There were many events planned for the UMNO GA but it had to be shelved. UMNO had good intel and anticipate their moves. They tightened security and only the Kelab Sultan Sulaiman event, in which Tan Sri Muhyuddin gave his "opening address to UMNO wings", could be done.

The shelling was resumed after GA but it lacked any bullet. Tun M was seen to be losing the plot. As the ground went about creating troubles here and there, Tun M side went back to the drawing board. He had meetings with his so-called Advisors every other day.

Quite a few familiar names is in his advising team. Sorry can't tell.

OK OK ... sorry for being a cocktease. Two names can tell - Khairuddin and Anina. Definitely, Tan Sri Sanusi Junid is in there.

His baby was to revive the Altantunya murder saga. But he failed! Sirul made a video declaration that Najib was not involved. Who would bother with the perception play of who ordered the murder any more.

Nevertheless, all the planning, decision and even the "dealing" are done himself by Tun M. From the days of Tunku Abdul Rahman till today, no one can match him in any political fight. Dato Najib has thus far resisted him well but it comes at the cost of UMNO.  

Tun M does not care UMNO loses the next GE. He is quite reckless these days compared to the days he was toppling Pak Lah. The latest reactions of Dato Mukhriz's cybertroopers is indicative of that attitude. They are openly supporting PAS.

The inevitable fight to the death is only expected. For a fact, the troubles created and the god-sent Kedah coup helped to keep the issue simmering and increase supporters hatred to the leadership. It was Tun M statement that sparked the Kedah coup.

All along, Tun M had something planned well ahead. The current blitzkrieg is not by chance. As Roosevelt used to say, nothing in politics happened by chance.

Matthias Chang and Dato Seri Khairuddin Hassan went on a worldwide whirlwind tour from June 8 till August 26th to make official reports to police, Attorney General office and any enforcement outfits at major financial centres they smell 1MDB money may had passed through.

That eventually got them in trouble. They were apprehended under SOSMA and charged in court for economic sabotage. It is still on going in the court with the sue and counter sue drama. Matthias and Khairuddin are capable dramatic actor and husband to a capable dramatic actress, respectively.

So you see, the Geng Loceng is not just Keling. It could be separuh Keling, Pakistan pura-pura Melayu, Melayu and Cina. 1Malaysia ma... It is not racial.

The common factor is loceng .... clang clang clang ... Tony Pua, Rafizi Ramli, Clare Rewcastle, Dato Tong Kooi Ong and Tan Sri Francis Yeoh could be in together.

Blietzkrieg


It is strange that in one go after AG rejected MACC investigation paper the second time and asked for the case to be closed, there was this blitzkrieg attack from several fronts.

Swiss Attorney General Office issued a statement. Kiasu Singapore do not wish to be left behind followed up.

International medias including Barron Asia was giving negative statement on Dato Najib and Malaysia including worst Finance Minister for 2015. Commendable of the envoy to reply to Financial Times.

Asiamoney has a serious credibility in their yardstick of measurement as Minister dispute their claim.  

An expose by a blog revealed a committee of corporate personalities hired an International PR Agency to get the international media carry negative stories of Najib and Malaysia.

This blog already mentioned before of this sabotage. Only different is our source only confirm the agency was hired by YTL. No committee mentioned.

There were some controversies hyped against MACC Commissioner and naturally, AG. 

Noticably, Mukhriz, that was checkmate at all fronts, tried to prolong the issue to build public resentment. He and his cybertrooper went to the point of saying something very unlike Mukhriz to ridicule Dato Ahmad Bashah for his SRP qualification and falling asleep during Agong Parliamentary address.

When attack came from all fronts, the shock and awe tactic could easily mislead those void of information and ability to analyse to lose their bearing and get suckered into the perception game trap of Presumed Guilty II.

The most rational of person will not comment and pass remark in the midst of the commotion but stay chill till everything settled and more clearer.

They should remember that 1MDB have been thoroughly investigated, enquired, and audited. None of their accounts frozen. No foreign investigator have approached them. It means they have been doing their operation legitimately. [Read BBC here]

What more when in the court of law, getting charged does not mean already sentenced as guilty. The biggest hurdle is still evidence. And when it involves international investigation and law, it gets bloody damn complicated. Remember the late Tan Sri Eric Chia?

Swiss AOG

By now, everyone would have known of the AOG statement but did they thoroughly read it?

It is republished below:


This brought about swift and serious reaction from Deputy Prime Minister, Dato Dr Ahmad Zahid Hamidi and Dato Salled Said Keruak. Zahid told Swiss AOG to use proper channel instead of going to the media. Salleh questioned AOG for breaking protocol.

The Swiss AOG was rather disappointed that our AG had directed the case to be closes. Why disappointed? Read on later.

Zahid and Salleh statement put a heat on them for their politically motivated statement. Geng Loceng manipulated public sentiment to presume it was Najib that was investigated.

Malaysian public tend to read only headline and make up uneducated assumptions. They could have failed to realise that Swiss AOG only mentioned of two former 1MDB officials and accounts held in private account in Switzerland by the former officials and current public officials of UAE.

The alleged amount in question of USD4 billion or equivalent to RM16-17 billion presumed to be siphoned out of 1MDB is too good to be true. That is almost one third of 1MDB's RM42 billion liability which Tun M claimed to have disappeared!

Swiss AOG may have realised that they had fell to the trap of Matthias Chang's convincing script. So they clarified that Najib is not under investigation. And neither is there any investigation by FBI as recycled.

AG may have erred to call on MACC to close case. That is under the jurisdiction of the investigating authorities like MACC, Police and Bank Negara.

To err is human and AG indirectly acknowledged in his statement to cooperate with the Swiss AOG. [Read in NST here]

An interesting part in the Swiss AOG statement is about a September 15 meeting in Zurich with their Malaysian counterpart.

Since AG had just touch base with Swiss AOG, it could only mean other authorities have been working closely with them.

Exemplary leadership

There is a perception built that MACC is playing psychological game on AG with their repeated announcements. And this blog has defended that whatever they are doing is fair and according to stated rules.

Same with the position taken by MACC Commissioner, Tan Sri Abu Kassim to respect to the constitutional position of AG to determine whether a case should be charged or not.

In that respect, the statement by Dato Bahri that MACC need to refer to MACC's review committee before closing any case is proper. It is fair for Abu Kassim to defend him for that.

However, Bahri has no business to question AG's jurisdiction.

There are those that felt Bahri would not have made the same mistake of shooting his mouth again without Abu Kassim's consent.


Although Abu Kassim had categorically said on many occasions that he does not question AG's authority, he still has to contend with the leak.

Bahri's wife squelled on her FB and he is suspected of leaking information, likely to be incomplete information to his wife.

Abu Kassim has stated publicly that he will do a police report:

It's a boo boo but frankly it is no big deal.

Abu Kassim exhibited exemplary leadership to shield his man in the line of fire. Still he should contain Bahri because this is the second time he is suspected of leaking information.


According to civil service conduct, he could be removed and it is quite justified. 

It shows Tun M and Apanama are proven wrong again. He was not dismissed for covering up Najib but for a later reason. It will be considered as an honourable discharge.

RPK seemed to be attacking MACC using his favourite cause against MACC to defend Dato Ramli Yusof, Dato Rosli Dahalan, Teoh Beng Hock and Ahmad Sarbaini.

Who leaked?

Nevertheless, the issue of leak is still relevant and important.

MACC had before being raided by police for allegedly leaking investigation paper. Bahri ended up being transfered before Najib step in to reverse the transfer.

Abu Kassim should make the police report as promised.


Many parties are now on a blame game mode. There is that blame of leak on MACC.

And there are those blaming AG. For instance, people suspected to be linked to Tan Sri Muhyiddin are doing that blame:

Tony Pua has the full IP because a copy was provided to a group of people including Tan Sri Musa Hasan, Dato Mohd Nor Abdullah, Dato Zuraidah Attan and former Bar Council President Lim Chee Wee.

That photocopy could have come from Chee Wee. Tony Pua blew Chee Wee's cover. AG's show off did not reveal as much as Chee Wee's.

This is the price of transparency. Damn on MACC if they are transparent. And damn on MACC if they are not transparent.

The problem is opposition do not respect confidentiality. These street ruffians do not respect governmental procedures and protocols.

Charles Santiago and Nurul Izzah signed Non Disclosure Agreement in order to be part of the TPPA caucus that gets regular update but not supposed to leak the ongoing negotiation.

But they do not care. They still spoke of it in public as though some snitch leaked it to them.

Legally speaking

Whether the information revealed much of the IP, one should read the AG's full statement on the RM2.6 billion donation and SRC here. It explains the legal basis he cannot form a case.

Some can make all sort of accusation against AG but it is his call. He need to be convinced that there is a case before he can argue convincingly in court. He does not want to do a Gani Patail ploy to charge with the intention to throw away and lose many important cases.

Yet, Datin Seri Wan Azizah can claim:

On the SRC, the money trail shown mean nothing by itself:


The major stumbling block will be evidence. The common law practise is 800 years old and very intricate and precise. Are there sufficient information, documents and documents to back every stage of the money flow to meet the evidence act standard of the law?

For instance, documents to show the Visa and Mastercard transaction will not be sufficient only by having monthly statements. The maker of the monthly statement must testify. It is similar to photograph evidence that need the photographer testify in court and his camera presented in court.

Many will need to be dragged to court.

AG said no criminal offense have been committed under the MACC Act and Penal Code. Lets leave it at that for a while now that the Swiss and Singaporean are in the picture.

On the Swiss AOG, there was a major error on their part in which Zahid did not expand. They claimed of initiating criminal proceeding but the remain of the letters tells it is still indicative and under investigation. Note the excerpt from Wikipedia:

While every crime violates the law, not every violation of the law counts as a crime. Breaches of private law (torts and breaches of contract) are not automatically punished by the state, but can be enforced through civil procedure.
The legal reason why Malaysia lashed at Switzerland and Singapore for releasing initial probe. It has not been determined yet as criminal. The suspicion is authorities feeding Swiss AOG may not sufficiently understand off-shore banking and finance enough to make any claims!

The Swiss are still:


As much as our AG erred, the Swiss AG erred also. Mat Salleh do not necessarily are any better than Malaysian. Since the Swiss have spoken, the Singaporean spoke too.

It is still a long way to go.

Switzerland and Singapore want Malaysia's cooperation but have they cooperated in the past with any of our investigations?

All money centres are haven for hot and illicit money. When something is exposed like what was successfully done by Matthias and Khairuddin, only then do they pretend to cooperate. Otherwise, they keep quiet and pretend nothing happened.


Most bank branches abroad will not want to involve themselves in any legal proceedings beyond their borders. Not even on a short haul flight from Singapore to KL. It is bad publicity.

So how will AG get these long winded money trail get proven in court?

For the Swiss to cooperate with any request from another country, say Singapore, an international law practitioner said it must be an offense that is wrongful under Swiss law. Visi versa, Malaysia could only cooperate with the Swiss on offenses which is wrongful under Malaysian law.

Malaysia want to extradite Alvin Tan but his offense under Malaysian law is no offense under US law. Same case which the bumbling idiot proTun did not understand why Najib could not sue WSJ abroad. 

The very reason AG's close case directive would have frustrate Swiss AOG investigators. If the case is close, no other countries can do anything.
 

Jho Loh and Shahrol?

At stake to the investigators, they need to prove Javace Ltd and Good Star Ltd belongs to Jho Loh. Thus far, this have been proven conclusively as not belong to him.

Singapore authority's statement indicate they are going after Jho Loh and may have frozen several accounts related to him. He used to be an "advisor" to 1MDB or TIA.

If the other former public official is 1MDB former CEO, Dato Shahrol, then this blog had been on the money all the while.

But we cannot presumed them as guilty yet.

The Geng Loceng should not assume that it will lead to Datin Seri Rosmah and her son Riza Aziz. Get a logical story backed by proofs before judging anyone as guilty!

The have failed many times.

Our suspicion is Najib was misled by Jho Loh and Shahrol. They have betrayed his trust. That was why Najib took the stand that no one will be spared from investigation.

Looks like a follower of Geng Loceng, that is a woman masquerading as a man, is void of a decent argument to counter this posting and could only resort to name calling and back her argument with her perceived public perception.
