YTL's new IPP venture an insult to the Johor Sultanate institution

The Johor State Government heeded the widespread voices against the Johor Housing and Property Amendment (JHPA) Bill to be tabled at the State Assembly tomorrow. [Read Utusan Malaysia, Bigdog and The Star

Hopefully all troubling clauses to the effect of giving the Sultan the absolute discretionary power be amended. The concern of all parties, opposition or goverment, politicians or activists/media, are that it could demean the institution of Malay rulers.

Public listed businesses and public policies are open to public scrutiny thus it puts the Malay rulers open to public critics and at times ridicule, as experienced by government-side politicians

This raises the question of YTL riding on their partnership with the Sultan of Johor for a new IPP project in Johor.

Since it was not done according to the proper open tender procedure already in practise, YTL had demean the institution of Malay rulers, specifically the Johor Sultanate.


In Bigdog's posting here and our past posting here, Crony Capitalist YTL had only few days ago won a Project 4A IPP venture project supposedly based in Johor, without undergoing proper open tender procedure and had used the much questioned direct negotiation tender.

Their so-called "innovation" had put the Sultan of Johor in a bad light to the public.

YTL's existing controversial PPA contract with TNB for their first in Malaysia IPP is due to end. In his pursuit to get the contract renewed, Tan Sri Francis Yeoh would have likely invited his Majesty into a new IPP venture, SIPP Power Sdn Bhd to secure a renewal.

However, YTL International Power Berhad owns 68% in SIPP Power. The 30% minority partner is SIPP Energy Sdn Bhd, in which 51% is held by the Sultan of Johor.

Obviously, YTL is in the driver seat with equity and management control in SIPP Power but it is the Sultan that will attract public scrutiny for Francis Yeoh's unsavory backdoor approach to securing the contract.

YTL supremo, Tan Sri Francis Yeoh is all too familiar with the open tender procedures for new IPP. He  had participated and lost in a recent tender despite his so-called financial and technical capability. [Read in our past posting here]

Disgraced the Johor Sultanate institution with his unsavory business practises

By dragging the palace in order to improve his chances in securing the IPP contract renewal for his company's benefit, he had indulge in a business transacton in which the procurement is made inconsistent with known public practises on IPP tender.

Francis Yeoh has disgraced his Majesty and the Malay Ruler institution in the eye of his subject.

Seriously, his Majesty should withdraw and insist that the award be re-tendered with proper governance, accountability and transparency. .

In addition, words emanating from within YTL is saying Francis Yeoh had told his Managers and staff that he is not worried with the uproar on the just concluded JHPA. He claimed that Johoreans can be tamed because they blindly submit to the Sultan.

If this is true, it tantamount to insulting the institution of Malay rulers as though they could be riden on and abused for his business pursuit.

His Majesty should distance from such businessmen of unsavory character and carries a bad public image which only taint the image of the royal family.

There are Bumiputeras that can be taken as partner by His Majesty in which they are as capable,  knowledgeable and most important, ethical in their conduct of of business.

If his Majesty pursue such smart partnership, it would send the signal that his Majesty has not foresaken the Malays in favour of Chinese in pursuing business interest.

Furthermore, the institution of the Malay rulers is entrusted by their forefathers to protect and defend the Special Rights of Malays and Pribumis of Sabah and Sarawak as prescribed in Article 153 of the Federal Constitution.

The social media is abuzz with talks that few Ministers will be dropped, recently won MP, Dato Mah Siew Keong of Telok Intan and Dato Liow of MCA will be appointed Ministers with some shuffling of an MIC Deputy Minister.

No ... we are most uninterested to predict and suggest names for an impending cabinet reshuffle. As far as we are concerned, Dato Najib should have placed his men and women when he assumed Prime Ministership and bleached both the cabinet and election candidate list. 

Thus, we are not writing to demand for Dato Hasan Malek to be dropped. He may have said many wrong things at the wrong time and in the wrong manner thus get himself spinned the wrong way. In fact, we have wrote of him back back in January. [Read here].

Let us leave the decision on his Ministership to his boss.


Hasan had been spinned and made the butt of conversation by the opposition when the press highlighted a remark he made. "Kalau ayam mahal, makan daging lain." Subsequently he earned himself the terrible title Menteri Chap Ayam.

His old school ways of communication and talking to the press and alternative media only made it worse. Below is some sample of his quote that had been lampooned by opposition:


As a result, Hasan Malek was seen as a liability in Dato Najib's cabinet when what happened was that he was misunderstood.

But, some dude among the alternative media pulled a fast one on him to spread a rumour that he would resign. His response was to make a police report. Oh gawd ... that does not help his cause, does it?

Is it a crime or threat to national security to spread rumour of someone resigning from their jobs? If so, the police should place special branch officers to track the office gossips of all company and government canteens.

Bank Rakyat 


When former Minister, UMNO Secretary General and Bank Rakyat Chairman, Tan Sri Sabaruddin Chik revealed Deepak was given a foregiveness of interest and allowed to pay his outtstanding loan in installments over a long period, DAP jump on the political opportunity.

They tried to paint a picture to imply that there was some hanky panky going on between Deepak and Datin Seri Rosmah. The repayment was seen as a show of force to impose on the Chairman and Board of Directors of Bank Rakyat. [Read Bujai's critic here.]

There have been other strange going-ons between Deepak and Bank Rakyat as we pointed out in our series on UEM Sunrise [read here]. However, we are not so much concerned with what Deepak do as a businessman till we are aware of the specific infringement/(s).

What was heard is that Deepak had borrowed some RM60 million and it was approved by the Board of Directors headed by Sabaruddin. He got into a problem ... biasalah berniaga. But, he paid back some RM330 million already including liquidating his FD.

He has a balance of RM30 million in which he offers a layway plan.

So there is no interest charged. That is normal in any scheme in the repayment of bad loans. The only problem is and it relates to why there are many bankruptcis in this country is because the ducking Banks are lazy and heartmess!

They only want the easy way out of  bankrupting the defaultor so that they could account for the loss to be written back manipulatively as profit when it is repaid.   

On this part, Hasan Malek is right. What would the Bank get back by bankrupting a resourceful businessman? Give the defaulter a lease of life so that he can repay back the loan. Lucky for Deepak that he got someone to talk to the Minister. Life is never fair, OK?

Imagine how many thousands of young people whose life being made difficult by Bankers just because they are lazy. The Banks were so eager to give them credit cards with a plural but when it got out of hand they pull the umbrella when it rains. These young people cannot get jobs and had to live on meager income. How the duck could the Banks get their right back?


Sabaruddin is only angry because his Chairmanship was not renewed. He got it when his former Political Secrertary, Dato Ismail Sabri was Minister. At least, do realise that it is a different Minister now.

Sabaruddin had not cooperated with Hasan Malek. The Minister's power is merely in the appointments and he has exercised it accordingly. He has not interfered in the running of the bank. So what is the issue?

To put blame on Hasan, it is not fair. It was Sabaruddin who approved the loans to Deepak. By right, Sabaruddin should be charged under BAFIA like Rafizi Ramli for disclosing bank secrecy. Deepak or anyone could make a police report and it is done deal.

KPDNKK


If you do not know what is KPDNKK, then refer to our article here on diesel sumggling. It is the Ministry empowered on matters of petrol and diesel subsidies.

Utusan Malaysia have been on the prowl on the diesel smuggling issue from Sunday, for today and believed to be tomorrow too.

We are not about to make fun of Hasan Malek for the droplets of seizure done by KPDNKK Enforcement team in Ops Titik. [Read here] It is already covered in our previous posting in which we believe the Government officers in Hasan's Ministry are on the take and all these are merely a cover-up.

Still, it is not Hasan that is being accused but certain public civil servants. So it is unfair to ask for Hasan's resignation. At least he showed the same concern with the Prime Minister on subsidy leakage despite Ops Titik is really a token effort.

We know that the major bust is coordinated by the Special Taskforce since it involved a high level and multi-agencies effort. KPDNKK is not empowered to undertake such kind of operations but allowed to take credit.

Our major concern with KPDNKK's Ops Titik is that it is scaring the bigger fish. Someone is giving the big boys a helping hand.

However, one issue with the current illegal diesel operation concerns a son of a VVIP and the VVIP is likely to be a Minister. He has been selling diesel confiscated by KPDNKK to wholesellers at 70 sen per liter.

Another source claim it is bought at RM1 per liter and illegally shipped to the Phillippines. Assume the retail price in the Phillippines is US$1 per liter. Go ahead and do the Maths.

To do this trade, there must be license and KPDNKK had issued a special license over an existing license for a bona fide operator. this information came from an honest KPDNKK officer. Hope Hasan address this or he could be misunderstood again.

Recently Hasan had made an announcement on a new system for managing diesel and fuel subsidies. [read Rakyat Post through here]. That had got the public fuming and politicians, BN and PR, demanding a review because it is not a practical solution and open to abuse.

Again, Hasan is seen as a political liability by BN. Critics were leveled at him to demand his dismissal or resignation. In his response, Hasan denied only consumers earning below RM5,000 are given subsidy [read here] and there are bloggers and social media activist defending him albeit immaturely. 

In FMT report here, KPDNKK Secretary General, Alias Ahmad said government will introduce a new system beginning this Sept 1 to ensure the sale of subsidised diesel and petrol is only to eligible commercial vehicles. He said a similar system for private vehicles would be implemented in October or November.

One source deep inside MOF suspect that it relates to the fuel subsidy card system that will be implemented and someone have been confirmed the contracts. Her fear is that all these raids are only for show to get the public to agree. It will end the moment the fuel card contract is awarded.

Hasan needs to look at our proposal in the last posting that were written in bold blue. Or he will be misunderstood again.

Zairil seemed to be too scarred to raise an issue by himself and he needs another DAP MP, Steven Sim to be by his side.

With the comfort of each other, the two idiots repeat the same irritating issue of Tan Sri Muhyiddin's overseas travel to Dubai in April.  This time it is Australia. [Read FMT here.] Zairil must have thought it is an issue of significance.

The last time these two idiots raised such issue, it was given an answer and it turns out their information was embarassingly wrong [read in Unspinners here and here.]. Can's understand why they would still be pursuing an already debunked line of allegation.

Thus, the DPM Office should not waste any more time to answer any more of such wasteful adolesence pestering. If Zairil insist on an answer on the pretext of public accountability, ask him this: Is it true that he is an illegitimate son of the man he used in his name as his father?

Questions

His date of birth and the year of his mother's marriage to his claimed father, Tan Sri Khir Johari does not tally. His place of birth in Hawaii only adds to the negative perception of himself trying to ride on the name of Khir Johari. As a public figure, he should be transparent and accountable on his  background. [Read Wikipedia here]

If Zairil is not comfortable answering such a personal question, then he should answer to his voters at Bukit Bendera how many times had he attend Parliament throughout the times it had been in session?

How many times has he stood up to deliver a speech or an address or participated in a debate? After all, DAP claimed he is a "thinking politician". It is no use thinking when one do not communicate. At least, he would have issues from his visits to his 'kawasan' and the feedbacks he gets from his constituencies. That is unless he hardly visit his constituencies.

So he is still a junior MP and has not reached the level of familiarity with Parliamantary rules even though those of his piers are already actively involved. Maybe Zairil prefer to get to the basic role no. 10 as a problem solver to his constituencies.

How many problems has he involved himself? How many gets solved? It should not be too difficult for him since Penang is a DAP run state. If Zairil's answer to all these questions posed are not satisfactory, he should learn to know where your station in life before trying to be a pesky irritant to the DPM.

Small minded


Quite sure the Deputy Prime Minister has more important task to do than answer to such small minded issues. Off late, DAP has been on this dumb mode since they saw their more than 7,000 majority overturned into a lost in Telok Intan.

MP for Kluang, Liew Chin Tong made a petty issue of Foreign Minister, Dato Anifah Aman much travel and place the blame of alleged poor communication of MH370 crisis on him. [Read The Malay Mail here]

Does the highest vote gatherer in the second questionable DAP CEC election thinks that a Foreign Minister should spend more time in the country and Kimanis?

Bigdog's comment reads:
Probably Liew’s mental capacity and intellectual inability is unable to fathom that simple logical notion. The fact that the MP for Kimanis to play this role and translate Malaysia’s foreign policy and international stance and position effectively, the he had to physically present himself with his counterparts or even world leaders ahead or preceding Prime Minister Najib’s visit, speeches and/or requests.
Liew must be spending too long a time in a forest off Kluang with no television, handphone and Internet to not be aware to whose portfolio MH370 belongs to.

Bigdog again:
Liew should start to politically educate himself to think before he shoots his mouth. Then probably Chinese Chauvinist DAP could present itself as a worthy member of the Oppositions’ coalition as the Federal Government if and when Malaysians could be hoodwink to give them power to rule.

Bigger problem

Back to Zairil.

He should realise that he is a mere minnow pulled up by Lim & Son Sdn Bhd. From someone who did not make the first time around DAP CEC, an Excel technical problem enable Zairil to appear out of the blue to replace a top five winner of the top 20 list.

The DAP CEC election and the subsequent CEC election remained not acknowledged by the Registrar of Societies following complains on the suspicion of rigging. That should have been the bigger issue for DAP to look into and Zairil to reflect hard  of himself.

Lim Guan Eng has appointed him as Political Secretary.  Surely Zairil is all too familiar with his boss's public image as a liar, arrogant and heartless leader to the minorities and lower economic class from all races in Penang.

To pick on Tan Sri Muhyiddin's travel plan will not help deviate attention from Lim Guan Eng's unpopular decisions to charge RM3 bed tax on hotel occupants, increasing water charges, non-existent rakyat housing policy, increase in parking rates, etc. More problem to come as Penang is increasingly building a reputation as haven for crime and sex.

Zairil should also help clear a lingering rumour that his boss went on a first class airline travel for Christmas vacation to Italy paid by a friendly corporate player several years ago.

He could be that "intellectual politican" DAP claim him to be if only he has the guts to raise Guan Eng's vacation that was paid by a taukeh in Parliament along with his allegations of  Muhyiddin. While it could potray him as a brave politician, it is still not an act of an "intellectual politician". In fact, they would say it is stupid.

In a previous posting this week here, we posted about a son of a VVIP and likely to be a Minister involvement in the sales of confiscated diesel and inextricably linked to subsidised diesel smuggling in Sabah. It seems the illegal act is made legit with licenses.

Hopefully KPDNKK Minister, Dato Hasan Malek will address this or the son could be  misunderstood as his.

Can't understand why Berita Harian is featuring him in the front page. [Read here.] It looks like another Dato Jailani Ngah style manouvering to embarass someone before dropping them. 

It is an old problem. VVIP children and wives can be a real problem when they exert their influence by throwing their husband name.

By right, it can't be done but the likes of Puan Sri Maznah Rais, her intervention in office matters and instructing officers was legendary.

The Minister should have put his stand and make the wife or children understand that the status of Ministership is accorded to him and it does extend to family members.

Anyway, someone whispered to us of a Minister who is supposed to stand his ground but it is him insisting on concessions for his son.

There is a high ranking and reputable officer in government. He came from a certain government fund and was seconded to head a certain government agency.

He had wanted to return to his original employee but his former subordinate has positioned themselves for his post. His return would be in the way. So he is stuck and has to stay within his current government agency.

He is due to retire but is being considered for extension. He was called to see the Minister and suddenly the Minister said, "Hire my son and I will extend your contract".

He has to create a position in the agency for the Minister's son to fill up. 

In one go, it looks likely to be a conflict of interest but given to any government officer, they can find the loopholes in the regulation or the procedures to justify. Bet the officer must be thinking "damn if I do, damn if I don't."

What we can only say is that, if the son of the Minister is the same as the son of an alleged Minister involved in the diesel smuggling in Sabah, then it is a serious interest to pursue the illegal opportunity to the hilt.

Hopefully the Minister would stop his nonsense. Can he see how much slack Hasan Malek gets for refusing to extend Tan Sri Sabaruddin Chik's Chairmanship despite it is within his power to do so?

In this case, it is not within the Minister's power to do so. Worse, he is using threat to get that someone to do something ethically and perhaps, regulation wise, wrong.

Ole Ole ... Orange!

We are One (Ole Ole Ola)

Holland gave reigning World Champion, Spain 5-1 drubbing in the opening game of the Group B match. A sweet revenge for their extra time defeat to Spain in the last final in 2010. 

Four years ago, we rooted for the old masters of the game. There is history behind the Dutch team and on that score alone, we felt they deserve to win the last World Cup. Again for the third time, the Dutch came out empty without the coverted Cup in football.

With that huge win against Spain, did the Dutch started out on the right foot?

Before giving our retired bettor's view of the game, let's see the video of the goals:


One thing that need to be noted is that at the World Cup level tournament, team tradition carries a lot of weight in ensuring success at and beyond the quarter final level. Based on that belief, winning the last World Cup was not meant to be for Spain.  

For newbies team, their objective is to survive but for the top teams, the early rounds is meant for building up the momentum and understanding within the team. At their levels, the players hardly had much time to play together as a team to develop the teamwork and clockwork six sense precision of each other.

The 5-1 win is a good indication of the teamwork developing for FIFA 15th ranking Dutch but it could build unrealistic expectation for the upcoming matches. The team could be easily frustrated in upcoming tighter matches as "Superman" Robin van Persie and Arjen Robben will be closely watched.


Another high ranking team, Chile at FIFA ranking 14th will be a testy match for the Dutch in Group B.

As far as Spain, we've seen many reigning World Champions like Italy and Argentina could not get their act together after losing or drawing opening matches. The devastating loss will be too much for Spain.

If we are still betting, we would have avoided the Spain-Holland match. We would have bet for the Dutch but since everybody would want to take Fifa #1 rank, Spain but not willing to give the goals. No bets can be made there.

As for Brazil opening match, we would have taken Croatia for 2 goals. Brazil is every other person's preferred team, so cough out the goals.

From the bettor's point of view, Croatia start the game with a 2 goals lead and Brazil will need to score 3 to win. A 2 goals win will be just even. No money there.

Despite the score, the game does not show the brilliance and flamboyance of the Brazilians. There was nothing spectacular.


They gave Croatia a 1-0 lead with an own goal. Neymar scored 2 goals and Oscar scored a brilliant third goal to seal in the win for Brazil.

However, Neymar's 2-1 lead from a penalty came from a questionable acting by Fred. Shame on Brazil. He should be banned for the tournament.


Croatia almost got an equaliser immediately.

The domination and flamboyance of Brazil was not there. In fact, they almost fell for the opening match jinks to the better playing Croatia.

For star-studded Brazil to win the World Cup, they have to be brilliant as a team and as individuals. Otherwise, no South American and African teams can match the more disciplined, methodical and strategic European teams.   

So far, the home court advantage and claim by Brazil Head Coach Felipe Scolari that "This is the World Cup that Brazil will have to win" only bring in more pressure and stress on the players.

It will not necessarily help Brazil win the World Cup and a vision of the Brazilians bowing their head in defeat can be seen. Survey by Mail Online, Sports website of the year saw 65% view Brazil will not win the World Cup.

Ooo la la, Lopez

Nevertheless, the World Cup will remain in the domains of the old giants with footballing tradition like Brazil, Germany, Argentina and Italy. Not even, FIFA 5th ranked Switzerland. The stage is too big for such emerging team to do well.

However,, it would be great to see old favourites like young building French team and two times champion and FIFA 7th rank, Uruguay do well.

And please forget former fluke winner, England. They can't control the ball and dominate a game. Only rely on long ball and lucky counter attack. That is no way to win a World Cup.

Just because EPL is popular in Malaysia, do not think they are actually a great team. Bet against them and one will sure make money. Used to make tons of money against England.

Enjoy tomorrow's 6 AM game of England vs Italy. Viva l'Italia!

However, the team destined to win a World Cup will be Holland. Hopefully it is this year.  That will mean a repeat of a back-to-back final appearance in 1974 and 1978.

Groundswell against YTL but pro-PKR The Edge defending

This picture just got in of TNB staff unions demonstrating against the company from having anything to do with YTL.

In Kg Chubadak, the 40-year original settlers of the village is up in arms against YTL and authorities for denying them land grants but gave the faceless corporation YTL the land title to evict them. 

Words are that teachers all over the country are furious with the YTL's Bestari.net which failed to deliver their system, is being seen as having pre-emptive intention to "cheat" the Government.

All it takes is a spark for a nationwide demonstration against YTL, which could be far bigger than the TNB demonstration.

With all of these happenings, it is strange that The Edge, owned by pro-Anwar Dato Tong Kooi Ong, is defending YTL. Read below and note the bold words:
EC justifies award of Track 4A on direct negotiation

KUALA LUMPUR: The Energy Commission (EC) has emphasised that the engineering, procurement and construction (EPC) portion of the Track 4A power plant project in Johor must undergo a competitive bidding process, in a bid to justify the award of the project on a direct negotiation basis.

The controversial power plant project was awarded to a local consortium via direct negotiations earlier this month.  The consortium consists of YTL Power International Bhd, Tenaga Nasional Bhd (TNB) and SIPP Energy Sdn Bhd, which is linked to the Johor royal family.

“In consideration of the medium-term planning scenario and current operational parameters, it was decided that there is a need to fast track the construction of a combined cycle gas power plant using proven technology that was scheduled to be operational in 2020, to an earlier date in 2018,” Minsiter of Energy, Green Technology and Water Datuk Seri Panglima Dr Maximus Ongkili told the press after a session in Parliament yesterday.

The EC had decided that the best way to meet this requirement was through a conditional offer while still stipulating the need for competitive bidding for the EPC portion.

“The Track 4A project was awarded with [the] condition that the technical and commercial proposals are acceptable to the EC while the competitive levelised tariff must be comparable to the last tender exercise. Hence, the allegation of unreasonable tariff rates for the said power purchase agreement [PPA] should not arise at all,” said Dr Ongkili.

“The Cabinet considered all angles before taking this decision to fast track the planting up of the 1,000mw to 1,400mw plant,” he said, adding that the project was awarded to the consortium based on the competitive rates offered in the recently concluded tender exercise for Track 3B.

According to previous articles in The Edge weekly and the Financial Daily, the need to fast track the planting up may have been highlighted by the recent power disruptions across Peninsular Malaysia which affected six states. The unplanned outages involved 3,860mw, comprising 3,000mw by TNB generation plants and 860mw by independent power producer (IPP) plants.

TNB was forced to import electricity six times from Thailand and twice from Singapore this year in order to stabilise the grid and restore power to the states. Due to permanent deration, the installed capacity in 2014 had to be revised downward by 450mw from 21,509mw to 21,060mw.

Dr Ongkili said the electricity generation reserve margin in the peninsula is “no longer comfortable”.

“The reserve margin in 2011 was at 6,341mw or 41% of the installed capacity and the average actual operating reserve was at 3,822mw or 24.7% of the installed capacity. In 2014, the reserve margin is 4,159mw (24.6%) and average actual operating reserve is at 1,510mw (8.9%),” he said.

“The government is deeply concerned by this major reduction in actual operating reserve and hence instructed the ministry to review the planting up of power plants for the next 10 years.”

In an article with similar title in The Edge publication dated June 9th, the attempt to promote and defend YTL is more prominent.


The Edge wrote that the profit margin for project 4A is razor thin and technical requirement is stringent. Read below:


They claimed it is high financial risk to justify a higher tariff than Track 1's 34.7 sen /kWh. Direct nego and higher tariff.

Hmmm .... YTL has gotten too complacent or greedy since Dato Seri Anwar Ibrahim raised the tariff for the first IPP to enable Anwar's crony in Realmild enjoy a higher tariff and profit margin.

In their attempt to defend albeit in a transparent style, The Edge quoted TNB officials reluctance to comment on diret nego and land issue.


The land could be the hidden jewel in the deal.

And The Edge tried to champion YTL's new technlogy that was the reason they lost in another IPP tender to 1MDB.


That is one among many reasons The Edge is endlessly bitching about 1MDB. In last week's issue, they were recycling an accusation made of 1MDB on issues that had been thoroughly answered.

Controversial Johor power plant under scrutiny after royal flap, Yeoh crony remark

A controversial multi-billion ringgit Johor power plant deal is coming under close scrutiny as part of a backlash against tycoon Tan Sri Francis Yeoh's (pic) now famous speech on cronyism and widespread concern over legislation that would have given the Sultan of Johor executive powers in the state, say sources.

Yeoh's YTL Power International Bhd, the Johor ruler's SIPP Energy Sdn Bhd and national electricity provider Tenaga Nasional Bhd have been awarded the Track 4A combined gas cycle project that could generate up to 1,400 megawatt (MW) of power under a controversial directly-negotiated deal.

There have been allegations of secretive meetings in London attended by officials from the consortium and a senior minister of the Najib administration. Also being openly talked about is the involvement of a family member of Prime Minister Datuk Seri Najib Razak in the promotion of the new IPP or independent power producer.

But it is only in recent days have the press started lifting the veil on the award of the project. At the same time, members of the Energy Commission have been on the defensive over the award of the Track 4A power plant through direct negotiation, instead of conducting an open tender.

This latest development is largely due to Yeoh's infamous comments that Malaysia must do away with crony capitalism and take advantage of its ethnic diversity to gain greater economic achievements and compete globally.

At the Global Malaysia Series forum run by Putrajaya's efficiency unit Pemandu, the tycoon had allegedly said that 85% of YTL’s businesses were in Britain, Singapore and Australia because these countries did not tolerate corruption, practise meritocracy and stand for the rule of law.

“For example in Singapore, we own a third of Singapore’s electricity; there is no subsidy of any kind, there is no cronyism of any type.

“The good thing about these three territories, I don't have to kowtow to the prime minister before I do a deal, I don't have to see them even, even after I’ve won the deal," he was quoted as saying at the event.

Yeoh later clarified that his words were misrepresented and apologised but it was too late and he has been savaged in the media by Umno politicians and former prime minister Tun Dr Mahathir Mohamad whose administration gave YTL its first power project.

At the same time, there is concern about the Johor ruler, Sultan Ibrahim Sultan Iskandar, who was in the news last week over his role in a housing and property board law that some say would lead to the throne being involved in government decisions. A slew of last minute amendments to the proposed enactment limited the ruler's role but the new law has yet to be signed into effect.

Barisan Nasional (BN) sources say Putrajaya is making overtures to the state ruler to find another partner for the project as there are also objections from TNB worker unions over YTL's participation in the Track 4A deal.

The SIPP-YTL consortium had earlier bid for the RM11 billion Project 3B to build a 2,000 megawatt (MW) coal-fired power plant with its closest competitor being the government's 1Malaysia Development Bhd (1MDB).

The Malaysian Insider understands that the consortium was deeply upset that it lost out to 1MDB in the larger power plant project and made its displeasure known to Najib and members of the Energy Commission.

It is uncertain if the government awarded the 4A power plant in Johor to appease the powerful and well-connected members of the Sultan of Johor-YTL consortium.

Energy, Green Technology and Water Minister Datuk Seri Dr Maximus Ongkili said earlier this month that Putrajaya had considered all options before awarding the project to the SIPP-YTL-TNB consortium.

“Everything is in order. The Cabinet considered all angles before taking this decision to fast track the planting up of the 1,000 MW to 1,400 MW plant.

“The terms are being finalised by the Energy Commission,” he said, adding that there was a condition for the Engineering, Procurement and Construction (EPC) portion of the project to undergo competitive bidding process.

But there is growing pressure for YTL to drop out of the consortium to prove that there is no crony capitalism in Malaysia apart from pressure for open bidding for the entire project. – June 16, 2014.

In the case of Bestari.net, teachers will be a bigger and louder number to handle.

It is incomprehensible that the Internet line put in place by YTL for Bestari.net is only for 4MB line which is too small, and the school have to pay RM280 per month. Our Unifi home use is 10 MB and  cost hardly RM200 but still too expensive.

Some civil servants must be taking something from YTL, which is their usual modus operandi to pay off insiders. There are lots of senior civil servants past and present in their payroll but it is the politicians that gets the blame for ill-advised and ill-informed mistakes from the "civil service".

Don't tell me about modern rules on land ownership, titles, land grant, and the various legalities. This is all man-made laws and regulation that can be adjusted should there be interest to seek social justice.

Even though, this is just a matter of the heart and probably there had been a settlement offered, a Kuala Lumpur High Court Order in 1998 to give the people of Kg Chubadak that started the village. Mostly the subsequent legal process did not favour them

The point is there is rationale to give the land to them. But to whom will the land to be given to?

The land supposedly belonging to the Kg. Chubadak squatters made "paupers" will be given to the  YTL monopoly prince living in a new avant garde palatial home on a hill.

KUALA LUMPUR, June 16 — Wahidah Md Salleh, 73, had the worst day of her life a week ago.

Officers from Kuala Lumpur City Hall (DBKL) forcibly packed her things in a truck and told her to leave. Then they demolished the house she had lived in for nearly 50 years in Kg Chubadak Tambahan, Sentul.

When DBKL returned on Thursday, Wahidah was ready.

She faced her tormentors in angry defiance, a picture of her taken that day immortalising her uphill struggle.

With her right fist upraised, her other hand on the wheel of a yellow backhoe loader with the letters “DBKL” on it, the photo has been making rounds online, including in a poster emblazoned with the words “Capitalist Bastards.”

“Oh dear, I looked like a crazy woman,” said the chatty religious teacher, laughing when The Malay Mail Online met her in the village over the weekend and showed her the photo for the first time.

When asked what drove her to confront the DBKL, she replied: “I was angry. I was angry of constantly being manipulated all these years.”

In 1998, the Kuala Lumpur High Court decided that the land belonged to the people who like Wahidah had started the village. The court added that if the area was to be developed the people must be compensated with an amount equal to the value of their settlement.

However by 2008, DBKL had listed down Kg Chubadak Tambahan as squatters’ settlement under the 2020 Kuala Lumpur City Plan, together with five other villages.

On Monday last week, three houses were demolished by DBKL as part of a clearing process that had started in 2013 in order to make way for future development.

Originally from Lenggong in Perak, Wahidah moved into Kg Chubadak in 1968 when she married her bus driver husband, Halim Hamid, who had already been staying there for four years.

Halim, now a frail man of 75 with bad hearing and eyesight, denied that the villagers were squatters as labelled by DBKL, and explained that they were pioneers who had settled there for decades.

“It was Datuk Harun who brought us here,” Halim said, referring to Datuk Harun Idris, the Selangor mentri besar who served between 1964 and 1968.

“He asked us to open up the land, so that more Malays could stay. Starting from there, one by one all of us arrived.”

He pointed out that originally there were only three families — two Malay and one Pakistani — in the former mining plot, while the surrounding area was mostly occupied by Indian labourers.

The village was allegedly named Chubadak after a place with the same name in Sumatera, Indonesia, where some of the original settlers came from.

At its peak, Halim said there were over 200 families who migrated to the kampung from all over the country, but they have mostly left after developers took over most of the lands, paying out RM7,000 for each family and a house in the Batu Muda People’s Housing Programme (PPR).

According to Halim, the developer had bought over the land from the Land and Mines Office, which had neglected to take note of the villagers’ status as urban explorers.

The demolition was, however, temporarily halted on Thursday after NGOs and PAS representatives managed to obtain a High Court injunction, staying the demolition until the case is heard on June 26.

With less than two weeks left, Wahidah and Halim have vowed to live out the remaining days in their garage which was left untouched. They are keeping guard against any move by DBKL to stealthily knock down the few remaining houses in the village.

“I will defend this village to the death. We have been here even when this was a horrible place. Now they easily want to take our lands away from us,” said Halim.

“We are the only ones who are still strong-willed,” Wahidah said, pointing out that she had made a pact with her neighbour and best friend, Mahwiah Daud, 58, to see out their remaining days in the village.

“People advise us to just move out, but they do not know the pain of fighting for our rights,” said Mahwiah, also a religious teacher.

Mahwiah’s house was also torn down on Monday, but her family of ten cannot move into the tiny flat provided for them because it still lacks electricity.

Mahwiah’s husband, quantity surveyor Abdul Hamid Mohd Saad, 60, has since pitched a tent in front of their demolished house and filled it with several sofas, where the four spend most of their time enjoying the cool breeze during the afternoon.

“After this, we might not see each other again like this. We were neighbours here, but we would not be anymore in the flats. This is what I am most sad about,” said Wahidah.

The two women also said that they would miss tree-filled patch of land behind their houses where Wahidah reared chickens.

“Even if the government could give us a little bit of land, that would be great. We could at least plant chillies,” said Mahwiah, who said that they were previously promised landed houses in Tanjung Karang, Selangor.

With the Muslim fasting month set to start at the end of June, the families also lamented that they would be celebrating Aidilfitri elsewhere, not in the houses they have lived in for so long.

“Every time I am saddened with my fate, I try to console myself: I am a Muslim, I can fast anywhere,”  Wahidah added.

As as DBKL is concern, they are merely doing their job and carrying instruction. By right, UMNO Seceretary General and Minister for Federal Territory, Dato Seri Tengku Adnan Tengku Mansor could something.

In final plea, KL mayor tells Chubadak folk to move out, not squat

KUALA LUMPUR, June 17 — Datuk Seri Ahmad Phesal Talib urged villagers recently evicted from their homes in Kg Chubadak Tambahan in Sentul to move out to the flats awarded by the Kuala Lumpur City Hall (DBKL) instead of illegally occupying the land.

According to the Kuala Lumpur mayor last night, the villagers’ decades-old houses were demolished because the land no longer belongs to them, as it has been sold to developers who now have the right to develop the area.

“You have to understand, the land belongs to somebody else. But we still try to solve the issue, even when they have settled on private land,” Ahmad Phesal told The Malay Mail Online last night.

“They have to move out. We have let them to stay in a better condition. It is better than living in that area. Until when do they want to occupy other people’s land?”


The evicted villagers were awarded RM7,000 for each family by the developer, and a house in the Batu Muda People’s Housing Programme (PPR).

However, some have complained that they cannot move in yet as there was still no electricity supply.


Ahmad Phesal was attending a meeting last night with residents of five heritage villages in the Gombak area, but a resident had pointed out that Kg Chubadak was absent from the list.



The mayor told The Malay Mail Online that residents from Kg Chubadak were not invited as they were not involved with the road upgrade exercise DBKL was proposing last night.

The proposal was however met with resistance from most residents from the five villages, who do not wish to give up their land.

Despite that, he insisted that Kg Chubadak, Kg Chubadak Tambahan, and others in the vicinity also count as heritage villages.

Datasonic pre-determined for fuel card contract?

In our posting seeking not to misunderstood Domestic Trade, Cooperatives and Consumerism (or the Malay acronym KPDNKK) Minister, Dato Hasan Malek [read here], this blog dropped a hint on an upcoming scoop related to an impending fuel subsidy management system said to be implemented on September 1st.
One source deep inside MOF suspect that it relates to the fuel subsidy card system that will be implemented and someone have been confirmed the contract. Her fear is that all these raids are only for show to get the public to agree. It will end the moment the fuel card contract is awarded.
Since TV3 in Bulletin Utama yesterday evening [try at Tonton.com here] reported Hasan Malek welcoming any suggestion to their on-going study but revealed that a decision is coming up soon, it  only confirmed the information of our MOF source.

Another source told us yesterday that the EPU under Dato Abdul Wahid Omar had pre-decided that the fuel card system will be used despite Hasan's invitation to any suggestions. In addition, the fuel subsidy management system has been guaranteed to a consortium led by Datasonic Berhad.

High government officials with vested interest and neo-liberals with insidious agenda are not interested to plug the leak on subsidised fuel to lessen the government subsidy burden but are only interested to make a buck out of public misery.

Agenda to abolish subsidy


It is strongly believed that the consumers' subsidy allocation will depend on their monthly income and car size used. In our past posting then, it was mentioned that many parties have reservation to the system.

Penang Gerakan expressed concerned to the possibilities of widespread abuse and smuggling and possibilities of system problems to consumers. [Read FMT here] There is the political opportunist opposition claiming concern for the poor. [Read opposition news portal Malaysia Chronicle here].

And, there are the self-centred neo-liberal capitalists demanding the total abolishment of subsidies based on the expected lax enforcement and exploitative consumer behaviour. [Read FMT here]

Extracting from FMT, Maybank research reported:
According to Maybank’s research unit, Malaysian taxpayers tolerate up to RM7.0 billion in subsidy leakages every year as the result of diesel and petrol smuggling to foreign countries.

The International Monetary Fund (IMF) meanwhile estimates that the top 40% of Malaysians that fall in the high-income group enjoy 80% of the nation’s fuel subsidies.

A total of RM24.8 billion is budgeted for fuel subsidies in 2014, but out of this, only RM3.5 billion is projected to benefit those in the low-income group after taking into account the leakages from fuel smuggling.

In reality only 14.1% of the fuel subsidy is benefiting the low-income group while 28.2% is lost to smuggling and the remaining 57.7% is enjoyed by the high-income group who have more and bigger capacity vehicles.
Just stop leakage

And the TV3 news reported that out of the 18.6 billion liter of Ron 95 petrol used last year, some 6 billion liter (or 32.25%) was misued.


Mingguan Malaysia dated June 15 (page 12) published the subsidy spent by government on fuel. There was a strange jump from RM9.065 billion in 2009 to RM20.275 billion in 2010 which eventually reached RM24.726 billion in 2012 and RM23.458 billion in 2013.

Given our 5% GDP growth rate and about the same growth rate of vehicle ownership, the value of leakage could be about RM15 billion or 62.5% against RM24 billion subsidy.

If there are seriousness on the part of KPDNKK, APMM, MACC, Police, and various enforcement agencies and authorities, the public does not need to suffer a higher energy cost from subsidies being taken away.


Both the low and high income voters can all savour the nation's prosperity.  However, the abuse by the greedy few and the lax by authorities and enforcement agencies are denying the rest of the population a comfortable standard of living.

No ploy of getting some half bake NGO with non existent network of members could convince the public. [Read of JMM here]

Have Wahid Omar considered this or he is in sync with the pro-IMF Maybank report to just simply abolish subsidies without thinking deep enough of the economic, political and social ramification?

From what Dato Idris Jala, who is due to retire from his Senatorship and Ministership, have been preaching against subsidy and pro-TPPA, corporate man Wahid will likely be subservient to the interest of the "company" over the "consumer and staff".

His concern will only be the Government's P&L and balance sheet.  

Pre-tender award

Our source said one Chinese businessman known as Chong have been going around telling everyone in the industry that the contract will surely go to his consortium. Thus other potential bidders should save their time from trying to put up a tender.

It could be his way of psyching his competitors. He is most likely to claim that Hasan Malek's statement in TV3 is merely a smokescreen. Already he claimed PM has confirmed awarding the tender to his consortium last week.


The consortium concerned is known as Fuel Subsidy Sdn Bhd and the main player is public listed company, Datasonic Group Berhad. [The company's Investor Relation webpage is here.]

The Managing Director of Datasonic is a reknown Accountant and close to Dato Seri Anwar Ibrahim by the name of Dato Hanifah Nordin. He is the largest shareholder of Datasonic. As of the 2013 Annual Report, he owns 15.49% and via his controlled company, DiBena Enterprise Sdn Bhd, he controls 26.99% of Datasonic. [See here]

DiBena was believed to have beaten Iris Corp Bhd, the creator of MyKad [read The Star here], for the second tranche of the MyKad contract. The Bumiputera company, DiBena procured the contract and the listed vehicle Datasonic was contractor for the 2010 contact and 2013 to 2014 extension. [Read here, The Edge here and The Star here.]

Together in the consortium are Ernest and Young (E&Y) and Innovation Associate (IA).

IA is a spin-off from Ernest & Young Cap Gemini when the partner, Dato Dr Hamzah Kassim left to be on his own.

Much have already been exposed of the opportunistic endeavour of Anwar sympathier and member of NEAC, Hamzah Kassim. [Search for previous postings.]

In a Bernama report dated June 23rd, Hasan Malek claimed to want government's procurement process be efficient and transparent in order to curb leakage and wastage [read here].

However from what was gathered, NEAC may have predetermined the system and company. The other 5 or 6 bidders can only work with Fuel Subsidy.

Fairplay

These information are revealed to pre-empt any such attempt for unethical and unfair practise. If there is really a need to rationalise subsidy over major crackdown of leakage, then allow everyone a fair chance so that the public can get the best at the least of cost.

There are other companies like Sapura and MEPS who could provide the payment gateway, infrastructure and transfer system.

As far as we are concerned, Government should not waste time to develop another more costly card system but use the existing MyKad.

For security of information, it must be only local companies and preferably locally designed system used.

In a swift act to counter our expose on fuel subsidy card contract revealed on Wednesday here, the propaganda machinery behind Datasonic went on overdrive.

NST ran a story yesterday on the fuel card bid and TV3 also ran a story on yesterday's Bulletin Utama on NST story. [See it on Tonton.com here]

Smart PR move. They had to expedite the process and make things transparent. However, it is noticeable that both NST and TV3 tried to playdown Datasonic, a powerful and major player in the smart card business. On Tuesday, Dato Hasan Malek welcomed proposals but by Thursday, public is told that many have submitted tender

This so-called transparency will not hide a fact that the contract have been pre-determined for Datasonic-led consortium, Fuel Sub House Sdn Bhd. and the so-called tender result will prove so. This group got it because they are buddy buddy with Dato Abdul Wahid Omar and he had given away hint that he is not comfortable.

The public will not agree to this new system. Voters will hate the government for it. This openness is still a facade because it is also noticeable that en tender. with two major players in the smart card business; Sapura and MEPS not in.

MCA and Gerakan is right to say it is open to widespread abuse and smuggling. Address the fuel subsidy leakage and stop use of fuel subsidy to foreigners and business first.

2 more join forces for fuel subsidy plan

KUALA LUMPUR: TWO public-listed companies, Pos Malaysia Berhad and Datasonic Group Berhad, have joined forces in their bid to secure the concession from the government to manage the impending Fuel Subsidy Rationalisation Programme, it emerged yesterday.

The two companies, a source said, had submitted their proposal via Fuelsubs House Sdn Bhd, a company they formed as the vehicle to manage the programme.

“Pos Malaysia and Datasonic are also using their vehicle (Fuelsubs House) as a project manager and service provider (for the scheme),” the source told the New Straits Times.

Fuelsubs House is among the seven companies which had submitted their proposals to the government to plug the loopholes in the current subsidised fuel distribution system to more than 10 million Malaysians.

Two of the companies are foreign-based entities, one of which is based in Singapore, and another linked to former cabinet minister, Tan Sri Mohd Radzi Sheikh Ahmad.

The other firms are MyEG Services Berhad, IRIS Corporation Berhad, ICASH Global Rewards Sdn Bhd and MOL AccessPortal Sdn Bhd.

Each proposal covers mechanisms on how the government can effectively address abuses and leakages, which has cost the government in the billions of ringgit in losses, and facilitate practical implementation of the distribution of subsidised fuel.

Each company had also proposed to use either the MyKad, Fleet Card, Smart Card, Biometric, cash and coupon as the platforms to address the loopholes in the current system.

Each platform, however, would trigger a different impact on the capital expenditure and upfront payment to be borne by the government, ranging from RM200 million to RM1 billion.

Some companies also proposed that they are given total ownership and control of their system hardware and database, but the government would unlikely consider due the amount of personal data involved, especially when foreign-based companies are involved.

“The national postal company (Pos Malaysia) plans to utilise their logistic strength of more than 700 post offices nationwide to manage subsidised fuel applications from Malaysians.

“Datasonic, meanwhile, will utilise their expertise in smart card (such as secure ID or chip-based credit, debit and bank cards).”

Fuelsubs House had proposed to use the MyKad and Fleet Card as the platforms for the distribution of subsidised fuel.

“The company has also suggested that their mechanisms will not require big funding from the government and can be implemented almost immediately due to the usage of the existing MyKad and Fleet Card.”

The source said the company did not ask to be given total ownership and control over database and confidential personal data for them to manage the scheme.

“They have suggested that the data to remain under government agency, National Subsidy Corporation Bhd.”

On Tuesday, Domestic Trade, Cooperatives and Consumerism Minister Datuk Hasan Malek had said the government was in the midst of studying the proposals and only the one that benefited the people would be considered by the cabinet. The plan was expected be rolled out in September.
In TV3, Fuel Sub was mentioned as the third name with MyEg.com as the lead story. While, NST pictographic present Fuel Sub in the last part.

And, the "Chongs" are the ones moving in the market packaging the whole thing and approaching the vendors.

The name Razali Naina Merican rings a bell. Habibur Rahman is a name no many knows but we know who is this former Nestle Manager.

If there is a need for a fuel card, it must be done with transparency and fair evaluation done with all deemed qualified be given a fair bite of the apple.

No need the secrecy and rush.


These Fuel Sub people have been throwing names left right and centre. Our unhappy source claimed they have been intimidating government officers including Petronas Dagang but they couldn't show the Letter of Award.

Pos Malaysia would likely be involved in logistics. However, it will not make the public happy to have to register with Pos Malaysia to enjoy fuel subsidy.

How about those people in the interiors in Sabah, Sarawak and even Pahang where Pos Malaysia does not reach and it will take days if not weeks for the fuel card to reach? No fuel card system will be implemented there.

Are they to be denied fuel subsidy? As it is, there are. Transport cost made their fuel cost extremely expensive.

If we can read from the Joint Venture and shareholding structure, profit could likely be thin. One IT businessman told us they can't make the expected return and the cards are likely to printed in China to be cheaper. 70 sen ma ...

It will not be safe security-wise to have our cards printed abroad. It is also an avenue for abuse and a sure chaos.

The fuel card idea is not that great an idea and no big deal technology wise. Any local geek can come up with something better. Our lade source in MoF said also that these people stole someone's idea.

As it is, the fuel card proposal is missing the most important point that the bulk of fuel subsidy leakage is due to smuggling.

Our estimate in the previous posting place it at more than 60%!!!

Why the need for another card in our wallet when there are already our MyKad and every Malaysians already own one?
 
The fuel card system will be a burden on the public and will cause a backlash against government. The Government already have lots of problems to solve and deal with. 
 
Not another one please.

Remembering Father in Pengerang

Yesterday was the first of Ramadhan. For our family, Ramadhan is a sentimental occasion.

The 18th of Ramadhan was the date father passed away in 1984. After 30 years or maybe 31 hijrah years, we still miss him and wish he had been around to witness the many achievements and milestones of our life.

The image of him on his Honda cup will always remain embedded in our mind. Only the last few years of his life did he owned a car. While the children, especially the younger sibings, they could own a car within months after getting employment.

Last Friday, we did what we had wanted to do for a long time and that was to track back to a short part of his life in Pengerang, Johor. It was his first posting with the Johor State Government.

Before that he was running a sekolah arab called Ma'ahadul Irshad in Bukit Timah, Singapore. That happened after Johor State Government denied the then teacher of Madrasah Al Attas Johor Baru a scholarship to study at the great Azhar University in Cairo.

He maybe have been denied but he would have been proud that his pupil and friend got into Azhar to return and rise to become Muftis; Dato Sheikh Murtadza of Negeri Sembilan and Tan Sri Harussani Zakaria of Perak.

Harussani's wife was his pupil. One pupil returned to be his boss and the district Kadi.

Years later, mother was also offered Azhar but conservative great grandfather did not bless his granddaughter further her education in a foreign land by herself. She was married off to her Azhar denied cousin and wasn't long she bore a future blogger.

They missed their chance for Azhar but they made sure all their eight children would never be denied tertiary education. Only thing was none went to Azhar or took up any branch of Islamic study but received "secular" education.


In his first posting, father was sent to the far end of Johor in Pengerang as Government Imam for Masjid Pengerang. It was a small masjid that should be a surau. It was so small that the masjid does not need nuja or Tok Siak to maintain the masjid.


Father opt to not have a government quarter in Pengerang so that the family could stay in the government quarters in Johor Baru next to Masjid Abu Bakar and have access to good schools in Johor Baru.

He was willing to live in the masjid's store room with a space converted into his living area. The sacrifice he made.

The masjid is no more under the State Government's care but given back to the kampong folks. The state government built another masjid along the main road.

Back then, one need to take a boat from Tanjung Puteri jetty to get to Pengerang. There was no state road to Pengerang. Back then, the access road to Pengerang can only fit a car.

However, one can reach Pengerang then by road through Kota Tinggi but the traveling must be done day time. We rode a bike to Kota Tinggi once at night with Father and it is awfully dark.


Pengerang lives in it's own secluded world at the southern tip of Johor. The stretch of Johor river from Pengerang to Pontian was smugglers' haven plying goods and human.

Father's stinct there was short and we remembered visiting him twice during the school holidays. It must be in 1970 because on May 13, 1969, we remembered watching Sekolah Ayer Molek, Johor Baru's sports day while waiting for Father to come fetch us from Singapore.

After Pengerang, Father was transfered to be Imam of the historical Masjid Telok Belangah in Singapore. It was only in 1972 that we finally get to live under one roof when he was transfered to his hometown of Batu Pahat till he retired in 1980.

By 1973, we left for boarding school and never returned.

Sg Rengit


We went to Pengerang with the hope to perform Friday prayers at Father's masjid but time does not permit and we had to stop and perform Jumaat near Pekan Sg Rengit.


For a place with hardly much economic activities than palm oil and coconut, Sg Rengit has a large modern looking Seafood Restaurant.


Sg Rengit is known today for it's lobsters and seafood restaurants for weekend Singaporean at Desaru.

It only indicative of a typical border town with striving smuggling as the real economic activities. Fish and seafood are usually camouflage for smuggling of illegal materials like drugs, arms, etc. In South Johor, it is to avoid tax at the Johor-Singapore immigration checkpoints.

The smuggling link to Singapore is the very reason DAP via the anti-Lynas Himpunan Hijau with  Singaporean volunteers took a keen interest against Rapid Pengerang project.

If Himpunan Hijau is serious about environment, why do they not complain of the environmental devastation to Pengerang by ships parking in Singapore waters that have been polluting the sea by dumping sludge and killing fishes and Dugong .

We remembered Pengerang beach looking like this before.


Back then, we could walk from home to pekan along the beach as we collected sea shells and corals on the beaches. But not anymore.


From Sg Rengit to Pengerang, the seaview is lined with hundreds of ships parking in the deep sheltered waters near Pulau Tekong, Singapore and Johor. Singapore provide ship maintenance and supplies.

If Pengerang were to provide same services for cheaper price, Singapore would be denied such economic opportunity.


So Singaporeans got DAP to instigate their smugglers counterpart to cook up issue to demonstrate and sabotage Rapid Pengerang plan. Not knowing better, idiot PAS and PKR join the bandwagon without knowing the Chinese were thinking of their financial benefit to sabotage the plan.

Rapid Pengerang

Rapid Pengerang is a great idea to take advantage of the deepwater off Pengerang coast.


Given to the Pengerang villagers, the strategic value could never be harness.

Only illegal smuggling activities, which deny Government income, provide unfair advantage against genuine retail business people, and risk of illegal activities advancing to more dangerous criminal activities like smuggling subsidised diesel and fuel, would continue.

Development would stop smuggling activities.

The projected employment to be generated by Rapid is 40,000. Local Pengerang population must seize on the employment and business opportunities. State government have already embarked in training youth for skills.

Local politicians and NGOs must be the watchdog to ensure government honour the promise that locals is given employment priority. There must not be another Shamsul Azhar later, who would come up with a new understanding of the social contract with the people of Pengerang.

Kg Pengerang


By the time, we reached Masjid Pengerang, Friday's congregation left home. So we had the space to have our remeniscence. 


The first thing that came to our mind when seeing Father's old masjid was that it hardly changed. Other than some extension to accommodate the bigger congregation, the old feature of the masjid remained.


The house of Penghulu Ali next door remain as it is 40 years ago. It is no more occupied and his off spring has migrated to Singapore.


Other houses nearby still remained.


Only Father's store room-room is now rebuilt as the ladies toilet.


The mimbar masjid is the same one.


The pillar father rest his back while, we sat learning the Quran, was still there. We can't forget the spot we finished the muqaddam (refered as Juzu Amma this days) and advanced to the Quran there. It is now carpeted but those days it was only straw mat and rubber mat.

When we walked to the beach, then came the shocker. It was really in a sad sorry state and not the past serene place it was.


The pristine beach with lots of shells, and corals that we grew up playing and swimming is no more. The shoreline narrowed by sedimentation and it is polluted with rubbish. We notice the brands of mineral water bottles are foreign. 

We found two shells we used to collect as children to play congkak to remember Pengerang.


Jeti Tg Pengelih

Those days we could walk along the shore to the pekan but not anymore.

Part of the shore line was used to built a road to end at the Pengerang Custom and Jettty Complex and TLDM Pularek


One can see that Singapore has been doing reclamation that the border is so near that it is within swimming reach.


Along the road, one can see TLDM Pularek, teachers' housing complex and part of an old British millitary bunker.


The bunker area should be developed into a historical site.

Gone are the kampong

According to the Rapid Pengerang masterplan, Kg Pengerang will be part of Rapid and it will no more be accessible to the public. Affected are:


When comparing the above map with the map below, Kg Pengerang and memory of Father short stinct in Pengerang will soon be gone.


So does the idylic Kampong road like the one below:


Earthwork on "town centre" for Rapid has begin.


When this portion is complete, construction in the areas along the main road will be begin. Rapid is targeted for completion by 2017. Our engineer brother, who got some contract work there, said, the kampong will cease to exist in 6 months time.

All will be left of  Kg Pengerang to us will be the two shells we have in our keeping.

Peoples' concern

Having heard of the various discussions regarding the strategic plans for southern Johor thoughout the 90s, quite glad that many of the ideas are finally coming to fruit.

Hopefully the Pengerang Malays will not fall prey to instigation from outsiders and seize the opportunities. The troublemakers are harping on petty sentimental issues.

The displaced kampong folks were given a very good deal for their inconvenience; land, given home and fishing project for fishermens. Although there are still lingering issues with the displacement, new housing area, burial sites and land compensation, it is not beyond resolution.


State government must go out of its ways to resolve it. Most of it are non-issue for urbanites but in an area where time stood still, it needs lots of human touch, some sensitivity and common folk PR.

If he is still alive, quite sure Father would be happy that development has finally come to Pengerang. He used to complain of how passive and insular the folks there.

The development that is coming is an opportunity o keep their family and youth to remain in the area. Our friend that took us around returned to Pengerang to look after his aged parents and parent-in-laws. His is the only child in both sides of the family willing to return and stay in Pengerang

Economic development should attract more to return. There is real need for manpower for Rapid.


The state government and leaders including local leaders must play their role. They should not allow carpetbaggers to take opportunity to earn quick commission but merely enriching some capitalist from outside like what happened to other places.

Knowing the process of court and documentation involved in the land takeover, it is unthinkable that anyone could be taking a couple of ringgit cut from their land compensation. Pengerang YB Dato Azalina and some of the ADUN's names is being bandied around especially since she was initially against but later became a vocal supporter of Rapid.

On the ground, they don't seem to understand that state could hardly do much profiteering to sell their acquired land at RM10 per square feet to Petronas.

Something must be done by Menteri Besar Dato Khaled Nordin to explain to the affected folks and be transparent on the rationale of the land valuation.

His boys in the communication team don't seem to be sufficiently educated or in tune with the world outside local UMNO petty politics. They can't even counter PAS and PKR simplistic instigation on the ground.

Already they fail to see the public real concern for LPHJ proposal. 

There is also the major problem with the infamous 32% dealmaker and land flipper, who thinks abusing his previlages is called doing business.

For all the sacrifice, the people of Pengerang had done, the state government must give due priority to their interest. And opposition instigators is forewarned as to not put to waste the sacrifice they have made.

NZ Foreign Minister failed attempt to "Murdoch" Malaysia

New Zealand Labor Party foreign affairs spokesperson David Shearer revealed the identity of a Malaysian diplomat charged with burglary and sexual assault with intent to rape of a 21 year old woman after New Zealand court lifted suppression order. [Read The Star here]

The concerned diplomat, Muhammad Rizalman bin Ismail, is a a defense attache from MINDEF at the Malaysian High Commission in Wellington. He was brought to New Zealand court in May but seek diplomatic immunity and had returned to Malaysia.

Until a decision by the court or the result of an official enquiry made, the initial reaction to allegation of burglary as reported by New Zealand media seemed far fetched.

New Zealand is a country practically neighbouring Robert Murdoch's Australia which is reknown for it's underhanded and sensationalised journalism. They seem to be doing a typical "Rupert Murdoch" style of media slandering on Malaysia.

For instance, the media with politicians suspiciously in cohoot made allegation that Malaysian government refused to waive diplomatic immunity from prosecution and brought the concerned diplomat home. [Read MI report in MSN here]

When spinned in that manner, the natural public reaction will certainly be an outcry as it tantamount to abusing diplomatic immunity. The public is also upset with the gag order by the court that resulted with the case went unreported till the weekend.

The New Zealand Herald wrote an editorial demanding the name and diplomat's nation revealed [read here]. They may have manipulated comment by British High Commissioner to New Zealand, Vicki Treadell to send the message that Malaysia should not use diplomatic immunity to cover-up criminal acts. MSN reproduced Malaysian Insider's report of Lawyers for Liberty Executive Director, Erik Paulsen  criticising Putrajaya and claiming diplomatic immunity is not a license to commit crime. [Read here]

Do a Goggle news and one can find our pro-opposition news portal like Malaysiakini, Malaysian Insider, Malaysian Chronicle and Malay Malay Online rampantly reporting critical reports from New Zealand's public point-of-view.

Doing a Rupert Murdoch

Under public pressure and criticism from opposition party, New Zealand's Minister in the Ministry of Foreign Affair and Trade (MFAT), Murray McCully turned on their own words to his Malaysian counterpart, Dato Anifah Aman.

McCully attempt to pander to public opinion went to the extent of issuing warning to the Malaysian government [Read MSN report here and Gulfnews here].

He was also reported by New Zealand media to demand the diplomat's identity and country revealed.


Earlier Monday, Prime Minister John Key and McCully was reported to have told New Zealand media that the New Zealand Government are seeking for the extradiction of the diplomat to face trial in New Zealand. [Read MI's report in MSN here]

McCully said the MFAT had formally requested that his right to diplomatic immunity be waived and the New Zealand government had taken all possible steps to prosecute him in New Zealand.

Malaysia was used as political scapegoat and diversion to cover-up accusation by their opposition that the New Zealand government shrugged off from their responsibility by allowing the diplomat to return and be dealt with by the Malaysian government.


There is some truth but the Malaysian government was prepared to waive immunity. However, it was the New Zealand government that offered the option for diplomat to return to Malaysia. Radio New Zealand report here.

In addition, Anifah agreed to have the accused sent back to New Zealand “if it is absolutely necessary” i.e. if New Zealand requests it or if its government thinks the Malaysian investigation is not being conducted properly.

MFAT attempted to dispute Anifah's statement by revealing a letter from the Malaysian High Commission dated May 21st which seek New Zealand police to close the case and withdraw charges. MyKMU, who is of the opinion that Wisma Putera should have taken a simple and clearer stance, provided link to the letter given by the New Zealand government. [Read here]

In contrary to MyKMU's view, their presumption could be wrong. Foreign relation and diplomacy is not so simplistic.

McCully failure

The latest report from Radion New Zealand released this morning reported McCully admitted that he failed to send sent the right message and apologised for his ambiguity. [Read the report here.]


McCully's may have realised his media charade cover was blown because the New Zealand government had acknowledge and agreed with to the Anifah's commitment Malaysia will not "sweep anything under the carpet" under the cloak of diplomatic immunity. [Read Bigdog here]

McCully receives Malaysian assurances

Foreign Affairs Minister Murray McCully has tonight spoken to Malaysian Foreign Minister Anifah to clarify any misunderstanding relating to the diplomat who was accused of an attack on a woman and the circumstance involving his return home.

“The Malaysian Foreign Minister is absolutely committed to the alleged offender facing a proper judicial process,” Mr McCully says.

“The individual concerned is a military person and the Malaysian Chief of Defence Force has established a Board of Inquiry process. Minister Anifah assured me that any material provided by New Zealand Police will be placed before the Board of Inquiry.

“The Minister made it clear that he would not allow the actions of one individual to tarnish the reputations of all Malaysian diplomats.

“It is clear to me from my conversation with Minister Anifah that his Government’s decision to decline New Zealand’s request for immunity to be lifted was driven by his Chief of Defence’s desire to put in place a robust judicial process to deal with this matter and his officials’ belief that this would be an outcome acceptable to New Zealand.

“The Ministry of Foreign Affairs and Trade has this evening provided me with the correspondence between New Zealand and Malaysian officials on this matter. While the formal request is absolutely unambiguous in seeking the lifting of immunity, it is now clear to me that officials engaged in informal communications over what is a complex case, in a manner that would have been ambiguous to the Malaysian Government.

“Due to the nature of the proceedings that lie ahead, I am unable to be more forthcoming on the matter at this stage. However, I can say that the Malaysian side have acted entirely in good faith.

“I have emphasised to my Malaysian counterpart the New Zealand Government’s commitment to justice for the victim in this case, and my colleague assures me that the Malaysian Government shares this view,” Mr McCully says.
Betraying national interest

The attempt to do a typical "Murdoch" on Malaysia failed but it is quite understandable for New Zealand politicians and media to do whatever it takes to save face their country nd protect their national and political interest.

However, it is puzzling and act of betrayal for our pro-opposition news portals to side with New Zealand to demean their own country by highlighting to the Malaysian public the views of New Zealand over that of the nation's interest?

They can claim it as fair reporting or giving the other side to the our official version but their bias intention to capitalise the political opportunity for Pakatan Rakyat is obvious. By right, our media should pursue the truth and give priority to  national interests on issues relating to foreign countries. 

Diplomatic immunity is something that had long been practise in foreign relation to ensure diplomats are not harass by foreign countries using their law. That principle must be understood and it should not be compromised for isolated case like this.

Furthermore, Malaysia made no attempt to cover-up the alleged criminal act using diplomatic immunity and had fully cooperated with their New Zealand counter part. Pro-opposition portals conveniently refused to tell the truth and revealed New Zealand's error.

Isn't this the same with DAP instigation of the public [read previous posting here] and siding with smugglers, Singaporean business interest and Australian environmental activist in their attempt to boycott Rapid Pengerang?

Justice seek, Principle upheld

The Star may have pre-empted the outcome of a diplomatic tussle between Malaysia and New Zealand with regard to allegation of burglary and sexual assault by a defense attacje at the Malaysian High Commission in Wellington to put the above frontpage headline. {Read here]

Perhaps Leanne Goh may have got away seditously spinning and pre-empting interfaith issues bbut not on this issue.

In the earlier posting here, it is mentioned that a decision was not decided and the Malaysian Government is still looking at the various options, including extradiiting the diplomat, Mohamed Rizalman Ismail back to New Zealand.

Essentially, Malaysia is upholding the principle that our foreign diplomat are given the rights to diplomatic immunity in any exchange of embassy or high commission. Our diplomat cannot be subjected to certain peculiar laws and be persecuted by such law in the course of their duties,

If it does not answer your curiosity, then you would understand that it would not be fair to subject foreign diplomats to our preventive laws like Sedition Act and former Internal Security Act.

In Rizalman case, the New Zealand court had charged him before investigation was uncompleted and evidence could be presented to our High Commission officials. Like US, New Zealand legal practise allows for charges to be made before investigation is complete.

Thus there was basis for Malaysia to invoke it's diplomatic immunity and seek for Rizalman return to Malaysia.

In the latest statement issued by the Foreign Ministry this afternoon, Rizalman would be sent back to New Zealand to assist investigation:


The statement does not mention of extradition but it is understood that Rizalman will be facing prosecution in the event there is sufficient evidence against him.

This position is most welcoming because diplomatic immunity should not be used to hide from proseccution for heinous crime like rape. There have been many cases in the past of diplomatic imunity abused to save the diplomats from act of crime. The Star has a report, below:

Bad apples in the diplomatic corps

Khobragade: Was in trouble over a domestic helper.

PETALING JAYA: They steal, refuse to pay parking fines and taxes, drink and drive and, worse, sometimes commit murder but never spend a day behind bars.

These rogue diplomats have been waving diplomatic immunity in the face of law enforcement authorities like get-out-of-jail-free cards for decades.

One of the most heinous examples of misuse of the diplomatic tag under the 1961 Vienna Convention on Diplomatic Relations was by a Burmese ambassador to Sri Lanka in 1979 who murdered his wife and burned her body in full view of neighbours and the police.

The incident was told by Gerald Hensley, a former vice-dean of the diplomatic corps in Sri Lanka, in his memoirs.

He said the ambassador shot his wife dead at their house in Colombo for having an affair.

Ionescu: Beat traffic lights and knocked down three men.

Neighbours who saw him preparing a funeral pyre in his backyard called the police but the ambassador told them that they could not enter his house because it was Burmese territory.

“He then carried her body out and dumped it into the fire,” Hensley said, adding that while the ambassador, who remains unidentified, was later removed from his position, no one knows what happened to him.

Another case was of an inebriated Romanian diplomat, Dr Silviu Ionescu, 49, who beat traffic lights and knocked down three men along Bukit Panjang Road in Singapore in 2009. One of the victims was Malaysian Tong Kok Wai, 30, who died three days later.

Ionescu, the man behind the wheel of his embassy’s Audi A6, later claimed that the car had been stolen. He fled to his home in Romania three days later.

Despite calls by the Singapore authorities for him to return to assist in the investigations, he refused and further claimed that he had been set up by the Singapore government.

However, the law did eventually catch up with Ionescu when a Romanian court sentenced him to three years’ jail last year for manslaughter in the Singapore incident. The sentence was later doubled to six years.

In April 2012, Panamanian diplomat Erick Bairnals Shcks was arrested for raping a 19-year-old Filipina in Manila but was released from detention when he claimed diplomatic immunity.

In a more bizarre case of diplomatic immunity being abused, a Mexican delegate stole the BlackBerry phones of several White House officials in 2008 during a bilateral meeting in New Orleans.

The delegate was nabbed by Secret Service personnel just as he was about to board a plane to Mexico. Although he handed over the smartphones after initially denying he stole them, he got off scot-free.

In a hotly disputed case, India’s former consul-general in New York, Devyani Khobragade, was charged with visa fraud and making false statements about a domestic helper that she employed.

Prosecutors accused her of forcing Sangeeta Richard, who acted as a housekeeper and nanny for the Khobragade family, to work 100-hour weeks for the equivalent of US$1 (RM3.20) an hour. The federal minimum wage is US$7.25 (RM23.20) an hour in the United States.

Her arrest and strip search sparked a bitter diplomatic row with New Delhi removing security barriers near the US embassy and revoking diplomats’ ID cards.

Charges against her were later dropped but in March this year, she was indicted on the same charges again and prosecutors said she would be arrested if she returned to the United States.
By agreeing to the "extradition", the Foreign Ministry managed to meet both the principle that diplomat in foreign land have rights to diplomatic immunity and honour the principle of natural justice by sending the accused Rizalman to New Zealand for investigation.

The keyword is assist investigation. If there are sufficient proofs to put him to trial, he will face charges.

The interesting aspect of this row with New Zealand is that the episode lasted hardly more than 48 hours with Malaysia able to both uphold the diplomats' rights to immunity and respect another nation's right to maintain justice.

Malaysia had not allowed the orang putih New Zealand to bully us at will but respect our rights and trust our good judgment to fair. So often tend to kow tow to orang putih and too overawed bby the slang and blonde hair to think they are better than us in situation where they are in actual fact no better.

This episode illustrates an important lesson to leaders, public servants and politicians in the need to be firm, consistent and uncompromisable in our principles. Yet it is able to find a sensible resolution to the problems within the ambit of the law and practise of good governance.

More so, it is done within the shortest of time and able to contain the issue without getting uncontrollable and evolving into other issues and problems.

Simple as it sounds, it is not oftenly happening these days.

It is unprecedented but it happened.

Pro-opposition news portal, The Malaysian Insider put up a report with a heading and content criticising Dato Seri Anwar Ibrahim strongly for the unprecedented act to prematurely criticised the government handling of the Malaysian diplomat row with New Zealand.

How easy for Anwar to take the side of foreigners vis-a-vis our own country. MI quoted from Wisma Putra's statement that he attempted "to opportunistically damage Malaysia’s reputation for personal political gain".

Putrajaya has accused opposition leader Datuk Seri Anwar Ibrahim of tarnishing the country's image by alleging in an interview to New Zealand media that there has been a cover-up in the case of the diplomat accused of sexual assault in Wellington.

In a statement issued last night, Putrajaya said Anwar's allegation was "completely false" and was yet another attempt "to opportunistically damage Malaysia’s reputation for personal political gain".

"Anwar also said Malaysia’s handling of the case has been 'appalling' and a 'fiasco'. If MI is serious in pursuing the truth to the point of criticising Anwar Ibrahim, surely they should be courageous enough to apologise to Zaini and Utusan for their vindictive conduct laced with lies and slander.   



Back to the NZ diplomatic row, it is interesting that Malaysiakini did not attempt to put a spin to soften the critic of Anwar or do a counter attack in their Malay report here. Maybe the spinning is done in their English report but it is noticed that their earlier wrongful reports suddenly disappeared.

Nevertheless Anwar deserve to get whacked because Wisma Putera did not buckle under pressure from the orang putih to waive their internationally accepted right to diplomatic immunity, which has far reaching implication in the practise of diplomacy.

The orang putih ended up apologising.

And, we fairly agree to allow justice for the victim to take it's course at our term with the orang putih acknowledged to say, "Malaysia ‘done right’ to return envoy in sex storm". That uolifted our image as a fair minded nation.

Problem solved within 48 hours, pride and principle intact, and done at our term without the orang putih pushing us around. Wondering whether it was Dato Anifah Aman that threatened the orang putih.

Something for Malaysian to appreciate and emulate.

On the slander on Zaini, MI took out the article but still left the nasty comments. Does Jahabar have the manhood to tell his reporter Hasbullah and MI to apologise and behave in the future? 

Why a Minister arrange for Datasonic to meet KPDNKK officers?

Our source tipped us with an information that late Wednesday afternoon one Minister brought the Fuelsub House Sdn Bhd-Datasonic Berhad consortium people to brief the Ministry of Domestic Trade and Consumer Affairs (KPDNKK in short) officials.

This is strange and inappropriate. Currently, we are fasting despite dehydration and experiencing cough, runny nose and diarrhea, However, the little black mole at the tip of our nose is a beeper that could alert us whenever that there is smell of collusion.

Why only Fuelsub House-Datasonic? It is reaffirming our past suspicion that the fueld card contract had been pre-determined for Fuelsub-Datasonic. [Read back here.]

Not that we have not warned on the danger of the new fuel subsidy program, we did.

And we warned the public will not take it well on this fuel card system. It is open to widespread abuse and more smuggling. It also means some Malaysian will get to savour the wealth of the nation, while others, financial well endowed they maybe, are denied.

None will appreciate it since Government failed to address the fuel subsidy leakage which could amount to more than RM15 billion a year, and they have to suffer the brunt of government inefficiency, poor enforcement and widespread corruption of civil servants.

It was last week that we had dinner with a police relative involved to assist KPDNKK official in halting diesel smuggling trucks. KPDNKK officials merely asked the driver a couple of questions and let him go. The truck and diesel content was not impounded  The policeman was damn sure there will be no further follow up investigation.

A source told us of one competing enforcement agency stopping other enforcement agency from doing diesel smuggling raid. Some enforcement agency would alert the smugglers before a raid. What is going on?


These are more serious issues that need addressing than the rush for September 1st dateline to give fuel card contract and deny the wealth of the nation to voters and rakyat. After all Government is so generous with BR1M and other handouts.

Shouldn't the leakage be seriously dealt first before imposing financial inconvenience on the rakyat which are already burden with unabated price increases?

Although some are justified, it all adds up and compounded further by pathetic communication.

Till today, Dato Husni Hanazlah failed to make the public understand the upcoming GST policy. Not Dato Najib since it was Husni's responsibility to do so and he seemed indifferent to the need of proper communication.

Please no cheap shot at Dato Ahmad Maslan. He did what he was expected to do.


Back to the Minister concerned or precisely who was the Minister that arrange for the colluding meeting.

One can conveniently point it at everybody's favourite punchbag, Dato Hassan Malek since he is Minister in charge of KPDNKK. Though it is to bizarre to believe, political pundit claim he is Rosmah's selected Minister.

However, the fuel subsidy program is being addressed by EPU and National Economic Council. Sources claim they are to determine to the mechanism and to whom to award the contract to. So Dato Abdul Wahid Omar would be suspect.

He and Dato Idris Jala was supposed to meet some senior bloggers but cancelled at the last moment. Till now both have not come back for another date.

Could goody two shoes from MRSM Seremban batch of 1977-82 and successful corporate man be involved in such unethical and improper governance practise?

There is serious security breach on the manner Datasonic supplies MyKad to the government. One corporate man in the IT business said they sub-contract it to China company to do at cheaper price and they can makan tengah.

It means our information could be made available to foreigners. 


Let's leave it the issue of which is the Minister because there is still the story of a Minister who told a retiring government officer,  "Hire my son and I will extend your contract".

Aftter 4 years, we have found out who the Minister rumoured to have bought an £8.5 million home in the Holland Park, London area. [Read here] He was dropped from Cabinet, but afraid to visit his London home and said to spend much time in Dubai.

There is a message that has gone viral to remind friends to change to the new Identity Card number to enable them to get field subsidy:

The message is not true but the belief is strong that Fuelsub House Sdn Bhd and Dataonic Berhad consortium ("Datasonic consortium") will get the fuel card contract.

If the message is true, there is no need to change MyKad because their plan is issue another card for more money obviously  and Pos Malaysia is their partner to get it deliver to all "qualified" Malaysians for more money, off course.

The nature of the fuel card plan is suspect and mired with many dubious past and present relating to Datasonic and the consortium.

Please do not say our MyKad cannot be used because attempts to link it with Banks failed. One Bank Negara source told us the reason it happened was the Bank had to follow a certain international certification but for that, MyKad refuse to reveal certain information on their system for international certification.   

One former GM of a card company said, MyKad can be used.

Now, we will not repeat the fact that the fuel card will only lead to widespread abuse and leakage.

Neither are we to repeat of the many dubious ways the intention to introduce the fuel card system for September 1st was unfold using scripts such as raids by KPDNKK and joint taskforce, initially hush hush, then  transparent and later private meeting, and the 70% owners of the consortium.  


Nor are we to plea again for the leakage, smuggling activities and syndicate, which became became widespread few years ago due to civil servant negligence and collusion, be addressed first before instituting these measures with suspected of self serving intention.

No point to plea to those with intentions to make money at public expense and are too obsess with neo-liberalism without considering the political implication to their own ruling political party. We will be the first to say "Padan muka!" should they not heed our warnings.

In a matter of time, they will pay some country bumpkins to defend their action on the social media with argument similar to defending Dato Nazir Tun Abdul Razak appointment as member of the Board of Director of Khazanah and anticipated to replace Tan Sri Azman Mokhtar is good because he is educated and CIMB made money.

We will just have to be aloof and talk to the "thinking" crowd.

Being under the weather on weekend, it enable us to do a bit of research and many dubious past and present of Datasonic was uncovered. There will be those getting unnecessarily implicated but we intend to present it as it is.

They can use their army of paid bumpkins to defend them.

The fuel card contract will be just great to keep Datasonic stock going. The stock price had a phenomenal rise since listing in 2012 from the benefit of MyKad contract they secured by beating the original architect of MyKad, Iris Technology Berhad.

Don't tell us they have more superior management or technological capacity or whatever dog shit analyst will tell you to justify to continue buying the stock even though it has risen from below 50 sen in May 2013 to more than RM4.50 with 2014 PER above 23.

The analyst may have been tipped off. Otherwise, only idiot apek pakai terompah would buy shares with earning that takes ore than 23 years to get back money. Dividend would be longer. They recommend buy because forecasted PER for 2015 and so on is lower.

When the Datasonic consortium, Fuel Subs House Sdn Bhd comprise of 30% Datasonic Bhd, 70% shared among Innovative Associate, E&Y, Razali Naina Merican, Dato Habibur Rahman and two Chongs, Steven dan Chua, one have to dig deeper beyond Dato Reezal Naina Merican and Dato Abbu Hanifah are linked in this company here.

Something must be cooking when major shareholder and Managing Director, Dato Abu Hanifah Noordin or in some reports, his name reads as Dato Dr Abu Hanifah Nordin, sold his shares to his  Chinese Deputy Managing Director.

We do not have space to explain the legal and corporate implication in the positions of Chairman, Managing Director and Deputy Managing Director but Focus Malaysia reported on June 4th below:
ICT solution player Datasonic Group Bhd’s largest shareholder Dibena Enterprise Sdn Bhd entered into a direct business transaction to sell 130 million shares on May 30. The shares were sold to two private companies – Enrich Epitome Sdn Bhd and Gerbang Subur Sdn Bhd.

Both Enrich Epitome and Gerbang Subur acquired 65 million shares each at RM3.33 per share. Dibena Enterprise and Gerbang Subur are both linked to Datasonic’s MD, Datuk Abu Hanifah Noordin. Enrich Epitome is linked to Datasonic’s deputy MD Chew Ben Ben. After the acquisition, Abu Hanifah owns a 15.49% direct interest and a further 24.54% indirect interest in Datasonic. Chew has a 12.64% direct stake and 9.88% indirect stake in the company.

Datasonic also recently secured a RM292.2 mil contract from the Ministry of Home Affairs for the supply of MyKad.

Why should Abu Hanifah sell off of a major block of his shares to Chew Ben Ben when he has just secured and is securing another major contract? And forecasted PER is cheap?

We do not have the answer but let's just see if Abu Hanifah will remain as major shareholder or a China man would take over the company after the shares spike further.

Dubious past


It is time now to dig up on Abu Hanifah.

His resume only tells his professional side as a public accountant. The one on the company website is too clinically clean. As businessman, why the desire to wipe out his footprints. Any businessman will have dirt, especially those capable of securing major government contracts one after another.

A quick google revealed his name surfaced as Dato Dr Abu Hanifah Nordin in a corruption court case in 1997-1998 against former Selangor exco in Menter Besar (now PAS) Tan Sri Muhammad Muhammad Taib adminstration, Dato Saidin Tamby.

As former Executive Chairman of a development company, Syarikat Nusantara Network Sdn Bhd., Abu Hanifah went to Saidin's infamously known to be robbed home to deliver a RM1 million bribe. Saidin was found guilty and supposed to serve 1 year prison and fines. [Read in Wikipedia here]

Was justice done? Not quite.

Such is the legal process in a corruption case, only one of the guilty parties; receiver or giver of bribe will be charged.

In this case, the equally corrupt giver, Abu Hanifah went away scot free.

Defence counsel to show mala fide in charge against Saidin

SHAH ALAM, Wed. - The corruption charge against Datuk Saidin Thamby was brought about by pressure on the Anti-Corruption Agency, the Sessions Court heard today.

Counsel Muhammad Shafee Abdullah said the defence would show why there was mala fide in the charge against the former Paya Jaras State Assemblyman.

He said this when explaining to judge Suraya Othman on the question he posed to witness Datuk Dr Abu Hanifah Noordin, who is a public accountant.

Counsel had asked Abu Hanifah whether his name had appeared in the "crony list" of Datuk Seri Anwar Ibrahim revealed by Prime Minister Datuk Seri Dr Mahathir Mohamad.

Deputy Public Prosecutor Datuk Mohd Zaki Mohd Yasin had objected to the question.

The politically savvy can interpret.

Abu Hanifah was carrying Dato Seri Anwar Ibrahim torch all the way to Majlis Tertinggi UMNO but lost in 1996. [Read in Nur Jazlan.net here.] That year was the year Anwar was going to topple Tun Dr Mahathir if not for his bum bashing past.

In 2009, the Shah Alam High Court acquited Saidin based on the evidence presented at the Session Court that Anwar was behind in framing him. [Read The Star here].

Mat Maslan?

If Mohd Maslan is current Deputy Finance Minister, Dato Ahmad Maslan, then it shed a bad light on Datasonic. As Deputy Minister, he denied the rumours thus presumably has knowledge of this contract.

One Director of Datasonic is his friend or comrade in a certain organisation. He is Dato Aziz Jamaluddin. God forbid he is not there as proxy because he is a good man, Chairman of Masjid Kg Baru, and former BN candidate for Titiwang Parliament that lost to the late Dr Lo' Lo' Ghazali.


Mat Maslan was at the launch of prospectus for the listing of Datasonic in 2012. [Read in Malaysian Reserve here]

Although Mat Maslan is in Dato Najib's team these days, back in reformasi days, he was a BTN officer and used BTN photocopy machine to photostat reformasi pamphlets. The associations are there thus there must not be any mystery and suspicion of collusion in the contract.

We will tell it as it is because our consideration is not just party politics but foremost is the rakyat well being and national security.

Security matters

An important question of security matter on Datasonic:
Does the company actually manufacture our MyKad?


Browsing through their latest available Annual Report here, it strange that they do not attempt to show-off their manufacturing plant printing the MyKad.

The company business activities masked as strategy only state their activities are in delivering, solution and integrating, research and development, marketing and some mumbo jumbo on human resource development to make the list long.

But no manufacturing. The financial accounts and asset list hardly tells anything.



There is mention of warehouse and Manufacturing and Quality Control team but is our MyKad manufactured there?

Someone need to explain precisely, particularly the NST reporter who wrote this report here, what do they mean by:
Providing cutting-edge innovation and technologies, Datasonic seeks out technology transfers through strategic partnerships with global industry players from the United States, China, Germany, Italy, the Netherlands, Singapore and Switzerland.

Top UMNO man playing treacherous games with Opposition

One top UMNO position holder with position nearing the post of President is playing games with Opposition.

In fact, there is a veteran UMNO leader also playing games with Opposition hoping to gain or more precisely to buy Sabah and Sarawak MPs at few million each. Half down and half later after vote for motion of no confidence is delivered.

However, we will not talk much of the veteran UMNO leader but just of the UMNO position holder. He is making his move now.

Every UMNO leaders in the right position would aspire to be President or Deputy President, which automatically would translate to the highest and second highest position in the land, save for the Sultans and Raja-Raja Melayu in the higher hierarchy.

However, this top UMNO position holder seemed to aspire only for the highest position in his state. Maybe he has certain intentions, good or bad, but the state is well endowed with budget.

Probably, when the time is right, the state would be endowed with more.


He may have support at the national level but his power within the state is limited to hardly a handful of divisions. So the only way he can do so is to do a guerilla tactic to weaken the current holder of the higest position in the state.

He has worked with the opposition to discredit the current holder of the highest position in the state to fix him on a corruption allegation in which the money is collected in a faraway land.

This sort of slander could work but his people did not do their homework. It could not be substantiated with anything resembling proofs. They could not and the highest position holder in the state was cleared by the relevant authority.

So the top UMNO position holder kept asking his man to babble and repeat what has already been clarified, explained and convincingly denied.

Naturally, he tried all sort of ploys but he did not know that the people collaborating the lies and slanders with him could not sleep. Their conscience is overwhelming and eventually told someone that he was involved in the framing.

One reason they could not live with the guilt of lying was because they knew the top UMNO position holder was corrupt.

Sometime people can keep a blind eye to all these nonsense as long things are delivered as promised and in accordance to his responsibilities. The problem is his people got contracts and at fat profit margin but it is not delivered.

The top UMNO position holder knows about it and is felling the heat. So he went around with the excuse of blaming the government servants, the officers working under him.

The problem was the government servants could not verify the work done by the contractors because they are too far away in Putrajaya. Furthermore, they know it is not worthy since there are powerful people behind them. They could get to transfered to Ulu Tembeling, Pahang or Bakalalan, Sarawak.


In his latest attempt to discredit the current top position holder, top UMNO position holder thought the people do not know. Unfortunately many are in the know of his moves.

He forgot that people could talk. so does walls.

His attempt is not likely to succeed but he is insistent on proceeding to built up the dis-credential of  the current top position holder of the state. Again, he will face a big surprise because not only his whole plan is known, it could backfire.

If he tries to face the music and later join forces with the veteran UMNO leader, he will be in for a bigger surprise. Veteran cannot pull it off with opposition paries in a mess. PKR is breaking up. PAS and DAP is waiting for an armegedon.

Yes, UMNO is not strong yet but there are ample proofs, documents and testimonies against him that Dato Najib will have no choice but to ... So think of the risk to himself first.

Off course, there will be those who think Najib will not dare. But he did unceremoniously sacked Dato Ahmad Said, right? And they say Najib has plans to purge the party of betrayers. Top UMNO position holder could end up as an example. 

Don't do stupid things.

Be happy that you are where you are. Your position there is not quite stable. Being close to his father-in-law, we do not want to see bad things happen to him.

No orange squash, but a pleasant surprise

It is too embarassing to lose in the manner that Brazil did this morning.

From the 10th minute, Germany seemed to be pounding in goals every 10 minutes in he first half. By the time it 0-2, it was practically over for Brazil but they just crumbed to pieces. Fans werer not focus on the game but was entertained by the jokes and pictures going viral on the social media adding to Brazil humiliation.

It is unlikely for Argentina to crumble to Holland in the same way with the presence of Lionel Messi. If Holland's defense is not steady, the two twin strikers of Holland, Arjen Robben and Robbie Van Persie cannot do their effective counter attack.

The Orange may not win but just do not get squashed. In these days of instant communication and distribution of information, the embarassment is instantaneous and perpetual till the next "kangkung" comes along.

We witness of things to come when Spain got knocked out in the group matches.



 
There were funny insults on England.

But why bother with a no talent over-rate. Costa Rica, Chile, Columbia, Algeria, Honduras and few minnow country were more pleasant surprises.


We commented here that Brazil were lucky to win 3-2 against Croatia and it did not take long to prove us correct.

Mighty Brazil with the football attacking talent and individuals unsurpassed by any nation in the world only managed 0-0 with Mexico.

The 4-1 win over African World Cup veteran were no big deal when compared to Mexoco win against Croatia.


They drew with Chile 0-0, which sent defending champion Spain packing 0-2, to win on penalities 3-2. In the quaterfinal, Brazil beat Columbia 2-1 by roughing up Rodrigues which was then the best player in the tournament but was even out with Neemar getting knocked on his back.


Brazil was not impressive.

History tells that whenever Brazil is not impressive they will not go far. An impressive 1982 squad with Zico, Falcao and Socrates lost to France in the quarter finals. That was a team touted to be better than the 1976 team with Pele that won the World Cup in Mexico.

Ronaldo's team that last won World Cup USA was just lucky. That year Brazil beat second rate Germany on penalities. The games were marred with draws, overly defensive and play acting.

They team coached by Scolari or maybe now more suited to be called Scorelagi were no Samba actually.


As home team, this team was already lucky to be in the semi finals in an exciting tournament where no team is a pushover anymore. With a team lacking a coherent strategy and ability to adjust to game circumtsances, they were not going to beat Germany.

Singapore could tac but Johor not allowed to tic

On July 4th recently, new Transport Minister Datok Liow Tiong Lai was reported by media saying that government is studying the  proposal by the Johor state government to impose a charge on foreign cars entering the Malaysian border through Johor Baru by RM20. [Read Today here]

That move is heard to have invited complains by Singaporeans and Malaysians driving SIngapore-registered cars, whose vehicles swarm the Johor Baru immigration checkpoint on weekends and also weekdays, except the morning and evening working day rush to and from Singapore.

Liow was overly considerate of Singapore in Johor's tic to the tac by Singapore's Land Transport Authority (LTA) intention to raise the Vehicle Entry Permit (VEP) fee for foreign-registered cars from S$20 to S$35 a day and Goods Vehicle Permit (GVP) fee from S$10 to S$40 a month from August 1st. Forwarders will be hit hard by Singapore's move [read Malay Mail Online here and NST here] but The Star quoted Liow saying, "However, this (the proposal by Johor) must be considered carefully as Malaysia has borders not only with Singapore, but with Thailand, Kalimantan and Brunei.”

Why must the MCA President be so concerned of Singapore access to these countries via Malaysia? Understood, he is merely concerned with the impact to other countries should we apply the same entry charges as applied to Singapore. Is that too difficult to figure out, Minister?

Not only none of the BN Members of Parliament or politicians are not vocal on this but moe important, our MCA Minister is too chicken to tic back the Singaporean's tic? Is our side of the border not congested by Singaporean vehicles?

A quick look at vehicles leaving and entering Johor Baru immigration checkpoint and one will realise that almost 90% of vehicles are Singapore registered.

The owner or driver of the vehicles could be Malaysian working in Singapore because Malaysian vehicles are restricted to only 10 entries into Singapore. The kiasu Singaporeans realised Malaysian cars are cheaper and Malaysians vehicles would be using or swarming Singapore roads and highways. Thus for the rule on Malaysian registered vehicles.


For RM20 charge on Singapore passenger cars to enter Johor Baru, that is hardly much when compared to Singaporeans charge of S$35 on Malaysian cars, which translates to RM91 or 4.5 times more for Malaysian passenger cars to enter Singapore than Singaporean passenger cars entering Johor..

With Malaysians hardly do much leisure traveling to Singapore, the charges paid translated to Malaysian ringgit are too drastic a move to further curb Malaysian vehicles congesting their side of the border.

The amount Singaporeans have to pay to enter Johor for weekend rest and recreation out of their pigeon holes should be significantly much more.

This blog here quoted Johor State Public Works, Rural and Regional Development Committee chairman, Datuk Hasni Mohammad mentioning a figure of S$20 (RM50).

Even at that rate, it does not cover the cost and inconvenience the people of Johor Baru.

They had to endure the  congestion not only at the causeway but the within Johor Baru city and Iskandar Malaysia which are more frequented by the rising number of Singapore registered vehicles.

The Singaporeans and Malaysians working in Singapore is having the best of both world.

They get Singapore salary and live in Malaysia for cheaps. Naturally, they do not pay their income tax and road tax to Malaysia but to Singapore.

They get to consume and buy Malaysian subsidised petrol and controlled food items. While it is acknowledged that it help the retailing sector in Johor Baru but the taxpayers had to absorb for the subsidy. Even so, a significant number of retailers at shopping complexes are Singaprean-owned.

In Malaysia, they get to use our more halaalan toyyiba tap water, which is not New Water as sourced directly from sewers and toilets as in Singapore.

The presence of Singaporean and Singapore money caused living quarters to be too expensive and beyond affordability of all Malaysians; Malay, Chinese, Indian or Ibans of Pasir Gudang. Perhaps charging Singaporean and Malaysian working in Singapore owning Singapore vehicle could help Johor state address this problem by building more rumah mampu milik than earlier planned.


An important point that need to be known and highlighted is that Malaysian government had to spend their own money or via privatisation to build infrastructure to addressed the traffic flow and congestion created by Singaporean vehicles.

The rationale for the aborted Scenic Bridge was to enable traffic from East and West and the ones  coming and leaving Johor Baru Central Business District to flow.

It was Singapore that made a big hurrah and Dato Nazri Tan Sri Aziz and double crossing Tan Sri Gani Patail chickened Tun Abdullah Ahmad Badawi into cancelling. The current chaotic predicament at the Johor Baru business district was partly due to the cancellation.

Singapore kept benefiting themselves without consideration to Malaysia and Johor kept losing out. It is high time for Johor government make some money and rakyat of Johor benefit more from the flood of Singaporean in Iskandar.

After all, company tax on retailers benefiting from Singaporean business all goes to Kuala Lumpur, if they actually pay.  

Do not talk about the toll at the Johor-Singapore Causeway paid to PLUS for RM2.90 to enter Johore Baru but not to return to Singapore. That is for use of widened causeway. It is pointless to raise issues on tolls for use of highways inside Singapore and inside Malaysia.


In another case, Singapore made a big complain on the land reclamation done by Johor at the second crossing. They are even going to the point of taking it to international court. [Read CNA here and MSN Malaysia here]

In early 2000, Singapore was reclaming land at Pulau Tekong that it is blocking water passage way and polluting the sea on our eastern side. [Read here and ABITW here].

And Malaysia did take them to international court.

That is both their tic for tat and an example of Singapore kept benefitting at expense of Johor but Johor could not do so.

It is high time that Johor and Johoreans not be halted from doing a tic-for-tac against the Singaporeans. Kuala Lumpur had decide on the fate of Johor for too long but Johor ended up being played around and the losing end to Singaporeans for too damn long.

Johor even lost Batu Putih island and soon as Tun Dr Mahathir said recently even Johor Baru will be lost to Singapore because of Kuala Lumpur's failure. The Singaporeans are already talking of the next acquisition in Batu Pahat as the next Iskandar. [Read here]

Before Pakatan Rakyat turn it into an issue

At one time, this blog was carrying stories and series of a corrupt mamak Minister.

Not too long back, there was a tip-off that one mamak government high official took bribe for the  construction of university campusses but got himself promoted.

It sounded similar to the stories of the first Director for ESSCOM whose name suddenly disappeared from the public. He was an Immigration high officials who was heard to be charged for corruption but ended up inappropriately promoted by someone high up in Home Ministry.

Yesterday one former MP tipped us off  to a website which exposed the naughty side of another mamak government high official. Usually we would not give a damn to a person's sleezy private life  but since it involved a high government official, it could lead to other implications.

Before Pakatan Rakyat take it up as an issue and gain political mileage as though the person is a political figure. The opposition are creative at spinning yarn of lies and slanders to implicate the Prime Minister.

According the blog magstadium here, this mamak KSU for an important Ministry have been indulging in what was described as "rewang" with woman during the mmonth of Ramadhan.

Rewang is a javanese word for gotong royng or community event to undertake community work together like cleaning up drainage, rubbish, weeds etc. The context the blog writer meant must be indulging himself with woman.

A picture of him in the company of woman at Bangsar Shopping Complex was posted.

Off course, not much was divulged yet but quite sure there is more to come. And we put up this posting based on the trust to this YB.

Woman, money and liquor are the major vices men could succumbed themselves to the extent of compromising the professionalism and personal integrity. Thus it could lead to other revelation.

Off late, there have been many stories in the manipulation of tenders at MoF level done by civil servants that are supposed to do technical assessment and/or proposal evaluation to bypass the cheapest pricing proposed. Many such examples have been exposed in this blog.  

The intention is simply for his superior to look up on the allegation against the KSU's"rewang"activities to ensure that it got nothing to do with exchange of favours. Sometimes women are used as entrapment to blackmail into carrying out a certain instruction.

Quite often it could be extramarital affairs that could intrude into his family and state of mind which consequently affect his work and responsibilities.

If it does not affect his work and responsibilities, it is a personal issue and just his private matters..

In the meanwhile, wait for future posting. Hopefully there is a logical story and proof. Then PM has to instruct the relevant authorities and enforcement agencies to step in.

Malaysian women call on UN for ceasefire

We Malaysians call upon our Government through its Envoy to the United Nations, to urge the UN to demand for an immediate ceasefire on Gaza and impose a UN-wide embargo on all trade with Israel.

Malaysians are shocked and horrified by Israel’s blatant disregard for human life and  the vicious acts of cruelty inflicted on the Palestinian people.

Indiscriminate air attacks have targeted civilian homes, injuring and killing innocent men, women, children and the disabled. Israel has shown a complete disregard for the holy month of Ramadhan observed not only by the people of Palestine but Muslims worldwide.

We Malaysians, can no longer stand by and watch the devastating consequences to the Palestinian people.

Swift UN action is needed to demand a ceasefire and stop the slaughter of innocent people, and impose a trade embargo on Israel.

Israel must be held accountable for serious violations of international humanitarian law and human rights.
