The bulls and bulls of Abu Kassim, Gani Patail and Bar Council

Tun Dr Mahathir gave a signal to start the call for a referendum to seek Dato Najib's resignation. In reply through his blog, Dato Salleh Said Keruak criticised Tun M for playing ignorant. It is as though he does not know Government is not form from popular votes.

DAP knows that there is only three ways to do so; via UMNO, or via vote of no confidence or via general election. Tun M lost out on the first two so is left with the third. But, it will smear his history legacy so the call for referendum.  

It is another attempt to hoodwink the public. It was in the same manner that Tun M gave an earlier signal to attack the Attorney General in anticipation submitted Investigation Paper by MACC will be thrown out.

This was the theme in the wayang bulls and bulls by Tan Sri Abu Kassim, Tan Sri Gani Patail and Bar Council, said various inside sources. 

Hoodwink the public 

Tun M knows Abu Kassim has no case, so the shadow play [read here, here and here].

The same script has turned to a motion to be raised at the Bar Council AGM to call on the Attorney General, Tan Sri Apandi Ali to quit. It is a futile move and mere wayang. Dato Hafarizam clarified that AG's power is constitutionally unchallenged under Article 145.

BC is also demanding that the Solicitor General play the role of Public Prosecutor. By giving the role to Datuk Azailiza, it is like allowing Gani to return as AG through an adjoing room between AG and SG offices. Rumour is the door was removed by Apandi when he assumed office.

BC had earlier filed for judicial review to challenge the exoneration of Najib in court.

The wayang being done to hoodwinked the public does not change certain facts. The decision by AG to reject MACC's IP is within the normal conduct of the law. As former DPP Tun Mahareza reasoned in his latest Facebook posting:
A. Transaksi RM2.6 billion dan RM 42 juta SRC telah diluluskan Bank Negara. Bank Negara telah memenuhi kehendak undang-undang BAFIA dan Akta AMLA (Anti-Money Laundering Act) dalam membuat kelulusan transaksi tersebut.

B. Kelulusan transaksi tersebut juga telah melepaskan undang-undang rasuah di bawah Akta SPRM.

C. Undang-undang Perlembagaan Parti BN yang diluluskan oleh Pendaftar Pertubuhan di bawah kuasa Akta Pertubuhan yang membenarkan Ketua Parti menerima sumbangan dan dana disimpan dalam akaun proksi parti juga telah melepaskan bebanan undang-undang rasuah Akta SPRM.

D. Pengesahan SPRM sendiri berkaitan kebebaran dana itu didermakan Raja Saudi juga telah melepaskan bebanan undang-undang rasuah Akta SPRM.

E. Jelas sekali, keputusan AG menggunakan kuasa yang diperuntukan kepadanya dibuat bersandarkan faktor undang-undang dalam kes tersebut. AG telah terbukti menyempurnakan kehendak sesuatu keadilan dalam sesuatu prosiding undang-undang.

After weeks of snooping and meeting people, sources able to explain the happenings inside MACC was found.

Sources said it is no more considered OSA because the leak on the initial investigation on RM2.6 billion and SRC was done at the verbal instruction by Abu Kassim.

BNM too leaked documents to Abu Kassim and Gani but it would be  considered as information sharing despite the establishment of the Special Taskforce was not legal.

One source claimed it was Abu Kassim that manouvred to intentionally allow their IP to leak to BC.

And, it was at Abu Kassim's instruction and permission to have the many officers of MACC to speak in public but these officers get the blame. So bloggers and facebookers should stop going after Shukri or Bahari or Rohaizad. Go after the man responsible and that is the father of the "family".

The mamak Abu Kassim was said to be a key man in the so-called Five Tan Sri conspiracy to topple PM. The plan was to get Najib charged for CRIMINAL MISAPPROPRIATION under Act 574 Penal Code. The relevant sections 403 and 404 are quoted below:
Dishonest misappropriation of property

403. Whoever dishonestly misappropriates, or converts to his own use, or causes any other person to dispose of, any property, shall be punished with imprisonment for a term which shall not be less than six months and not more than five years and with whipping and shall also be liable to fine.

Dishonest misappropriation of property possessed by a deceased person at time of his death

404. Whoever dishonestly misappropriates, or converts to his own use or causes any other person to dispose of property, knowing that such property was in the possession of a deceased person at the time of that person’s decease, and has not since been in the possession of any person legally entitled to such possession, shall be punished with imprisonment for a term which shall not be less than six months and not more than five years and with whipping, and shall also be liable to fine; and the offender at the time of such person’s decease was employed by him as a clerk or servant, the imprisonment shall not be less than one year and not more than ten years and with whipping, and shall also be liable to fine.
In both the sections, the key word is "dishonestly".

Weak case

The burden of proof will be on AG to prove in court that Najib had dishonestly misappropriate money.

If the money in Najib's account is not used for his own use but as a special purpose trust account and it can be accounted for, there is no case. If Najib has other money in the account and the account is operated by a trustee, thus making him not aware of any misappropriated money, there is no case also.

It seemed AG office had seek clarification from MACC. Neither was it a rejection nor request for more evidence. Despite report that MACC insisted on AG to charge Najib and it was leaked to TMI as penal code offenses, they could not give the answer in the much publicised subsequent re-submission to AG.

Thus, the only way to charge Najib is for MACC themselves to prosecute in court because AG is not convince.

Fortunately and unfortunately, MACC cannot do so under our system. Abu Kassim had said publicly on many occasion that MACC insist on the separation of role between investigation and prosecuting. That way he can divert the blame of not charge enough big fishes to AG.

Abu Kassim did all the wayang to pressure Apandi to prosecute Najib based on the weak given case. When charged, Najib will need to vacate his PM position. It does not matter he will be acquited later as long as the little Napoleans in the conspiracy could get him to vacate the post. The acting PM will then block Najib's return.  

In the case of MACC officers being investigated and apprehended by police, the source from within MACC said it was Abu Kassim that gave the go ahead to IGP Tan Sri Khalid.

He was undergoing recovery for back operation. It gave him an excuse to not speak and let his men lose to create the perception of crackdown to cover-up. MACC had a solat hajat but it was a drama to make the public to vilify Khalid and police.

Khalid told Abu Kassim that he was aware that MACC can retaliate by investigating policemen from bottom all the way to the top but there is a report, thus he has to do his job. Abu Kassim understood and gave the go ahead.  

One inside sources claimed that it was Abu Kassim that pressured Gani Patail to charge Najib. He convinced Gani Patail that since he is retiring, charging will be one way to get public to remember him by. It clears his name from past misdeeds.

This happened on July 22nd last year at Gani's official residence. The Special Taskforce of four Tan Sri have been meeting in a clandestine way outside office and most of the time at Gani's residence or KLGH. The taskforce was illegal from the beginning.

It was the fake charge sheet that blew the cover on Abu Kassim and Gani's manouvre. Tun M tried to provide cover for Abu Kassim's fail moves but it is inevitable for Abu Kassim to be replaced. 

Bar Council

The whole wayang of Abu Kassim is now passed to Gani to get BC to file for the judicial review.

It is suicidal on Gani to do so since he has cupboards and cupboards of skeletons, including Jessica and the secret adjoing door to Azliza's office.

It is heard that BC also planned to file a lawsuit against Najib, Apandi and few others. It will be led by Dato Gopal Sri Ram with Steven Thiru, Lim Chee Wee and Ragunath Kesavan in the team.

This one has Gani's hand behind the move. He is currently chambering at Ragunath's firm. All the while, it was thought that BC was fighting Gani but now it turns out the Sabahan Gujerati is friendly with BC. It is so Geng Loceng

Few lawyers expressed dismay at BC's political campaign using lawyers money. Quite a few are pissed with GLCs for giving these anti-Government lawyers legal work.

However, there is also a slack for Gani. SN Rayer, Dato Rosli Dahlan, and Dato Seri Anwar Ibrahim is challenging his admittance to the Bar. Anwar is citing the first sodomy trial in which Gani allegedly fabricated evidence against Anwar in the black eye incident.

The ghost of sinful past haunting on Gani or it is a cover-up?

The same Gopal Sri Ram is representing Anwar to protest Gani's entry to the Bar. The latest on Gopal Sri Ram is he was "charged" in hospital for dengue yesterday. It will be awhile before he is "discharge." So both the lawsuit and Gani's admission will likely be delayed.

As far as Apandi, he has been very economical with his words. He is aware of the legal fraternity bad mouthing. And, sources claimed he is aware of BC's plan. His response was, "Bring em on."

Critic is streaming endlessly at Bar Council for their intention to seek judicial review and to pass a motion to demand the resignation of Attorney General, Tan Sri Mohamed Apandi Ali.

One statement from a DAP state assemblyman and lawyer, RSN Rayer caught many by surprise. He criticised Bar Council's action.

A Penang DAP backbencher said the Malaysian Bar has been “tainted” by its actions against attorney-general (AG) Mohamed Apandi Ali and his decision not to press charges against Prime Minister Najib Razak.

Seri Delima assemblyperson RSN Rayer is referring to the Bar’s plan to table a motion to seek Apandi’s removal at its AGM and the application for judicial review to challenge the AG’s decision not to prefer charges against Najib in relation to the RM2.6 billion donation.

Rayer, who is also a lawyer, said he personally felt the two issues have tainted the position of the Bar as a professional regulatory body for advocates and solicitors in Malaysia into a partisan organisation which is pro-opposition and anti-government.

“The Bar Council is urged to withdraw this action for a judicial review as it will not meet the legal pre-requisites as the Bar Council is not aggrieved by this decision of the attorney-general who decided not to prefer charges against the Prime Minister.

“It seems to me that this action of the (Malaysian) Bar Council has drawn wide criticism as being a busybody and further fuelled speculation that the Bar is now very pro-opposition and anti-government, although I personally do not subscribe to this misconception as I think the Bar still upholds law and justice in this country,” he said in a statement today.

The Malaysian Bar is holding its AGM in Kuala Lumpur tomorrow.

Rayer said Apandi Ali is the Attorney General and Article 145 of the Federal Constitution gives him the power to decide on all matters related to prosecution.

He added that moving a motion to call for his resignation or removal at the Bar AGM may not be the legally correct thing to do.

“It is wrong for the Bar Council to propose and debate a motion calling for the removal of the newly appointed AG when it is legally and constitutionally clear that the appointment of the AG is the prerogative of the Agong on the advice of the Prime Minister.

“I urge the Bar Council to abort debating this motion because the Bar cannot be seen to be doing something for the sake of doing something, although it may not have any legal impact lest we want to be the laughing stock of the entire nation,” he added.

A. perkara 143/5 give the AG right to resign , and the right is absolute for the AG to decide for himself without having to do it for others demand.

B. no other entity can use the 143/5 right for AG to apply pressure the AG to resign.

C.the 143/5 wasnt meant for other parties than the AG himself

Other parties cannot and must not use 143/5 as a reason to demand the AG resignation.

D.whoever use any fed cons law for the ag and ydp agong for their interest are deemed to insult the ydp agong and challenge the fed cons.

145/3 clearly a prerogative privillage granted for the ag himself and not for other than him.

E.143/5 is an absolute right of the ag , no one should use the right  to demand for his resignation.

There has been much discussion concerning the Motion on the Attorney General that will be discussed in the upcoming Malaysian Bar AGM. [You can view the full motion in the Malaysian Bar website..]

Relevant facts:-

1 - The Motion dated 8/3/2016, was received by the Bar on 9/3/2016.
2 - We did not know that the Malaysian Bar was going to file a case regarding the Attorney General, which was done on 15/3/2016 > I personally do not understand why it was done then, 4 days before our AGM, and having note that a Motion existed. Time bar for filing a Judicial Review is 3 months, the AG's decision was on 26/1/2016 - in short, it could very easily been filed after the AGM.

SUBJUDICE - Well, in a recent Malaysian case, Syarikat Bekalan Air Selangor Sdn Bhd V. Fadha Nur Ahmad Kamar & Anor, YA, Mohamad Ariff Yusof J[2012] 6 CLJ 93, this very question was considered... It is NOT subjudice, either was Freedom of Expression, Opinion...takes precedence of matters of public interest, and/or public concern.

'..matter of general public interest of this kind is not to be stifled merely because there is litigation pending arising out of the particular facts to which general principles discussed would be applicable. If the arousing of public opinion by this kind of discussion has the indirect effect of bringing pressure to bear on a particular litigant to abandon or settle a pending action, this must be borne because of the greater public interest in upholding freedom of discussion on matters of general public concern...."

Hence, this motion on the AG, which is really is looking at a much broader reforms that are needed...taking also into consideration the relevant duties of the AG, as provided in the Federal Constitution, and noting also 'competing' responsibilities exist. How can an AG prosecute, when he also acts as advisor of the investigated/accused > which role is more important?A choice too will make him 'guilty' of not performing his other role properly?

The motion deals with the INDEPENDENCE of the AG and prosecutors - suggesting that he should not be getting monetary gain from other sources, and/or holding positions of Directorship in legal entities (Our AG is Director of Lembaga Tabung Haji??).

We have, in the past deliberated and voiced out about the Judiciary, Judicial and Legal Officers, Police, etc - and, now it is our duty to consider AG/Public Prosecutor and Prosecutors?

Is Appandi Ali personally guilty of any wrongdoing? Well, he was appointed by the Yang Di Pertuan Agung on the advise of the Prime Minister - and we know that the King has little choice but to listen to the PM.

Note also Art. 143(2) 

(2) It shall be the duty of the Attorney General to advise the Yang di-Pertuan Agong or the Cabinet or any Minister upon such legal matters, and to perform such other duties of a legal character, as may from time to time be referred or assigned to him by the Yang di-Pertuan Agong or the Cabinet,...

Well, it could be said that all (if not most of what he did) was what was required of him pursuant t0 Art 143(2)...but then, we need to look at Art 143(3) being his prosecutorial powers...

The call for Apandi Ali to resign, as such is not for any wrongdoing per se, but rather for the good of Malaysia, public perception, etc.. [We did not call for the Yang DiPertuan Agung to remove him, or for the PM to advise the YDP Agung to remove Apandi Ali...]

Note Article 143(5) which states, amongst others, '...the Attorney General shall hold office during the pleasure of the Yang di-Pertuan Agong and may at any time resign his office...', as such, he can himself resign...and this is what we are calling him to consider and do...

Looks to be more political arguments than legal. 
 
Heard some Muslim lawyers against Bar Council fell for their argument and buy-in to the psychological argument and shallow political game without full knowledge and understanding on the reasons and details behind AG's ad rejection of MACC's IP. [Read previous posting on MACC here].
 
If they are too stupid to fell for it, are they worth our support now?
 
In the meantime, some lawyers should suggest that Bar Council re-register as political party and have different NGO or a Law Academy as the professional body for lawyers.

Bar Council had just done their Wayang Tamil bit and now Tun Mahathir is doing his.

Today, Tun M filed a lawsuit on a claim of abuse of office against Dato Najib with two of his paid Geng Loceng actors, Dato Seri Khairuddin and Anina. He raised issue over the sacking of Tan Sri Muhyiddin, Tan Sri Gani Patail, etc.

Frankly, this will not pass the exchange of affidavit stage.

Minister for Communication and Multimedia, Dato Salleh Tun Said Keruak said it is indicative of Tun M's desperation to take the legal avenue after he has exhausted his "political avenue". Hopefully he remembers well in court as he usually conveniently forget.

Deputy Home Minister, Dato Nurjazlan Tan Sri Mohamed felt Tun M and his motley crew of dramatic actors have no locus standi since they are not aggrived party. Tengku Razaleigh denied, thus indicating possible willingness to be played out again despite it is known Tun M is pushing for Dato Mukhriz as PM candidate against Najib.  

This is mere political wayang kulit (shadow play). Since it involves Geng Loceng, consider it a dramatic wayang Tamil.  

If Tun M is so concerned with 1MDB and related events that he had written from item 6-30 in the Citizens' Declaration on 1MDB only, then he should just lay out his proofs.

But he didn't.

Instead he has been caught lying on many occasions and have got at least 15 to 17 facts on his allegations wrong. It is only indicative that he is merely politicising the issue and may not have any facts or proofs!

Mahathir, two others, sue Najib for ‘abuse of power’

In their statement of claim, the trio said that they are among the rightful beneficiaries to take the action against the Prime Minister.

KUALA LUMPUR: Former Prime Minister Mahathir Mohamad and two vocal critics of Prime Minister Najib Abdul Razak, Khairuddin Abu Hassan and Anina Saaidudin, filed a suit on Wednesday over claims of abuse of power in office.

In their statement of claim, the trio said that they are among the rightful parties to take the action against the Prime Minister.

They also stated the chronology dated back to March 2015 on the 1MDB investigations, the formation of a special Task Force, to then Attorney General (AG) Abdul Gani Patail’s dismissal, and former Deputy Prime Minister Muhyiddin Yassin’s sacking. Muhyiddin was also denied the right to speak during last year Umno Annual General Assembly.

“We say that the chronology of facts leads to the irresistible and undeniable conclusion on the manner in which Najib has continuously interfered with the due process of the law in order to ensure that all the relevant authorities could not continue to carry out, and conclude the necessary investigations pertaining to his alleged misconduct over RM2.6 billion donation and RM42 million from SRC International,” the statement said.

They added they were directly affected by Najib actions. “Mahathir had attended Bersih 4, where he made a statement criticizing Najib. He was thus under police investigation for criminal defamation.”

“He has also been in the spotlight by the police for his blog post on current Attorney-General Mohd Apandi Ali,” their statement said.

For Khairuddin, he has been making police reports in Europe and Asia on 1MDB allegations. He was charged with senior lawyer Matthias Chang for attempting to sabotage the country’s banking and financial system while in the case of Anina, she was sacked from Umno because she took legal action against Najib last year.

Their lawyer Haniff Khatri Abdulla filed the lawsuit today at the Kuala Lumpur High Court this morning. “The writ of summons will be served on the Prime Minister’s solicitors (Hafarizam Wan and Aisha Mubarak) by this week,” he said.

They are seeking a declaration that Najib had abused his official position as the country’s leader and Umno president by deliberately obstructing investigations on 1MDB, RM42 million from SRC International and the RM2.6 billion donation.

Besides that Mahathir, Khairuddin and Anina are also seeking a declaration that their constitutional rights were obstructed because Najib had been “punishing” them for merely exercising their rights to ask questions and seek answers to matters pertaining to 1MDB, the RM2.6 billion donation and RM42 million. The trio are also compelling Najib to pay the government the RM2.6 billion and RM42 million.

Khairuddin was charged last year with Chang, Mahathir’s former secretary, for attempting to sabotage the banking and financial services of Malaysia. They were said to have committed the “act” in various countries such as France, England, Switzerland, Hong Kong and Singapore between June 28 and August 26.

The prosecution attempted to try them under Sosma or Security Offences (Special Measures) 2012. On 18 November 2015 the High Court ruled that the attempting sabotage charge against them under Section 124L of the Penal Code did not fall under the constitutional ambit of Security Offences (Special Measures) 2012 or Sosma.

Anina had on August last year sued Najib and Umno Executive Secretary Rauf Jusoh, seeking that Najib return the RM2.6 billion “donation” that was deposited into his personal account. She claimed that he had breached the Umno Constitution, the provisions of the Societies Act 1966 and his common law duties as a trustee.

The suit was struck out by the High Court on December 31 last year. Anina then filed an appeal. Because of the lawsuit, she was also expelled from Umno. Her attempt to challenge her sacking has also failed.
It is all part of their moves for a Presumed Guiltywayang Tamil on Najib [read here, here and here].

Tun Mahathir's latest action demonstrates how desperate he is. He is clutching at straws. ‎
Tun Mahathir tried to topple the Prime Minister through UMNO. He failed. Tun Mahathir tried a parliamentary vote of no confidence. He failed. ‎Now Tun Mahathir is trying to sue. His accusations are false, so he will fail yet again.

Tun Mahathir has run out of options. This action shows that he has no political channels left. ‎

“If you want to sue, you need to have locus standi. If you want to sue the prime minister as a private citizen, means there is no locus standi. The one that can sue is someone who feels he has been wronged.

“Let the courts decide but to me, he doesn’t have locus standi. What he is doing as a political gimmick only,” he told reporters at the lobby of the Dewan Rakyat today.

“Locus standi” is a legal Latin term which translates to “place to stand”, which refers to whether a party has a right to be heard in court.

This desperation is reflective in some of the staunchest supporters of Tun Dr. Mahathir in the Anti-Najib Campaign, who one time was a much respected GEIC of a very important media group to resort to posting of fake Time magazine cover on his social media account.

This is politics never seen in modern Malaysian history, especially by a party which will be celebrating its 70th anniversary in less than seven weeks and had been in power continuously for over 61 years.

He was also "kecam" for his cheapshot to ridicule the PM. Malaysia Digest explains what the actual article had hidden.


In the meanwhile, Melayu Tan Sri Muhyiddin was said to be doing cheapshot by claiming he was offered the position of Penang Governor.

MyKMU asked him for proof of the offer. TV14 website asked who offered him the post?

Muhyiddin was known to be a Malay at heart, shy in his disposition and Johorean cool calm composure. He seemed to have lost it since signing a declaration together with DAP.

All this leading to March 27th. There better be millions coming and not just pro-Tuns only. It also serve to divert attention from Lim Guan Eng's house alleged corruption scandal. And it serves to supplement all the various lawsuit against Najib, AG and government.


In the light of Anwar's withdrawal of lawsuit against Dato Nallakaruppan, all these political related lawsuits are meaningless. And today he issued statement through his lawyers to say he has forgiven all past and present PMs for he is merely going for institutional reform.

Another wayang Tamil from the grandson of a converted Hindu from Ceruk Tok Kun. Should have seen how Keling his brother Rani looks like.

Political lawsuits seldom goes all the way to conclusion or till judgement executed. It is all wayang politik. The moment Najib is toppled it is all withdrawn and one day forgiven.

It is a deja vu similar to the July 23rd 2015 event at Tan Sri Gani Patail's home. Our source claimed Tan Sri Abu Kassim convinced Gani to pursue Najib "since he is retiring, charging will be one way to get public to remember him by. It clears his name from past misdeeds."

The timing of Zeti's statement is uncanny and seem to compliment Bar Council's motion to demand AG's resignation, Bar Council's filing of judicial review, Tun Dr Mahathir's lawsuit against Najib, and Dato Zaid Ibrahim's "Citizens' Declaration" March 27th gathering. With many media and news portal playing up Lim Guan Eng's house purchase issue, it like extending assistance to relief the Penang CM of the pressure.

This surprise is a party pooper to 1MDB confidence boasting move by CREC for Bandar Malaysia.

She alleged 1MDB have not provided the requested document as proof. In fact, this was the request for criminal action against 1MDB that was rejected for prosecution by Attorney General, Tan Sri Mohamed Apandi Ali in September 2015 last year.

1MDB said then that the money was allocated for their restructuring, presumably the IPIC's asset to debt swap. However, 1MDB denied and have cooperated with the authorities.

KUALA LUMPUR: The central bank is in the midst of pursuing appropriate “administrative enforcement actions” against 1Malaysia Development Bhd (1MDB) for failing to substantiate the reasons it gave as to why it could not repatriate a sum of US$1.83 billion (RM7.34 billion) it invested overseas.

Bank Negara Malaysia (BNM) Governor Tan Sri Dr Zeti Akhtar Aziz said this yesterday after revealing that the bank had requested for the controversial state-owned strategic investment fund to submit documentary evidence in October last year to substantiate its claim that the remainder of the sum not spent by the fund had been earmarked for a debt asset swap arrangement.

“At this stage, we have yet to receive that. The date [for the submission] has expired. As a result, we are now in the process of pursuing appropriate administrative enforcement actions that are allowed under the laws,” she told a media briefing on the bank’s 2015 annual report. However, she did not say when the deadline is.

The move could possibly result in a penalty or compound, she added. However, the proposed administrative enforcement actions, which will be submitted to the Attorney-General’s Chambers (AGC) before Zeti’s tenure ends, are subject to endorsement by the AGC.

“This is different from criminal action. It will not result in a court action; it is for breaches under the rules and regulations under the bank’s purview,” she said, referring to the bank’s earlier recommendation to the AGC to initiate criminal prosecution against 1MDB for breaches under the Exchange Control Act 1953 (ECA), which was turned down by the AGC despite the bank’s appeal for a review.

Zeti also promised to resolve this issue with 1MDB before she hands over the reins to her successor. “It happened during my term in office and I would like to hand over a clean slate to the next governor.”

Asked if 1MDB’s issue would be one of the regrets that mar her term with the central bank if it is not resolved, she said: “I would like to have a high degree of confidence that the matter would be resolved.”

The AGC in September last year cleared 1MDB officials of any wrongdoing with regard to the investigation carried out by BNM, and directed that no further action should be taken. Following that, BNM had requested for a review of its decision, but the AGC held firm on the grounds that there was no new evidence.

Subsequently, the central bank revoked three permissions granted to 1MDB under the ECA for investments abroad totalling US$1.83 billion, saying that the fund had obtained permission required under the ECA for 1MDB’s investments abroad based on inaccurate or incomplete disclosure of information.

It also issued a directive to 1MDB to repatriate the sum to Malaysia and to submit a plan for that. 1MDB then said the sum had been spent or earmarked for debt settlement arrangements. The money was originally for equity and loan investments in a joint venture with oil company PetroSaudi International Ltd between 2009 and 2011.

BNM was previously part of a joint special task force headed by former attorney-general Tan Sri Abdul Gani Patail, which was probing allegations made by The Wall Street Journal that funds originating from 1MDB amounting to RM2.6 billion had made their way into Prime Minister Datuk Seri Najib Razak’s personal accounts.

In an immediate response, 1MDB issued a statement yesterday saying that it had yet to receive any official correspondence or confirmation from BNM “on the specific matters attributed to the governor today (yesterday)”.

“We are therefore unable to comment further. However, we highlight that 1MDB has in the course of the past 12 months fully cooperated to the extent possible with BNM investigations, including providing documentary evidence where available,” it said.

It added that 1MDB is committed to continued cooperation with BNM and will provide any further information that may be required by the central bank if it possesses such information, and if it is possible under the law.

Meanwhile, when asked if she had confirmed to former deputy prime minister Tan Sri Muhyiddin Yassin that the US$1.103 billion, which 1MDB invested in the Cayman Islands fund, did not actually go into 1MDB’s accounts in BSI Bank Ltd Singapore, Zeti said she has had many meetings with Muhyiddin in her official capacity, but could not recall the specifics of what was discussed.

“I never had a meeting specifically to discuss that...If I did discuss it with him (Muhyiddin), it should be more broadly and [about] what was happening. That was quite some time ago.

“As far as 1MDB is concerned, what we are doing now is relating to the three approvals that we gave. That is the follow-up action we have taken and it is not related to what you are referring to. What you are referring to, the AGC has concluded the case already,” she added.

Najib, who is also finance minister, told Parliament last March the US$1.103 billion was brought back, but kept in BSI Bank, Singapore. But two months later, the finance ministry issued a correction to its March written reply, saying the US$1.103 billion transferred by 1MDB from Cayman Islands to Singapore was money “redeemed” in the form of assets in US dollars.

Later, Second Finance Minister Datuk Seri Ahmad Husni Hanadzlah clarified that the assets were in fact in the form of “units”, but the explanation added to the confusion when he refused to explain what it meant.

Muhyiddin told a news portal on Tuesday he had asked Zeti if it was true that the money had not gone into the BSI account, adding that Zeti had confirmed that to him.

‘I will resolve 1MDB issue’

KUALA LUMPUR: Bank Negara’s outgoing governor Tan Sri Dr Zeti Akhtar Aziz has promised to use her remaining 38 days in office to resolve the 1Malaysia Development Bhd (1MDB) issue before handing over the reins to her successor.

“I want closure on the 1MDB case, as I want the new governor to start with a clean slate ... and not have to deal with the matter that happened during my time,” Zeti said.

Pointed out during the PC, Zeti said she is not raising legal issue as it is the prerogative of the AG, but merely, in her term, a "proposed administrative enforcement actions". It will be in the form of penalty or compound.

If there is no legal wrongdoing, how is AG to agree to any action to be taken. 1MDB should be legally proven wrong. For whatever excuses, Zeti could not furnish any details to convince the attending media.

She conceded that it still require AG's endorsement.

We further highlight that 1MDB remains focused on its rationalisation plan, the positive benefit of which was commented on by the ratings agency Moody’s today.

This success has been achieved in spite of the calculated efforts of detractors, to generate negative headlines in the face of positive developments.

The president, Zhang Zong Yan, said China’s state-owned company, a Global Fortune 500 company which was ranked 71st in 2015, would consolidate all its current regional businesses and operations once its new headquarters in Bandar Malaysia was completed. Bandar Malaysia would serve as the country’s gateway to the world through the planned high-speed rail (HSR) to Singapore and the Pan Asean Rail Transit to Bangkok.

The Prime Minister of Malaysia said CREC’s plan to build its regional centre in Malaysia would be a major boost to the domestic economy, and would attract more international players to relocate their headquarters here. It would create the demand for high-powered talent and effectively help stem Malaysia’s brain drain to other countries as well.

Chinese Ambassador to Malaysia Dr Huang Huikang,  also applauded the Prime Minister’s vision and determination to attract prominent global partners to set up regional offices in Bandar Malaysia. He believed that there will be more Chinese investments and iconic projects in cooperation with China in the years to come under the leadership of Dato’ Sri Najib Razak.

CREC’s announcement comes three months after its successful bid, with its Malaysian partner Iskandar Waterfront Holdings, to acquire a 60% stake in the Bandar Malaysia project from 1MDB Real Estate at the cost of RM7.41bil. CREC's faith and confidence in the Malaysian economy remain strong and both the World Bank and the IMF have applauded Malaysia’s approach in the last few months.

Why didn't Mahathir file lawsuit jointly with Sanusi or Daim?

Over breakfast, a friend wondered as to why Tun Dr Mahathir did a joint lawsuit together with his paid minions, Dato Seri Khairuddin Abu Hassan and Anina Saadudin.

There seemed to be many supporters judging by the names in the G25. Any of them could jointly file the lawsuit and give more credibility. Why not them instead of the two clowns?

Why not have credible faces like Tan Sri Sanusi Junid and Tun Daim to jointly do the application related to Tort Misfeasans? Sanusi and Daim were signatories to the Citizens' Declaration, though Daim's absense and silence remain a mystery.

And, there is also the supposedly long list of so-called credible personalities in the coalition of NGOs and opposition leaders in the Citizens' Declaration. Forget certain names that claimed to be in the list but they are not in the like Tan Sri Zaman Khan and Tengku Razaleigh Hamzah.

Any of them could have be jointly filing it. Why the two dogs with only big bow wow but upstairs zero?

As of yesterday, the talk within UMNO circle is the presence of Ku Li in UMNO Kelantan's Kelantan Declaration in support Dato Najib. It may seemed to be a finality that he is not going to be tricked by Tun M again.

In the last coup against Pak Lah, Raja Petra said Ku Li was promised but Tun M snaked him at the last minute in favour of Najib. Rumours emanating from the other side said the coalition wants Ku Li to be next PM to replace Najib.

They are so confident these days but are already quarreling over the spoils of war like in Prophet Muhammad's Uhud War against the Quraisy. Tun M insist it to be Dato Mukhriz.

So this is to say Dato Ibrahim Ali's boys could be bullshiting about he was present at the declaration because Ku Li was supposed to be present. He was there, as his Secretary general Syed Hasan put it, to pay respect to Tun M to sign a declaration with DAP.

Nevertheless, Ku Li is a Kelantanis and options are always left open.

Purely wayang

There will be those claiming Khairuddin and Anina are affected by certain matters by Najib's Misfeasans. Fine, but how could the court proceed with Khairuddin's case with Matthias Chang is still outstanding in court?

As far as Anina's issue with UMNO, it is a lost cause from day one. She should know that but still pursue the inevitable. Only a bozo would do that.

It is safe to assume that it is merely wayang Tamil. T

Tun M will pre-empt the court to say he expect the court will throw away the case. A better script will be that it remain pending to perpetuity to await completion of Khairuddin and Matthias case which will be for years.

So Tun M could go to town to keep reminding and media keep repeating that he has a pending lawsuit against Najib. There will be other pending lawsuits too to be kept drumming.

No case

The fact about it is in a well reported statement by a lawyer and Bersih 2.0 activist, New Sin Yew:


 While former prime minister Dr Mahathir Mohamad's lawsuit against his successor Najib Abdul Razak has caused a sensation, lawyers are pessimistic about the outcome of the suit.

Lawyer New Sin Yew said the suit will ultimately fail because Najib is not considered a public officer under the law.

“One element of the tort of misfeasance of public office is it must be shown that Najib is a public officer. He is not,” he told Malaysiakini in an e-mail yesterday.

He explained that the Interpretation Act of 1948 and 1967 defines public office as “an office in any of the public services”.

Article 132(3)(a) of the federal constitution defines 'public services' in a way that excludes any member of the administration of the federation or the state, which in turn means ministers, deputy ministers and other posts under Article 160 of the constitution.

“Najib is a minister, but ministers are not considered a public officer.

“Therefore, the suit will fail,” New said, when asked about the suit filed yesterday.

Mahathir, former Langkawi Wanita Umno member Anina Saadudin, and former Batu Kawan Umno division vice-chairperson Khairuddin Abu Hassan are plaintiffs in the suit.

In the suit, the sole defendant Najib is accused of breaching his fiduciary duty and misfeasance in public office, by compromising various investigations against him in relation to the 1MDB scandal.

Misfeasance is a legal term referring to actions that are legal but performed improperly.

Meanwhile, lawyer Andrew Khoo opined that proving sufficient locus standi would be an issue in the case.

Locus standi refers to whether a party has sufficient grounds to bring a case against another.

Khoo said the plaintiffs would have to show the court that they have been especially affected by Najib's alleged malfeasance compared to the general population, including other taxpayers and Umno members.

“So when the court considers the issue of locus standi, it would have to see what specific interests he has, as opposed to any other ordinary person (to decide) whether or not to allow his suit,” he said.

He said insufficient locus standi is often among the first objections raised by the defendants in cases against the government, especially Najib.

But Khoo added that the court should take on a more relaxed view of the concept in public interest litigation.

“It is a question for the court as to whether they want to be more liberal in interpreting the concept of locus standi (in public interest cases),” he told Malaysiakini last night.

Interesting that Sin Yew highlighted about the distinction between public offices and public service. It should be of interest to the Dato Seri Khir Toyo and Lim Guan Eng debate going on.

Despite having the leftist with him, could he not have a better team of lawyers?

The friend ask the question over breakfast because he wondered also why too few people of credible standing is with Tun M's team in his yet another coup. It is only different set of excuses to justify another of his power play.

In the coup against Pak Lah, he had division support. Will the so-called grassroot support within UMNO via the GKCM group of branch leaders show their presence on March 27?

Currently, it is an embarassing feat as Tun M had to do endless wayang Tamil. The people supporting and fighting with him are of no credibility. That led the politically motivated drama to be obvious.

Retribution

For all practical purpose, Tun M is defeated in UMNO and he is in desperation of losing face. PKR knows that he lost it to Najib thus need a platform outside UMNO to continue his fight.

His options to bring Najib down from within UMNO failed and vote of no confidence in Parliamanet does not stand a fighting chance, thus he is left with election to bring down Najib. That will mean betraying by destroying UMNO. Should he end hs life about now, it will be a pathetic end to his glorious history.

By the way Citizens' Declaration in disarray with the declaration lack any specific reform promised and both NGOs and opposition parties' grassroot members are not acceptable to working with Tun M, it will require a lot of effort to make it work.

Dato Zaid Ibrahim said a sizeable number of UMNO members will turn up at his orgainsed March 27 gathering. It better be because PKR and PAN cannot attract sufficient crowd. That is the much needed endirsement to the Citizens' Declaration.

Thus far heard, it is DAP that is working hard to bring people. If that is so and the numbers present are large, it will be like Bersih 4.0 and the message will be lost. That will not make it attractive to Malay voters. 

The proTun may think they are winning.

Let them think so. after all, they are fanatics unable to think and will swallow everything the old man puke out.

Our friend reminded the words of the late PAS President Dato Fadzil Nor in which he prayed that Tun M will live long enough to disaster that he has done, see people realised the destruction he made and and his sins revealed out in the open.

The friend acknowledged that Tun M was a great man with ideas and visions but his problems is with his politics. His politics supercede better judgement. Sanusi loves to repeat the view that political considerations must supercede socio-economic, technical and commercial considerations.

The friend emphasised that it is because of politics and pursuit of power that Tun M is willing to do the unethical and unsavory acts like lying, twisting facts, slandering and even destroying what he has built.

As we ponder over these strong words from our friend, whose view is likely the views of many wise and distinguished elders he had consulted, we believe many may not realised that Tun M's politics had ruined the institutions he now claim to want to do the reform and yet blame it on Najib in his declaration.

Finally, we mutually agreed that whatever Tun M is undergoing, it is hope that it serve to cleanse his past right here in the temporal world before he meet his maker than face the afterlife retribution destined for mortals.

A bit malas to blog lately.

It is partly due to a new routine that takes up half the day away. It is a new healthier lifestyle. Early to sleep and early to rise. Our priority now is the personal target set.

So somewhat lazy to meet up people too often as it takes away productive hours.

Being Asians, hospitality is equated with food. Respecting the hospitality could end up choosing menu heavy with carbohydrates and sugar, fat-laden fried stuff and limited nutritional fresh fruits and vegetable item. It only disrupt and upset our new regime.

Too often it means sacrificing hours chatting away aimlessly. Frankly there is nothing really exciting to talk about lately. Economy is still in the doldrum though market beginning to look exciting. Maybe a leading indicator of good things.

Politics getting to be a predictable bore and looking increasingly stupid. As always, allow us to be blunt here. Too much wayang and auta. Too many self interest in play. And too many clowns and idiots playing ridiculous game. It is no more power seeking opposition but even statesmen are openly lying. [Note the plurality.]

There is serious lack and depth in discussion on policy or governance or nation building in the public sphere. Discourse dominated by same old political power play bullshit but guised as simplistic human rights, civil liberty, liberalism, and what not cliches.

Nothing intellectually relevant to discuss and write about, be it pro or con.

On top of that, there are tons of things to do but have been delayed to await the right undisrupted time. Need to get our focus on clearing up backlogs. 

Maybe it could be done out of town away from distraction. It is in the pipeline anyway. Really looking forward for the planned long getaway. So do not be surprise when blog not updating over a long time.

Mike Jagger's "beast of burden" about being free from the burden for his pursuit. Our case may not be girls but the burden of changing to a new routine and lifestyle.

Something feels good about the new routine. It made us feel more alert, energetic and spiritual albeit with some pain of adjustment.

The feeling now is winning or losing, or anything temporal is no more relevant. It is what is inside and up there that matters. The conscience will be the ways of the prophet for siddeq, amanah, tabligh and fatanah. And, ultimately about getting Allah's blessing and acceptance is everything.

Nothing else really matter. That is worthy and moral to claim as it does not matter.

To be spiritually and principally right in one's struggle, be righteous, responsible and factual. No lying, twisting and spinning. Siddeq, amanah, tabligh and fatanah means righteousness, trustworthiness, propagating good and wisdom.

Many asses got burnt

It looks like any other typical 1-2-3 bang tactic employed by Tun Dr Mahathir.

There was the less than expected crowd at the Kongress Rakyat without PAS, Tengku Razaleigh and Datin Seri Wan Azizah, then the far from 3 to 4,000 turnout at Rafizi's and use of foreign media.

Instead of achieving what they set out to do, it turned out to be one boo boo after another including open squabbles between Tun Dr Mahathir and Ku Li, and Wan Azizah dismiss Deklarasi Rakyat for it's intention to bring someone rather than a reform agenda. It was a right in the face critic of Tun M.

It may seemed like Tun M got his ass burned but it is not just him. There are many more.

Perception of Fear


Four Corners documentary feature ny ABC Australia to create a perception of fear pervading Malaysia under Dato Najib. It would have been more relevent for a Malaysia under admit-dictator Tun M.

The attwmpt by ABC to Australians is meaningless since only Malaysians voters matter.

So it could be intended for the impending Sarawak state election. Co-incidently, the feature begin with attempt by two ABC reporters to break security to get a statement from Najib in Kuching.

It become a controversy because police was going to charge the reporters for breaking the law.

Frankly, equal blame should be directed at Najib's security detail. Though can be unnecessarily rough and harsh to the public at times, they slackened when it really matters.

The documentary may be well produced but for the discerning observers, it has no credibility, wrong on facts and tried to join together unrelated events. The state owned television looked outright vengeful.

With issues like submarine revived, they were recycling old issues and over dramatised by tying unrelated murders of Kelvin Morais, Altantunya, and Hussein Najadi to the current accusation of money laundering.

Yesterday's ABC documentary; 'Four Corners': State of Fear" done by the two Australians who tried to ambush Najib going into the mosque in Sarawak aired on TV - including in Malaysia.

The documentary recycled a bunch of old allegations including Altantuya/scorpene and any blind person can see that it seems to propaganda that is purpose built to paint as bad a picture as they can on PM Najib.

This basically ignores the fact that Altantuya's murder went thru three court trials and PM was never implicated in this trial.

But what is new is that Mahathir admitted that he had talked to convicted murderer Sirul supposedly to "help him get asylum" in the Australia. Mahathir claimed he asked for nothing in return!

Yeah right, we believe you that Mahathir is now an immigration lawyer and can help Sirul and expecting nothing in return.

No wonder Sirul had made a series of video "confession" claiming that certain high profile leaders had asked Sirul to unfairly frame Najib in return for certain favours.

Mahathir has admitted to talking to Sirul and I believe PDRM should investigate Sirul and Mahathir if there was conspiracy by Mahathir to frame Najib by promising freedom for Sirul.
He should be investigated for the crime of abetting a convict to escape. Since he said in the documentary that institution to safeguard public interest is not functioning anymore, it should start with him.

After all, late Tun Abdul Rahman said it was him that started the breakdown of public institution.

The fact that 4 Corners still tried to blame Kevin Morais' murder on Najib on the pretext that he was investigating Najib's RM2.6b is also astounding as his murder has now gone to trial with seven suspects.

Also, I cannot understand why they would want to take out Kevin Morais who was not even working on this case when the rest of the investigation team including the ex-AG is still around - it makes no sense.

And what happened to the so-called pen-drive full of evidence that Kevin's brother said he has and threatened to review 6 months ago?

Can't you just drop the contents of the pen-drive into Google Drive and send us the link? What decade are you living in?

Also, the 4 corners program said that ex-AG Gani, who was in communication with ex-DPM Muhyiddin, was about to file charges against Najib just before he was replaced.

It is simply beyond belief that these journalist would even dare run this story knowing full well that the MACC investigation papers on Najib was not even completed and sent to the AG Office for further actions.

Heck! Najib, the so-called main suspect was not even questioned yet so how can the investigations be completed?

And if investigations are not completed and the file not sent to the AG for further action, how can charges be filed?

Surely experienced journalists know this.

In fact, are we to believe that MACC and the AG's effectiveness and efficiency has reached an entirely new level where investigations started on July 3rd 2015 would mean charges by July 27th 2015?

That would be incredible speed of our legal system - never seen before and seen since.

It either points to a high-level conspiracy to frame or the entire ex-AG story is not credible - especially since our ex-AG himself have not said a word about this.

However, the program did indeed have a new revelation

Their crew had been apparently shown the bank documents by an unnamed 'high-level source'.

“The banking documents reveal an extraordinary and steady flow of money between 2011 and 2014,”

Among others, US$75 million came from a Saudi prince, while another US$80 million came from the Saudi Arabia's Ministry of Finance.

A further US$120 million supposedly came from an unnamed British Virgin Islands shell company.

The documentary also listed two transactions in March 2013 that supposedly came from another BVI company, totalling US$681 million. This is the often-reported RM2.6 billion political donation.

The total received by Najib, according to the documentary, was US$1.03 billion (RM4.14 billion) by April 10, 2013 - just over a month prior to the 13th general election.

Now why would the Saudi Ministry of Finance send money directly to Najib's accounts?

This is significant as this is no longer just a transfer from individuals in the Royal family but the actual Saudi Arabia Govt itself.

That Saudi MOF transfer is just one of the 4 transactions.

Do remember that MACC said they had interviewed the donor who confirmed that all 4 transactions were from Saudi and was a political contribution.

MACC had long ago said they have 4 letters for the four transfers lodged at the time of transfer - all from the same person. This means that the donor was sending funding to Najib via different accounts and sources - which is not unusual as you would expect the Saudi country and Royal family to have money all over the world and kept there for confidentiality purposes.

Which means the person who lodged the letter for the transfer from the Saudi Ministry of Finance was also the same person who lodged the letter for the 2013 RM2.6b transfer - which WSJ had claimed Najib had returned most of the money right after GE13.

And is this why Najib and our government does not want to reveal too much information on the deals?

That this is an official Saudi Govt covert initiative and it is not right for Najib and Malaysia to disclose other countries covert initiatives?

Is this also why the foreign media seems obsessed on this issue to find out how Saudi Arabia funds other countries and is trying to get an admission?

All in all, this 4 corners programme looks and fells like an exercise in planned propaganda to paint PM Najib as black as they can.

In fact, they interviewed all those politicians and NGOs who are known to be anti-Najib but did not interview anyone who is pro-Najib nor anyone who would be seen as neutral - which goes against the very essence of balanced reporting.

For laugh, Tun M said he suspect undesirable activities.

Since people always say he always knows what he is talking about though have made many factual errors, when is the proofs on RM42 billion lesap to be revealed?

Why buyers for Edra and Bandar Malaysia, and debt for asset swap still see value in 1MDB assets? Shouldn't it be valueless assets?!

He said the institution to safeguarding public interest is not functioning anymore. Sure ... if only Tunku Abdul Rahman and Tun Hussein Onn are still alive.

He has just quit Proton and other government positions held. Bigdog's posting here may have been too much for him.

Today, for the first time, the Wall Street Journal has been forced to admit that at least some of the funds donated to the Prime Minister came from Saudi Arabia.

For nearly a year, the WSJ denied that the funds came from Saudi Arabia, and attacked all those who suggested otherwise.

This included the Attorney General who, after reviewing the exhaustive investigations and examining all the evidence – including wire transfers and interviews with the Royal Family – confirmed that the funds were a donation from the Royal Family of Saudi Arabia.

Neither the confirmation from lawful Malaysian authorities, nor the Foreign Minister of Saudi Arabia, nor reputable outlets such as the BBC and Daily Telegraph, was enough to make the WSJ stop their attacks or denials that any of the funds had come from Saudi Arabia.

This exposed the bias in the WSJ's reporting, and made clear that their coverage was not driven by an impartial desire to cover the facts. Instead, their reporting was based on false information they were willingly fed by Tun Mahathir's Anti-Najib Campaign.

Maybe it's their embarrassment that stops them accepting the facts in full. Namely, as the Prime Minister has always maintained, the funds were a donation from Saudi Arabia – as the evidence shows.

However, today is a small step towards the WSJ admitting that they have been wrong all along – and that they were wrong to base their reporting on unnamed and anonymous sources who have never been revealed and may not even exist.

Nazir's black eye


Equally blackened ass and with a black eye is Dato Nazir Tun Razak. He was so vocal against 1MDB and recently tone down to say never again 1MDB.

WSJ confirm this blog's long suspicion that Nazir's loud mouth is basically covering up for his own failings. In this case, he was involved.

Prominent banker Nazir Razak, who has been critical of the state of Malaysia's institutions and politics, has found himself embroiled in a financial scandal swirling around his brother, Prime Minister Najib Razak.

The Wall Street Journal (WSJ) reported that Datuk Seri Nazir received US$7 million (S$9.4 million) transferred into his account from his older brother's, and the money was then disbursed to Umno politicians ahead of the 2013 General Election.

The newspaper said that Mr Nazir, who was chief executive of CIMB at the time, confirmed in a statement that the money was distributed in accordance with instructions from party leaders. He also said he believed the money was from donations he helped to raise from Malaysian companies and individuals for the election.

"I had no knowledge whatsoever that these funds may have originated from any other source," he said in the statement. "The entire amount was paid out in cash to various recipients according to the instructions of the party president, and the account was closed with a zero balance."

The WSJ article centred on allegations that money from 1Malaysia Development Berhad (1MDB) was used by Datuk Seri Najib, the state investor's advisory chief, for both political and personal purposes.

1MDB has denied the allegations, while Mr Najib has insisted that US$681 million found in his personal accounts was a donation from the Saudi royal family "to be used as the Prime Minister saw fit".

The Prime Minister's Office accused the WSJ of bias yesterday, saying in a statement that the newspaper's position has shifted to "admit that at least some of the funds" came from Saudi Arabia.

Mr Nazir's involvement in the disbursement of political funds has drawn surprise. Since becoming CIMB chairman in 2014, he has been vocal about national issues. He has slammed 1MDB and called for its board to resign, while bemoaning the state of the country that his brother has governed since 2009.

Last June, he announced plans to launch a non-governmental organisation with former deputy minister Saifuddin Abdullah to champion moderate views. "I just can't see how our institutions can recover, how our political atmosphere can become less toxic, how our international reputation can be repaired," he had said in February.

Datuk Saifuddin, who left Umno last October, told The Straits Times he was quite surprised by the WSJ report, as he was unaware that Mr Nazir had been involved in disbursing party funds, although raising money to help politicians is a normal practice.

Malaysia's integrity minister Paul Low, who heads a newly established committee to recommend regulations on political funding, made it clear that such activities were "not regulated at all".

He said: "This is precisely why we need regulations to distinguish (between) what are political funds and what are not, and if it is political, then we must ensure full disclosure."

A top finance executive familiar with political funding told The Straits Times that "as CEO of a major bank, I wouldn't do it, because now you are tarnished".

"I understand wanting to help (Mr Nazir helping his brother), but admitting you helped raise funds will lead people to assume it came from your clients because every big guy in town was his client. It raises the question of 'fit and proper'. Putting it in your personal account also seems careless," he said.

Mr Nazir did not specify the individuals the money was disbursed to, or why his personal account was used. CIMB officials have not responded to queries.

Adding to 1MDB's woes, Luxembourg's state prosecutor has launched an inquiry into allegations of money laundering by 1MDB in 2012 and 2013, Reuters said yesterday.

The prosecutor said there was evidence that funds held by the Malaysian government in offshore accounts in Singapore, Switzerland and Luxembourg had been misused, it said.
Misused? Then go after the operator or management. How is a PM to know everything?

Since they are investigating, do contact 1MDB or give their list of specific enquiries to the Attorney General Office.

Not just talk to the press for self political mileage as a certain other foreign agency did. When the final letter came in, the request is hardly significant.

Back to Nazir, he responded. He said to ST, except below:
"I had no knowledge whatsoever that these funds may have originated from any other source," he said in the statement.

"The entire amount was paid out in cash to various recipients according to the instructions of the party president, and the account was closed with a zero balance."
But, why now only after WSJ revealed on him? [Update] Rahim Zanudfin poser to Nazir on FMT here was where is his due dilligence?

Now that Tun M have resigned from Proton, Rocky Bru asked whether Nazir should consider quitting his positions in CIMB, Khazanah and all government appointments.

It would be useful to help alleviate unemployment problem in the country. Many 5-year working Gen Y thinks they are ready to fill up his positions. Argument is give them a chance.

Nazir's saved fat salary can be donated to an education fund to send deserving student like an Engineering student bound for UCL.

The kid, Mohamed Najib finally got his wish, as told by elder sister, Soraya to come true.

Little Najib got to meet Big Najib at the recent opening of the Permata Kurnia National Austism Centre. Soraya too got her chance last Thursday.

KUALA LUMPUR: Prime Minister Datuk Seri Najib Tun Razak said yesterday he is confident the establishment of the Permata Kurnia national autism centre will be an investment in the provision of early intervention for children with autism.

He said the approach and alternative methods of early intervention for children with autism would be able to reduce the cost of care for a lifetime.

“Early intervention can reduce the cost of care that the country has to bear. I am convinced that this is an investment for the country, not an expenditure,” he said when opening the Permata Kurnia Centre in Sentul here.

Najib’s wife Datin Seri Rosmah Mansor, who is patron of the Permata programme, Women, Family and Community Development Minister Datuk Seri Rohani Abdul Karim and Chief Secretary to the Government Tan Sri Dr Ali Hamsa were also present at the event.

The Prime Minister said the centre provided full-time service for children four to six years of age as a transition to prepare them for mainstream education.

He said he would be proud if children with autism could attend normal school as it would not pose a burden to their parents, and the children would have the opportunity to excel.

Najib said that in the United States, for example, the number of children with autism was 1.5 million and the lifetime cost of care per child was estimated at US$3.2 million (about RM12.3 million).

The RM28-million Permata Kurnia Centre in Sentul cares for about 300 children, having started operations in December last year.

The Prime Minister said Permata had expanded to seven programmes since it was introduced in 2006 and won international recognition. It has been nominated for the Global Good Governance Children’s Awards in the 3G Children’s Welfare Awards category in London.

Permata would compete with the programmes of three other countries, namely Qatar, the United Kingdom and India, he said.

Najib expressed the hope that the autism centre would spread its wings to the states with teachers dedicated to bringing up successful children.

Ar Mumtazah is a member of the group of international multi-disciplinary experts and researchers invited by Autism Speaks New York to explore new environment architectural design using new technology for individual with autism.

There is a paper prepared and due for publication in an American health journal in April next year.

In a speech by Prof Abdul Razak Omar, he mentioned that 1 out of 600 newborns has autism. It is quite approriate to address the autism at the early stage and not wrongly classify them as handicap or mental problem.

Not sure of Razak's position in National Autism Society of Malaysia (NASOM) or in UTHM, but know him as former Political Secretary to Dato Shahrizat Jalil and former Executive Director of Yayasan Nur Yaqeen.


NASOM had a booth to make the public aware of autism. More information can be found in their website http://www.nasom.org.my/


Part of our interest at Batu Pahat exhibition was to also lent support to Najib and Soraya's cousin, Hazim (the young man in white shirt), who is a Civil Engineering student at UTHM and volunteer for the exhibition.

Hazim was assisting Prof. Hye Won from South Korea who is introducing Music Theraphy for children with autism. Her display:

There was another interesting display on a theraphy method by Green Apply Hippotheraphy. Hip in Greek means Horse. In other word, Hippotheraphy is theraphy using horses:



The displays are only a few since awareness on autism in Malaysia is still limited.

Nevertheless, the convention helps to bring together experts, professional service provider, health officials, NGO, and parents of children with autism to share information and discuss and exchange views.

For the public interested to understand and appreciate more on autism, they could attend a movie due for release on April 14 entitled Redha by Tunku Mona Riza.

The film will likely be about the challenges faced by those with autism particularly the misconception by society.

Nazir is unfit to assume positions in CIMB, Khazanah and BNM

It is irrelevant that Dato Nazir Tun Abdul Abdul Razak is the youngest brother of Dato Najib Tun Abdul Razak. Neither does it matter that their father is our idol, Tun Abdul Razak.

An issue has to be seen from the perspective of the facts of the issue and nothing else. His relation to the Prime Minister is of no consequence. That maybe unrealistic to ignore but we are not insulting the PM.  

This blog have been critical of Nazir so nothing and no one will hold us back from calling for his resignation as CIMB Chairman, and member of the Board of Director of Khazanah. The Wall Street Journal made a revelation and Nazir admitted.

It does not matter that Nazir is close to Bank Negara Malaysia Governor, Tan Sri Dr Zeti Akhtar Aziz. He not only should not be considered for the position of BNM Governor, but should be investigated.

And, never ever should he get to be Minister of Finance.

This is no more the first cabinet of Malaya where brothers can be members of the cabinet. Malaysia should be beyond such feudel thinking.

That become the first reason among "99 dalil" to insist for Nazir's resignation from all government appointed position.

He should not have been appointed to the Board of Khazanah Nasional since he is the youngest brother to the Prime Minister. There lies the conflict of interest.

2. By acknowledging the WSJ report that he had received and distributed fund from Najib's bank account, he has revealed on a client's account.

Bank Chairman Nazir has flouted BAFIA and FSA rule for banking confidentiality and should be investigated.

3. He acknowledged that the money was transfered from his brother's account into his account and then transfered to the assigned recipients.

If it is an illegal act or as he puts, he is not sure of it's legitimacy, then his professionalism is in question. As banker, he should have done his due diligence.

4. He insinuated the legitimacy of the fund. As Dato Dr Puad Zarkashi said in the press, Nazir has ill intention to accuse a legitimate political donation as illegally obtained political fund. Political donation is not wrong.


5. Puad Zarkashi is right to assume Nazir is doing a publicity stunt.

It was reported that "he believed the money was from donations he helped to raise from Malaysian companies and individuals for the election."

Nazir raised the fund but not taking responsibility and now finger pointing to pass blame on others. He is irresponsible and unfit to look into government and public interest.

6. Since Nazir claimed the money may not be legit, then he may like to reveal to the public in the name of transparency, and accountability as to who are the "duo entrepreneurs" that gave the RM30 million "now everyone can donate".

Why are they not ligit and why did he took the money?

7. Are the "duo entrepreneurs" his banking clients in which CIMB has a big lending exposure thus need to ensure they are afloat?

8. Is the money raised by Nazir for favours to secure licences for "low cost banking" and "low cost insurance" till all legacy financial institution end up closing like GrabCar doing to traditional taxis?

9. Are the "duo entrepreneurs" sincere in their donatio?

Do the donors secured by Nazir's expect his RM30 million to be given special treatment as though the Geng Loceng donated RM3 billion just because he is Nazir's friend?  

10. Is the money donated with the intention to position themselves when Nazir is appointed as BNM Governor?

The "duo entrepreneurs" could set monetary policy and regulations for the banking and financial institution in the manner they did an industry rationalisation plan during Pak Lah's time that favoured them heavily?

11. Talking about finger pointing, this is not the first time Nazir Razak have been passing the buck or more precisely, passing the shit he made to others.

He screwed big time in the management of CIMB and passed the buck to Dato Tengku Zafrol. [Read past posting here]

12. As CEO for 15 years, why should be be made Chairman by Khazanah Nasional? When he "fucked up" at CIMB, he should be treated like all other expired CEOs which to be given the boot!

13. Why did BNM allowed him to be Chairman of CIMB?

This is a decision made without consideration for the public interest and smooth running of public institution. It made life tough for the new CEO to address past problems and institute new policies and measures without Chairman intervention.

It is in the same manner Tun Dr Mahathir is intent on toppling Najib for addressing legacy problems.

14. He is Chairman of the Executive Committee of CIMB and it was publicly announced as so.

BNM is very clear on the rule that Chairman must be non-Executive and ideally it should not be former, and long serving CEO either!

Why is this special favour to Zeti's close friend?

15. With Nazir strong grip on CIMB management, he should not be appointed on the Board of Khazanah. They are the biggest shareholder in CIMB thus it is a conflict of interest.

16. The biggest conflict of interest is Nazir and wife ownership between them of about  50 million shares in CIMB which is worth approximately over RM200 million.

This is on top of his RM10 million plus other perks which is way above average GLC pay!

17. Nazir has not been truthful and honest in his decision and comments. He gave negative comment on a government company just to divert attention from his problem at CIMB.

18. Nazir is being emotional and unprofessional. His open remarks against his brothers are too personal. It goes to the point that it is out in the open [read Asia Sentinel here and here].

If that is his attitude, then he is psychologically not fit and unstable to fulfill his duties and obligations in government companies.

He cannot put aside his personal issues from his responsibilities. The country cannot be run as a family fiefdom for him to run tantrum as he wishes.

19. As a professional serving the government, it is unbecoming and rude to slant past insults like "Even my teen son can tell 1MDB bad news", "Malaysia in the ‘darkest’ of times", "Malaysia sliding into ‘a game of thrones’", "1MDB - never again", and various other politically motivated comments.

20. It is highly improper that he ruined the country's image by making dispraging remark on the country like mentioning "Malaysia’s sovereign credit rating deserves to be accorded “junk” status" at an international conference with the presence of foreign investors.

Is he so dumb to not see the insidious intention of WSJ, FT and NYT?

21. Nazir has been open to rubbish his brother's leadership and dabbling in politics by "talking" to Dato Saifuddin Nasution about starting a political party or political NGO.

If so, then he should resign from all government executive positions and most welcome to.enter the ring.

22. For someone whose been given deals on a silver platter, Nazir should know where his situation is. He changed CIMB to a fee-based income organisation by getting fat fee government deals.

Many of the deals do not have sufficient commercial justifications and even led to the ruin of government own companies.

He should prove his mettle out there beyond the comfort of political and family connection. Try make it out of Malaysia.

There is 77 more dalil to go and we are due to meet someone.

It is not difficult to fill-up.

Just go through his deals like MAS-Air Asia merger, MAS rationalisation, Sime Darby-Guthrie-Golden Hope trimerger, Sime-E&O and many many more deals made justified by the fee and commision for CIMB and Nazir than the economic or socio-economic needs!

If it is true that if Najib remains Prime Minister then Barisan Nasional and Umno are going to get kicked out in the next general election in 2018, why not just wait another two years and then Barisan Nasional and Umno will get kicked out and in that same process Najib will get kicked out together with his party?
We are taking excerpt from RPK's The reason for the hurry to finish off Najib".

There is a chronology of event that should be an eyeopener for those still with an open heart for the truth as to why there was the Ops to remove Tan Sri Muhyiddin, replace Tan Sri Gani Patail with Tan Sri Apandi Ali, raid on MACC, "changing" PAC members, etc.

The simple line to accuse of stopping investigation is too simplistic. After being in existense for almost 60 years as a nation, no politician at the helm of leadership will not allow an action that will create such detrimental perception of himself. That is unless something seriously wrong like being set-up.  

If Najib has his answers and reasons, where is the proofs by the accusers?

RPK's answer first as to why they cannot wait for the General Elections to remove Najib.
The first reason is they do not want Barisan Nasional and Umno to get kicked out. “But then Mahathir and the ANC are working with the opposition?” you may ask.

Wrong. Mahathir is not working with the opposition. He is just using the opposition to oust Najib. And the opposition thinks it is using Mahathir instead to kick out Barisan Nasional and Umno.
Second reason ...
... the Bank Negara Governor has only about a month to go before she retires. So, if they want to act, they have to do it within this next month. And that was why Kadir said we do not have long to wait to find out what the secret that he is keeping and which he cannot tell us is.
Sometime last year RPK presented a conspiracy theory of very senior officers of Bank Negara are in a conspiracy to oust Najib. RPK had mentioned the names then.
The very next day, Bank Negara issued a press statement denying that allegation. They then lodged a police report and called in their lawyers for a meeting. The plan was they were going to sue me for slander.

According to my fly on the wall in the meeting room, the lawyers advised Bank Negara to sue me only if they have nothing to hide. However, if their hands are not really clean, then they should reconsider the plan to sue me or else it will backfire.

Bank Negara then made a decision to drop the plan to sue me. So what does that tell you? Are their hands clean or dirty?
Chronology 


The chronology should be the eye opener for those with an open heart to seek truth and not those talking of truth, righteousness and quoting Martin Luther but to dumb and loyally blind to truly go for the truth.
... on 2nd July 2015, The Wall Street Journal (WSJ) ran a story based on what they claim were documents related to an investigation on RM2.6 billion of 1MDB’s money being transferred to Najib’s personal bank account.

Now, the story was published on 2nd July 2015. So they must have received the documents before that, probably in June or even earlier. WSJ said they have seen the documents and the documents are regarding an investigation by Malaysian authorities.

The Attorney General, Gani Patail, in turn said that he received the documents on 4th July 2015. And that was two days after the WSJ report.
And who gave him the documents? Well, Bank Negara, of course. So Gani received the documents two days after WSJ ran the story, according to the official statement.

And then they announced on 8th July 2015 that a Special Task Force is being launched to investigate the WSJ story. So that would mean no investigation has been done yet. It is only being done after 8th July 2015.
So what investigation was WSJ talking about? And which investigation papers are they referring to?

Actually there was no investigation and there were no investigation papers. The investigation did not exist and the investigation papers were fakes. WSJ was duped and they ran a story based on fabricated documents. The investigation started after the WSJ story of 2nd July 2015, after 8th July 2015, in fact.
Then, on 30th March 2016, WSJ ran another story, an updated version. And this time they said the USD700 million is US$1 billion after all and that the money was a donation from the Middle East after all. This time they appear to have got part of the story correct and a story very different from the 2nd July 2015 story.

And in this story of 30th March 2016, just like in the 2nd July 2015 story, WSJ said they have seen the documents and the documents are the investigation papers.

So, two different investigations and two different investigation papers — one report on 2nd July 2015 and the other on 30th March 2016. And WSJ says they are in possession of the documents and have viewed them. The question that needs to be asked, though, is how did they come to be in possession of them?
Can you get that?
And that is what the police are trying to establish. The prime suspect is Bank Negara. Someone or some people in Bank Negara gave WSJ fake documents on or around June last year and, last month, gave them another set of different documents.

And someone or some people are going to go to jail for this. And the Bank Negara Governor is pissing in her panties because everything leads to her door. And she has only another month to go: either to go into retirement or to go to jail.

So she has nothing to lose. And when you have nothing to lose you have to go for broke. So she is planning to get Najib before Najib gets her. And that is the secret Kadir is talking about. The Bank Negara Governor wants Najib arrested before she herself gets arrested.
Still wondering why suddenly BNM Governor Tan Sri Dr Zeti Akhtar Aziz is promoting and campaigning underhandedly for Dato Muhammad Ibrahim as successor but all the past few years, she never ever pushed him up to the international forefront.

And even in her last PC, it was Dato Nor Shamsiah that was answering her for "information unavailable" questions. 

Nor Shamsiah is the one that stopped the practise examining bank as though our Bank can be trusted to self-regulate. How could one trust dealmakers at the helm of Bank management and businessman minded Bank owners to self regulate?

Weak enforcement

One Central Banker leaked to us that Samsiah is the cause for the weak monitoring and enforcement at BNM. Is she covering her weakness using 1MDB to cover her incompetence?

RM2.6 billion (or RM4.2 billion) is not a small amount of money. How could that huge amount come into Malaysia three years ago without triggering any alarms when just RM100,000 would send the alarm bells wailing like a banshee?

Najib first discussed this matter with the Governor and after explaining where the money is coming from and what it is for, the Governor advised Najib to place the money into his personal bank account. It would be less complicated for both Bank Negara and the Registrar of Societies if the money did not go into Umno’s bank account.

The money is not from illegal sources. There is no crime involved. There is no money laundering involved. And the money is not being smuggled into Malaysia. “So just put it into your personal back account,” said Bank Negara.

And that is what the police are going to report. So, if Bank Negara says otherwise, then without a doubt they are trying to set Najib up. And instead of the Bank Negara Governor arresting Najib, she will end up getting arrested instead.

And that, dear readers, is why they are in a hurry to get Najib — because if they delay too long they are going to end up in jail instead. So, Kadir, that is the secret you are keeping which you cannot tell us, right?

No one inside BNM can be trusted.

Bring back Dato Dr Awang Adik. So what he is a politician. All World Bank are involved in US politics and defense.

So he is now a diplomat. That is emulating the doyen of integrity, Tun Ismail Ali. Awang was already groomed for the Governorship position way before Muhammad Ibrahim. Remember that Awang was Director General of LOFSA?

It could be Irwan but too many Geng Loceng in high places already. Whatever it is, as long it is not a fee seeking dealmaker Investment Banker that started as a phone operator stockbroker feeding on breadcrumbs commission. Even an economist can give 2 projects to husband.

Set-up

Another theory going around is that it is Tan Sri Gani Patail is going to squell. If so, it should be interesting. Remembered Tan Sri Abu Talib making a statement that Gani should not be part of the illegally established Special Taskforce he set-up.

Why did he say so?

A latest incident in the court that may have missed everyone attention is Dato Rosli Dahlan managed to get MACC and government to apologise. It has implications including Gani's application to the Bar.

The person believed to be a proxy to "RM27 million of illegally obtained money" and believed to be part of the set-up to create perception of RM8 billion MAS lost was earlier acquited. Many parties sued by Rosli including Tan Sri Musa Hasan and media have apologised.

The perception created by RPK was Tan Sri Musa, Tan Sri Abu Kassim and Gani had set-up Rosli and Dato Ramli Yusof. Has the perception become real?

Are there other cases of perception, diversion, set-up, and incompetence like what happened to Dato Dr Khir Toyo, Pulau Batu Putih, PKFZ, Anwar's black eye case and many others?

Off course, another theory will be on PAC's report. How will ANC spin?

This blog started hinting way back in April 2015 that the person responsible for the crap faced by 1MDB was first CEO of TIA / 1MDB, Dato Shahrol Halmi.

But, the problem with many people out there is they do not read and lack sensibility in their logic. Seldom they are too quick at making simplistic assumptions based on limited public information.

Generally, there is a tendency to swallow every bull the old man dish out like a cow feeding hay at the hands of it's owner even though there exist a long list of erroneous facts.

Since then, we been inserting the fact that it is Jho Loh and Shahrol that is supposed to be investigated and not simply blame on Dato Najib. Patience must have run thin when it was blurted outright in the postings Presumed Guilty II and Presumed Guilty III in February this year.

Today, PAC report confirmed what we have been saying all along. Najib should not be held accountable but it is the management, specifically Shahrol as the one with the fiduciary duty is at fault and the culprit.

The Star reported that "The management had repeatedly not complied with decisions and orders made by the board of directors or the management took its own decisions before going though it with the board of directors."
 
"There were also a few investments and huge loans secured that were done without proper valuation and its impact on the company's cash flow, said PAC."

In another The Star report, "1MDB management did not inform the directors about the joint venture proposal letter dated Aug 28, 2009, or the proposed terms of the joint venture project that were agreed with PetroSaudi."

Another report mentioned that the Petrosaudi venture "was done without a due-diligence process; there are no specific details on the project stated on the proposal paper that was prepared by management and no feasibility study was done". 

In contravention to the Company Act, the "board of directors was repeatedly given inaccurate information" by Shahrol.

Shahrol has exceeded his authority and undertaken illegal transaction. He should be investigated and if necessary, charged. His irresponsible act have caused serious problems to the country's finances and reputation.

He was equally incompetent for not doing proper evaluation and taken into consideration the funding of IPP acquisition

For someone with a background in IT, he has been extremely arrogant to the point of calling Maybank as "bank kampong". The arrogance was either a cover for his wrongdoings or was getting big headed for transacting complex off shore banking transactions without Board authorisation.


Not only was Najib not accountable, PAC report specifically said that allegation by Tun Dr Mahathir that RM42 billion had disappeared was proven wrong.

Despite being wrong and is supposed to apologise, his response was to feel sorry for "guilty party". He cannot shed his political hat to speak the truth but made a bigger lie to accuse RM50 billion had disappeared. Perhaps he was kidding but it is wrong time ad wrong place.

Another person unable to shed their political hat was Tony Pua. The PC to present the PAC report was made by Vice Chairman of PAC, 6-term DAP MP for Kepong, Dr Tan Seng Giaw. It was him that said Najib is not accountable.

But Tony Pua insist to put a political spin to apply a clause to maintain his politically motivated blame game on Najib. He cited Najib's position as Chairman of the Advisory committee.

He must have taken his cue from Lim Kit Siang. It could also be his practise in managing his Singapore PLC company to the ground by passing even implementation and operational issues to the Chairman.

It shows the greed of politicians in the quest or desperation for power. A veteran journalist whose been doing a "gempaq" and no more as journalistic in his writings, have also been proven wrong but again.

He quickly turned around and demand enforcement agencies to continue investigation [Read FMT here]. Will he stop slandering Najib? He should and owe Najib a big apology. The man is late in his age.

The PAC report highlighted 5 key findings and recommended to adopt Putrajaya Committee on performance in the Green and Blue Book, avoid excessive debts, strict control by BOD, abolishment of Board of Advisory and transfer subsidiary companies.

The board of directors was also cited for being weak by PAC. They have duly offered to resign en-bloc. Credit where it is due, Tan Sri Muhyiddin Yassin first suggested to do so when he first went vocal on 1MDB.

Shahrol has issued a statement to deny any wrongdoing. For someone in hot soup, that can only be expected. It is tough for him to escape the hands of the law for superceding the board of directors and carrying out major decisions without BOD approval.

In the first place, why was an IT person involved in IT transformation and integration and with an attitude be given a task unrelated to his expertise? [Read in Malaysiakini and Kinibiz]

He was the guy who suggested the trimerger of plantation companies into Sime Darby for the getting more value out of the three asset. Imagine an investment banker doing a deal from an idea by an IT guy.

And yet for all his blunders, he is given an important position in Pamandu.

Does Dato Idris Jala think he still has the competency and integrity for a job there to boost public delivery and performance? So what he studied at Stanford.

A diplomat finished his term abroad and returns home.

Since he is a politician and UMNO Division head of Bachok Kelantan, there is reception for him at the airport.

It is quite the usual ritual of welcoming a "party boss" back.

However, a few Kelantanis were excited with this development and viral the above Facebook posting. Wonder why are they excited?


It's really no big deal but this blog did put up a posting to suggest or predict that the next Bank Negara Governor should be either Awang Adik or Wahid Omar. [Read here]

Dato Dr Awang Adik was earlier groomed for the position, before Dato Mohamed Ibrahim. If anyone remember, he was a Director General of LOFSA.

Ibrahim may have gone to Harvard. But Awang is no small change. He went to the same Alma Mater as Zeti at Wharton @ University of Pennsylvania, Philadelphia.

Zeti and a certain foul mouth banker have been lobbying hard against Awang by using the excuse it should not be a politician.

But through years, no comment heard of ex-politicians like Robert McNamara, Paul Wolfowitz and Christine La Farge assuming positions as Chairpersons of World Bank and IMF.

In fact, she accepted accolades from the same network of people.

Central Bank governorship had seldom been selected from within BNM. It could have come from any background - auditors, bankers, civil servants, diolomats and even colonialist.

Why Zeti "memandai" to dictate the PM a successor when through the years she never put Ibrahim in the forefront but dominated the limelight all for herself?

Presuming Awang would resign from his political post or maybe not necessary so depending on the definition of civil servant, his background as former Deputy Governor of BNM also follows a past precedent.

In case any "Melayu mudah lupa", the great late governor Tun Ismail Ali used to serve at the Malaysian Embassy in Washington DC, US as a civil servant and diplomat.

It is quite OK then for Awang to follow the footstep of the great man. More so for Awang who served as Ambassador.

It would mean the son-in-law to the successor of Tun Ismail may not be the choice. Too childish and too much his own self for such an important government post.


One concern with Awang as expressed by an officer in BNM is that he may be a wee bit "relax" and not as firm and swift in his decision on operational matters.

BNM need to buck-up in the area of monitoring and enforcement which is in the allay of Dato Nor Shamsiah. [Read previous posting here]

They can't put together evidence case agsinst 1MDB but still adamant to penalise them.

Her new concept out of thin air and dreaming we are already Wall Street or City made BNM slackened and CIMB a mess.


Guess she will not be Governor and be reassigned elsewhere within the Civil Service just like Solicitor General Dato Azailiza [read here].

How's the date with a former boss at IOI Mall last week?

Awang may have picked up quite a lot of experience and he will bring more experience and exposure if given the post.

Another concern to come with Awang's appointment will be the petty issue of more Kelantanis in the civil service.

Tun M made sure Ku Li never ascend to PMship because he believe Ku Li will be clannish and bring up more Kelantanis to the forefront in government.

Anyway Awang may still have the kampong in him but he has left Kelantan since age 12 to study at STAR Ipoh.

At least, Awang is friend-ly party and not green but blue. Furthermore, better Kelantanis than another Geng Loceng or another K as in Keling in high places.

Better a Kadazan or Kayan or Kenyah.

One elderly K even invited foreign intervention to topple the government in the betrayal tradition of another K, Raja Mandeliar.

Thought a light casual Sunday posting on Dato Dr Awang Adek's return back to Kuala Lumpur would remain as it is, light and casual.

But, no ... we were beseiged by SMS, Whass App meesages and calls from friends expressing reservation.

It went till late into 2:00 AM intersperse with other conversation on Johor politics and Ibrahim Ali trying to run on PAS ticket for Pasir Mas for next GE.

Excuses range from too many Kelantanis in civil servants, him being a politician, and resemblance to a cigar chomping Rani Kulop in suits.


It is not Malaysia without accusations of Awang did this and that at MOF, KKLW, TNB, and various outfits till his short lecturing stinct at USM.

Quite sure the allegation will fall to pieces the moment details are sought and logic disputed. Does not need to even talk of evidences.

One Geng Loceng cannot not express a four letter response. In fact it was two words into one.

Must be from poor upbringing. Otherwise, he would not have back a hypocrit who made a RM42 billion lie and seek for foreigners to re-colonise the country like the history of Malayan Union he loves to repeat

Anyway it is not a confirmation. Just pulling the legs of Kelantanis friends and ANC pentaksub Zeti chapter.

Saw somewhere one oppo portal had at one time predicted it to be Dato Abdul Wahid Omar. The posting title predicted Wahid but posting conyent was doing copy paste of news from media.

Yes, supposed it is Wahid Omar. Whay say you?

Still a friend-ly candidate. More friendly personality than the seldom misjudged as aloof Awang.

He is a competent banker. Maybank did way better than silver-trayed CIMB.

Honest, Mr Clean and by the book chap. Good fearing and pray 5 times a day Muslim. No questionable stories of him.

A man of humble background from Kamping Melayu, Johor Baru and has not forgotten his roots.

He is unlike other Governor with Johor roots. There were quite a few.

The late Tan Sri Jaffar Hussein came from the aristocrat of Parit Bakar, Muar (pronounced Muo).

While, Zeti is a truly Johor aristo family that dominates Johor corridor of power and academia. Her family members are practically the whose who of Malay politics, civil service, millitary, academia and business.

Save for Tan Sri Ahmad Don from humble Pontian but illustrious MCOBA.

Wahid will follow the tradition of ex Maybankers of late Tan Sri Jaffar Hussein and Tan Sri Ahmad Don assuming BNM Governorship. Both former bosses to yours truly.

Both are accountants like AWO too.

There is another accountant as in Tan Sri Aziz Taha. Seems to be a favourite of Tun Mahathir at one time. Just kidding.

And Wahid follows another precedent of former EPU head being appointed Governor.

With exposure in banking, economic management at EPU and managing corporations, it will be useful for the governorship position.

Najib could free one Minister position to push someone able to develop new economic sectors of growth and the ecosystem.

Should it be Wahid, it will be something to be proud from an Alumni whose members are dying breeds and not increasing in numbers.

Who knows the next Governor too could also be from Maybank and ANSARA Seremban.

More important for 'Zakar" and 'Zikir Naik'

The presence of an Indian Muslim interfaith debator, Dr Zakir Naik attracted 30,000 in Kuala Terengganu but agitated some segment of Hindu that IGP had to initially cancel the scheduled Melaka do. 

The Hindu were upset of a statement Zakir Naik made during a debate with a Hindu in India that had offended them.

It is quite the usual exchanges in an inter-faith debate about my religion is right but your's is wrong. The Muslims seem to feel nothing wrong with that, but when something is said about Islam, they can be equally emotional.

Keling being Keling, they can dished out but lack patience and tend to be emotional and easily agitated when are dished back. They now take their dispute into our country.

Some will say Malay or Muslim can be the same too. We will not dispute that.

Anyway wattaheck, lets not be hypocritical. All religion bitch about other religion. It is not the ideal thing to do but it happens all the time, in the open or behind close door.

Muslims say something about Christian's trinity and Christians make remarks about Allah moon god and Prophet Muhamamad having many wives including a child.


So the Christians should not be offended about the close door session to Muslims at UiTM about Christian threat. An organised and focused evangelical movement for mass conversion of Muslims to Christianity in this country is an open secret.

Why should they be upset of Muslims discussing among themselves of this threat?

To Christians, propagating Christianity is a cardinal duty. Guess it is same of all other faith, Muslims included, to propagate God's message. Each faith's version of God's message, off course. Except for Buddhist, Christians or Muslims or Hindus are fanatical about this

Diversion'


When Hindraf and Indian members of DAP got vocal and demanded to get this "satan" out of the country, it is no more about Zakir Naik's deemed offensive words to Hindu in India. It has turned political and the motive to agitate an interfaith conflict for next GE is obvious.

And, they went to the point of dramatising a bomb threat of P Ramasamy.

It serve to make it difficult to tahan this racist agitators. At one time, he challenged Malays to reignite May 13. Police should have taken him and his counter party for trying to invoke May 13 again.

What we cannot understand is what does May 13 got to do with Indians or Hindu? So this Indian dog is minding for DAP. These days DAP got Malay dogs as in Amanah with Dato Nizar Jamaluddin and the horny entertainer and Tun M's pinch hitter, Mat Sabu as part of package.

Deputy CM of Penang could be creating a diversion for Lim Guan Eng who is a hot soup over suspicion of corruption in the purchase of his home in Jalan Pinhorn and the link to the development of Taman Manggis.

Frankly as an Facebooker wrote here, it is "buang masa".

It's a Keling problem!

Another thing we cannot understand is why these Kelings have to bring their conflict at Tanah Besar Keling to this country?

And to the point of doing a wayang Tamil.

May have offended some Mamak when we said this frankly this morning. Allow me to explain. 

We have been living in peace and harmony with great tolerance for various races and religion.

By right, Malaysian Muslims should stop bringing such preachers from India and Indonesia but instead be preaching to these countries how to live in peace and harmony.

Zakir Naik comes from a country with long history of clashes between different faiths and races. His combative style of debate is the wrong orientation for Malaysia.

Off course, we expect to get criticised from fellow Muslims for saying so.

One argument claimed that although Muslims are minority in India, Zakir Naik is free to give public talk on differences of religion. He even operate a television program on Islam viewed by millions of Muslims and non-Muslism.

They claimed no incidents of quarrel between Hindus and Muslims. Yes, sure ....

Generally, the Muslim public and "ulamak" came out in defense of Zakir. [See one of the FB dedicated for Zakir here].

They see no issue with Zakir. He is said to have been open and inviting to dissenting views in his dialogues. Sure, it is to whack the bugger to pieces.

But they argued that Prophet Abraham went to the extent to destroying idols and blamed it on the Principal deity for it to prove his point. It may be suitable for the times so they felt it is all well in a public debate.

They also see Zakir have been quoting from the Quran and Hadith, so what is wrong.

Our concern is whether he is interpreting it right in accordance with epistemology of knowledge or just literal self interpretation.

Security concern


The Muslims have generally criticised IGP for being cautious in maintaining peace and harmony.

They  cited Zakir as a former recipient of the Maal Hijrah award. Islam is "official religion" but who is ruling and dictating things around?

The mamak IGP has since conceded.

A response can only be expected from the Hindu. So do not be surprise a radical Hindu preacher be brought in from India.

Interestingly, our opposition sympathiser friends are coming out to defend Zakir.

They were so open and liberal on the kalimah Allah, Anwar's sodomy conviction and many other interfaith issues in-sync with PKR, pre-GE 13 PAS, and various left leaning Muslim NGOs.

This time around, all Muslim groups and political parties, including PAS and Amanah are for Zakir Naik to speak.

Bet they would not mind to see Zakir speak in Penang at Ramasamy's area in Peral. The combative Zakir would not mind.

We have been following Zakir and the late Ahmad Deedat for years.

Yes, they are great debators, capable at the power of reasoning and serve the purpose for their more hostile environment.

So you think you won a debate but does it serve any porpose, more so it's suitability in Malaysia.

We did not notice him saying anything out of the ordinary in such debate or dialogue.


However, the extent of Zakir's combativeness have gone to the point of insulting Hindu God, and have been reported to not be received well by Muslims and Muslim clergy in India too [read here and here].

From a security point of view, Zakir's presence can be suspiciously dangerous.

There is the suspicion that he is preaching Wahabism, and defender of ISIS. He is allegedly funded by Wahabi of Saudi and the Saudi never deny Iran's accusation of them funding ISIS.

There is nothing seriously wrong with Wahabi or more accurately the Salafi. They are generally Sunni and in many areas we are quite in agreement.

Problem with Wahabi is they tend to simplify things and brand other Muslims not in sync with their practises as kafir. We will not rewind the incidents in Kelantan and Terengganu.

There is a tendency to be militant like ISIS. Will expect someone say Saudi donate because Malaysia is against ISIS. 1MDB also has syiah Qatari as partners. So leave 1MDB out for a while.


It is hard to identify Wahabi. Like the syiah, they have a tendency to practise taqiyah till the situation suited them. Sometimes they could blurt out like the You Tube video here, allegedly.

One indicator of a Wahabi is their animosity towards syiah as Zakir demonstrated. 

Some say Zakir argued using power of reasoning and logic. It is useful tool for debate but religion if based on faith. Theology is body of knowledge developed over centuries. Is it guided by knowledge or simplistic logic?

Wahabi, syiah, Islam Liberal and anti hadith all use logic and end up misguided. Who is Zakir's guru?

Some say he is a good debator and converted non-Muslims into Islam. Unfortunately, oratary skill does not impress us. One aspiring Prime Minister had great oratarial skill.

It goes back to the characteristic of preachers or pendakwah. A pendakwah should have three important qualities; ilmu (knowledge), amal (application of ilmu) and adab (proper and exemplary conduct).  

Zakir serve a certain purpose but may not be exemplary for Malaysia.

So does the likes of Perlis Mufti Dr Asri, and "Ustaz" Azhar Idrus that do not potray the right adab. We are not just being partisan as we have reservation of pro-BN preachers like Dato Mashitah, Dato Kazem and those brown envelope driven ones.

The Perlis Mufti and former MB of Perlis, Dato Seri Shaidan Kassim have been at the forefront in questioning religious establishment and preaching Wahabism.

It goes to the ridiculous point of Shahidan wanted to organise a debate of himself against Dato Dr Jamil Khir in cabinet.

This exuberence could eventually lean towards a mild version of kafir mengkafir.

Coincidentally, Dr Asri is supportive of  Zakir Naik.

The religious establishment is playing the role of protector of faith for the masses.

To understand this, refer to the mystical incident between Sunan Ampel and Sheikh Siti Jenar in preserving the faith and practises of the masses. Those outside the mainstream religious approach should keep it within their circle.

Since we are touching on mysticism and sufism, Zakir Naik is not important to argue over. He could be another celebrity preacher which usually does not add much to existing body of knowledge.

More important that our "zikir" is embodied within our heart and soul and reach heaven. Focus on the this month of Rejab to prepare for Ramadan.

 Equally important to some is their obligation and responsibility of a Zakar Naik. Quite sure Zakhir would agree.

To debate or not to debate, MACC?

The Rahman Dahlan vs Lim Guan Eng debate is set for April 19th, next week. So stay tune to TV3 for next Tuesday night.

MACC has called on both parties to not proceed with the debate through a statement by the Chairman of the Special Committee on Corruption, Tan Sri Zahar Ujang.

It seems Tan Sri Abu Kassim is shunning away from making any public statement. It is sad that there is a perception that MACC is now #1 enemy of the state.    

Hope the silence has got nothing to do with this posting here. It does not mean this blog stopped supporting MACC in their fight against corruption. Just like parents spank their kids because they love them, it is the same.

It is to make sure MACC do not go on the wrong path.

Out of political expediency, both sides seemed to ignore MACC's advice. It is wrong to have the debate since MACC Act 2009 stipulated in Section 29(4) below:


It is not good because both parties in the debate are in Government and Ministers. Both should respect the law and not do political theatrics outside the ambit of the law. They will be no better than Mahathir's democrazy ways.

Furthermore, the debate only complicates investigation. Same like leaks complicates investigation and put pressure on authorities to do the wrong thing. 

After several exchanges of challenges, name callings and threat of backtracking, Guan Eng could not wiggled out any more. He may not want to respond to bloggers but DAP had to brave it out and insist he accept the challenge after Rahman Dahlan gave an open poser of 15 questions.

The 15 questions is leading to a conclusion that Guan Eng had allegedly and consciously purchased a bungalow for cheap in exchange for sale of a state land meant for low cost housing at below market price to a company that is not qualified but won through tampering of the tender process. Work never got started but there is proof that the land was to be sold for "atas angin" profit of RM59 million.

A 5 questions poser by a blogger and facebooker Lim Sian See in which Guan Eng will not answer is worse. A yes to all the questions would mean he is screwed.

Guan Eng had to brave it and face the public. The important facts and proofs against him is out there in the open.

One blog made a series of 30 postings against him that practically covered all the issues. The first posting here and the 30th posting here. The pre-series posting here asked whether MACC is afraid to investigate Guan Eng.
 
To-date, that is not true.

MACC had went in and investigated Pang Li Koon to Guan Eng. It is was done faster than the 4-month wait for MACC to interview Dato Najib on SRC, political donation and 1MDB.

Our sources at KOMTAR (and we do have including within vicinity to Guan Eng's office) said Guan Eng was served a warrant to declare asset, office ramsacked and computer confiscated. All within days after the investigation file opened.   

MACC had announced that investigation would be completed by end of April. By then, the special committee from among ORP members will be formed.

Most likely, Attorney General could not reject the IP this time because everything will be so transparent that the ORP meeting will be telecast LIVE on TV3 to avoid someone say or leak something different from the press release.    

No grumbling please

The allegation MACC was giving them special treatment to Guan Eng is not true. However, MACC should not grumble over such open scepticism against them.

There was an MACC report made in 2010 on the Jalan Pinhorn bungalow but nothing happened. So do on the Taman Manggis but file was only opened recently.

It is a natural response of certain segment of the public to turned sceptical of MACC. The Taman Manggis issue had been talked about openly for so long. The UMNO fella got sued by Guan Eng and had to make an apology.

Things get done only when there is a big public commotion.

MACC should not be hypersensitive towards blog Masterdedah that wrongly accused a Penang state MACC officer of trying to clean up evidence for Guan Eng.

Such incident happened before in the big financial scandal against late Dato Nik Aziz's son-in-law, Ariffahmi. It is an open secret in Kelantan that MACC officer helped to clean-up the minutes of exco meetings. 

PAS was so confident of their kaki inside MACC that former Perak MB, Dato Nizar Jamaluddin throw a challenge to show PAS commited corruption. Perak MACC head then was openly friendly with PAS that they could harrassed family member of a then UMNO exco to force admittance of guilt.

Anyway, MACC denied Masterdedah's suspicion in a Bernama report here taken from FMT. The officer pow (blackmailed) a police officer.

Stories of MACC officers and top officials pow on AMLA suspects are abound. There is also a rumour that Kevin Morais is not that straight and it is not about his sexual orientation.

Distrust

Returning to the debate, Rahman Dahlan is not likely to manouver himself to be candidate for UMNO VP. Unless Dato Musa Aman or his brother Dato Anifah Aman do not contest, it may not likely to happen.

Though it raises his political profile, the debate may serve the purpose of cornering Guan Eng and keep the issue burning in the public psyche.

Also there is a distrust towards MACC and other government outfits in taking actions against opposition.

Partly due to the presence of government sceptics and opposition supporters, particularly Kelantanis in the civil service. And, partly due to a Malay government officers lack of confidence in dealing with non-Malay oppositions.

There is a widely held belief that opposition can get away away with murder. Remember ROS and the issue of DAP AGM?

There is also a perception that MACC will KIV cases.

The memory of then Director of Investigation Dato Mustafar Ali saying Dato Suhaimi Ibrahim will be charged next week in the case involving welfare fund still rings a bell. It broke out in February 2014. What happen to the case? Why Tan Sri Gani Patail didn't charge?   

While opposition and anti Najib group believe MACC is being stifled, there is a belief that MACC is not as straight as a Chinese hair and the wayang involving the 1MDB/SRC episode strengthened their perception.

As a result of that incident, there is much talk of the town of this Dato or that Tan Sri government official has got money stashed away from blackmailing of the accused. There is even talk that someone benefited financially in helping to frameg Najib.

All this is happening because too much wayang was happening including Dato Rohaizad posing with Kit Siang and gang. MACC officcers never took picture with those making reports.

MACC is not going to charge a certain deposed Minister or a celebrity's husband because someone up there is buddy buddy with the accused. Who knows, maybe smitten by the pretty girl-next-door look singer wife. 

And the MARA Inc case has it's strange twist and turn. Why only apprehend the suspects for questioning now when all had provided the same answers to the same questions some 7 months ago? Is it helping someone make a comeback?

It is an open secret that the former Chairman is aligned to a certain politician. Someone could badly trying hard to pin the politician to win some brownie political points for a comeback.

The mystery of that case is why didn't MACC go to Australia to investigate. The real hanky panky happening involving the Malaysian developer being sued in court for not paying his contractors could open to more credible lead.

Talking about leads, what happened to the U-Custom tender that was even raised in Parliament in November 2013. That project was supposed to be delivered but is heard to be extended for another 14 months!

The system does not work. The staff say it does not and will not work. IT people say it will not work. But why is the non-IT, non-Custom and due to retire Custom DG so adamant to continue. Apa cerita ni ...?

There is rumoured concern of national security risk.

These are among many issues that only built up a bad perception towards MACC that culminated into mistrust and now even Ministers had to play wayang to get things done.   

With the recent events that led to perception problems with MACC, what are they doing about Bar Council representative, Dato Lim Chee Wee that is stongly suspected to have leak papers? Rather than sulk, why didn't MACC apply their ability in manouvering to sack him.

Change with any lawyers from Persatuan Peguam Muslim. Unlike Chee Wee who support the immoral act of sodomy, the Muslim lawyers are god-fearing and morally upright.

Relief for Guan Eng, but how about for Tony Pua?

There will be no Rahman Dahlan-Guan Eng debate ...

That is the advise of police chief, Tan Sri Khalid Abu Bakar and MACC Director Dato Azam Baki. TV3 announced there is no debate. It is a relief for Lim Guan Eng as our previous posting argued.

In the meanwhile, Arul Kanda has accepted Tony Pua's challenge.

Tony Pua thinks he has got the 1MDB issue cornered with the latest development on IPIC and Aabar and his alleged missing USD7 billion. He will be surprise as Sarawak Report itself has admitted it as a non issue though still trying to point blame at Dato Najib.

Some commentator was thinking this blog was stunt by this development and not able to reply. On the contrary, My Dear Watson. Why comment over recycle allegation? Didn't 1MDB answered already last year?

Tony Pua's challenge is strange.

On one hand, he wants Arul kanda to resign but on the other hand, he wants Arul to stay to debate him. The third hand is asking for investigation on those implicated in the PAC report but yet insist Najib should be overthrown. 

Stay tune for tomorrow's posting as we comment on the PAC and the post PAC episodes. May there is some hope of enlightenment. The pentaksub ANC will never buy into it. Orang tidak dapat hidayah memang susah hendak beriman.

IGP urges TV stations to cancel planned Rahman Dahlan-Guan Eng debate

KUALA LUMPUR: Inspector-General of Police Tan Sri Khalid Abu Bakar has urged all television stations to cancel the proposed live telecast of a debate on the Taman Manggis land issue as the case is under investigation by the Malaysian Anti-Corruption Commission (MACC).

He said if the debate between Urban Wellbeing, Housing and Local Government Minister Datuk Abdul Rahman Dahlan and Penang Chief Minister Lim Guan Eng was allowed to take place, it would affect the investigations and prejudice the witnesses and the case.

"@PDRMsia agrees with @SPRMMalaysia, the Manggis bungalow debate should be cancelled. Police investigations are still ongoing. Key witnesses, including the Chief Minister have not been called," he said on Twitter on Friday night.

Khalid tweeted: "@PDRMsia asks all TV stations to cancel the live debate before the case is settled."

Rahman Dahlan-Guan Eng debate postponed
PETALING JAYA: TV3 has postponed the proposed debate between Datuk Abdul Rahman Dahlan and Lim Guan Eng on the Taman Manggis land issue following advice from the police and the Malaysian Anti-Corruption Commission (MACC).

The network, which was originally supposed to televise the debate live on Apr 19, backed down after taking into consideration the views expressed by Inspector-General of Police Tan Sri Khalid Abu Bakar and MACC’s investigations director Datuk Azam Baki.

“TV3 respects the opinion of Tan Sri Khalid and Datuk Azam that the debate may interfere with the authorities’ investigations on the Taman Manggis land controversy and Lim’s bungalow purchase,” said Media Prima Bhd Group Managing Editor of News & Current Affairs (TV Networks) Datuk Seri Mohd Ashraf Abdullah.

He said a new date for the debate would be announced later.

That is a much needed relief for Lim Guan Eng and DAP.

What's out there is still not explainable, let alone defensible. Believe that the link between Lim Guan Eng and Pang Li Koon has already been  established. It will only surface somewhere and somehow near the time of the debate.

Arul Kanda-Tony Pua


In the meanwhile, Tony Pua was adding on to P Ramasamy's diversion for Guan Eng to challenge Arul Kanda him to a debate.

He must be thinking he has an upper hand in the 1MDB issue with the development in London and the new twist to his recycled allegation with a USD7 billion missing. It is still short of Tun Mahathir's RM42 billion allegation.

PETALING JAYA: 1Malaysia Development Bhd (1MDB) president and group executive director Arul Kanda Kandasamy has accepted Tony Pua’s challenge to a debate following the conclusion of the Public Accounts Committee (PAC) investigation into the government investment arm.

In a statement on Friday, Arul Kanda questioned the Petaling Jaya Utara MP's remarks calling him a liar and asking him to resign from 1MDB just hours before issuing the debate challenge on Thursday.

“It is clear that YB Tony is confused and contradicts himself. He does not know if he loves me or hates me.

“He says I should resign, then says I need to stay on and debate with him,” he said.

Arul Kanda also said that he hopes Pua, who is a member of the PAC, had consulted the Parliament Speaker before issuing the challenge.

“To avoid being embarrassed a second time, I hope YB Tony has first checked with the Speaker of Parliament before issuing this debate challenge,” he said.

Arul Kanda said that despite questioning him for two full days at the PAC hearing, Pua still wanted “to spend quality time” with him.

“Far be it from me, to deny YB Tony this pleasure.

“I hereby accept the debate challenge. Bring it on!” he said.

On April 7, the 106-page PAC report on 1MDB was tabled in the Dewan Rakyat.

This is the second time Pua has challenged Arul Kanda to a live debate over 1MDB.
Dewan Rakyat Speaker Tan Sri Pandikar Amin Mulia had said that to safeguard Parliament’s integrity, Pua should first resign from the PAC if he wanted to debate with Arul Kanda.

The Star
When Arul dare to take the challenge, it only means he is more than ready and has materials that would embarass Tony on national TV. Unless Tony badly need to be embarassed, someone need to provide him some face saving passage out of this debate.

Quit Tony, quit ...

Tony Pua maybe the politicians, vocal in Parliament and DAP's propaganda chief. He thinks he is good but he is neither a good debator or a communicator. He will get creamed by Arul.

When he speaks or raise an issue, Tony is usually convulated with facts that he can't communicate his points right or throw the right punch. It is as though he thinks he is talking to an intelligent Oxford crowd capable at digesting facts at one go. The general public hardly understand him.

It is not that he has yet to find a silver bullet that will deliver the final blow. He will never get find the bullet because he has no idea of the audience he is talking to.

He thinks his spin on an issue is sensational enough like the new spin of USD7 billion missing. Too in love and overawe with himself.

Odds are stacked up against Tony with the latest from Saudi Arabia absolved Najib again for the RM2.6 billion:



The Najib side is not just defending but attacking to demand a Mahathir apology. The upper hand is moving to Najib.

And with Dr Tan Seng Giaw statement below, ANC and opposition's faith is sealed.


If he said there exist no evidence pointing towards Najib, it is too late for him to clarify many days later that certain evidences or documents are not available. After all, it is common, be it in court or parliamentary proceeding or other other official occasion, that documents and evidences are not complete.

They did try to highlight Najib's signatories but it is no end game. Maybe it is useful in the court of public opinion dominated by the ignorant and easily swayed by propaganda. It can be easily explained and argued back thus an easy comeback to do.

Withdraw la Tony ... trust me, withdraw or be embarassed.

Tony Pua prematurely ejaculated on Aabar BVI

As of tonight, Lim Kit Siang's blog team dedicated four postings with their typical paragraph long titles on the latest revelation by the IPIC announcement to the London Stock Exchange [read here, here, here and here].


They must be thinking 1MDB is cornered and the bogus company Aabar Investment PJSC Ltd (Aabar BVI) will expose Dato Najib's scam to embezzle money from 1MDB. Tony Pua was trying too hard in the PAC to corner Arul Kanda and place the blame on him.

Sarawak Report could only confirm former Aabar CEO Mohd Badawy Al-Husseiny was the signatory for the bogus BVI company and used it as the vehicle to embark in various deals with 1MDB. Arul is not wrong to just stay put and insist they have proof and dealt with the Aabar and IPIC top executives.

Tony was too overzealous to create a sensational political story that could lay the blame on Dato Najib. and subsequently, repeat the call for Najib to resign. No wonder he has yet to find the silver bullet to finish off an issue he has been dwelling on for the past two years.

His problem is premature ejaculation. Shooting off too soon.

In SR's posting dated April 14 entitled "Mohamed Badawy Al-Husseiny Was The Signatory Of Bogus Aabar Company - EXCLUSIVE!", the Ap version provided the following documents:

Based on SR's given documents, which is still not subjected to any verification, it only proves that the former Aabar CEO established the bogus company. The opening line of the Ap version of SR emphasised that point.


Even the collusion with his Chairman Khadem Al Qudsi is not established. And there are many unverified claims and linked by SR.  

For Tony to try lay blame on Arul, he cannot fathom that it can be easily dispelled. All these happened during the tenure of Dato Shahrol.

Furthermore, PAC made a consensus to recommend further investigation on his conduct as CEO. Tony was a signatory to that consensus though he changed his mind upon realising he lost the political thus say he is only 80% satisfied.

The practise of PAC is for those with dissenting views to prepare a minority report. Unless he does so, he should just shut the duck up.

This would also be a turn-off for Tony.

To quote Limbang MP Hasbi Habibollah, "The PAC report finally proved that all money and funds were accounted for and all transactions have been verified. No money or funds have gone missing. It was also proven that there was no element of crime or misappropriation of funds as alleged." 

Tony's intention can be easily gauged. Sometime ago, WSJ made the following chart:


According to WSJ in which it is better not to believe Rupert Murdoch's newspaper, the allegedly funneled money via Aabar BVI ended up in Red Granite, the production house where Riza Aziz is a partner.

It is written extensively by SR that Jho Loh had a role in assisting Riza to raise financing of the award winning film, Werewolves of Wall Street.

Tony Pua is too "gelojoh" (reckless) and impatient to link it to Taek Jho Loh, Datin Seri Rosmah and her son from a previous marriage, Riza Aziz. Subsequently lay the blame on Najib and stress the demand for his resignation.

Few commentators couldn't resist the temptation of applying that same conspiracy theory and assumed our silence as stunt and cornered. All these is old story so why need to comment.

It is indicative that substantial number of Malaysians especially among the anti Najib and opposition suffer from premature ejaculation for being to presumptous, too quick and simplistic in making allegations. 


What need to be done is to prove that 1MDB under CEO Shahrol was aware of the bogus Aabar BVI company and yet still proceed to advice PM to allow remitting the money. Or more sensational is to prove that Najib is aware of this bogus company but still proceed.

As PAC concluded, it needs further investigation to establish certain facts.

Just like all the allegations against Good Star as conduit to siphon US681 million that later was alleged to appear in Najib's personal account, the facts need to be establish first as to who owns Good Star. Show the documents with the list of shareholders.  

What majority people believe or perceive is of no consequence. They may not be following the issue closely or have too many missing links in their understanding.

If the anti Najib and opposition wish to do a propaganda to promote the WSJ chart, the least they could have done was to begin with a foreplay. It needs the right level of excitement and anticipation before the exposing more sordid details.

However, if they wish to deal in the truth and justice, it is already a wee bit too long to await for them to lay out the evidences with facts and figures. With the old man still wrong in his latest RM50 billion liability instead of RM42 billion missing, only indicate they may have none.

IPIC pullout: Get the popcorn, but no need yet to call "bomba"

Just when the rationalisation was going on smoothly and Arul Kanda can comfortably say his job is finish, thus only to maintain the 1MDB shell company, something is bound to happen.

It has been this way everytime some good development about to happen.

Arul said at the end of March that 1MDB will be debt free within weeks. And indeed it did. 1MDB had just received the RM9.83 billion from sales of Edra.

They immediately settled the RM950 million standby credit from the Government, RM150 million financing facility from Exim Bank, and RM2.0 billion debt from purchase of Powertek. Some RM7.25 billion debt repayment were made.

1MDB came out of the exercise with cash surplus of RM2.3 billion in which it would not happen should RM42 billion went missing.

Off course, the ANC will always be up to something. If it is not some expose, new or recycled, it could be like the extensive nitpicking on the PAC report.

This time it is the first deal that Arul Kanda announced upon joining 1MDB.

IPIC was reported this evening to pull out of the debt-for-asset swap. Malaysiakini was quick to spin it as "rescue plan terminated".

Come to think of it, the rumours of the termination had been making it's round in August 2015. It could be a rumour to trigger the event.

We remembered Arul had to go to Dubai to finalise the debt for asset swap thus unable to appear at the PAC proceeding last year and it was used by Tony Pua to start his attack on Arul.

The day the deal was announced, we were in a meeting at Putrajaya and the remark was things will be smooth sailing hitherto.

The Aabar BVI affair was certainly the dealbreaker as speculated at the end of last week.

Still, it is premature to assume and presume anything. There could be the other less conspirational side behind the Aabar BVI existence. WSJ is not always right. SR spin and fabricate negative stories excessively.

1MDB explained the dispute that led to the pullout by IPIC. MMO reported below: 
1MDB says unsettled interest payment due to dispute with IPIC

KUALA LUMPUR, April 18 — 1Malaysia Development Berhad (1MDB) today admitted that an interest payment due to its bondholders today has not been made due to a dispute between the state investment fund and Abu Dhabi’s International Petroleum Investment Company (IPIC).

“A dispute has recently arisen between IPIC and the Issuer concerning, among other things, the Issuer’s obligations to IPIC and IPIC’s corresponding obligations

“Consequently, at the time of the settlement, the Issuer understands IPIC has not paid the interest,” 1MDB said in a statement.

The bond interest payments due is for US$50 million for US US$1.75 billion bonds issued by 1MDB’s energy arm 1MDB Energy (Langat) Limited.

But the firm stressed that it would be able to meet all other financial obligations.

“1MDB wishes to make it clear that it and its group entities will meet all of their other obligations under any other financing arrangements and have ample liquidity to do so,” it said.

According to Reuters, IPIC said today that a June agreement to provide financial support to 1MDB had been terminated after the firm failed to meet obligations to the Abu Dhabi fund.

IPIC said in a bourse filing in London the Malaysian state fund and the Ministry of Finance had failed to meet obligations including to pay US$1.1 billion plus interest and was now in default.

While the obligations of IPIC and its subsidiary, Aabar Investments, under the June agreement had now been terminated, the Abu Dhabi fund still expected the Malaysian side to honour its commitments.

IPIC said it was now considering all its options to remedy the default, including referring the matter to the appropriate dispute resolution forum.

Under the June agreement, IPIC agreed to provide US$1 billion in cash as well as assume US$3.5 billion of 1MDB debt.

It also forgave an undisclosed amount of debt owed to IPIC by 1MDB, in exchange for assets that have not been named.
IPIC to lose more


Lim Sian See made an explanation of the situation in her Facebook. It is reproduced in full below: 
Making sense of the IPIC announcement that it wants to terminate on the Asset-Debt Swap deal with 1MDB.

Today's announcement by IPIC is prompted by a USD50 million (RM190m) coupon payment that is due tomorrow on part of the USD3.5 billion 1MDB bonds that are guaranteed by IPIC. 

After settling off RM14.25 billion worth of loans over the past month after completion of the Edra deal, 1MDB still have RM2.3 billion cash.

This means 1MDB can easily pay the coupon payment but according to the Singapore Straits Times quoting MOF officials, PM Najib had apparently told 1MDB not to pay.

These bonds are not guaranteed directly by the Malaysian govt (which is why it is not part of the RM5.8b govt exposure as per the PAC report) but by IPIC with a back-end guarantee by 1MDB the company.

In the event of the USD3.5b bonds default, they will call the guarantor to make good first. 

If IPIC refuse to make good then the rest of their IPIC bonds which is worth more than all the 1MDB loans will default. 

It's like playing chicken - and IPIC has a lot more to lose if they allow these bonds to default whereas Malaysia's losses are limited.

This means that the likely scenario would be that IPIC will pay up the interest and then sue Malaysia to recover the amount.

However, 1MDB believes they have already transferred all the USD4.5b assets to IPIC/Aabar (these were the assets to be swaped with the USD3.5b + USD1b payment from IPIC) as it was on the direct instructions and with full paperwork by the MD of IPIC, the Chairman and CEO of Aabar as well as the due diligence done by the lawyers and the international auditors since then.

IPIC/Aabar, however believes otherwise and claims they have never received the money - but somehow have agreed to transfer USD1 billion, pay the USD110m interest on the bonds previously and also cancelled the Aabar options even though they claim they have never received all these payments.

These money is not lost but is in dispute. If Najib had songlaped the money, he would have asked for the coupon to be paid instead of stopping 1MDB from doing so.

This means 1MDB believes it has a strong case when it comes to litigation over IPIC.

It's a risky strategy however but I believe that this is the best option for Malaysia to take right now to get the IPIC/Aabar guys to own-up and take responsibility that they have received all these assets.

Yes, get the popcorn ready. Lots of it because there is the possibility of litigation and it will be a long one.

From what's heard so far, 1MDB and MOF are confident and believe they have a strong case. Documents are in place. It was instructed by the management of IPIC.

Why would IPIC/Aabar cancel their options over 1MDB's power assets and allowed Edra to be sold to the China company if it had not received any payments from 1MDB and all payments were made to company not controlled by IPIC?

These options were the reason why they were so nice to guarantee the 1MDB USD3.5b bonds in the first place. So, why give up the options if no payment was ever made?

It is neither "deadly development" as exaggerated by SR's Clare Rewcastle nor attempt towards a deception by WSJ in December 2015. They didn't quite get the figure right back then.

We would have preferred it to not reach that stage as our Abu Dhabi friends did not plan to be in this predicament. After all, they are in a similar situation when two key person of the Dato Najib died in a heli crash.

Quite sure there are better diplomatic and legal resolutions. Too early to call the "bomba", but can call the first CEO dumbo. Kasi malu orang Stanford!

It does not matter whether it favours Lim Guan Eng or Dato Abdul Rahman Dahlan to cancel the debate.

The long and short story is it is subjudice to the investigation to have the debate. One can refer to Section 29 (4) of the MACC Act 2009 here.

Both of them are still dishing their last word. Better stop or they could end up in the same cell together. Then they can debate without any interference from authorities.

However, there is no audience to hear Rahman's unanswered issues. Guan Eng side had plan to play up on a Rahman error on the per sq feet of land value vis-a-vis property value.

Frankly, the debate serve no purpose. Both side will be grandstanding.

The concern now is the mistrust against MACC has culminate to what seemed to be an act of "marah nyamuk bakar kelambu".

The dissatisfaction for alleged special treatment to Guan Eng cannot be the reason to destroy this important institution.

After the incident of an MACC Director being taken picture together with opposition, they cannot continue to be oblivious and insensitive to public sentiment.

The public reaction to MACC officials call to stop public debate is now responded with questions as to why they were silent when Tun Dr Mahathir, Tan Sri Muhyiddin, Lim Kit Siang, Tony Pua and Rafizi were happily trumpet blowing on 1MDB.

Believe Tan Sri Abu Kassim did express caution. Guess it is no good to point that out now.

Allegation that MACC was behind the leak to Sarawak Report and WSJ and the fake charge sheet is still pretty much at large.

And, it is a situation of damn if I do and damn if I don't deny for MACC. Some would not believe any denials and it would just attract attention.

The allegation that MACC was giving special treatment to Guan Eng.is not be fair. Director for Investigation, Dato Mustafar Ali denied. Sinar Harian reported:
Timbalan Ketua Pesuruhjaya (Pencegahan) SPRM, Datuk Seri Mustafar Ali, berkata pihaknya sudah mempunyai tindakan serta perancangan untuk memanggil Guan Eng dalam melengkapkan siasatan berhubung kes tersebut.

"Telah ada perancangan dan tindakan, macam mana sekali pun akan dipanggil.

"Bahagian Operasi akan menentukan masa sesuai untuk memanggil beliau (Guan Eng).

But why in heaven should he himself appear with Guan Eng in a delivering the Certificate of Integrity. The Edge reported it here.

They should have insisted it be not Guan Eng. If he goes off scot free, MACC is fried!

As a result of increasing scepticism, there is allegations that the CIP is a scam to create opportunity for MACC officers and their friends.

The claim is the Chief Integrity Officer (CIO) is a fairly well paid position that could earn RM30,00 a month thus a job for the boys.

Also MACC is made fun off for holding Solat Hajat last year. An MACC officer boldly said, "You ada kuasa, saya ada tuhan."Should have exercise some restrint.

Now the reply is, "Tuhan sudah ke mana, MACC sudah takut sama Tokong ka?".

A blog Masterdedah accused an MACC officer for attempting to clean up evidence for Guan Eng. After it was denied and the officer admitted guilty in court, new allegations of cover-up and attempt to hide surface.   

It is also launching a campaign against certain MACC top officials here.

This is not good and it is unfair.

Lying, spinning and slandering is a big sin. The case against Guan Eng is close to completion. Believe that the link between Guan Eng and Pang Li Koon has been established. Procedures have been applied. He did not get special treatment.

Applying pressure could obstruct investigation and backfire on PM. If they want Guan Eng's blood, the other side will want PM's blood.

As supporter of the current government, we should defend this important institution. It is not the first time that government institutions were abused by irresponsible officers or politicians. Never has it come to the point where supporters of the government ended up destroying the institution.

The opposition always blame the government for compromising the integrity of public institution but it is them that never respected the law, and public institution.

It should remain so. Since Tun Dr Mahathir is on their side, they do not have to raise it too loud. Ask the man himself.

To be fair to the supporters, MACC should accept their mistake for being seen as overzealous on the PM but could be perceived to cover less relevant politicians like Dato Suhaimi Ibrahim. Which Thursday will he be charged, Mustafar?

If not for these government supporters, MACC would be left undefended in facing the DAP onslaught on the death of Teoh Beng Hock and Ahmad Sarbaini.

At the end of it, MACC and other enforcement agencies should be professional and not involved themselves with any political agenda. They should do their job without fear or favour.

If they could be fearless against Dato Najib, they should be fearless against Lim Guan Eng, DAP CEC and even UMNO politicians. By not covering up the corrupt UMNO politicians, they are helping UMNO in the long run.

Assume they do not fear politicians but they should remain the same against their own civil service peers. The talk on the Youth and Sports Minister had been around for half a decade and this blog had subtly implied so, but it seems forever before action is taken against them.

Heard any top government officials reprimanded? The level of KSU, for instance.

Someone out there is saying there are Little Napolean whose afraid to apply the law against their contemporary.

This is the root cause. Corruption is equate with authority. The real authority lies with the civil servant. If civil servants are not corrupt, politicians or their spouses cannot line their pocket.

And an enforcement agency must be god fearing and unwavered by the big dollar of the corporation and GLCs. Too much dirty money laundering circulating within the economy. It is unfair for honest hardworking citizens.

MACC must not be selective and defensive. They cannot be judge and jury to determine who they will investigate and who will be charge. They will then be equally guilty of the allegations being levied against AG Apandi.

The tarnished reputation for the late opening of the Taman Manggis file is their own mistake.

If they have God on their side, they too must be clean and seen to be clean. They must not fell to the temptation of money, power and flesh.

The mosquitio net is important to keep the nation and government intact and functioning. That affects tens of million of rakyat.

Both side of the political divide should respect it. MACC should not be playing games but be serious to ensure it's continuity. The rakyat should defend and support it.

Anyway, election offers an opportunity to see the people coming out and to hear their concerns, grouses and hope. It is the time to see the real Sarawak, the Malaysia that we in Semenanjung are totally ignorant about and took them for granted.

We talk of Vision 2020 to be a developed country but some of our countrymen are still struggling with the basic necessity of life.

In Semenanjung, we politicise everything. Political quarrels are endless.

Yet despite the shortcomings, our East Malaysian countrymen live in peace and harmony. Not merely tolerable of each other but accepting each others' existence. 

There is no specific plan for this trip.

All on ad-hoc and spontaneous basis. Hope we get to see much. As for happenings in Malaya, maybe need to leave that all behind for a couple of weeks.


Have to get on board for the first leg of today's journey. Will continue later.
