Three smugglers charged yesterday and more to come

Three foreign ship captain involved in the smuggling of subsidised diesel was charged at Session Court of Kota Tinggi Johor yesterday.  Johor is the hotbed of human trafficking and smuggling activities involving subsidised fuel, control food items, and cigarette.

In the presence of honourable Salawati binti Jamhari, Myanmar Kyaw Zay Yaa, Thai Pak Bunk Long and Indonesian Hasanul Idris were charged under regulation 3 (1), Regulation of Controlled Supply (Peraturan 3 (1) Peraturan Kawalan Bekalan).

Except for the Thai ship captain, the other two captains admitted guilt and will pay fines of RM100,000 failing which they will face a one month prison term. The ship and goods are confiscated by the Malaysian government..

Myanmar ship captain, Kyaw Zay Yaa was charged for possession of RM1.5 million worth of subsidised diesel in his ship MT TJ 99. While, the Indonesian was charged for RM2.16 million of subsidiesed fuel on his ship, MT Christine.

Thai captain, Pan Bunk Long will face trial for being on board of his ship MT Inter which allegedly had in possession of  RM3.3 million of subsidised fuel. He is required to put up a bond of RM60,000 with two Malaysian guarantors. Passport is kept in possession of the Malaysian government..

Trial date is due on August 12th and he will be required to report to a determined police station every two months.

Another four ship captains will be charged today at the Kota Tinggi session court.

These charges signal seriousness on the part of the Malaysian government to address the financial leakage arising from smuggling of subsidised fuel and eventually other controlled items to smuggling activities.

It dispel the scepticism by certain quarters that there will be no charges made.

Congratulations to the efforts involving Police, Special Branch, KPDNKK Putrajaya, MACC, and other agencies under the watchful eyes of Attorney General Office.

Sources said state KPDNKK was not involved and trusted upon to be invited into the joint effort.

APMM


Already in a hot seat for the Mabul incident, Agensi Penguatkuasaan Maritim Malaysia (APMM) was also not brought into the operations.

APMM officials are suspected of collaborating with smugglers by watching the other way. Illegal transfer of diesel done openly at jetties are ignored.

APMM was established as a one stop marine agency to takeover the role and assets of Marine Police.  and given wide ranging power similar to police, immigration, customs, marine department etc. However, they failed to curb the problems blamed on weakness of police and other agencies.

It was believed it was a PTD mafia move initiated by former Home Ministry KSU Tan Sri Aseh Cik Mat and former KSN Tan Sri Sidek Hasan in a power play to curb the power of police.

APMM have proven to not be responsible and masters in the blame game.

In the latest statement issued by APMM, they blame the Marine Police for the death and abduction of policemen on their territory but refuse to be responsible for easy entry of the Suluk intruders into their waters.

The statement accused Marine Police for the poor state of asset thus for their ineffectiveness. However, it was not logical since Police Marine have been using the same asset without any repeated violent intrusions into Sabah, save for smuggling activities. 

Suspicion is some PTD mafioso was trying to make a buck from purchase of new assets.

Sources claim APMM patrols have oftenly been far in between that intruders and smugglers can sense their presence. As soon as the abducted police is release, this blog will reveal a shameful incident in the Mabul intrusion.   

Leakage of subsidised fuel had risen sharply from 2010 when fuel subsidy rose from below RM10 biillion in 2010 to reach more than RM25 billion in 2012.

The public should monitor whether the Ops Titik under the suspiciously corrupt KPDNKK's Enforcement Division will lead to any charges made. Be ready for token effort to get publicity but the prosecution will fall short to a conviction.

The remaining smuggling syndicates are still much at large and the war against smugglers is still on-going.

The smuggling syndicates have hired tonto thugs to trail enforcement agencies in order to alert the syndicate operatives. They are being paid RM200 a night.

Few nights ago, tonto have blocked the path of enforcement officers. Three were apprehended and charged under Penal Code 323 and 324 for obstructing a government officer from carrying out their duties. They willingly admit guilty and paid fines of RM2,000 each.

It shows the profit from a night's work is far more profitable than the cost of paying the fines and maybe bonuses to the tonto thugs.


Politically, they have got DAP to heighten campaign against Petronas's Rapid Pengerang and ignoring the fact that their cover and intention are blown open.

Johor waters is infested with smugglers. Not only notorious for human trafficking of Indonesian labourers, subsidised diesel, kretek cigarettes, sugar, cooking oil, and flour are continously being smuggled to Indonesia.

In some cases, frozen meat have been found on these smugglers' boat to Indonesia.

Last week, police managed to held 50-60 Indonesian illegal immigrants returning to Indonesia.

Why some Malaysians are idiot enough to fall for CNN crooked reporting?

First of all, condolence to the family of the deceased affected by MH17 conveniently accused by CNN was shot down by Russian aided Russian Ukranian separatist.

After the horror and despair of undergoing the disappearance of MH370 four month ago, why MAS again?

In the MH370 incident, opposition took a week before starting their blame game on an unexplained phenomenon which puzzled the whole world.

However, it is hardly 24 hours but opposition leaders, pro-opposition portals and ridiculously over critical pro-Government blogs and social media are blaming MAS and indirectly to the government and eventually Dato Najib.

The line of argument used was why did MAS took the "war torn" route.

Logical as it is, that was the accusation used by CNN from last night and it has been repeated upteen times together with the American immediate accusation that Russian Ukranian separatist fired with a surface to air missile supplied by Russian.

Incidently, US had just announced an economic sanction against Russia for aiding the rebels. Their tone to is confrontational as they warn about tampering with evidence at the wreckage.

CNN also gave much publicity to Ukranian government statement and transcript of the conversation between two Russian millitary personnel with regard to the incident in which Ukranian claimed they managed to tap.

As openly known, US is supporting Ukraine. 

Such is manner of CNN's atrocious journalism that one should take everything that was reported with kilos of salt. The American have interest and CNN report slant is obviously questionable.

Unfortunately, many loud mouth Malaysian are idiot and too quick to fall for such trap.

The first noticed to blindly agree to the wicked CNN was Free Malaysia Today [read here] as the alleged that MAS flew that route to save fuel.

Stupid! To save fuel one fly high and they twisted the report to claim MAS was flying at 33,000 feet and another report later claimed MAS was flying at 10,000 feet.

If that is not stupid enough, Malaysian Insider [read here] titled their report to say MAS was flying at 300 metre above restricted air space. WTF is that?

Malaysiakini [read here and here] made same allegation by reporting the much touted mute Ketua Pemuda PAS, Suhaizan Kiat. Quite sure he does not understand aviation and took the idea from CNN's notably unconfirmed allegation. However, he sounded more credible than Dato Mahfuz Omar.

Lim Kit Siang made the same allegation by reproducing an AFP report in his blog [read here]. The report quoted only Korean Airline, and Qantas stopped using the route.

However, it was mentioned that the International Civil Aviation Organization (ICAO) and the International Air Transportation Association (IATA) declared the route is safe.

Is MAS supposed to ask the opinion of Lim Kit Siang, Suhaizan Kaiat and some wise guy bloggers and social media first before flying the route? Naturally, they rely on an authority.

If they had asked, they are likely to spin around to say MAS did not know what they are doing.

Unfortunately, some of our friends fell to the same simplistic logic to blame MAS endlessly. [read Syed Akbar here and Wee Choo Keong twitter here]. Surely we will not call them idiot.

Wondering whether they are in an over critical mode that they fail to be objective and ask themselves before believing into the conspirational CNN. One can be equally a dunggu for not asking the simple question of whether other Airlines have been using the same route within the last 24 hours.

They are accessible to ask the relevant people for information and clarification or at least to hear the other side of the story. Why did they not do so?

Too many are being judgemental and simplistically making conclusion but could not provide shread of decent argument and proof.
 
Only blog who answered it was The Unspinners [read here] that sensed and may have known that many other Airlines and quoted few used the same route.


Even so, there are those insistent on claiming Malaysia still took the risk for flying over Donesk using their smartphone information. Hate to call our school buddy by any names but just smart.... Isn't Donesk merely only minutes in flight time from the nearest plane crowded area?

That map showed lots of Airlines passing through the area, isn't it?

As of early this morning, there are motives already established, endless spinning by CNN and misinformation being spread like the fake picture above. Shouldn't we be wary of any unconfirmed information?


It is hardly 24 hours since the incident and yet we are already taking the side with malicious intended foreigners and making unreasonable expectation.

For sure, none of these people shooting their mouth can handle the half such a situation if they are in position to do so. Bila diusik untuk jadi Pengerusi MAS, pun tak mahu...

There will be a PC by the returning MCA Minister of Transport at 4:00 PM. Hope he is firmer against DAP, US, Russian and Ukraine than when he chicken out from doing a tic for tac against Singapore.

Update 6:00 PM:

MH17 PRESS STATEMENT
BY LIOW TIONG LAI, MINISTER OF TRANSPORT, MALAYSIA
 

FRIDAY, 18 JULY 2014

Ladies and gentlemen, I will now give a brief statement on the loss of Malaysia Airlines Flight MH17.

On behalf of the Malaysian government, and the Malaysian people, I would like to offer my deepest sympathies and condolences to the families of those who lost their lives. Our hearts go out to those who have been affected by this tragedy.

In recent hours, officials in the US and the Ukraine have indicated that Malaysia Airlines Flight MH17 was shot down. Should this be confirmed, it would contravene international law, and be an outrage against human decency.

Malaysia condemns any such action in the strongest possible terms, and calls for those responsible to be swiftly brought to justice.

INVESTIGATION

As set out in the International Civil Aviation Organization’s Annex 13, the Ukrainian government will institute the investigation into the circumstances of the accident, and be responsible for the conduct of the investigation. Updates on the investigation will be provided to the next of kin by the investigating authority, as per the ICAO guidelines.

Malaysia offers its full and unqualified support to the investigation. Malaysia has been formally invited to participate, and will send two senior accredited representatives to assist.

Malaysia also welcomes calls for an independent international investigation into the incident, and urges all parties to co-operate to ensure such an investigation can be completed.

It is essential that the integrity of the crash site be preserved, out of respect for the investigation and for those who have died.

NEXT-OF-KIN

Malaysia Airlines takes its responsibilities to the next of kin seriously. The airline has arranged for some 40 staff to be flown to Amsterdam, to support the families.

Separately, as the Prime Minister announced this morning, Malaysia willtoday dispatch a Special Malaysia Disaster Assistance and Rescue Team to Kiev.

In total, 62 people – 30 SMART team members, 15 medical staff, 10 Royal Malaysia Air Force representatives, 5 Malaysia Airlines staff, 2 Department of Civil Aviation staff – are travelling to Kiev.

PASSENGERS

Earlier today, Malaysia Airlines released a list of those on board the flight and their nationalities. The list included 41 passengers whose nationality could not be verified at the time, as they were in transit from previous flights, and had not entered passport control in Amsterdam.

21 of these passengers’ nationalities have now been verified, and 20 remain to be verified. The latest breakdown of known nationalities of those on board is as follows:
173 from the Netherlands
44 Malaysians
27 Australians
12 Indonesians
9 from the United Kingdom
4 Germans
4 Belgians
3 Filipinos
1 Canadian,br /> 1 New Zealander
Malaysia Airlines is in the process of notifying the next of kin of those on board. Once all families have been contacted, the passenger manifest will be released. In addition, Malaysia Airlines will release the cargo manifest later today.

Responsibility for releasing further information about the investigation rests with the investigating authority, which in this case is the Ukrainian National Bureau of Air Accidents and Incidents Investigation with Civil Aircraft.

FLIGHT PATH

The flight path taken by MH17 was approved by the International Civil Aviation Organization, and by the countries whose airspace the route passed through. And the International Air Transportation Association has also stated that the airspace the aircraft was traversing was unrestricted.

15 out of 16 airlines in the Association of Asia Pacific Airlines fly this route over Ukraine. European airlines also use the same route, and traverse the same airspace. In the hours before the incident, a number of other passenger aircraft from different carriers used the same route.

There were no last minute instructions given to the pilots of MH17 to change the route of the flight.
Earlier today, Malaysia Airlines released a statement on the aircraft’s service record, which showed the aircraft had a clean bill of health. They have also confirmed that all the aircraft’s systems were functioning normally. ACARS and the aircraft’s transponders were working and transmitting as normal.

CONCLUDING REMARKS

Ladies and gentlemen,

Before I take your questions, I would like to reiterate Malaysia’s condemnation of any attack on innocent civilians; its support for an independent international investigation; and most of all, its sympathies with those affected by this tragedy.

MH17 was carrying 298 passengers and crew. Our thoughts and prayers are with their families at what must be an incredibly difficult time.

SIA took same "risky route"

When Minister of Transportion, Dato Liow Tiong Lai was giving his statement to the press yesterday, the TV and PC was set on CNN and Free Malaysia Today.

The important Liow's quote was:

It didn't take an hour for CNN to brush off the Minister report and had a so-called expert to comment and accused MAS for not taking the precaution. FMT published a doubt creating article, "Why were commercial planes still flying over Ukraine?" at 5:32 PM.

The route that carries a dozen planes an hour high above eastern Ukraine is so popular it has a name: airway L980.

It is a primary pathway between the capitals of Europe and the mega-cities of Asia — Tokyo, Hong Kong, Mumbai and Singapore.

Although the skies seem like a boundless, borderless domain, the paths flown by commercial aircraft are well beaten, constricted by a desire to conserve fuel and a system of waypoints that stand like figurative mileposts at 35,000 feet.

“Typically, that flight plan doesn’t change much,” said Kees Rietsema, a professor at Embry-Riddle Aeronautical University in Phoenix. “If that airline flies every day from Amsterdam to Kuala Lumpur, they fly the same route every day.”

The only variation — and Malaysia Airlines Flight 17 flew about 200 miles north of its normal path Thursday — would be if the pilot encounters bad weather, he said.

“The airline is responsible for planning the route of an airplane, not the pilot,” Rietsema said. “The airline stays abreast” of notifications and warnings.

And the airline would assess the risk of flying over areas of conflict.

“Airlines overfly conflicted areas all the time, whether it’s in the Middle East or wherever it might be,” said Rietsema, an Air Force veteran and former commercial pilot who also served as a staff member at the Joint Chiefs of Staff.

“From a strictly legal perspective, you can overfly that closed airspace and there’s no one telling you you can’t be there, but on the other hand I would say that you also are assuming the risk on your own that something untoward could happen.”

By late Thursday, that aviation highway over Ukraine was empty, abandoned for fear that a missile fired from the conflicted territory below might take down another aircraft. Dozens of flights between Europe and Asia will be re-routed from airway L980 on Friday, and probably for weeks to come.

But until Malaysia Airlines Flight 17, flying its daily route from Amsterdam to Kuala Lumpur, was struck from the sky Thursday, it was business as usual on airway L980. U.S. intelligence said the plane, with 298 people on board, was brought down by an antiaircraft missile.

“It’s an established route and there’s no war declared,” said Robert Benzon, a former investigator for the National Transportation Safety Board. “There are commercial planes flying in and out of Iraq all the time.”

Much as the Federal Aviation Administration controls and regulates domestic flights, its counterpart Eurocontrol has authority over the airspace in 40 European nations, including Ukraine.


Eurocontrol said the Malaysia Airlines Boeing 777 was flying at 33,000 feet when it apparently was hit by a missile. The agency said Ukrainian authorities on Monday closed airspace up to 32,000 feet for commercial flights. After the crash Thursday, Ukraine banned all overflights of the eastern part of the country.

Brian Flynn, a spokesman for Eurocontrol, said airspace up to 26,000 feet had been closed since July 1. In both cases, the closures came after rebels shot down Ukrainian military aircraft.

The FAA said Thursday that U.S. airlines had agreed not to pass over the Russian-Ukraine border following the crash.

Before Thursday’s crash, about 300 commercial flights a day flew at cruising altitude above eastern Ukraine headed between Europe and Asia. Most of them fly over another conflicted nation — Afghanistan — as well. For example, other Malaysia Airlines flights passed over Ukraine on Thursday, as did aircraft flown by Singapore Airlines and Air France. British Airways routes some of its Asia-bound flights to the north of Ukraine and some to the south.

As the conflict escalated in Ukraine and Russia took control of Crimea, airlines were told not to fly over that part of Ukraine. The FAA issued a warning to U.S. airlines in April, and the International Civil Aviation Organization, a U.N. agency, cautioned that competition between Russian and Ukrainian air-traffic controllers had created an unsafe situation.
If the intention is to accuse MAS as being negligent, Liow's answered that there is no instruction to the pilot to change route.

As CNN was on a path steadfast to bury MAS, Singapore Airline was trying to downplay their presence near the MAS shooting in The Straits Times, Singapore's noon news yesterday:

SINGAPORE - Singapore Airlines has stopped all flights over Ukraine, following the crash of a Malaysia Airlines flight MH17 in the country's eastern region.

"We generally have a number of pre-existing flight paths for our flights to and from the destinations that we are operating to," a spokesman told The Straits Times on Friday. "At this point, we are no longer using Ukrainian airspace and have re-routed all our flights to alternative flight paths that are away from the region."

SIA did not elaborate on the revised flight paths, added the spokesman. "In line with aviation safety and security protocols, we will however not provide specific information on the flight path of any particular flight prior to flight departure," she added.

Singapore's national carrier also did not comment either on reports that flight SQ351 from Copenhagen, Denmark, which was flying over the area at the time was about 25km away from flight MH17 when it was allegedly shot down.

Sources, however told The Straits Times that the SIA flight was "pretty close."

There were 283 passengers and 15 crew members on board MH17, when it was apparently shot down and crashed while crossing above a conflict zone in eastern Ukraine where pro-Russian rebels are fighting forces controlled by the government in the capital Kiev.
The morning news of The Strait Times, Singapore was shocking. It would have shamed DAP leader, Lim Kit Siang for his allegation against MAS, thus for a sudden change in stance later to call for unity [read FMT here].

A Singapore Airlines flight was within 25 kilometres of Malaysia Airlines flight MH17 when it lost contact with air traffic controllers and crashed near the Russian border with Ukraine, according to a website that tracks global aircraft in real time.

According to flightradar24.com, Singapore Airlines SQ351, a Boeing 777, and Air India AI113, a Boeing 787, were about within 15 miles (25 kilometres) of MH17 when the Boeing 777 disappeared and crashed after presumably being shot down.

Malaysian Airlines flight MH17 disappeared from radar screens in eastern Ukraine at around 1415 GMT (10.15pm Singapore time), the carrier said on its Twitter account, hours after the Boeing 777, bound for Kuala Lumpur, had taken off from Amsterdam's Schiphol airport. There were 298 people on board.
In the picture, clearly there were 15 other airplanes in the vicinity. Singapore Airlines had only changed slightly their flight routes but still maintaining a low fuel route still not to far from the trouble spot.

The 17th flight was still traversing southern Ukraine.


SIA only changed their route away to the south of the Black Sea from the now announced trouble spot yesterday 18th.

The day before it was the same route taken by MAS. SQ 323 was only 30 minutes ahead of MAS.

So why then is CNN viciously singling out the victim MAS but spared Singapore Airline from the same  accusation of negligent? Is it because Richard Quest had once gave a rave review of Singapore Airlines? Or is it because MAS is seen as more vulnerable to be a trophy of media victim?

Maybe Quest could not get his way with a pretty MAS stewardess when he was either stoned on alcohol or drugs. He managed to do so on SIA's free complimentary 1st class.

Non-CNN version of who shot MH 17

Anyone watching CNN from the night of the incident without any suspicion and pondering over the CNN motive, they would have taken the bait hook, line and sinker.

Not only they are now convinced that MAS and only MAS was negligent in thinking the L980 route across southern Ukraine, they are now suckered wholesomely to believe that the Russian-backed Ukrainian rebel soldiers were the culprit.

CNN and Western media motive to blame the Russian is too obvious to take any of their words as credible.

Forcing Western Agenda

In a report by Malaysian Insider, Oi Eh Sun, a Malaysian at the Rajaratnam School of International Studies, Singapore is pushing on Malaysia to move away from non-aligned nation to be pro-western for an anti-Russian position.

Thus, Malaysians should not fell into the trickery and deception of these war-mongering media. Remember that unlike China, Obama hardly brought investment and business to Malaysia but only the MNC favoured TPPA.

Co-incidently, there is only one month left for the critical negotiation on TPPA. Only weeks ago, Malaysia is faced with another attack by the Sulus of Southern Phillipines. Anwar's sodomy case is due for the Federal court in early August.

Unlike MH370 incident, the opposition is not waiting for a week to attack MAS and government. 

With these constraints faced, Malaysia is placed in a difficult position by the MH 17 incident as it is caught between two superpowers; US and Russia.

No nation would want to be responsible for starting a war. These days the aggressor could be the one blaming the victim. Currently, both the Western allied Ukrainian and Russian government are doing it. So Malaysia has to tread it carefully.


Russia, China and Iran are allies with each other.

While, the Ukrainian rebels are Russsians and pro-Russians. Thus, the claim that MH 17 could have been mistaken by the Ukranian rebels as Russsian President, Vladimar Putin's plane is absolutely ridiculous.

Only the second day did another report changed it to be Ukranian government that made the mistake. That is a dumb excuse because it will lead to a declaration of war.

Thus far, the Russian denied they had passed through Uranian air space. The side claiming Putin had passed thrugh failed to furnish any flight route and proof.


Ukraine fired the first salvo with an offical statement claiming the missile was shot by Ukranian rebels but there is no official acknowledgement by the separist movement leader, Sergev Kavtaradze.

Russia denied responsibility to the incident. The separatist movement too denied any involvement. Their reason being their missile capability is limited to within 3,000 to 4,000 feet above sea level.

Ukraine also denied involvement in shooting MH 17.

They fed the international media with an official release of intercepted phone conversation transcript, pictures of vehicle carrying missiles to a certain undetermined location and proof of a fallen aircraft. However it has yet to be considered as an undisputable proof.

Ukraine. Britain. Australia. and the USA are alliance and media like CNN, Telegraf, Dailymail, Foxnews etc are pro western media. All western media reports are slanted to the west and Ukraine.

The resignation of Russian News correspondent in London could be intended to give the impression Russian are trying to suppress the truth. But is the western media giving a fair and independent report?

Thus far, Malaysia did not make a statement to confirm MH 17 was shot down as an official position in order not to be seen neither siding with the Ukrainian nor Russian. It is only prudent for Malaysia to not confirm the Ukranian allegation thus used the word believed to be.

Malaysia is only hearing the argument from both sides but have not been given the opportunity to verify.

International media continue to bombard Russia with all sorts of claim. Ukraine claimed the black box are found and sent to Moscow. They denounced the act as intervention. The US accused the Russian for tampering with the evidence.

Reuter sensationalised it further.



However, there have been no official announcement from Russian and separatist to have found the black box. However, the rebel did acknowledged in a statement to send the black box to Moscow for official investigation.

ICAO and Australia urged for investigation be led by an international team of expertise so that it is fair and transparent. .

Flight route taken by MAS is the same taken by other Airlines as determined safe by an international aviation authority and not determined by Malaysia. MAS merely takes instructions from the relevant authorities on the path and height determined.

The airspace controlled by the Ukranian separatist only ban western Airline from among others, US, and Britain but not to not aligned coountries like Malaysia.


The last MH17 radar was detected was at 33,000 feet. That is the allowable height not to be considered as encroaching into the rebel airspace. There had been no emergency call made by the pilot before communication was broken.

Notice that immediately upon the incident, the whole world proclaimed that domestic conflict in the Ukraine as an international conflict. this is to justify superpower nations, primarily US and NATO  to interfere and determine the direction of the comflict.

Most Malaysian failed to realised the media manipulation done. Some of the western media reports are credible but always be wary. They could be manipulating the news report to slant in favour of their political interest with Malaysia as victim of circumstances.

Though difficult and delicate, Malaysia is taking the rigt approach to not take side with any party until the facts are known as to what had happened, and why it happened,

Igor Kolomoisky

Thus far, they only actors mentioned are the Ukranian government, Russian government and Russian backed Ukranian separatist claimed as Donetsk People’s Republic. All denied shooting down MAS MH 17.

There is one important name that was intentionally left out by the media and is still remain silent. He is Igor Kolomoisky.

Born on February 13, 1963, Kolomoisky is a Ukrainian-Cypriot-Israeli business oligarch of Jewish descent and the current Governor of Dnipropetrovsk Oblast.

He is said to be the second richest man in Ukraine

Kolomoisky is the President of the European Council of Jewish Communities.

The billionaire governor fund his own army in Eastern Ukraine with massive weapons purchases and fascist mercenaries. Last month, Russia’s Investigative Committee had issued a resolution to indict Kolomoisky on charges of using prohibited means and methods of warfare.

The Buk missile system alleged to have been used to shoot down MH-17 is in Ukrainian stocks and has been sold by Kiev to Georgia. Media propaganda claimed Ukraine does not possess Buk system.

Donetsk Republic also says it has no missile system capable of hitting a plane at 33,000 feet.


Could Kolomoisky, who takes orders from Tel Aviv, pulled this attack off to divert attention from Israel’s Gaza genocide and try to put blame on Russia?

Israel and its sayanim are masters of false flag attacks. Malaysia's MH 17 was targeted because as said by Dato Seri Anwar Ibrahim, Malaysia support Hamas and strong campaigner against the Israeli Zionist regime.

Dollars and senses of flag bearers

When Pandelela Rinong won the first non-badminton  Olympic medal for the country in August 2012, the NST bestowed her the honour of "the country's flag-bearer". [Read NST here]

It means her victory enable the Malaysian flag to seen on the winners podium. Having the Malaysian flag covered by international media, it raised the profile of Malaysia and that has brand value says advertisers.

When Monsoon Cup was under heavy criticism for wastage, the Malaysian government engage a media consultant to determine the brand value of the 2009 World Match Racing Tour. The Event Media and Brand Value to Malaysia was RM 538,833,381 (USD 164,806,049).[Read here] The 2010 event had a media value of USD175.8 million.

Facebooker, William Cheah expressed his anger to the unpatriotic treatment by some segment of the public to a badly wounded 77 year old flagbearer of the country. He was talking out of patriotism but had he put it in dollars and sense, only then the pubic realised the real value of MAS.

Since ancient times, the flag bearer has always been a position of great honour. From battlefields to sports arena, the flag was always carried by the strongest, the most special and the most deserving. And it needed to be.

The flag bearer was the one that would lead the charge. It would be the point of rally when defeat seemed imminent. The flag bearer was the one who would bear the true essence of the flag it carried.

But with that honour came the greatest danger and responsibility.

It carried a burden that was heavier. It carried the danger of being the prime target on the battlefield. The flag could not afford to waver. The regimental standards must not fall into the hands of the enemy.

And so often, the flag bearer would be the one who would bear the heaviest burden of ensuring the flag was kept flying high and proud.

For the last 77 years, MAS, its crew and staff have been the flag bearers for Malaysia around the world.

Day in day out. Countless countries and people have experienced Malaysian Hospitality. It has been and still remains the pride of our nation. Since 1937. Before many of us were born. And it never failed us for decades.

Granted it is ailing now. Part of it due to mismanagement, we can't deny that. And also part of it due to global circumstances.

But today, it is wounded badly. Shot by an unexpected enemy. An arrow that streaked from the ground and brought it crashing down on its knees. It's wings broken.

So my fellow Malaysians...What do we do?

Pardon me if I get angry when I see fellow Malaysians asking for its blood. Pardon me for getting furious when I hear Malaysians gleefully seeking it's death and enjoying it's painful throes of suffering.

You have forgotten the burden it has carried all those years on our behalf. You have forgotten that it is our pride, our Malaysian pride which you poke fun of.

But I will rally with our standard bearer even as you seek to bring it down.

I and many more true Malaysians will fight for it when it can't defend itself much. We will raise it from its knees. We will bring It back to where it belongs.

Soaring in the clouds and sky, carrying our flag, sharing our love and most of all, staking our claim of pride in the global arena.

Malaysia Airlines... I fly with you. Malaysians fly with you. And we are proud to do so. Hang in there.

However, much of Malaysians have become to overly critical and took the myopic view of dollars and sen from the perspective of its profitability and the financial burden it has imposed on the nation.

Can't quite remember but Khazanah may have pumped in some RM4 billion to keep it flying. Maybe it is more. Heck ... let us throw a number of RM10 billion.

Looking at merely return and additional investment by shareholders is only part of the picture. If one look at it's asset, MAS has more assets than liabilities. It means there is still a surplus.

Off course, some will question the assumptions with more specific numbers. Having been up all night clearing some of our outstanding work before getting our "night sleep", we are not going to prepare for a debate to study the latest account now.


But, quite sure there is value to Cheah's patriotism to keep the flag-bearer flying proud. If we can read the thinking of those people in Khazanah Nasional, they must be thinking of the easy way out of dumping or closing up MAS.

That is the problem of having an analyst and fund manger as Managing Director. The new director is now being addressed as banker but his real background was a stockbroker. The guy one of the wives insulted in the movie "Bonfire in the Vanities" as picking up the crumbs.

We are still puzzled as to why Tan Sri Azman Mokhtar is still being kept as Managing Director of Khazanah when he failed to turnaround three companies he was assigned to from the first day of his appointment; namely UEM, Proton and MAS.

Frankly, it is more puzzling to see how he can be seen with high regards when his contribution is merely as fund manager whose chase for return still can't beat the Bursa Index performance and from a national interest, it is of minimal strategic value.

It is only indicative of the lack of quality of the person, whose been there throughout the decline of MAS from a world leading airline to a presently struggling one. It is he who pick and recommend CEO after CEO that failed and leave but despite his direct hands in the failure, he is allowed to stay.

Typical of financial man whose worldview is only dollar and sen and claimed his role is to maximise shareholders value. To be able to value things, it is not the methodology that matters but the dollar and senses to appreciate the value.

Given to a monkey, it will not know the appreciation value of a beautiful flower and just eat it.

If something insignificant like the one-week Monsoon Cup can have a value of more than half a billion ringgit, what is the value for selling the name Malaysia to the world non-stop for 77 years and at one time reached about 100 countries to the world?

Forget about how much brand value to Malaysia for the past 77 years. Just ask how much it is for only a year.

And we did ask one corporate man. In turn, he asked us to estimate estimate. The number we threw was RM2 billion. After much discussion, he said if managed properly, MAS could bring a brand value of RM5 billion a year to Malaysia.

Yet Amokh kept grumbling over having to pump in money and has decided that he will never pump any more. In other words, he wants Malaysia to get billions of worth in brand value without having to pay money and he is willing to forego the billion dollar worth of brand value for nothing in return.


That is just brand value from expose and free advertising. But doubt Amokh has the dollar and sense to understand that because he allowed the lack of foresight Chief Powerpoint Officer of Pemandu liquidate a property in London with a valueless advertising value for quick cash.

That is not taking into account as to how MAS helped to boast the country into the top 20 trading nation in the world. 16 to be exact.

Just add up the total trade generated to the country that can be attributable to MAS presence and it only add on to the M5 billion brand value.

Add also tourism.

Supposed it is beyond the ability of any party including government to sustain MAS and it is liquidated. Think of this.

Malaysia will be the only top 20 trading nation without an airline. It will depend and be at the mercy of the airlines of other countries or greedy low life bastard like Tony Fernandez to bring in business people and tourist.

If they all gang-up to refuse to go to Langkawi, the beautiful island will be closed and the people go back to the poverty stricken economic activity of padi farming in months.

MAS need a proper shareholder and CEO with the leadership and ability to think beyond just cost but more on generating revenue for the operations and perhaps, creative enough to translate some of the billions of value it created for the country into it's own profit.

If one can understand that strategic statement, then one should realise how dumb were the moves by Amokh throughout the years. Imagine still surrounding himself with failures and plunderers of MAS like Tan Sri Mohd Nor Yusof, Tan Sri Dr Munir Majid, Tan Sri Azman Yahya and many others.

Not straight to The Hague, Anwar

Few DAP leaders and one of their wives may have made lots of stupid statement in trying to gain political mileage and get themselves whack for being unsympathetic.

However, Dato Seri Anwar Ibrahim was just short of being a stateman with his statement showing compassion and support for the family of victims and government. [Read here and The Star here] Hopefully, he will show compassion without the pre-fix com- to Saiful.

His statement dated July 17th said so and he gave support to Dato Najib in parliament today in the debate. The idea to have a motion to unite the country is far from a stupid idea from any advisers but a necessary move in settling international dispute.

Anwar was careful as to not blame any parties in his statements. While he was on roll, he should not have tried to act smart and got his facts embarassingly wrong under the spot light of the whole world.

In his speech in Parliament this morning to support the government's motion, Anwar call upon the government to bring the matter to the the International Court of Justice in The Hague.(ICJ).

He was extending an earlier report in which he demand an international team of enquiry to investigate. Fair but the ship had left the port on it. The game could have went few steps ahead. 

Government could demand compensation from the wrongful nation but that is not the way things are done at the international level.

It is similar to his sodomy case in which it has to go through the Session Court or in his case was a step up to High Court, then Court of Appeals and finally Federal Court.

By the way, Anwar is due in court on August 8th after Hari Raya to get the Federal Court to agree to hear his case and acknowledge that his case will not be a waste of time to be brought to the Federal Court.

To do so, he must have a significant point of law other than a conspiracy theory against Tan Sri Shafee Abdullah whch was out rightly thrown out. Thus far, case heir apparent Ram Karpal to prepare for the case and is still muttering the same futile issue on Shafee.

Dato Seri PM-in-waiting aspirant but first go to jail, Anwar should know that one does not go straight to ICJ.

As told by one lawyer aspiring to do International Law, the international court and arbitration process for international dispute resolution, it has to go through a series of arbitrations and eventually it will involve ICOA before going to ICJ.

Our salute to the unknown and selfless team of people thinking together to solve this major national problem and potential international dispute or even war. Their presence makes me proud that there are still exist such Malaysians and not those shallow thinking DAP politicians.

After ICJ, there is another final process at the ICC.

That is what we understood from the bombardment of newly heard acronyms and unfamiliar international law conventions. Surely if Malaysia were to go to ICJ straight as suggested by the Malay Studies dropout, the ICJ judges will embarrassingly tell us, "Ini bukan kes liwat lah!!!"

Wonder what will the clown but politically savvy, Dato Mahfuz Omar be making a fool of himself in Parliment today. Nevertheless, respect is due for this SRP drop-out and former bag carrier at Bayan Lepas Airport.

Heard the defiant and rude Khalid Samad was taking cheap pot shot at MH370.

Wall Street worshipers cannot turnaround MAS

Rumours have been gong around since early July that MAS is going to be restructured. [Read The Star here].

Stockbrokers have been quietly recommending a BUY on MAS to take advantage of the plunge in shares arising from the alleged shooting of MAS MH 17. The price is too low vis-a-vis it's asset value and MAS has a better asset backing than lean mean Air Asia.

The rumour that it will go private has reached the ears of Wall Street Journal. Supposedly another turnaround plan will be proposed after Raya. Yes, everything will be after Raya.

Most likely, Khazanah Nasional will offer a General Offer and take charge privately like it did to hide the true financial status of UEM. With the same hands that wrecked it in the first place at the helm of Khazanah, serious doubt they can pull off another "turnaround".

That is unless Tun Dr Mahathir is willing to be there as Adviser to guide the National Pride and most valued brand name to Malaysia back to past glory. [Read back our posting Dollars and Sense of Flagbearer]


There will be a lot of hardwork needed and the management, particularly middle management need to be kicked in the right spot out or remain in.

The staff will need to be remotivated or revived their morale from a recent witch hunting done from a certain RM150,000 per month salary Head of Human Resource. The former human resource Manager of Danone biscuit factory does not understand her job and could only think of a chicken dance to release staff of work stress. [Read Woo Chee Keong here]

All one need is to think of MAS from the perspective of national interest and the path forward can be clearly seen.


MAS has the three major components; Cargo, and Passenger Operation - International, and Domestic.

Cargo is profitable and must continue to be profitable. The role that MAS played to bring tourist and businessman to this country has lead to increase trade between Malaysia and other countries. That  has translated to benefit MAS through MasKargo. 

The problem with MAS lies in the passengers airline which covers international and domestic. Someone was saying MCA wanted an airline for Chinese and Firefly was established, thus for the controversial Mandarin proficiency requirement for flight attendents.

It was not necessary but since we have it, might as well expand Firefly to takeover the domestic route and give Air Asia (AK) a run for their money. It must be profitably driven.

Change that name, it is cool but does not add value. Call it Malaysian Airline or plain Malaysia.

MAS will focus on international and carry the name of Malaysia. It must resort to its previous role as National Carrier and flag bearer.

AK cannot be considered as National Carrier for the same reason Garuda is not an Indonesian Carrier or flag bearer. For one it has no Malaysia on its name and thus does not give brand value to Malaysia but to Asia. AK is listed in other countries in the region and is also associated with other country brand.

As an only for profit organisation, it has refused national and social obligations. The fine example is AK ending the Rural Air Service (RAS) because it is not sufficiently profitable.    

MAS could be linked to be part of government tourism, trade or transportation role. For instance, why do one need TDC offices all over the world. That can be combined under one roof with MAS.

In fact, MAS office and presence at Airports all around the world are a better and more cost affective advertising to country than a big TDC downtown office or large expensive billboard.

From people to people to trade


On trade, MAS should re-establish presence in direct routes to Kuala Lumur with cities like Buenos Aires, New York, and many other countries in Europe and North American to enable people to people relation.

Look at what Emirates is doing to promote Dubai. If it is a money drainer, then keep it to few flights a week but presence all over the world we must.

Many countries like Iran that faced economic sanction to see the need to have a national carrier to enable Iranian and foreigners to come to Iran. 

Air Asia will stop when profit is not there any more. But, Malaysia must remain connected to the world. Israel is willing to pay for extra for security for El Al to fly all over the world despite many years of boycott.

Can MAS afford to do so?

With some creative thinking, MAS and Malaysian government can do it.

For bringing tourists, MAS should have benefited from the tourism related investment in hotel, resort, etc. but the Butcher from Shell slashed it without a ponder. He even wastefully over paid a Singaporean Malay lady executive merely to do asset sales.

They say MAS is bleeding by the day. Tourism has a promotion budget. Lets not waste that fund as political fund to create wasteful unnecessary event to please Minister's cronies. Why not rechannel that budget to MAS to enable them to play the role of tourism promotion?

If it is going private, MAS does not have to answer and report to Bursa every quarter. It can go on a long term thought though turnaround plan. No need to give a damn of opposition politicians. They are shallow in their thinking of nation building.

MAS could be used to invest in tourism.

As a corporation, they would be more effective and synergistic to be involved in tourism than Tourism Ministry's PAMPENA. If MAS is involved in Tourism, most of tourist agencies cannot squeezed MAS any more cause they can compete at their doorstep.

If only MAS management had some thoughts to buy the company providing ticketing system,  Abacus which they used to subscribe to, that would have put their hands direct on a valuable database of air travellers around the world.

The important thing to do is to bring back the old sense of family and pride back to the staff. Managers of MAS must stop behaving like school headmaster going around with a cane to find fault and scold. They need to be more a listeners than the tendency to muscle flexing.

Nation builder

Most important in getting this plan, it need someone who feels strongly about national pride and bringing dignity to Malaysia. It has to be someone so synonymous with nation building

His presence is not to sleep and enjoy the lavish salary and office paid by MAS for his retirement but to motivate, inspire and bring back a sense of pride for serving the nation into the psyche of management - top, middle and lower, staff and down to menial workers.

That is only one person and his presence will attract and harness the right brains to help strategically draw up a proper turnaround plan and not the one level thinking turnaround plans that have been brought in.

He has committed himself for Proton to bring in RM1 billion of R&D funding, thus he can do a national pride revival for MAS too. After all, Tun Dr Mahathir does not need to bother of Petronas anymore. It is an MNC taking it's own path. His heart is no more there with the attitude of Tan Sri Shamsul Azhar.

The way we see. It is him and only him that can inspire MAS back to its former great when it roam the world in 100 countries.

With the way the Wall Street worshipping people in Khazanah thinks, there is no way MAS will ever turnaround. Malaysia Airport under Khazanah could have raised the profile for MAS and Malaysia but they fail to do so.

Azman Mokhtar has openly said Khazanah will not invest anymore in MAS. So it means he cannot appreciate the need to reinvest to upgrade fleet to stay competitive. Thus he could be thinking of cashing out - liquidating or a selling the parts of MAS.

Nazir must be thinking of saving CIMB's loan in Air Asia and that was the reason for the manouvre for Air Asia to "takeover" MAS and do a chop shop operation the last time around. MAS Kargo is something Tony F would want to lay his hands on.

The problem MAS could not turnaround is also because those people on the Baord of Directors of MAS and Khazanah has no creativity to do turnaround and create opportunity. They are too predictably text book and their ideas does not bring about awe.


Among them are the very people that plundered and failed in carrying out their task for MAS. They are never concerned with MAS. They do not know it's history and thought MAS started as Malaysian Airlines System.

As for sleepy, why was he as Adviser not seen visiting the aggrieved families of the crew victims of MH 370 and MH 17? Only Tun Dr Mahathiir took the effort and showed concern. 

As though they are a major tax contributor

In the last few years, Malaysians loves to adopt a western style argument to claim their rights to be concern as taxpayers. Rightfully so.

However, Malaysians forget that their livelihood is filled with subsidies from a government policy from the Merdeka days to control inflation and make living affordable. For them to talk as taxpayers, do these Malaysian pay more tax than the benefit they received?

For some group claiming to pay more tax than others, are they a major contributor of tax? The widely held believe is that they are the biggest evader of tax by not declaring their revenue, participating in illegal underground activities and laundering the illegal money that distort market mechanism.

Tax raid


YTL's Tan Sri Francis Yeoh had recently paraded himself to the political gallery as though he is a major tax contributor to hypocritically call upon government to do away with crony capitalism which he benefited immensely.

Now he is so silent. Why? Does he pay tax?

In the midst of big coverage by Utusan  Malaysia on tax evaders, there was a report of a major raid on a public listed company.

All the while, the major tax evader known to us was Tan Sri Vincent Tan. Our University friends inside the Inland Revenue Department alleged the Director General had given Vincent Tan a tax discount of more than 60% and a leeway to pay his discounted tax of RM150 million over 18 months.

It is within the sole power of the DG but it is unfair to the rest of honest taxpayers who has to clear up their taxes in 6 months!

It was also told to us by a source that his RM1.5 billion Tropicana land controversy brother, Dato Danny Tan is also guilty of the same tax practises.

However, we were told by an enforcement officer recently that the public listed company raided was YTL. The common misguided perception is that he was pinned for his crony capitalism remarks but any government officers would argue you have to start somewhere.

Many corporations have been evading tax. The enforcement agencies will have to pursue them all for us to write about other tax evaders. For the time being it is YTL.


Whose blood will not boil when one IT industry player said that YTL will get their failed Bestari.net contract renewed. Chinese politicians namely Tony Pua defended Francis Yeoh on crony capitalism and SIPP Energy award but it was DAP that raised issue with Bestari.net. [Read DAP here]

They were awarded contract at a tender price of more than RM4 billion when they are other contenders coming in at significantly lower than RM3 billion. Yet he is under investigation for not paying taxes?

Deputy Minister, Kamalanathan seems to be preparing the ground for YTL's contract renewal. Slowly but surely, he is slipping up and getting complacent.

Defending non-taxpayer


While DAP raised issue against YTL due to capital cronyism practises, DAP state assemblymen for Senai, Wong Shu Qi made a statement to oppose the proposal to charge Singaporean cars entering Johor. [Read Mael Pengerang here.]

Pemuda UMNO Johor demanded for a Vehicle Entry Permit (VEP) of RM100 in retaliation for Singapore's move to increase VEP to Malaysian registered vehicle. If Singapore wish to reduce the entry of Malaysian registered car, Malaysia has every right to reduce too.

Malaysia had to absorb infrastructure cost to cater to for Singaporean vehicles. Locals had to face  push inflationary pressure from Singaporean presence. Properties have rise beyond  affordability. Many other issues. [Read here]

Shu Qi's statement can be seen to be the new outlet for MCA's reservation to charge VEP to Singaporean registered vehicles.

As a PAP satellite political party, the popular presumption is DAP is taking care of Singapore's interest. It also means DAP is not taking care of Malaysian taxpayers interest.

The concern mentioned by Shu Qi is the economic impact of local economy, specifically retailers. But most retailers hardly pay tax and are major tax evaders. Most retailers in major shopping complexes in Johor Baru or even as far as Klang Valley and Penang are Singaporean-owned.

Why should we care? A slower economy could be that the much needed relief to the Johor Baru folks irrespective of race.

Perhaps the real reason has to do with Singapore's assistance in creating a political issue and sabotage of Rapid Pengerang. That area is where Singaporean benefited from smuggling activites and that sort of economic activities are to evade excise indirect taxes like excise duties. [Read here]

"Taxing" beneficiary


Since Malaysia had already built a special highway, Eastern Dispersal Link for vehicles entering CIQ into Singapore and Najib used to say locals will not be charged toll, might as well charge vehicles entering Singapore.

Bulk of users are non-tax paying Singaporean registered vehicles. Since so much infrastructure had to be put in place to cater for their presence in Johor Baru and government could not generate much revenue from their presence, let them pay!

MAS also attract attention of taxpayers.

The limited understanding of tax and revenue for the country was noticeable in the discussion on MAS. There are commentators talking about not wasting taxpayers money because of losses incurred by MAS.

While they are right in certain aspect, they fail to realise that MAS has contributed immensely to nation-building. They know of dollar but short of senses.

Supposedly doing strategic investment with impactful benefit to the future of our economy, Khazanah failed to understand the true value and harness the value into operating profit. Yet they talk of increasing shareholders value, in which the shareholders are the taxpayers. [Read here and here.]

When Chinese argue in commentaries of blog, facebook, forum, and social media to demand something, they love to claim on the ground as taxpayers. Some claim they paid more taxes than Malays, Pribumis or Sabah and Sarawak, Indians and other citizens.

Collectively as a race, they control the private sector economy - corporate and retail. But are they a major tax contributor?

Without shame, they think that they are a major tax contributor thus can make demands and sometimes unreasonable ones which they expect government is obligated to secede to their demands.


On another important matter, Khazanah is responsible as a major revenue contributor to the government. GLCs are the biggest revenue contributor to the country. Sources claimed more than 70% of corporate tax is contributed by GLCs.

According to the chart above, petroleum and corporate taxes forcasted to contribute RM88,2 billion for 2013. It translate to 72.3% of direct taxes and 42.3% of total revenue.

Personal income tax is only 11.9% of revenue. That include all working Malaysian and exclude those retailers and smugglers in which the majority are Chinese.

The legally paying trades in the indirect taxes figure is 18%. Quite sure more than 10 times can be collected should enforcement be more stringent. 

Consumption tax is small vis-a-vis the size so it is only fair for GST to be introduced albeit progressively and has to be thought through.

More important, government should go after the tax evaders first. Government is raising revenue and spending for the people. However, many loud mouth are talking as taxpayers when they hardly pay tax or on collective basis, their contribution is insignificant.

EDL toll: You can't have your cake and eat it too.

Oppositions complained over announced "toll rate" for EDL but it is free for use to Johoreans and help reduced traffic jam in Johor Baru.

For PKR and DAP politicians to oppose the VEP or new toll rates at the CIQ, it shows ignorance in governance and an irresponsible politicking that does not serve the interest of the nation.

The English idiomatic proverb, "You can't have the cake and eat it too" means one cannot or should not have or want more than one deserves or can handle, or that one cannot or should not try to have two incompatible things.

The proverb's meaning is similar to the phrases "you can't have it both ways" and "you can't have the best of both worlds." Conversely, in the positive sense, it refers to "having it both ways" or "having the best of both worlds."

The Malaysians or Singaporeans working in Singapore, earning Singapore income and pay Singapore tax, yet living in cheaper Johor Baru but using Singapore registered vehicles cannot have it both ways.

They can't have the cake and eat it too. So pay up.

In the previous posting, Singapore could tac, but Johor not allowed to tic, this blog complained that Singapore is raising the Vehicle Entry Permit (VEP) but MCA President seemed reluctant to collaborate to do a tic-for-tac.

Johor Pemuda UMNO called for a VEP of RM100 for Singapore-registered cars upon entry. It is almost equal to the Singapore charges of S$35 on Malaysian registered cars. While the relevant Johor exco member mentioned the VEP proposed charge as S$20.  

In his blog here, UMNO State Assemblymen for Kempas, Tengku Dato Putera felt it is only fair to do so. He wrote, "Singaporeans cannot drive Malaysian cars in Singapore and will be slapped with a hefty fine, we allow Malaysians to drive Singapore registered vehicles on Malaysian roads if it eases their purpose."

DAP Assemblymen for Senai, Shu Qi expressed reservation to the planned VEP on Singaporean registered car by citing the loss of business to Johor Baru retailers as reason.

This blog argued here that it is not quite relevant and beneficial to the government. Doubtful that it will significantly affect Singaporean vehicles or tourist coming to Johor. Not with the cheaper goods, petrol, hotel etc, added on furthermore by cheaper Ringgit Malaysia.

In a previous statement for a group of state assemblymen on July 9th [as reported by The Star here], Shu Qi expressed her reservation by seeking the revenue from VEP charged on Singaporean registered vehicles be channeled to improve the public transportation system in Johor Baru.

Address congestion


Shu Qi failed to remember that government had a plan to address the traffic jam and congestion at the causeway from spreading clogging up the whole of Johor Baru.

There was supposed to be a new scenic bridge planned to replace the causeway and that bridge would be connected to the CIQ and a highway that would disperse inbound traffic from Singapore and direct traffic to Singapore without causing congestion to the Johor Baru central business district.


The CIQ was planned as a node for a multi-modal transport system for road, buses and train that would help solved all the issues raised by Shu Qi. The problems faced by the congestion by both Malaysia and Singapore could also be solved.

Since Singapore did not cooperate to demolish the causeway, the plan was only for the Malaysian side to do a scenic bridge. Singapore not only refused to cooperate but sabotaged by scaring off a former sleepy Prime Minister to cancel construction.


Sleepy cancelled the bridge after the CIQ was completely constructed and the Eastern Dispersal Link (EDL) is already under construction.

Life has to go on for EDL. It was already completed four years ago, opened to the public for use but face resistance to charge toll.

Initially, Dato Najib said no toll was going to be charged and government was to  takeover the elevated highway but considering the large subsidy bill to maintain, it is fair for them to decide to revert back to the original plan to charge toll.

Upon the announcement, it is PKR and The Malaysian Insider that is screaming now. Why should they? After all, the outbound fare of RM6.80 and inbound fare of RM 9.70 is similar with the second crossing of outbound and inbound fares of RM7.50.

Blogger Jebat Must Die here highlighted few important facts. The EDL highway is free for Johoreans to use within Johor Baru to avoid traffic jam but charged to vehicles it is meant for, which is vehicles  using the CIQ to go to or coming from Singapore.

He highlighted that 60,000 vehicle used the EDL out of which 80% are Singapore registered vehicles. It means government had to come up with RM1.1 billion (via privatisation to MRCB) to build a dedicated highway to address traffic congestion problems related with these Singaporean cars.

Whether the vehicles are owned by Singaporean or Malaysians, they are most likely employed in Singapore, get paid in Singapore dollar, and pay taxes to the Singaporean government, while Malaysia is providing the accommodation, cheaper lifestyle and transportation infrastructure.

Why should Malaysia be saddled with the problems of vehicles of Singapore employees and the burden to provide better public transportation system as requested by Shu Qi for the economic benefit to Singapore?

If Singapore wants Malaysians to work in Singapore and not willing to pay them on expatriate terms, the least the Singapore based companies could do is to provide for their housing, transportation and other basic necessities in Singapore.

Insensible PKR

Najib only promised Johoreans in Johor will not be burdened

PKR politicians, Steven Choong and Jimmy Puah are opposing the toll by drumming up support from Malaysian owning the Singaporean registered cars plying the causeway and using the facilities built by the Malaysian government.

These are kiasu Malaysians coming from all over Malaysia who wants the best of both world; Singapore salary but cheaper cost of living in Johor Baru. They want to earn more money from the higher exchange rate, enjoy cheaper goods in Johor but pay tax to Singapore.

By opposing the toll rate, PKR politicians are demanding that these Malaysian should enjoy free infrastructure and access to Malaysian roads and highway for the comfort of having a private transportation which in Singapore, they have to pay up their nose to afford such comfort.

Come on. If they are concern about cost, car pool and use public transport to help their Singapore government paymaster reduce congestion in Singapore.

Essentially, these PKR politicians are saying government should subsidise their comfortable lifestyle without any benefit for the government and the remaining rakyat. in Johor Baru bear the inconvenience.

Yet PKR took issue to accuse BN governments for over spending, high borrowing, highlighted contingent liabilities and questioned subsidies like BR1M.

To earn political brownie points from Malaysians earning a living in PAP Singapore but voting in Johor Baru voting districts, it is not alright for PKR and DAP to be inconsistent.

Considerate neighbours

Choong and Puah argued that road users must have the rights to other non-toll alternatives. That is ludicrous. No such alternative route will ever be available when it comes to crossing the borders. Singapore practise the same but PKR raised no issue against Singapore.
   
They claim it is not timely due to softening property market may actually turn soft. Perhaps at it's worst, migration out of Johor Baru could occur. Frankly, it is a much needed relief for Johoreans. Hopefully the skewed demography of non-Johoreans will be corrected. 

Singapore is also guilty of increasing financial inconvenience of these daily commuters to Singapore. Blame it also on them.

The immediate effect to Singapore will be a massive labour and skill shortage which would also soften their economy. Furthermore, it is not easy for Singapore to replace Malaysians with other nationalities.


When Singapore decide to sabotage our scenic bridge plan, raised VEP, or an upcoming toll increase, they never considered the implication to our side or bother to discuss. Neighbors are supposed to be concerned with each other but they are only concerned with their own.

It is high time Malaysia make them understand that whatever affects their neighbor will affect them too. It is time they absorb the cost of having Malaysians working in Singapore and not just lump it on Malaysia.

In the meanwhile, somebody has to pay for all that the Malaysian government has spent on but rakyat not getting the economic benefit. Definitely not the Johoreans in Johor.

Those highly paid for working in Singapore could certainly afford to sacrifice a few more Singapore dollars for Malaysia.

Singapore's Land Transport Authority office

Factory bus drivers was heard to hold a demonstration at the Sultan Iskandar Building in Johor Baru this morning.

At the CIQ this morning, two factory bus drivers left their buses and blocked the CIQ in a protest against Malaysia charging "toll" for use of the Eastern Dispersal Link into Singapore. The four years overdue toll charges is being drummed up by DAP as increase in toll by 570%.

After they have practised their democratic rights, which Malaysia is more open to these days, these bus drivers should do the same at the Singapore's Land Transport Authority at the old Kandang Kerbau Hospital at 1 Hempshire Road, Singapore. Block the road with few buses at Singapore's CIQ to see how democratic Singapore is to dissenting views.

After all, Singapore should now be open to dissenting views since Singaporeans fund and participate in demonstrations to sabotage Rapid Pengerang to save their smuggling business. PAP volunteers participated in the Tenang and recently Telok Intan by-elections to support PAS and Malay DAP candidates, respectively.


This morning on the first day toll is charged for the EDL highway at the CIQ, two factory buses  jammed up the bus lane to Singapore with a demonstration. This had disrupted other public buses making their way to Singapore.

Sources said the demonstrators demanded that toll charges be reviewed back to the old rates. Otherwise, the same demonstration will occur tomorrow.


There was negotiation between the leader, one Chandran P. Gopa with the the Pengarah Lembaga Lebuhraya Malaysia Bahagian Selatan, En Mohamed Ridzuan bin Jahidin.

Touch N Go cards of RM10 each for 200-400 pieces was offered and agreed as short term measure. The payment mode for entry use the Touch and Go card and the cards given allows for traffic to flow again.

One eye witness source said there was no demonstration but it was merely staged by two bus drivers who blocked the bus route about a few metres from CIQ tolling. The two drivers then refused to bulge thus jamming up the entry into the CIQ. However it gave the impression of a demonstration.

Hopefully they would be fair and do a similar exercise in Singapore. Do not blame one side and keep quiet on the other involved party. Singapore charges a higher Vehicle Entry Permit than Malaysia.


Malaysia had to built infrastructure to solve the traffic problems created by these Singapore registered cars owned by employees of Singapore based employers, who pay income and road taxes to Singapore but enjoys the cheaper urban in Johor Baru at the expense of Johor Baru based residents and employee.

Why should Malaysia spend money and go out of their way to assist even Malaysians to get employment in Singapore?

They should make their demand from their Singapore employee or demonstrate in front of the Singapore authorities which would most likely not give a damn and pass the buck back to Malaysian government.

See if these bus drivers which suspiciously pulled this antic at DAP's request will ever be allowed to return to Singapore should they try to hold such a stunt in Singapore.


Ask DAP are they more concern for Singapore or for Malaysia's interest? By right they should use their Singapore connection to get the Singaporean authorities to lower VEP and toll rates, better still make it free for DAP sake. Not give bodoh excuses like why certain non-Singapore bound EDL users are not paying for use of EDL. Is DAP asking PLUS to charge for use of highway within Ipoh city limits?

Still waiting for DAP government of Penang compensate PLUS and demolish the two promised tolls in Penang.

Khalid should bare all or bear the consequences

In late March and early April, this blog put up two postings with regard to the questionable land deal with Tropicana.

The first posting, Khalid sold 1,172 acres land for kickback? discussed the deal in which the state sold land to Tropicana for a 20 years repayment with a small deposit but they sold off 25% of the land for a handsome profit and the proceed provided the cashflow to develop the land.

Sheer rent-seeking. However, it is not UMNO, but PKR government looking to be in cohort with a korparat. It raises suspicion that it was a deal to pay off Tan Sri Khalid's RM67 million loan to Bank Islam.

In the second posting, Royal touch to the Tropicana land deal?, a source was saying someone with a royal surname acting for Khalid. This would have made rumour mongers churn slanders that Khalid had paid off someone for his current political fight for survival.

DAP was believed to be upset with happenings involving the land deal, which almost affected Chinese votes in the Kajang by-election and surely affected Chinese votes at Telok Intan. There is a new twist to the Tropicana land story spreading in the social media.

DAP was upset not for the right reason but the wrong reason.

Why is DAP siding with PKR to replace MB Khalid?
In April 2013, a vast swathe of land, covering 1,172 acres – that lies closeto Kota Kemuning, Putra Heights and Bandar Rimbayu with accessibility to four major highways - was sold to Tropicana for RM1.297 billion, payable over a period of 20 years.

Less than ten months later, in Jan 2014, Tropicana sold just 25% of this land (308.72 acres) to Eco World for RM470.67 million cash. Up to that point, the only payment it had made to Permodalan Negeri Selangor Bhd (PNSB) was a deposit of RM50 million.

On hearing this, on March 29, Khalid was fuming mad and requested accelerated payment from Tropicana for the sum of RM844.2 million instead of RM1.3 billion over 20 years. 

The sum is yet to be paid.They were able to make this outrageous sale because under the agreement, some smart fool in PNSB decided to transfer the full power of attorney to all the land to the buyer despite only receiving RM50 million out of RM1.3 billion.

Word on the market is that MB Khalid is making it hard for this sale to Eco World toproceed unless Selangor receives full payment.Tropicana is still negotiating with MB Khalid for this but Khalid is insistent on the full amount to be paid first before allowing the transfer.

Tropicana is owned by Danny Tan.
Danny Tan and brother Vincent Tan are now doing big-time property development in Penang including the RM10 billion GDV Bayan Mutiara Penang World City project (where they bought the land at a very cheap RM240 psf payable over 5 years from the Penang State Govt) and also the IKEA Batu Kawan deal thru Ivory Properties Group. 

Vincent Tan is also involved in the multi-billion redeveloping of the Penang Turf ClubSo, other than a common big-time property developer friends, why else is DAP concerned with removing Khalid as Selangor MB?

Perhaps this article from more than one year ago before GE13 by RPK regarding this land sale can shed some light. Look for two senior DAP leaders (and one senior PKR leader) that RPK had implicated in his story here:

By the way, coincidence of coincidence. Both of these two very senior DAP leaders have since been dropped as Selangor EXCO with one not even getting a seat to contest in GE13. I wonder why?

This deal is not gonna be easy to explain for them..

1) Why the extra generous 20 years payment terms?

2) Who transferred full ownership of the land to them even though they only paid RM50 million out of RM1.3 billion deposit and hence allowing them to make RM420million cash profit within 10 months.

3) Why did MB Khalid get angry and demanded full payment immediately instead of 20 years - just less than a year after the contract was signed?

With the link between the Tans and the Developers Association of Penang or DAP established, the social media message is inferring that DAP was instructed to get rid of Khalid at the behest of the Tan brothers for trying to cancel the deal.

The suspicion is Khalid will try to clean up his name in the Tropicana deal. If so, then he should start to speak up and stop his stuttering. Quite sure he can strip naked the pretentiously innocent looking DAP leaders like Lim Guan Eng, Teresa Kok, Hannah Yeoh, etc.

Khalid should reveal also the truth on the likes of Ronnie Liu, Ean Yong, etc. This could implicate PAS leaders so indebted to Anwar and DAP like Mat Sabu, Khalid Samad, Dr Rani, etc.

If Khalid does not, then the responsibility on the Tropicana land deal falls on him. Knowing Khalid's tight control on the state coffer and SLCs, major corporate deal  does not surpass him. He cannot claim ignorance or pass the buck to PNSB.

This blog make no bone to express our disgust to discuss Interfaith issues. Faith is something personal. As far as possible, it should remain so and kept within the ambit of the Federal Constitution.

However, it took a legal dimension when conversion by one spouse results in dispute over the religion of the children. Whatever the argument, divorce should be done amicably and religion of children should be resolve within the family and not to burden or divide the society.

One friend noticed and concluded that interfaith issue is more synonymous with the more argumentative in nature Indians. Be it parents or lawyers or human rights activists or man the woman covert to marry or priests and archbishops, or women columnist cum gay rights activist, or liberal writers, so on and so forth, it will involve Indians or Mamak at the fore front or as the most vocal.

The latest involving Ustaz Shahul Hamid Seeni Mohameed Hamid is no indifferent as it involves a Mamak. The freelance speaker is a member of PAS and likely to be part of PAS psywar operating from masjid to masjid and surau to surau. His lawyer is likely to be PAS MP and a mamak, Hanifa Maidin.

Nevertheless, we disagree with Attorney General's strange swift action to charge.


Increasingly, the Malay and Muslim population is unhappy with Tan Sri Gani Patail, police and MCMC. Unless a convincing answer is forthcoming, it lead to a political backlash to BN as  government enforcement agency and machinery is seen increasingly to discriminate against Malay Muslim.

The log arms of the long seemed fast and swift against Malay offenders, justified or not, but not on non Malay Muslims, especially the seditious remarks of DAP Chinese Red Bean Army against Malays and Muslims.

The action on road bully Kiki was swift but the police could not locate and charge a Chinese man,  who is very much recognisable on video for abusing a Malay boy with hands tied and caught for theft.

The latest outcry on AG got even one Ketua Pemuda UMNO Bahagian to strangely gave support to Ustaz Shahul for the seemingly unfair and unjustified seditous charges against him. [Read what happened in MyNeweshub and Malaysiakini here and here.]

Maybe UMNO is trying to talk PAS into a coalition, but it got opposition friendly Sinar Harian to take the risk of giving a front page critic of AG.

The act criminalises speech with "seditious tendency", including that which would "bring into hatred or contempt or to excite disaffection against" the government or engender "feelings of ill-will and hostility between different races".

From a simple understanding of the description, it looks to be that the Indians of Shah Alam are on a selective judgement mode.

The Indian villified Dato Zulkifli Nordin till he lost badly in Indian areas for his remarks on the practise of Hindu religion amongst Malay PKR crowd but PAS supporter Indian could accept Ustaz Shahul explanation.

Though disparaging, Ustaz Shahul and Dato Zulkifli Nordin made those "comparative religous practise" among Muslim believers, which happen to be PAS and PKR supporting crowd. MIC and then Hindraf, respectively made police reports against both of them only many years later.

Ustaz Shahul and Zul Nordin is speaking among Muslim believers. And quite sure Christian or Hindi priests do make similar remarks on the practise of Islam, and others religion. It is only natural to strengthen the faith of their own followers and should not be deem as inciting hatred.

It is those that took the issue outside the confine of the private affair and into the public sphere that has "seditious tendency" which is trying to "bring into hatred or contempt or to excite disaffection against" other faith and "feelings of ill-will and hostility between different races.".


In this case, The Unspinners wrote here yesterday that it is MIC that made the report and make this issue to incite the Indians against Ustaz Shahul that commited sedition. Police report must be made against Dato M Saravanan and Youth leader, C Sivarraajh and AG should respond swiftly.

Moral hazard of expecting Khazanah to turnaround MAS

Last night's news on TV featured PAC Chairman, Dato Nurjazlan Tan Sri Mohamed commenting that MAS will have to be de-listed should there be no new capital injection.

It is public knowledge that MAS is bleeding by few million daily with not much could be done to cut cost and boost revenue.

Subsequent to the shooting of MH17, there was news report that there was a plan hatched, which was rumoured to involve going private, will be announced immediately after Hari Raya.

Have written this before and will keep writing it again.

How could MAS undertake a successful turnaround when the same bunch of  turnaround con artists and plunderers linked with Khazanah Nasional, which were responsible for the decline of MAS from a world reknown airline to its present position, be the ones putting together the plan?

It is the same bunch, who propped up Air Asia at expense of MAS and almost got away with a collaboration with Air Asia, which was to favour Air Asia again.


The first turnaround by Bina Fikir involved buying over Tan Sri Tajuddin Ramli's equity and it eventually led to the takeover by Khazanah. Bina Fikir's Managing Director, Tan Sri Azman Mokhtar was made Khazanah's Managing Director.

The hands behind was Tan Sri Nor Mohamed Yakcop. He was responsible to manouvre and unsuccessfully attempted to fix Tajuddin with criminal charges and civil lawsuits.

Till today, there are those still trying to blame Tajuddin but when he was stuck with the debt problem arising from the ringgit devaluation, MAS was operating profitably.

Thanks to Dato Seri Anwar's cahooting with Jewish financier and rouge speculators, it was only the balance sheet that became a sudden and unbearable burden.

Together collaborating in the attempt to do that number was the failed Managing Director, Dato Idris Jala, who lied and hide the true operating loss. He was personally picked by Tun Abdullah Badawi's son, Dato Kamaluddin.

Abdullah's man, Dato Anuar Zaini was the mastermind together with Dato Kalimullah and Nor Mohamed Yakcop.

Despite his repeated failure to guide and turnaround MAS, UEM and Proton, not to mention losing RM16 billion of nation's reserve in currency trading, Nor Yakcop is still kept as Deputy Chairman of Khazanah and Management Committee Chairman of Khazanah.


Abdullah's family benefited immensely by a long term catering contract. He became adviser upon resigning as Prime Minister but failed to show his face throughout the ordeals the company had to face in the disappearing MH370 incident and recent shot down of MH17.

When management send off the nervous crew to work the Hari Raya morning, he is celebrating Raya in Melbourne totally oblivious to the company he is supposed to advise but bore the cost of his multimillion ringgit office in Putrajaya and earn fat monthly salary from for doing nothing.

CIMB, which is a major financier of Air Asia, had its former CEO, Tan Sri Mohd Nor Yusof as Managing Director during the execution of the Bina Fikir financial restructuring plan. He returned back as Chairman of MAS upon the collaboration with Air Asia and still remain.

Dato Nazir Tun Abdul Razak, who is now Chairman of CIMB Group and Director of Khazanah, was much involved in the Air Asia collaboration and behind the scene was involved as Investment Banker in the Bina Fikir plan.

The original partner to Azman in Bina Fikir, Dato Rashdan "Danny" Yusof had returned briefly in the collaborated MAS as Executive Director before got nannied out of MAS.

An important person and still involved is former Danaharta Chairman Dato Azman Yahya.

He had been part of Nor Yakcop's self serving machinery in Dana Harta to force out shares and asset from entrepreneurs for cheap and was suspected to have sold it back to cronies.

For his role, he was given the IT privatisation of MAS and important component which in the information age, should strategically have remained within MAS.

Throughout the decline of MAS and the changing CEOs from Mohd Nor Yusof to Dato Fuad Dahlan, Dato Idris Jala, Tengku Dato Azmil and now Ahmad Jauhari, the same bunch of people are still the ones carving out MAS and formulating one failed financial turnaround plan after another.

It only shows they had merely theoretical textbook knowledge of airline operations and was testing out one  textbook turnaround case studies after another at the expense of MAS. It could be possible they are just destroying it for Air Asia.

The problem in MAS is really moral hazard at the highest level.

Some may have issues with Tajuddin but unlike them, he had put his money where his mouth is. Analyst/fund manager Azman Mokhtar, Khazanah boys, and the bankers are all salary men, who takes risk but the cost is borne by government.

News of resuscitating Malaysia Airlines (MAS) is back in circulation especially after the second tragedy in five months.

Various proposals, from corporate restructuring (whatever it means), privatisation, rebranding, nullifying existing contracts and getting rid of MAS’ employees union are being proposed and considered by those in the know.

But MAS was already in limbo way before MH370 and MH17.

I remember massive injections of working capital were made many times earlier, way before the two tragedies occurred. Of course, now with its reputation dented, the problems have become more acute.

We must all look at the problems in MAS objectively.

To me it is more than another ‘restructuring’ exercise, since we have done so many times over with no significant effect.

It is also more than privatisation or state-ownership. We have privatised the airline before but with disastrous consequences. We have since de-privatised it but with no significant improvement either.

SIA (Singapore Airlines) has been state-owned and state-controlled from day one but the airline has remained profitable.

Disentangling MAS’ unfair and lopsided contracts is another major consideration. But a more pertinent question is why MAS entered into these contracts in the first place?

If this fundamental question is not answered, there is no assurance that contracts entered into in the future will not fall into the same trap even though we have gotten rid of present ones.

The same goes with the employee’s union. The fundamental issue is whether employees’ demands are reasonable and within the industry’s norm – fair wages in exchange of services rendered. We must bear in mind that MAS is not the only airline having to contend with employees’ unions.

I don’t claim to know the answers to the problems in MAS, far from it in fact. But I do believe the proposals being tossed around cannot really solve the problems either.

In many ways, the problems in MAS are those associated with moral hazard and incompetency.

When the airline was state-owned, those entrusted to run it were never held accountable for their performance. It was like running a business using other people’s money, the essence of moral hazard.

When the airline was privatised under the Malaysian privatisation model, the risks and the responsibilities of running the airline were never transferred to the privatised entity.

The real mockery was when the airline was making money, the profits went to the privatised owners. However when the airline was in trouble, the government bailed it out, fully and completely.

This is the essence of moral hazard again. Who in their mind would care whether MAS was run to the ground when their capital was never at risk?

AirAsia is successful because there is ‘real’ cost of capital and those entrusted to manage it are responsible for it.

If AirAsia gets into trouble, the investors must bear the consequences and those running the airline will be punished for it.

If MAS gets into trouble, no one is responsible except the taxpayers in general and the national coffers (the minority shareholders of MAS have no say at all, except to lose their money).

We must find a way to manage moral hazard first and foremost. Otherwise, the problems in MAS will remain irrespective of the business models or corporate restructuring exercises we pursue.
The problem of moral hazard is so prevailing that the existing management and staff hardly care about the company's failing condition but only themselves.

MASEU is only interested in asking for AJ's resignation. Maybe in two months time but can MASEU managed the company to profitability?

The President, Alias used to be in cohort with a member of management in securing inflight cleaning contract for himself. One MASEU officio, Jabar call for the return of Idris Jala as if no one knows that he was an Idris Jala hatchet man inside union.

NUFAM is more interesting to seditously pit the MH370 and MH17 victim family against management. Same like MASEU of having credibility issue at its leadership, NUFAM is headed by a sleazy womanising dismissed flight attendant.

In MAS, there are many characters, who are critical and vocal against the company, but it was to cover up their incompetence and disciplinary problems.

Talking of discipline, the discipline and commitment of flight attendants have been on the decline and it cost the company. MAS could operate with lesser crew per fight to reduce cost and give more rest time for others but the FAs resist.

The FAs have a problem of thinking they are the only one that matters in MAS and need to be treated like a celebrity.

Another celebrity and big ego group are the pilots.

The A380 has a special private apartment for them but they insist that the two seats allocated to them under collective agreement remain. That is something like RM20,000 value of seats that company could have sold off for London flights.

These flying express bus drivers come with such big ego as though they know all that is to know about management. Discussion with pilots are frequently not civil as they are many incidents of table banging.

But then, be it unions or FA or pilots, they must be frustrated that one management team after another and CEO after CEO, local or orang putih, yet the company could not turn to profitability but the packed trips are losing.

Sure, selling seats is a cut throat affair and seat prices could go up or down according to demand and supply but that is part and parcel of revenue management. It is puzzling that one management after another are not aware and bother to hear ideas of revenue management.

It is indeed tiring to hear another call to support Khazanah's another turnaround plan and Director of Human Resource can only think of a chicken dance to inspire staff when she has absolutely no idea to put together a human resource strategy for the company.

The ex-Air Asia top executives inside MAS are screwing up the company and knowledge attain from experience within the company will be forever lost.

AJ and Zaharah Zaid may not know of this. The young inexperienced middle management then brought in by Idris Jala still hardly appreciate the essentials in managing airlines but are insidiously short circuited up the ladder.

And some shallow minded racist thought bringing more Chinese will make the operation more serious and focus and the airline profitable. It is supposed to retain capable people and take in potential ones irrespective of race.

Zaharah was heard to be abusing her duty travels and outsourcing training contracts to her friends cum failed human resource consultants. Is she behaving like those commission taking buyers at the procurement department of a biscuit factory?

Operationally, communication between the various levels are almost nil. The boss are bossy, busily flexing their muscle and politicking like in a government organisation. Working staff are frustrated with their poor listening bosses and their generally self serving attitude..

Only certain top management or few middle managers are concern. The rest are just apathetic and do not seem to bother.

Our conclusion is simple. The common denominator that exist and the ones setting the policy and direction for MAS from the days of Bina Fikir till today is the real bunch that has to go.

Take MAS out of Khazanah and sack all the Directors first. Get airliners, the real pros to manage. Azman Mokhtar have been only taking in kawan-kawan.

An immediate problem will be to address the wide spread human resource problem pervading in MAS that cannot be thought over by a manager from a biscuit factory.

Otherwise, it will fail again and cost the government more money!

Bump into a friend at KLCC who told us that Khazanah is waiting for several proposals on MAS.

Our immediate response, "Not the same stupid game! Last time around Khazanah manipulated the share prices up to sell Proton at a premium to Syed Mokhtar."

Khazanah idea of turnaround is to repeatedly fail in all their turnaround effort.

Someone must check all their Sendirian Berhad start-up companies. Bet 90% of all the ventures spearheaded by the textbook understanding of Analyst/Fund Manager Azman failed too.

By right, Securities Commission should investigate Tan Sri Azman Mokhtar for rigging Proton shares then. Obviously not.

On our way back, someone rang us to tell that it is the talk inside MAS that MoF Inc is taking over MAS after Khazanah turned it private.

It makes more sense or perhaps it is what we had hoped for. MAS should be taken out from the jaws of the Khazanah incompetent but devouring sharks.

KHAZANAH Nasional Bhd, the majority shareholder of Malaysia Airlines (MAS), is believed to have started discussions with the government on the restructuring of the national carrier, and an announcement may come in a few weeks.

Business Times understands that Khazanah has held several meetings with the government over the last few weeks on the future of the ailing carrier.

“The announcement on MAS will possibly be made next week onwards,” a person familiar with the matter told Business Times yesterday.

It is believed that MAS will opt for a delisting from the Main Market as the first step to revive its fortunes.

Should the plan get the green light from the government, Khazanah will buy back the remaining MAS shares that it does not currently own. The move will enable the government investment arm to privatise the airline.

Khazanah holds 69.4 per cent stake in the national carrier, with the government holding a golden share.

MAS is worth RM4.01 billion yesterday after its share price inched 0.005 sen to close at 24 sen on Bursa Malaysia.

Meanwhile, another source said MAS favours the idea of delisting to make way for privatisation, rather than selling it to a third party or declaring bankruptcy. The source said the worst-case scenario for the airline is to opt for a complete shutdown.

“It is the last resort but it would be difficult.

They can’t just close down a national carrier. The airline has to work this out with the government.”

There has been much speculation on the fate of MAS, from privatisation to the selling of its subsidiaries and declaring bankruptcy.

The airline’s head honcho, Ahmad Jauhari Yahya, announced on June 25 that the only option to ensure the airline’s survival is by making radical changes to its business structure.

MAS has been hit by financial losses over the years.

Last year, the airline reported a wider net loss of RM1.17 billion from a loss of RM432.59 million in 2012 despite revenue growing to RM15.12 billion from RM13.76 billion.

Many are so frustrated that they want the the easy way out to sell or close-up MAS based on a camera snap shot of the situation.

IT is a terribly difficult conversation that we have put off for too long, and one that seems even more difficult given the current situation, but we need to talk about MAS.

For the airline, it has been an incomprehensible year to say the least. Enveloped in unprecedented incidences, there is no guide, no book, no tested marketing strategy that its management can use to help navigate our national carrier though these difficult times. No other airline has ever gone through what MAS is going through now.

As Malaysians, our first reaction is drawn from the feeling of patriotism, and that deep comforting knowledge that says "I'm home" when we hear the words "Kepada warganegara Malaysia, selamat pulang ke tanahair" as the plane lands on Malaysian soil. We fly Malaysia Airlines because of the comfort it brings – it's also a little bit of home that we take with us when we leave. The food tastes familiar, the language during announcements are native, the cabin crew represent our people, our culture, our values.
For many, MAS and Malaysia are intertwined and it is an iconic carrier. There isn't a Malaysian company that touches us on so many levels. And that is the epitome of why national airlines were created – national pride, and they act as country ambassadors.

However, today the modern airline industry is very different and travellers have options. With the onset of budget airlines and multiple modes of transport available for a cheaper price, the case of public interest is unconvincing. It's cheaper to bus the KL-Penang route than it is to fly and with considerations such as airport travel time and security process the time-saving argument is also weak.
Even if one does decide to fly, there are multiple low-fare carriers competing for passengers and this applies to international flights too with better frequencies and a variety of destinations. So how does a national carrier position itself and still report revenue? It's not an easy task but it's also not an impossible task. Other airlines manage to do it so why not MAS?

The harsh reality is that before the tragedies of 2014, MAS was in the red, reporting a RM4.1 billion loss for 2011-2013. That's a lot of money, much of it public money. So we start questioning the priorities of a bail-out. The pot of gold is not bottomless and MAS has had its hand in it too often with numerous government bail-outs. With scrutiny on the allocation of government funds, the growing call for responsibility and the pressing need for accountability, it is extremely difficult to justify another government boost into MAS just for the sake of vanity when there are other pressing issues such as security, defence, healthcare, education, etc.

So does that mean MAS should fold? After all, the first quarter net loss posted was RM443 million with the loss of MH370 taking the bulk of the blame.

It is important to understand that it's not just about MAS going bust and ceasing airline services. The airline is part of a much larger ecosystem which has a multiplier effect. There are the airports, the cargo, the avionics and then there are the people – the MAS workforce alone is about 19,500, that does not include others within the aviation ecosystem. What happens to them? How does all this impact the country's economy for example? It's easy to say let the airline go bust, but it also affects trade, tourism and connectivity.

Basic observation tells me that the airline should not be making a loss. After all, the planes are full and at the 2012 World Airline Awards, MAS cabin staff won the top award. So what's happening?

It's simple, the airline has been bleeding through the sides for years preventing it from being competitive. It's the understanding with certain quarters who pay coach but sit in business, it's the decades of lopsided catering contracts that sticks the airline with a cheque containing too many zeroes, it's the perks of complimentary flights without earning the miles and it's the cutting small cost but dishing out large compensations to the higher ups.
So no matter who heads the airline, and how great their credentials are, they are literally carrying the weight of an ailing airline up a steep mountain of debt with their hands tied. Imagine what this alone has done to staff moral – and then add the weight of the two tragedies.

The question then is how do we turn the airline into a profit-making airline? In order to discuss a turnaround, we first have to acknowledge a few other challenges. While these observations may not reflect the totality, it is worth considering.

» At this point, MAS is not in a place of power to merge with other airlines. If the option is to merge, MAS will not have the upper hand.

» The MAS brand has become somewhat synonymous to tragedy and mismanagement, and that needs to be turned around to win back passengers' confidence. While many Malaysians have pledged their support to fly MAS, it's also about winning back international travellers.

» In doing that, it must be acknowledged that it is extremely difficult to build a hub so close to Singapore's Changi. To do so, it must include investing in infrastructure and creating policies that are conducive to creating the need to fly into Malaysia. There is an unscientific correlation to income per capita and the need for airline services.

While no airline has experienced such timelines as Malaysia has in this past year alone, there have been many national carriers who have had an infusion of government funds which partly contributed to turning around nose-dive bankruptcies such as Garuda Indonesia, Korean Airlines, Japan Airlines to name a few. Tap into those resources for a turn-around plan.

But if a bail-out is prescribed, there need to be cautionary measures to preserve the long-term health of the airline and industry. There has to be a workable time frame to avoid a welfare addiction like we have seen in the past. The government cannot keep throwing good money after bad.
Restructuring must include rebuilding pride in its people. The top guns of the airline have to be able to walk in to any room holding their heads high because they run a truly profitable airline – the national carrier. This means that the brand needs to be protected – it needs to represent the values of the country and the political baggage should be dropped.
While the politics of airspace is complicated to navigate, it's imperative that the government prioritise MAS's needs by allowing the airline to run not just as a business – but a profitable business that has lowered costs without compromising its reputation of service. That means holding true to its beginnings of being an ambassador for the country.

It's a painful road ahead with restructuring, cost cutting measures and other reforms but the airline is in a very difficult position. It's really a dammed if you do, dammed if you don't situation, but the reality is we can't sit in limbo for much longer, and that's why we really need to talk about MAS.

Another part of the words circulating in MAS is that Tourism Minister, Dato Nazri Aziz will be taking charge of MAS. Under what capacity or structure, not much is known yet.

This blog did wrote of combining the National Airline unit with the Malaysia brand and tourism operation here and here. However, we are not claiming credit. It is somebody else's and the person is generous enough to want the idea be shared and made known to benefit the country.

If MAS were to entertain MASEU, NUFAM and all those noisy Unions, can they think of any ideas like this? The answer is an emphatic NO. Yet they talk as if they are concern for the Company's future.

Rush to sack Khalid foiled [up-dated]

His Highness the Sultan of Selangor is due to berangkat overseas from August 12th to 24th.

From all the moves of Dato Seri Anwar Ibrahim, he wants to get his wife's appointment as Menteri Besar of Selangor as soon as possible before his highness leaves.

Without a royal consent, the state assembly could not convene, the dismssal of Tan Sri Khalid Ibrahim as Menteri Besar through of vote of no confidence could not be done, and planned appointment of Datin Seri Dr Wan Azizah Wan Ismail will not happen.

Anwar had planned to get Khalid sacked by the 10th tomorrow. That way PAS has no option but to accept PKR decision to submit Wan Azizah's name to his highness. However, Khalid has made his move.

His lawyer and Rocky Bru's former lawyer, Edmond Bon has issued a letter of notification to PKR's Disciplinary Committee Chairman. See below:




Basically, Khalid has notified the committee that he has a counsel representing him and his lawyer have warned the former Gerakan Minister, Dato Dr Tan Kee Keong that anything you see or issue will be used against you in a court of law.

PKR will hold a press conference on this new development and reporters should ask as to under which law or quote from the party constitution is the current proceeding against Khalid being done.

Why is Anwar rushing if he is not rushing the legal process on his sodomy case but seemed to rush this process to sack Khalid?

Subsequently he was requested to attend a hearing yesterday in which he was requested to answer a list of new issues:

Khalid questioned as to the sudden appearance of 4 more issues. He inform that he will not attend the hearing date set for yesterday and today but will only appear on August 15th next week.




PAS Central Commitee is supposed to meet on August 10th tomorrow but delayed the meeting twice to August 13th and now August 17th after Khalid's hearing.

In the meanwhile, words on the grapevine are saying Khalid has requested his lawyer to file a lawsuit against The Malaysian Insider and will file a lawsuit against Dato Saifuddin Nasution and Rafizi Ramli for slanderous allegation against him on issues relating to Ecoworld, Tropicana and Bank Islam.

One will expect Dato Rashid Manaf or Ecoworld will file a similar lawsuit since he was accused of doing the payoff for Khalid's loan with Bank Islam.

The reported amount for Khalid's outstanding is RM67 million but as one former top executive of Bank Islam informed us, Bank Islam had a weak case since they did not apply 'duty of care' in disposing Khalid's shares in Guthrie and the settlement amount could have been only RM7 million.

Mampuslah Rafizi and Saifuddin. Been reading too much ABITW but not reading the cautionary lines.

In the meanwhile, Lim Guan Eng had sued Nasruddin Hassan of PAS who refused to apologise within the 24 hours stipulated period but only gave a reply. Guan Eng has no case against Nasruddin and Nasruddin's statement maybe naive.

However, Nasruddin did not bought into Guan Eng's often repeated threat and it looks like it is Guan Eng have bitten the bait and got himself trap. He will be dragged into other issues. 

The legal notification by Khalid's lawyer to Dr Tan may tie PKR's hand. Although Anwar claim to have the mandate from Pakatan Rakyat in which Lim Kit Siang signed for DAP but only Deputy President Mat Sabu signed for PAS, he cannot remove Khalid through party disciplinary process that easily.

PAS Presideent, Dato Haji Hadi Awang and Spiritual Leader Dato NIk Aziz Nik Mat have expressed support for Khalid and questioned the basis to seek removal of Khalid. PAS's Dewan Ulamak and Dewan Syura echoed the same opinion and position.

The Erdogan's inside PAS which support Anwar have questioned Hadi's position but dare not question Nik Aziz. Anwar reiterate that the two Dewan's position is not necessary because Pas has expressed agreement through Mat Sabu.

Earlier, Saifuddin loudly told PAS to stay off and claim the choice of Menteri Besar is purely PKR matter. In BN, the position of PM may be from UMNO but there is a process to seek opinion and  consensus from BN member parties in UMNO's succession plan.

Since decision in Pakatan Rakyat is based on a consensus, Saifuddin may have over step his boundary. While DAP and PKR may be able to out vote PAS, there is the possibility of UMNO and few assemblymen from PKR and DAP voting against a vote of no confidence.

The implication and possibilities is wide ranging but for the time being Anwar's game was read well by Khalid and he managed to foil Anwar's rush to sack Khalid.

With more time available, Khalid could be calling the shot. It is a contrary view to the common believe that it is done before the end of the month and Wan Azizah will be the first woman MB and a the first sleepy woman MB.

Khalid can go for broke because his still has the card to dissolve the state assembly. This is the possibility which many are also thinking. However, it might not be the case.

Khalid looks to be in the driver seat with Anwar's days as a free man is closing near. Without Anwar, PKR that is still unsettled with party election problem will crumble to pieces. The Erdogan inside PAS may come out to salvage PKR in which PAS grassroot tolerance with them has met its limit.

However, do not hope so much with UMNO. The grassroot do not understand what is happening and leaders at branch and division level are blur.

Lembaga Disiplin KEADILAN telah meneliti dan mengadakan siasatan berkenaan kes disiplin dan tatatertib TAN SRI KHALID IBRAHIM (Cabang Kuala Selangor). Kes ini telahpun dibentangkan dalam mesyuarat Majlis Pimpinan Pusat KEADILAN bertarikh 9 Ogos 2014.

Berikut adalah keputusan yang dicadangkan Lembaga Disiplin, yang turut mempertimbangkan surat-surat balasan oleh TAN SRI KHALID IBRAHIM bertarikh 6 Ogos 2014 dan 8 Ogos 2014, dan dipersetujui Majlis Pimpinan Pusat KEADILAN.

Beliau telah didapati mengingkari keputusan mesyuarat Majlis Pimpinan Pusat yang bermesyuarat pada 21 Julai 2014 yang sebulat suara memilih Presiden KEADILAN, Dato’ Seri Dr Wan Azizah Wan Ismail sebagai calon Menteri Besar Selangor yang baru.

Beliau telah membuat kenyataan media pada 22 Julai 2014 yang menyatakan keengganan beliau meletak jawatan Menteri Besar dan sehingga hari ini beliau terus enggan melepaskan jawatan tersebut.

Atas alasan ini sahaja pun, Lembaga Disiplin berpendapat beliau wajar dipecat.

Majlis Pimpinan Pusat turut mengambil maklum bahawa:

• Beliau ingkar terhadap keputusan yang telah dicapai oleh Majlis Presiden Pakatan Rakyat yang turut dihadiri Dato’ Seri Tn Guru Hj Abdul Hadi Awang, sdr Lim Kit Siang, dan Dato’ Seri Anwar Ibrahim mengenai:
o menangguhkan proses dan perbincangan mengenai projek Langat 2;
o menangguhkan kenaikan elaun Speaker, Menteri Besar, EXCO dan ADUN negeri Selangor;

• Beliau turut gagal mematuhi keputusan Majlis Presiden Pakatan Rakyat yang dipersetujui sendiri oleh beliau untuk melibatkan Jawatankuasa Penstrukturan Air Selangor dalam isu penstrukturan aset air Selangor;

• Beliau turut berkeras untuk meneruskan projek Lebuhraya KIDEX walaupun parti sudah mengarahkan beliau untuk mengkaji semula projek tersebut kerana ia bertentangan dengan matlamat dan manifesto Pakatan Rakyat yang dibentangkan sebelum Pilihanraya Umum ke-13 yang lalu;

• Beliau turut gagal memberikan penjelasan sepenuhnya kepada Majlis Presiden Pakatan Rakyat mengenai isu pelupusan hutang beliau dengan Bank Islam bernilai hampir RM70 juta.

Oleh yang demikian, adalah diumumkan bahawa TAN SRI KHALID IBRAHIM dengan ini dipecat dari Parti Keadilan Rakyat, berkuatkuasa serta-merta.

With the sacking, Khalid is no more a member of PKR and PAS must accept  that Khalid is no more a member of PR. If they do, game is over.

If they don't, then it could be the signal of a possible break-up of PAS from Pakatan Rakyat.

One possible reason for PAS to reject the decision is that Hadi, Nik Aziz, Dewan Ulamak and Dewan Syura have specified that Khalid must be determined guilty by MACC or other suitable agency. PKR Disciplinary Committee is not.

House Speaker could be in pursuit for an appointment with the Sultan to grace the convening of the assembly to call for a vote of no confidence on Khalid.

Unlike Perak's case, Sultan has no indication to assume Khalid has no more majority support in the state assembly.

Unless PAS, UMNO and those supporting Khalid make statements of support and dismiss the decision by the two Dewan, Sultan could not deny should Khalid request for the dissolution of the state assembly. To be fair, Sultan must allow the matter to be voted.

Khalid could bring the issue of his dismissal to court. Since he is no more a member, he may have lost his locus standi to bring the matter to court.

If the court see it that he has a basis, then the state administration will be in limbo till Khalid's position is sorted out. It might take years or the fastest months.

Will it be over before the month end or will it be a long bumpy ride?

Why not a long one? Then the public can get to know what kind of going on in this PKR runned state government. Then they could see whether what have been said here about Selangor's ruling government is true or false.

Our issues on PKNS is still under lid awaiting further development.

Again, he is missing the leaves from the tree to repeat his blame and call for CEO Ahmad Jauhari resignation.

He is still not addressing the real problem. What do can you expect from typical self serving and populist union officials. To paraphrase former American President Bill Clinton, it is Tan Sri Azman Mokhtar and Khazanal Nasional la ... stupid!

And, one clever statesman realised the validity in the argument of this blog's previous postings on MAS.

We reproduce the statesman's latest comment in his blog on the MAS privatisation or as he pointed out, it is nationalisation. Must be a wrong advise from a stupid overpaid and over rated Investment Banker.

MAS PRIVATISATION

1.I am a bit mystified by the privatisation of MAS. Khazanah, I believe, is a Government company, or at least a Government controlled company. The CEO reports to the Prime Minister and usually acts on the direction of the Prime Minister.

2.The Prime Minister personifies the Government. If a company is fully acquired by a Government company, is it privatisation or nationalisation?

3.Yes, a company that is owned 100% by one entity, is not a public company. It is a private company. But if that person or entity is the Government, can it be said to be private?

4.I believe prior to this privatisation, Khazanah owned 70% of MAS shares. Its control over MAS must be almost absolute. None of the minority shareholders can really say ‘No’ to MAS even if they all act together. So Khazanah has been in full control of MAS all this time. And all this time MAS has been bleeding profusely. In 10 years it has lost 10 billion Ringgit in terms of capital injection.

5.So why should anyone believe that with 100% control Khazanah will not keep on losing.

6.In fact with no one to check and give concerned criticism as when there were minority shareholders, MAS can go very wrong indeed.

7.In true privatisation, fear of losing money on the part of a private owner would force him to scrutinise the management and check the balance sheets frequently. The Government as the owner would be less concerned. The Government is about spending money. Any shortages (or losses) can be overcome by increasing taxes or borrowing money. The way money is being spent nowadays doesn’t indicate the kind of careful financial management and scrutiny that MAS would require in order to turn around.

8.Once when a new CEO was appointed MAS registered some profit. But that was through selling assets. How much more assets can MAS sell?

9.Catering was given to a company with very long term contract and even as MAS loses money the contractors seems to be doing well. A Government company will not be able to terminate this unusual contract. It is too sensitive. Someone might advice against it.

10.People in glass houses should not throw stones. Right. I shouldn’t say all these. I had such a bad record as Prime Minister. But I was ready to resign. And I did. I did because I failed. But no one wants to follow my example.

11.I may be wrong but I think Khazanah’s 100% ownership of MAS will not be much different from its 70% ownership. We are going to see a lot of new people who will receive huge salaries, allowances and bonuses and not much else. That I believe is how Khazanah operates.





Monkey waiting for cheap peanuts

In the good old days of profitability, MAS would serve cakes or cookies as the first meal to help passengers adjust to the new air pressure around them.

Since MAS fall into the hands of Tan Sri Azman Mokhtar when he was at Bina Fikir and then later into the Khazanah Nasional he headed since, passengers were served only peanuts and fruit juice.

Even that there is a jungle Monkey waiting outside quietly supportive of Khazanah another sure-to-fail-again turnaround effort. The animal has no business to comment but it did.

Good thing that Tun Dr Mahathir commented something yesterday. Otherwise, no one realise there is a jungle Monkey waiting for the Zookeeper to giveaway cheap peanuts.

Who would likely be that Zookeeper?


True enough, it is almost like the Malay proverb to give flowers to a monkey. It will just destroy the flowers and they have been destroying it for almost 15 years.

But the Zookeeper is not human but a Monkey in the Zoo giving cheap peanuts to his fellow Monkey.

This Monkey specie stand to lose his jungle for allowing Jungle Monkey to borrow his trees. He was the monkey with the money idea of putting the Zoo inside Jungle Monkey's jungle and it could have not only destroy the flowers but all the flora and fauna too.

Why then did Monkey turned Zookeeper and Monkey specie helping Jungle Monkey when they are only on paid salary? Their incomes is in the millions and are not peanuts.

Those who like Jungle Monkey will sincerely believe he did not steal fruits from the plentiful orchard. Let us just leave them alone because they like to be treated like animals in a cage and be asked to wait at the airport for 3 hours...!!!

Khalid's corporate move to de-register PKR

At yesterday's open house, the Selangor leadership crisis was the conversation of the evening.

The latest move by Dato Seri Anwar Ibrahim's boneka, Datin Seri Wan Azizah Wan Ismail to get 30 statutory declaration of support puzzled everyone as to why Tan Sri Khalid Ibrahim wants to stick around.

The answer is he wants to take it to the Assembly to do a vote of no confidence on him. All one need to do is to read back history on the Ming Court incident in 1984. It was an attempt to topple Sarawak's then Chief Minister, Pehin Sri Taib Mahmud.

All had gathered at Ming Court and as one old journalist who witnessed it described, "We have the numbers!" to requote Anwar's words used again by Wan Azizah. But, when it was near the time to do a vote of no confidence, there was no motion to do so.

Frankly, any "surat sumpah" used by Pakatan Rakyat politicians in their game of perception is as good as "sampah". Remember how the late PI Bala flip flop on his Statutory Declarations and Deepak too on his statements.

Another answer lies in Khalid's own words to want to cleanse his name.

And, one interesting part, which not many players, from both side of the fight - in PKR and Pakatan Rakyat (no blaming UMNO cause they don't bother) - did not realise is that Khalid is not playing politics but his approach is typical in a corporate board room tussle.

"Akaun sampah"?

Raja Petra's opening remark in his posting, "It's not about Khalid Ibrahim any more" said it right:
The debate is still raging as to whether Khalid Ibrahim is still legally (or morally) the Menteri Besar of Selangor.

Some same legally ‘yes’ but morally ‘no’. Some say both legally and morally ‘no’. Some say even if he no longer commands the majority in the Selangor state assembly he must be legally or constitutionally removed. And that would be through a vote of no confidence against him in the Selangor state assembly.

Some even quote the Perak Crisis of five years ago as the precedence in which to remove Khalid, while at the same time saying that the way Nizar Jamaluddin, the Perak Menteri Besar, and Pakatan Rakyat, were removed is wrong, even if the court upheld HRH the Sultan of Perak’s decision. After all, say these critics, the court will do what it is told (by the Barisan Nasional government, that is). Hence we cannot trust the court.

This means what happened in Perak is wrong but doing in Selangor what they did in Perak is right.

Different lawyers and legal/constitutional experts have different opinions. That is how lawyers make money — by arguing these differences of opinions in court. If the law is clear then no need to go to court. Only when it is ambiguous and is not clear do we need to go to court and make lawyers rich.
In this case, the avenue to resolve dispute is with the state assembly and istana.

Unfortunately, both the PKR and DAP politicians including Anwar's supporters in PAS have been disrespectful of his royal highness that they can only get a by-the-book treatment from the Sultan.


Instead of trying to win the favour of Sultan, they hired a handful nuthead, perhaps reflexologists massuseses from China, to further bring out his royal highness's anger by calling for a return of power to the people.

It only shows how legally illiterate and lacking in common sense these Pakatan supporters can be. They have a tactfulness of a bull rampaging through glass walled showrooms.

Khalid is playing his card in accordance to the "Code of Mergers and Takeover". It is unlike Pakatan Rakyat, whose argument is emotional and purely political as mentioned by Raja Petra. Eventually, they will have to deal with the issues Khalid placed upon them.

In a corporate game, it does not matter whether one has 20% or 15% equity but what matters is to achieve legal control of management, by hook or by crook but legally plausible.

One should realise that immediately upon clinching the legal rights to stay, he did what any corporate player would do and that is to sack the opposing team representatives on the Board of Directors. He should sack more but he need to stay legal within the four exco members.

The PAS exco members are bound by their party loyalty, in which they are effectively proxies to the real "shareholders" aligned to Khalid.

After sacking, a corporate player would dispense his lawyers to ensure the other side cannot move any more. If he is in the minority, he would apply all his resources to ensure the other side's advantages are neutered or if need be, destroyed till they achieve the upper hand.

Then only the soft approach to persuade or cajole support comes into the picture.

One thing corporate players do not do is to play on too many issues and fronts like what Pakatan is doing. They pick the front they want to fight and it must be the one advantageous to them. The whole game is usually about pulling the opponents into their preferred front to fight.

Khalid has shown more of his card yesterday and it is still the same issue he started with regard to his dismissal. That is the front he wants Anwar to come to. [Read here]

His lawyers told the press that the statutory declaration is all show. What matters is inside the assembly hall. [Read here]

So why is Khalid cool and confident?

Another lawyers said PKR had no legal basis to sack Khalid.

On top of that he said PKR had breached it's own party constitutution. The Act related with society registration specify that when a party breaks it's own rule intentionally, it will be de-registered. [Read Malay Mail Online here]

Pakatan can play all the sentiment games they want including pressuring the lawyers [ Read Rakyat Post here and The Star here] but the pressing matter, which they have been ignoring, is the legal issue on the dismissal of Khalid.

PKR had also open themselves to more potential liability by raising issues which had defamed Khalid. That will be another front that will push further Anwar, PKR and DAP further into defensive mode.


DAP already have long standing issues with ROS on their two election of the Central Committee. While, reports on PKR's faulty party election have piled up at ROS for a long time.

Both are ripe for the taking especially with Selangorian and party grassroot are disgusted with the current Kajang Move episodes.

As for PAS, better preserve themselves and let PKR and DAP have their headache. If they decide to vote in favour of Wan Azizah, it is a wasteful move. By the refusal of his royal highness to receive her attendance, Wan Azizah will not get selected by his royal highness.

Voting in her favour tomorrow means PAS Central Committee made a decision against the wishes of the PAS Spiritual Leader, Dato Nik Aziz Nik Mat, President Dato Seri Haji Hadi Awang, various wings and grassroot who have expressed their disgust for Anwar, directly or indirectly.

The grassroot have long expressed their disgust openly.


For too long, PAS have been disgraced, ignored and ridiculed by PKR and DAP. It is time they assert  themselves in Pakatan.

If they play their card right, PAS could be in control of Selangor government and eventually, have Iskandar Samad as Menteri Besar. It will help elevate PAS stature in the long run and no more seen as party for kampong folks.

Quality and depth of PAS leaders is not there but with MB candidate like Iskandar, they are more palatable than having PKR and DAP in control of government and raping the RM3 billion in MB Incorporated.

The question is, do PAS leaders like Khalid Samad, Hanipa Maidin, Husam Musa and other rampaging bulls in PAS knows how to play the card properly.

Fat lady ain't singing yet

Almost everyone expect PAS's Central Committee (CC) to defy the Spiritual Leader, President, Ulamak Council, Syura Council and grassroot.

They did.

In a decision said to be 10 for and 27 against supporting the President's position, PAS did a U-turn from support to withdraw support for Khalid. Faekah Hussein should start singing for Khalid but she is only feisty but not fat.

The physically well endowed Ampang Parliment Member cum Woman's Wing Chief for PKR, Zuraidah Kamaruddin is unlikely to sing too. Her come-from-behind push for Azmin Ali has suddenly received a new burst of life.

In a seemingly defiant act against their elders, PAS's CC suggested for Datin Seri Wan Azizah and also Azmin Ali. PAS can find some fat Muslimah to sing for PAS's game is over for now.

The ball have been lobbed back to PKR's court.

PAS's Anwarinas basically succumbed to Anwar's insistence to suggest Wan Azizah. But, whether it is their own initiative or Anwar's insistence, they suggested Azmin Ali too. For the past two days, Azmin and Dr Idris's name surfaced on the social media.

Wan Azizah's name could be suggested but she is not likely to make the cut. She is not a capable administrator and failed as a Opposition Leader in Parliament.

Furthermore, it is morally unsustainable to support her when Anwar used to blame UMNO of practising nepotism. She will only be a puppet carrying out her husband's instructions from inside Sungai Buloh Prison.

Sultan should sense that it will be the destined-to-be Kemaman Ketua Cabang cum what ever left of his so-called Strategic Director position and PKR's Parlimentary candidate in Kedah that will run the state.

As for Azmin, it is an open secret that he will not get the royal consent.

One reason speculated is that like Wan Azizah, Azmin is not Selangor born or Anak Jati Selangor. Both are born in Singapore and there is a tradition that past Sultan only appointed Selangor-born Menteri Besar.

Some may argue that Azmin's parents are Selangorians but Azmin's questionable personal life could be a factor. And, Azmin's anti-monarchy stance will be a risk no royals will take.

Khalid seemed to have thrown the towel and there is no likelihood for the State Assembly to convene an emergency session. His statement below:

Sehingga DYMM Sultan membuat keputusan muktamad, saya akan meneruskan pentadbiran kerajaan Negeri Selangor bersama 4 ahli MMKN daripada PAS bagi memastikan rakyat tidak terkesan dengan krisis politik ini.

Saya mengucapkan terima kasih kepada rakan-rakan dan semua rakyat Selangor atas sokongan dalam usaha bersama untuk menjayakan agenda reformasi di Selangor.

He does not sound defiant, but the corporate player in him is sticking by the rule of law to keep fighting. Actually, he was merely setting the ball for his royal highness to make his position known.

According to the state constitution, his royal highness could request for three suggestions. Failing which, Sultan could insist on keeping lame duck Menteri Besar Khalid to remain. Khalid expressed his willingness to remain.

PKR may try to play games but the Sultan will insist on the three names and it is his royal highness's constitutional power to choose. 

In the meanwhile, the investigation on PKR by Khalid to the Registrar of Societies will commence [read here].

At the same time, there are complains against Azmin for breaching election rules. If Azmin's name is suggested, it will cause further split in PKR. Xavier exploded when he found out fat lady Zuraidah tried to slip Azmin's name in a press statement [Read and see the video in the blog Angin Perubahan here.]

MACC is still investigating on the allegations made by Rafizi Ramli and Saifuddin Nasution againt Khalid [read here].

By the way, our postings on the Tropicana land deal was only part of the story. The remaining part is only coming out soon. Then one will understand why after a long silence Lim Guan Eng was visibly panicking.

This deal must have been under the radar of MACC for quite a while. If it had came out in this blog, we believe it is on anyone or any organisations of relevence's radar screen. Thus, do not be surprise that the result will come out soon.

Then, Khalid could only be expected to legally clean his name. It was to PKR's disadvantage for not giving Khalid a fair hearing to explain.

For PAS, the implication of their decision could lead to two possibilities. One, it could further split the party and most people expect this to happen.

The second possibility and a rather remote one is that today's development was merely a Wayang Tinggi Production. The suggestion for Wan Azizah and Azmin was merely to preserve Pakatan Rakyat and weaken PKR.

DAP will oppose Azmin and it is an open secret that they want someone malleable to obey their requests. They are behind the move to gather public support to return power to the people and take away Sultan's disgression in the selection of Menteri Besar.  

Another of DAP's move is to attack Khalid's lawyers, Edmund Bon and New Sin Yew by questioning their human rights advocacy. [Read Bigdogdotcom here]

Who says championing human rights must deny someone like Khalid his "human rights" for a fair hearing?

Human rights is about freedom of speech, freedom of expression, free media, and right to assemble. And, surely human rights is not the rights to to the sexual practise of lesbian, gay, bisexualism and transexualism. That is not human but acts of hedonism.

But that is our personal view.

As far as Khalid, his options is getting limited and his back is being pushed to the wall. It ain't over till the fat lady sings and not sure which one is the fat lady.

But, bear in mind that Khalid still want to clean his name and fight against his unfair expulsion before he step out of politics for good.

RM100 million defamation suit against TMI

The Malaysian Insider was asked to apologise or face a defamation lawsuit of RM100 million from Fuel Sub Sdn Bhd-Datasonic consortium. They are given 48 hours to retract the report or correct an allegedly defamatory report on the bid.

Tan Sri Dr Shafee Abdullah described the proposal from Fuel Sub Sdn Bhd as a private initiative for a directly negotiated contract and it is not a public open tender for it's own reasons.

In a report by The Edge, cabinet was understood to have held back the contract award. Will MI hold back and retract?

KUALA LUMPUR, Aug 18 — A company bidding to manage Malaysia’s fuel subsidy rationalisation programme gave news portal The Malaysian Insider 48 hours from today to retract or correct an allegedly defamatory report on the bid.

Shafee & Co – which represents Fuelsubs House Sdn Bhd, Datasonic Bhd and three people – sent a letter to The Malaysian Insider’s legal firm today, urging for an immediate response out of fear that the allegedly defamatory article could cost the companies hundreds of millions of ringgit worth of losses.

“We’ll go ahead with the defamation suit if TMI doesn’t respond,” lawyer Tan Sri Muhammad Shafee Abdullah told a press conference here today.

The Star reported last month that Fuelsubs House sent a legal notice to The Malaysian Insider demanding an apology to be printed in major papers and RM100 million in compensation for publishing an allegedly defamatory article headlined “Umno-linked firm frontrunner bidding to manage fuel subsidies”.

Shafee’s clients reportedly said in their letter of demand that The Malaysian Insider’s July 15, 2014, article had implied that they did not possess the necessary credibility or expertise to bid for the country’s fuel subsidy rationalisation programme.

Businessweek describes Fuelsubs House as a company that exports and imports crude petroleum oils, besides providing business management consultancy services.
Basis

An extract from The Star Online report explains the basis for the letter of demand:
Muhammad Shafee’s clients claimed that the article by the news portal insinuated that they did not have any expertise or credibility to qualify them to bid for the national fuel subsidy rationalisation programme.

The lawyer said the news portal must give a “satisfactory response” by either retracting or correcting the article, which was published on July 15.

Should the case go to court, Muhammad Shafee said, Minister in the Prime Minister’s Department Datuk Seri Wahid Omar would be subpoenaed as a witness.

“He is very much aware of the proposal so he would be able to tell us how serious was the evaluation of it (Fuelsubs) by the Government,” added Muhammad Shafee.

Muhammad Shafee said the article, which was defamatory in nature, could also cause loss of reputation and possible loss of the contract for Fuelsubs.

In the earlier letter of demand, the legal firm demanded an unreserved apology to be published in major newspapers as well as a sum of RM100mil as compensation.

Recently, Fuelsubs announced it would pay RM10mil for a 30% stake in Datasonic Bhd, a smart-card producer, if the company secured the award to implement the fuel subsidy rationalisation programme.

The Malaysian Insider’s chief executive officer Jahabar Sadiq said in a text message: “My lawyers are handling the issue and have corresponded with Tan Sri Shafee Abdullah.”
Utusan Malaysia elaborated it further:
"Kami bimbang kerana kertas cadangan (program rasionalisasi subsidi petrol dan diesel) daripada konsortium ini telah melalui proses yang meyakinkan, seolah-olah ada agenda jahat dan propaganda untuk memecahkan konsortium ini," katanya.

Tegas Muhammad Shafee, kertas cadangan program rasionalisasi subsidi yang dikemukakan oleh konsortium itu merupakan inisiatif swasta bagi rundingan terus dan bukannya melalui tender terbuka sebagaimana tanggapan umum.

"Kalau kami tidak mengambil tindakan, kami bimbang kertas cadangan konsortium tersebut akan menjadi 'fotokopi ekspres' oleh pihak lain. Tindakan ini adalah amaran kepada pihak lain untuk tidak merampas projek ini," katanya.

Katanya, pihaknya juga bersedia untuk mensapina Menteri di Jabatan Perdana Menteri, Senator Datuk Seri Abdul Wahid Omar sebagai saksi di mahkamah untuk menerangkan betapa seriusnya pihak kerajaan telah menilai kertas cadangan program rasionalisasi daripada konsortium itu.

Beliau memberitahu, konsortium yang ditubuhkan pada awal tahun 2013 itu telah membawa kertas cadangan yang dibincangkan di peringkat Majlis Ekonomi pada 26 Mac dan 21 April lalu, Jawatankuasa Polisi Fiskal pada 7 April lalu dan mesyuarat Kabinet pada 20 Jun lalu.

Langkah melaksanakan program rasionalisasi subsidi bahan api oleh kerajaan bertujuan menangani ketirisan dan penyelewengan yang mencecah nilai RM1.2 bilion dalam tempoh lima tahun kebelakangan ini serta memastikan subsidi berkenaan sampai kepada golongan sasaran.

Program itu dijangka mampu menjimatkan perbelanjaan kerajaan antara RM7 bilion hingga RM9 bilion.

Putrajaya is understood to have held back the award of a contract — for the management of the proposed fuel subsidy rationalisation programme — to Fuelsubs House Sdn Bhd.

Sources familiar with the matter told The Edge Financial Daily that a Cabinet meeting chaired by Deputy Prime Minister Tan Sri Muhyiddin Yassin last week did not reach a full consensus on the award of the contract to Fuelsubs, which had been deemed the front runner for the job, as some ministers were concerned that awarding the contract via direct negotiation would raise the question of objectivity.

“This [fuel subsidy management project] is not something where there is only one specialist supplier as in defence contracts, so it was decided that in the interests of transparency and good governance, there must be a review as to how this project is awarded.

“Fuelsubs may be the best company for the job but like everyone else, it should be going through the normal channels, lest the government is accused of favouritism,” said the source.

He added that the matter will be discussed again at the next cabinet meeting after Prime Minister Datuk Seri Najib Razak returns from leave.

Minister in the Prime Minister’s Department Datuk Paul Low, whose portfolio covers transparency, good governance and anti-corruption measures, is understood to be among those who raised alarm bells over how the fuel subsidy management project was initially meant to be awarded, and on this had previously advised Najib that Putrajaya could do without the adverse scrutiny.

The fuel subsidy rationalisation scheme entails the implementation of a selective fuel subsidy programme targeting the lower-income groups, which privately-held Fuelsubs had been touted to be the front runner for the project for some time.

Indeed, Bursa Malaysia-listed Datasonic Group Bhd had in June entered into an agreement to acquire as much as a 30% stake in Fuelsubs for RM10 million, should the latter bag the fuel subsidy management contract. Tan Sri Syed Mokhtar Al-Bukhary’s Pos Malaysia Bhd is also understood to have formed a joint venture with Datasonic and Fuelsubs for the project.

Datasonic has its mainstay in the production of smart cards, while Pos Malaysia operates 730 post offices in the country.

There were known to be other parties that had expressed interest in the fuel subsidy management project. Some of the names bandied about include Iris Corp Bhd, MyEG Services Bhd, and MOL AccessPortal Sdn Bhd to name a few. MyEG, however, is understood to have backed out of the race for the project. Another relatively big name that was touted to have expressed interest is Dialog Group Bhd, but it is not clear if the company had made any inroads to bag the contract.

Fuelsubs which was registered in November 2013 is about 70% controlled by Habibul Rahman Kadir Shah, and almost 25% by Datuk Razali Merican Naina Merican while some 5% of the company is controlled by Zaid Kedershah.

Reports have it that Habibul is closely linked to Umno, the lead member of the ruling Barisan Nasional coalition. He also sits on the boards of Group Lotus plc, a unit of national carmaker Proton Holdings Bhd which in turn is controlled by Syed Mokhtar’s DRB-Hicom Bhd, Twin River Technologies Holdings Inc — which is controlled by Felda Global Ventures Holdings Bhd — and was earlier this year appointed to the board of Petronas Energy Trading Ltd, a unit of national oil firm Petroleum National Bhd.

Razali, meanwhile, is the brother of politician Datuk Seri Reezal Merican Naina Merican who is the Member of Parliament for Kepala Batas in Penang. In January this year Reezal was appointed chairman of Amanah Raya Bhd, a unit of state controlled unit trust outfit Permodalan Nasional Bhd.

The fuel subsidy rationalisation programme is imperative as Putrajaya spent a total of RM28.9 billion on fuel subsidies in 2013. A year ago in 2012 the tab was RM27.9 billion.

Reports of Fuelsubs likely winning the fuel subsidy management contract have spurred the share prices of Pos Malaysia and Datasonic.

From mid-May this year to end July, Pos Malaysia’s share price had gained about 22% or almost RM1 to hit a high of RM5.46, in response to news of the company forming a venture with Datasonic and Fuelsubs for the project. The stock closed at RM5.19 yesterday, slipping one sen.

Datasonic, meanwhile, saw its share price gain some 100% from January this year to close at RM1.99 yesterday. The stock had even hit a high of RM2.41 in March on speculation of the firm likely winning the contract. – The Edge Financial Daily, August 19, 2014.

Muhammad Shafee menjelaskan, laporan The Malaysian Insider bertajuk 'UMNO-linked firm front runner bidding to manage fuel subsidies'bertarikh 15 Julai lalu mengakibatkan konsortium berkenaan mengalami kerosakan reputasi dan berniat untuk memecah-belahkan konsortium berkenaan.

Menurut beliau, selain portal berkenaan, pihaknya juga akan menghantar notis tuntutan terhadap pengendali laman blog Another Brick in the Wall dan memberi tempoh 14 hari untuk laman blog itu meminta maaf dan menarik balik kenyataan pada 4 Julai dan 7 Julai lalu yang turut memfitnah serta merosakkan reputasi konsortium tersebut.

This involved individuals, thus no necessity to implicate UMNO. If Theresa Kok, Lim Guan Eng, Dato Danny Tan etc are involved in a certain corporate or business deal, does it mean DAP is involved?


This blog had written much on fuel leakage and fuel card.

The intention was to send a message that government should be very cautious and not pre-determined a decision to rationalise fuel subsidy that badly affect cost of living for the rakyat.

Already they are worried with the badly explained GST coming.  

Do not impliment the subsidy rationalisation when there are multibillion leakages of subsidies in the system.

By including to refuse foreigners' access to subsidy, the amount recouped could almost cover the fuel subsidy for the rakyat.

It is an open secret that the leakages are due to the lackadaisical attitude of government servants, especially the enforcement side, corruption by authorities, greedy businessmen cum criminal smugglers and international criminal syndicate.

Some of them are linked to politicians from the ruling parties and it will make the rakyat despise government more.

So much for our good intention.

In 14 days, it is September 1st. This blog should act accordingly.
