A great talent leaves (Part 4): Rogue trader

Societe Generale trader, Jerome Kerviel was sentenced to 5 years in prison for losses of €4.9 billion (US$6.9 billion) for trading in Euro stock index futures between 2006 to 2008. Yashuo Hamanaka of Sumitomo Corporation was sentenced to 8 years in prison for copper trading losses of US$2.6 billion in 1996.

The infamous rogue trader, Nick Leeson of Baring Bank received imprisonment of 8 years for trading losses of £827 million (US$1.3 billion) in Nikkei futures in 1995. The more than 200 years old London Merchant bank collapsed due to speculation by a trading clerk from their Singapore outpost.

When the late Bank Negara Governor, Tan Sri Ja'afar Hussein and Manager, now Tan Sri Nor Mohamed Yakcop announced the RM5.7 billion losses from foreign exchange trading in 1994 (eventually RM13 billion), both merely resigned from the job.

Despite his integrity and impeccable record, Ja'afar was not given any more assignment and just retired.

But, Nor Yakcop escaped any form of investigation and far from any possibility of imprisonment. He joined Abrar and the same bad habit of a foreign exchange trader resurfaced. There is more to the Abrar story in previous posting here.

The financial crisis was bad for Malaysia but good luck for Nor Yakcop. Tun Dr Mahathir sought his criminal mind to resolve the crisis and eventually became his Special Economic Adviser in May 2000. When Tun Abdullah became PM, he was appointed Minister of Finance II.

What happen to his illegal acts at Bank Negara and Abrar? Why was there no more news or talk of his many offenses? Did police stopped investigation? If they had investigated, why was no more further action taken? The Home Minister from January 1999 till October 2003 was Tun Abdullah Ahmad Badawi.

For Nor Yakcop contribution to Selective Capital Control policy, was his sins forgiven?

Rogue Trader


A rogue trader is an employee that made unauthorised financial market trades on behalf of his institution. The offense is a grey area between civil and criminal illegality.

The perpetrator is a legitimate employee of a company or institution but entered into transactions on behalf of their employer without permission. Leeson was a trading clerk to punch in trade orders from their London office when he made that unauthorised "bet."

Factor that may have contributed to his loss were, among others, poor judgement, lack of oversight on the part of bank management, naive regulatory environment, and unexpected turn of event like Kobe earthquake.

However, the factors that led to the eventual RM13 billion humongous loss for Bank Negara must be more than the case of Barings.

Something systemic or negligence or possibly criminal could be at work for an activity to undertake active management of national reserves could go awry and reduced to day trading activity of traders and their typical indiscretions.

Furthermore, the active management or more accurately, trading in foreign exchange is done by civil servants and their usual practises would usually be heavily regulated, concise procedures and red taped. Where did it go wrong?

Poor judgement


Many academic try to explain why foreign exchange moves or fluctuate and some try to ascertain the fair value of a certain currency. Frankly, it is all hogwash.

Whether it is Purchasing Power Parity theory to determine a fair value of currency or using charts to determine relative sentiments or trying to read into economic performance or indicator on statistics related to trade balance and current account, it still go back to the trader; his feel of the market, his gut for risk taking and balls to withstand any adverse set-backs.

Any trade to go long or short has a 50:50 chance to be right or wrong. To the more seasoned trader, his probablity to be wrong maybe lessened but at best, it is could be only at 60%. Of course, there is also the time frame factor of anywhere between seconds to days to show one has made the right or wrong call.

To say, a trader loses because of bad judgement is too simplistic and naive because losing is part of the game. You make some and you lose some but at the end of the month, the management wants to see you win more than you lose.

The trick is a simple rule, but not necessarily as easy to do, to limit your losses and maximise your profit the furthest. It is not necessary easy because at any one time the reading of the market is 50:50 with no certainty. And there is no such thing as asset backing in stocks to provide the theoretical limit to losses.

It is considered bad judgement when one knows that inflation figure had registered a convincing upward trend and the market feels it is a question of time that Bank of England was to raise interest rates, yet one still insist on shorting the pound despite the unfavorable interest differential with the US dollar.

Then again, the trader could argue that the pound had been in an overbought position and the market is awaiting a drastic correction downward since cable, as what traders used to call pound as, is still not reacting.

The traders judgement and bad decision is not something easy to control and limit. When desk Managers try to interfere too much, traders will ask for their call on the market and most likely then not, he will end up being wrong more than being right.

The only tool left to management to screw traders for running his losses is when they bust their limits. Traders are given all sorts of limits or credit limits to reduce risk exposure. There are daylimit trading limits, rules and limits in carrying over a position overnight, exposure to specific banks, stop lost limits, etc.

Trader's Indiscretion


Playing the market is always the interplay of emotion between fear and greed. Traders become overcautious when they are too consume with fear.

They turn greedy when luck is on their side and prudence is put aside. Overconfidence usually brings out the beast in them. If they believe strongly the market will go a certain way, traders have the tendency to do things that borders on doing illegal and breaching the trading rules set upon them.

They are at their worst when they are in a bad position. They refuse to admit lost despite there is no hope left. Moral hazard takes over and they end up doing things like hiding their dealing tickets and not disclose their true trading position in their records. Sometimes they could be coverting with the back office to hide the trade.

Their contention is that market will turn and he will come out a hero and make big.

Sometimes this traders are losing but since the calculation of profit and loss could be subjective, flexible and up to the traders to determine, the real condition could not be ascertain. There are tricks like averaging out, tinkering with the opening and closing rate, and other manipulations.

Averaging out is one of the dangerous and imprudent trading technique. It is similar to putting good money into a losing concern. It is like the gambling practise to double up or top up a bad position by doing more trade to average the price higher or lower depending on the forecast direction.

There had been cases of loses being hidden from the attention of management till it got too big. One way is in structural trading.

Different traders, by virtue of their experience, perceived skills and profit target, are given different limits to work-on. The new ones would be "jobbing" for few pips (1 pip = 0.0001) here and there and square their position before leaving office, whetever the time could be.

The more senior ones could be doing those structural or long term trades which ignores the noises or short fluctuation and move for the big trend and market swings.

This is the game of star traders that is seen at Wall Street parties and cocktails in penguin suits. They spend more time traveling, talking to media, and giving lectures at seminars, then slugging it out on the trading desk. Usually they have assistants to execute and monitor their trades. 

Sometimes it could be made complex by combinations of short term positions and long term positions. Sometimes one will see traders record is seen as short at a low side or long at high side but the two are not square because it is assigned for different term. Only the traders know which is which and back room only take their words as good.

The more complex one could be employing cross trades in third currencies. Instead of US dollar based trades, they could be translating their US dollar/Yen position into Yen/ECU or Sterling ECU.

Bank Negara debacle


Bank Negara had then decided to actively managed their extra foreign exchange not put aside to cover trade. It helps to reduce the risk to devaluation by shifting to appreciating currencies and moving away from possible devaluing currencies.

A well managed foreign exchange reserves is to maintain at least 6 months of imports without any exports in the proportion of the historical utilisation of foreign currency.

Nor Yakcop was the person who took charge of this new activities of Bank Negara's trading room. From initially day traders jobbing for few pips for familiarity, he started to assume structural trades by virtue of the managing long term reserve positions. The nation's trade depended on many currencies and thus exist cross trades.

In the case of Nick Leeson's, he created a fictitous client account 8888 and leave the bad trades inside to square when hopefully market situation gets better. It is not a surprise that such practise was happening at Bank Negara.

Those days Nor Yakcop was heard to going in and out of the markets in hundred of millions at one go that Bank Negara was getting the international media attention as market mover. Malaysia was outshining the earlier big player, Russians.

Moving the stock market is easy with availability of money but to move the trillions dollar a day market volume, it must have been sizeable move. So often that media was reporting that it was beginning to be obvious that Bank Negara was known to be stuck in positions. Strangely, those positions were never unwind.

Anwar accused Tun Daim, but Bank Negara is under auspices of Minister of Finance
For a loss of RM5.7 billion, then changed to RM9.2 billion and insider's source claimed as RM16 billion but not RM30 billion as alleged by then Finance Minister when he left government, how big was Bank Negara's position?

Other billion dollar lost rouge traders were usually derivatives traders where for a small sum of capital, one can take position equivalent to larger underlying asset positions.

Doubt that Bank Negara traded in the highly mathematical and technology driven financial futures and options markets. Thus to lose so much, the trading volume, positions taken and outstanding unwinded positions must be huge. It is impossible to escape attention of then Minister of Finance, Dato Seri Anwar Ibrahim.

It only indicate Nor Yakcop and his accomplice trading team must have hidden their loses in reserves, cover-up their true position and profit and loss, double up on losing trades, averaging up or down, went around the rules and trading limits, manipulation of positions and accounts, use of complex trade to hide true situation, and probably change the rule to cover himself up.

Why tell all these from past?

It is to understand the psyche of the man and how his mind operates. He does not care for rules. He gets around it, manipulate it and break it, especially when he is in trouble and covering up something.

Yet, many are taken by his soft spoken ways and believed him to be knowledgeable. However, when he was a reckless trader, novice corporate man at Abrar, and threatening businessman to steal their company for Khazanah, he still spoke in that same soft manner.

He is not an honest and responsible man, even though he admitted and resigned. That he had to do. But there is more to it that is not known.

As for being knowledgeable, one can read books and talk to a lot of people. But does his knowledge and ideas translate to any practical and sustainable success?

A great talent leaves (Part 5): Forgiven sins

Abrar Corporation is under receivership. That is the notice found on the Internet. It is a tombstone to remind of the failure of Tan Sri Nor Mohamed Yakcop's first "legitimate" attempt in business in 1994 to 1998. Despite his strings of failure, he still rose up to high position.

Abrar was started by two Malaysian student Islamicsts activist in the US back in the late 80s. Both of them were doing their Phd - Ex Malay College, Dr Wan Hasni and ex MRSM Pengkalan Chepa Dr Rahim Ghouse. It was believed then that they were managing Arab funds in Connecticut before returning to Malaysia. 

Nor Yakcop was with Abrar and was cordial with Anwar. When Anwar won the 2010 by-election, a former staff said he called Anwar's office to congratulate. Nor Yakcop may have been identified with Anwar for letting him go. 

Some felt Nor Yakcop may have got away because charging him would have would have implicated a lot of big names, especially Anwar.

There was some element of collective decision that would have saved Nor Yakcop from prison like other rouge traders. But, the curious part is who saved and forgiven Nor Yakcop for his bigger sin at Abrar?


At that time, Anwar was DPM and Minister of Finance. He was looking for an Islamic financier when Abrar came into the picture. Through Rahim Ghouse, Abrar received Anwar's political patronage. 

Another was Al Baraka group led by Dato Kamaruddin Mohd Nor.


Today Anwar is pointing fingers to Tun Daim and Tun Dr Mahathir for the loss of foreign reserve but many people are aware that Bank Negara was under the auspices of the Ministry of Finance. So these days he would use ex-Bank Negara Manager but sold as former Adviser, Dr Rosli of PAS to raise the issue.

Do not discount Tun Abdullah because in his last term as Prime Minister, Tun Dr Mahathir appointed him as Home Minister and he handled the reformasi.

Criminal Breach of Trust



In August and September 1998, there were two police reports made against Nor Yakcop who was the then Executive Chairman of Abrar Corporation Berhad (ACB), 

As Chairman, Nor Yakcop had made several infringement. He had used the ACB's money to settle his personal loan to Bank.  

In Part 3, it was mentioned, below:
When Nor Mohd joined Abrar he was offered a chance to own 5% of Mun Loong Bhd. He thought it was a great deal. Since Anwar was the Finance Minister, a RM30 million loan was arranged from Bank of Commerce for Nor Mohd to buy shares in Mun Loong (later Abrar Corp).
There was still remaining loan of RM13 million. He had funneled the money of a public listed company in which is partly owned by the public, to Abrar Group International Sdn Bhd (AGI) and subsequently to himself to settle the Bank of Commerce loan (today it is CIMB Bank). AGI is the 25% owner of ACB.

That is a criminal breach of trust and breach the statutory and fiduciary duties of a Director of a Company. The Company Act clearly stated that Company Director cannot borrow money from their own company, what more for a public company.

Reckless Investments


In the same manner as he deals in foreign exchange, Nor Yakcop was reckless in his brief attempt to be a corporate player. As Director, Nor Yakcop had conspired with several other individuals in ACB to authorise the use of company funds for wrongful purpose. 

Perhaps for lack of any profitable investment opportunities or lack of experiance in doing investment, Abrar was once scrambling in desperation to undertake investment for their shady Arab clients, suspected to be linked to Al Qaeda. 

Nor Yakcop had placed ACB's fund of RM44 million to the group's license fund manager, Abrar Global Asset Managers Sdn Bhd. (AGAM).

Nor Yakcop may have requested a ridiculous return of 15% but it was never meant for investment in portfolio but only as conduit for ACB's investments. The money never returned back to the public listed outfit, ACB. The liquidator sure would like to know where.

They had used it to buy shares in ACB or in other words, illegally buy back their own shares. At that time, it was illegal to do so under Section 67 of the Company Act 1965.

The Board of Directors of ACB including Nor Yakcop had approved investment by AGAM for US$5.4 million investment in China, acquisition of one company called Platinum Avenue Sdn Bhd for RM16 million, and acquisition of Silicon Vision Corporation for C$3.95 million. 

No proper evaluation was done and it was made despite full knowledge that the investments have low possibility of recovery.

With Nor Yakcop as Executive Chairman, he had ACB purchased an overpriced land in Gelang Patah for RM16 million which was later sold at a substantial loss. 

Cover-up


Basically, the Abrar people including Nor Yakcop know nuts what they are investing in. 

Not only that, he may have misrepresented hmself and the company to their investors and various parties. He guaranteed the recoverability of the invested funds despite knowing well that it is not recoverable.

As public company, Nor Yakcop was supposed to disclose any losses to the authorities; namely the Kuala Lumpur Stock Exchange then and the Securities Commission but he did not. Strangely enough, despite knowing and aware of such irregularities, they was no investigation done by them.

This is basically leaving the public and government bodies holding shares in the company of being cheated. 

It was believed that the police had commenced investigation into the irregularities but nothing happened from there on. There are those that believed police had completed investigation and there was a case but was instructed to stop from taking action.

At one time, now Senator Ezam Mohd Nor used to make a big issue of Nor Yakcop, in particular the case of ACB, AGAM and AGI when he headed the anti-corruption NGO, GERAK. 

Ezam and the former Parti Keadilan Nasional used to claim that they have 16 boxes of documents of wrongdoing in high places. One of them and it is believed that he made a police report against Nor Yakcop. 

Is there truth that Exam had been bought and the figure said was RM10 million to stay quiet? 

The figure RM10 million was sheer guesswork because for sure, Nor Yakcop paid RM10 million blackmail money to Dato Sharif Omar to stop him from sabotaging his campaign for Tasek Gelugor at the 2004 general election.There was a tape going around....

Having him to help as a Special Adviser at Bank Negara to solve the currency is like using "a thief to catch a thief." Do we have to make him as a Minister? Do we have to decorate him as Tan Sri and such?

It is mind boggling that someone so reckless in his decisions, indifferent to law and rules, dishonest and corrupt be allowed to still continue to hold high positions.

Nor Yakcop with his reckless psyche at Bank Negara in foreign exchange and his amateurish attempt to being a corporate player at Abrar was allowed to be involved in many major decisions that affect Bumiputera, UMNO, and the country at large.

Musical Prelude: Thick as a Brick

The "A Great Talent Leaves" series will take a short break. Only covered was the talented Tan Sri Nor Mohamed Yakcop's days in Bank Negara and Abrar.

In Part 1, Nor Yakcop ended his days supposedly as a knowledgeable financial man but acknowledged as only mere talent by PEMANDU and TERAJU.

However, he is not leaving. In Part 2: Continued presence, the concern expressed is his continued presence to be able to wield power at Khazanah. There is speculation that he will be the next PNB Chairman.

Part 3: Bounty to Hunt dispel views that the series have ulterior motive related to recent developments. It's not true because he has been on the "hit list" for a long time. Like a bounty hunter, we never give-up.

It does not matter that many do not appreciate the destruction caused by Nor Yakcop. So we start the revelation on the foreign exchange loss and Abrar to enable others to understand the psyche of this dangerously reckless man who has turned from gentleman to a conniving man.

Part 4: Rogue trader talks about his humongous loss trading in currency and the negligent and reckless attitude, not to mention breaking the law and ignoring rules. He continued the same trait at Abrar.

In Part 5: Forgiven sins covers his indiscretion at Abrar. It seems he is forgiven. Was he forgiven because he helped solve financial crisis of 1998/99?

If so, is his consultancy worth RM16 billion and contribution means closing one eye over CBT, breach of statutory and fiduciary duties, mismanagement of public fund, given positions, accolades, and continuing his recklessness?

Is it worthy when those suggestions he gave on Selective Capital Control were not his ideas but that of a local University professor and believed to be modeled along China? Which experienced trader do not know of the Chile experience? 

Still to discuss is his days as Special Adviser, then as Minister and those many strange deals.

Already, the comments for the series are sliding. It could mean readers are bored or the point has got through already or something else.

Before writing this series, we were discouraged by few people. However, we refuse to budge because this is about the truth and being righteous.

If this is what it takes to convince others and those in high places that Nor Yakcop is not supposed to have anything to do with government any more, so be it. He has been more destructive than his so-called contribution and he should be in prison for his wrongdoing

That is why we are willing to be that lone voice as Another Brick in the Wall to struggle for the values we believe in. It does not matter what others' think and feel. Nor does it matter should others follow or not.

We are not as easily compromised. At this stage in life, our only fear is to Allah. Hopefully when we die, our grave is not piss upon for keeping quiet.

In a previous posting here, we wrote about a quote from Prime Minister Dato Najib's speech at last month's Invest Malaysia conference. The quote below:
"In the medium term, we must make our affirmative action programmes more market-friendly and meritocratic."
We are reminded of this quote and posting because it is conflicting. Affirmative action can never be market-friendly and meritocratic because in the context of Malaysia, it has a certain nation-building objective to do social engineering to narrow some ethnic-based gaps.

Affirmative action (or known as positive discrimination in the United Kingdom) refers to policies that take factors including "race, color, religion, sex, or national origin" into consideration in order to benefit an under-represented group "in areas of employment, education, and business".

We know in our days back in the US, blacks from the hood were given many form of assistance to get them college degrees. It is not just financial but goes to the point of creating courses to enable them to catch-up with the rest. Some courses meant for them seemed like Form 4 or 5 materials to us.

So there is nothing sinful about affirmative actions. But it made us ponder what does market friendly and meritocratic affirmative action means.

Perhaps, affirmative action should not be ethnic based but since it is about some social transformation, it has to be based on some form of social entity or groupings. In one conversation we had in a chance encounter last year with Prof Tan Sri Kamal Salih, he said we could also look at income structure. 

Last night, we met a friend, a Phd holder and practitioner in human resource and he told us of a foundation established meant to giveaway scholarship for Bumiputera paid the CEO a salary of RM25,000 a month. Since we are not so sure, we will withheld the full story until we get more information.

He was sharing with us that piece of sensational information in response to our information about a so-called Council for Bumiputera economic action. We were curious of this group that had a long list of affiliate NGOs. These NGOs are the sort that have lots of demand on government to safeguard their economic interest.

We found the group was headed by a suspicious looking mamak character. Despite the nature of it's associates, they were strangely spewing the PEMANDU mantras on their website. Then we saw lots of posting and call on Petronas. It reminded us of a character that was highly critical of Petronas but was talking more of self-interest.

It begs the question: Could such large salary by an organisation meant for affirmative action be what is meant as market friendly and meritocratic affirmative action?

By the way, the Council we talked about was something that came out from EPU sometime back. With the change of guard at EPU from Tan Sri Nor Mohamed Yakcop to Dato Abdul Wahid Omar, something interesting happened few days back.

Wahid was answering the first few questions at Parliament. Interestingly, he did it without having to refer to any text. It was off-the-cuff and no "soalan bocor" as done by Tan Sri Amir Sham Aziz, the predecessor to Wahid at Maybank and EPU, on his first attempt to answer question in Parliament.

No bad for our fellow MRSMer over our former boss. But, we will have to limit that accolade there.

Since taking over Nor Yakcop's position, Wahid have been going around to hear the various taklimat from and giving his directions to the organsations and agencies under EPU.

In his meetings at TERAJU and Equinas, former Nor Yakcop-picked GLC CEO Wahid brought along his Special Officer and it became a discomforting experience for those that attended. He could be a Kadazan or other Chinese looking ethnics from East Malaysia but our friend swear that he was Chinese.

Not trying to be racial or racist, because NEP and MRSM had the support, input and effort of Chinese civil servants when it was formulated and implemented. Why was Wahid so insensitive to not allow the Malay officials and members of the Directors/Trustee of TERAJU and Equinas the space to express themselves?

He could have asked the chap to stay outside or bring other Bumiputera instead. Then he can hear more frank discussion and himself be more frank on information and data. Lately, there are too many alarming data besieging the Bumiputeras. If Malay is in trouble, what more the marginalised other ethnics in East Malaysia. 

It seems Wahid had been saying the same thing he said in his briefing of EPU bosses. Policies must be need-based. It could mean the end of any form of affirmative action. It could also be the start of a new concept of need-based affirmative action.

Hope his training at BTN's boot camp had not thinned his empathy for all the orang asal of Malaysia. It is because things have really changed in that department in Maybank since we left decades ago.

Since policies are no more affirmative based, even analysis of politics is no more looking at the Malay and Bumiputera side of the story.

Two weeks ago, there was a Cabinet Workshop conducted PEMANDU. For Day 1, 26 Ministers and Chief Secretary attended. While, Day 2 was for the 21 Deputy Ministers, Auditor General, the Attorney General, KPPA, KSP, KP ICU, KP MAMPU, 21 KSUs and more abbreviations than PEMANDU can create policy acronyms.

Surprise surprise ... the man, who always goes around saying he is non-partisan and apolitical, was giving an analysis of the 13th General Election. Yes ... it was Chief Powerpoint Officer of PEMANDU, Dato Idris Jala. No more Butcher from Shell but we know he has lots of butchering to do.         

He presented comparative analysis of GE 13 vis-a-vis GE12, issues and concern of the "rakyat" prior to GE13, and came down to a hypothesis by testing voting trend of urban, new and Chinese voters. There was also presented possible GE14 scenarios.        

It seems War Room member, Omar Ong had PEMANDU called in external panelists to give their views. Names were:
  1. Tan Sri Datuk Rafiah Salim, former Dean of UM's Law faculty, former Maybank Human Resource Head, a do with United Nations and now with a women NGO.
  2. Tan Sri Ambrin bin Buang,
  3. Tan Sri Tony Fernandes,
  4. Tan Sri Yong Poh Kon, Selangor Pewter taukeh
  5. Dr Chandra Muzaffar,
  6. En Afzal Abdul Rahim, CEO of Timedotcom and reformasi supporter
  7. En Wan Saiful Wan Jan, AMANAH, IDEAS and PAS member
  8. Mr Stephen Hagger, British and KL-based foreign stockbroker
We wrote about some of them here.

Were they really expressing the views of the public or the agenda of themselves or their race or organisation? If it is the public's view, good for BN. Otherwise, disaster to come.

It does not feel like the views of the majority but that of minority, non voting monority. Their attributed factor to BN's dismal performance seemed consistent with their agenda and concern on: 
  • Polarisation of the nation
  • Education system that differs from the rakyat’s expectations
  • Rising incidences of crime and corruption
  • Distrust with key institutions
  • Inconsistent communication from the government
Of course, one can argue back to say these are excuses by Chinese and youngs to do a Cinami or to cibai BN and UMNO. Nevertheless, let's take it as it is because this is not election year and no a need to argue and defend issues. For us, we just want to belasah UMNO and B till get their act right.

Interestingly, the takeaway for cabinet members to take home to digest were: 
  • Government must embark on more effective communication and avoid inconsistencies in messaging
  • Government must strengthen its fiscal position and the Goods and Services Tax (GST) must be implemented
  • Government must do more to meet the expectation of the rakyat in terms of education, crime and corruption
  • Bantuan Rakyat 1Malaysia (BR1M) need to continue
  • Embark on Public Service Delivery Transformation
The Cabinet Workshop seemed to be to justify continued existence of PEMANDU, muzzling on Utusan Malaysia and any pro-Malay voices like PERKASA, and full of liberal speak. There was nothing for the core and main supporters of BN i.e. Malays and Bumiputera.

Perhaps, there is always BR1M to shut their mouth. That is their only additional income while CEOs or GLCs and EPU-linked agencies and organisation are earning millions if not in the tens of thousands in the new economic model of high income GLC CEOs.

According to Idris and Omar Ong in a meeting as told by our sources, PM was apparently happy with the cabinet workshop and there was a note for cabinet. Hope PM is only bullshiting. 

PEMANDU will not only control the economy via the ETP, EPP, GTP, NKEA, and all other acronyms, they will be tasked with Social Transformation, Political Tansformation, Public Service Delivery Transformation and many other projects.

PEMANDU to do social transformation? Hopefully, their's is more effective than NEP's attempt to do social transformation. Currently, the grassroot supporters of BN do not know that we are regressing from the achievement of NEP. 

Looks like PEMANDU will basically control Government and civil service from top to bottom. The best part is there will be hundreds of millions to be spent for their friendly consultants. Thanks to the takeaway, the job for the Public Service Delivery Transformation is their's.

Idris Jala was so excited that he told his management team at PEMANDU that he intend to privatise PEMANDU and provide services to Government within the next 5 years. That is better than being owned currently by Government.

The argument is it is politically neutral and he is worried in the event of a change of Government. That must be the analysis he gave Cabinet then.

Looks like it is no more about Malays. It is also about themselves at PEMANDU.

If there is nothing about Malays, there is nothing too for the still marginalised Pribumis of Sabah and Sarawak. With more budget for vote deposit Sabah and Sarawak, they may have a better chance.

But, let's not just blame the Government.

The Malays blew it when they got the chance to better themselves. Now that the Semenanjung Malays are split and lost their political dominance, do not hope for the return of NEP or affirmative action.

Furthermore, the latter generation Bumiputeras in Semenanjung thinks they can do it on their own without any assistance, so they are comfortable to do away with UMNO and BN and "try" the more liberal PKR, the Chinese interest DAP and Islamist PAS.

Hopefully they could achieve where recipients of NEP failed to do.Can the three come up with something better to entice the Malays?

The Mamak Dilemma

It's our birthday today and it will be celebrated with a quiet dinner with our other half. At the ripe old age of "35" ... sorry for the switch-up, 53, we do not need noisy parties.

However, we can't have our dinner till we get this off our chest. It's a real dilemma occupying the cavity in our ears and head. The dilemma hardly compares with Tun Dr Mahathir's observation in The Malay Dilemma but it is irritating.

It does not matter what many pengampu academician said, but The Malay Dilemma was not a scholarly work. However, we've heard our American professors complimenting Tun's astute observations. It was the premise for his policies for 22 years as Prime Minister. 

Our dilemma is The Mamak Dilemma variant. And, it relates to the appointment of Dato Azeez Abdul Rahim as Chairman of Lembaga Tabung Haji (LTH).

Many would comment that it is a clear cut issue, thus there is no dilemma.

True, there is no dilemma and we should agree. We will not dispute the concern of this circulating SMS disputing Azeez's appointment:
..... Bolehkah xxx terima seorang wakil rakyat yang menipu kelayakan akademiknya dan PM Najib tanpa berasa malu telah melantik beliau memegang sebuah Institusi terbesar orang Melayu. Itu bab akademik, ada banyak lagi cerita yang tak enak didengar berkenaan misi misi bantuan kemanusiaan yang beliau kendalikan terutama sekali Misi kemanusiaan Somalia yang mengorbankan nyawa wartawan Bernama. Saya telah terlibat dengan NGO kemanusiaan selama hampir 12 tahun, banyak cerita berkenaan Azeez Putra. What is Najib trying to proof? Its look like he is destroying UMNO n our country. Ikhlas xxx

Not only did we agree that his MBA degree was from a dubious then American University, we were one of the first to take potshots at him during the golden era of Pak Lah and the group of young mamak hypnotising Pak Lah to restful bliss.  


However we will refrain from calling him a cheat and give him the benefit of proving that he had undergone the required coursework and thesis and also the necessary accredition.

If we are chorusing concern to raise issues on candidate choices, cabinet appointments, GLC CEOs with "Dr" Emir Mavani" of Felda Global Venture Berhad being the latest raised and now an ongoing series on Tan Sri Nor Mohamed Yakcop, we cannot keep quiet on our "now a friend" Azeez.

Is the dilemma because he is "a friend"....?

There was an argument put forward that Dato Anwar Ibrahim himself appointed his inadequately qualified father as Chairman of IOI. It is not a sufficient reply but just returning back the question with another question. [Read MyMassa here.]

It could mean if Anwar is immoral, what is wrong for us to be immoral too. Mampus negara like that.

Someone tossed back PAS's Dato Mahfuz Omar's statement against Azeez by saying that he should be grateful for Azeez's appointment. One day, if PAS ever ruled Malaysia, under-qualified Mahfuz can also be LTH Chairman.

Furthermore, who is PAS to talk when they have the likes of Dato Husam Musa aspiring to be President? Dato Nik Aziz himself was caught helping himself and his wife of land in Gua Musang.
 
Still not answering. Are we to stoop as low as the oppositions?


Remember that the first Chairman of LTH was Royal Professor Ungku Aziz. There was a high benchmark already set and the position was never filled by politicians. Dato Najib wanted 1MDB to be benchmark of excellence in corporate governance by not having politicians on its Board of Directors.He has to be consistent.

One blogger friend argued that Azeez has the experience from running his own family property business and being on the Board of LTH subsidiaries. Sorry bro, not strong enough an argument. [Read MIK here.] 

We have to be honest to ourself. Having Azeez, LTH will not be seen seriously by the investment community.  LTH is managing RM34 billion worth of assets by millions of depositers saving up to go to the holy land.

This is a sacred trust and depositors confidence is essential. The burden is more than having those with the capability and impeccable integrity but also those "seen to be clean."

MIK rebuted by saying that there is process and governance in LTH. Azeez cannot just enter the office and ask any staff to issue a cheque to his or proxy's name. Mahfuz should better answer for Tabung Memali. [Read here]

That we admit is fair comment from MIK. It could also be a debate clincher but it is only us that is not convinced. It is like evading Azeez reputation or negative perception, which ever we view it as.

He has a past and today's Azeez seemed different. 


On the unpleasant words of his global humanitarian work, we admit that Azeez did do a wee bit of showboating.

Some say he does not need to bring so many media people and end up having Bernama's Noramfarizul killed in Somalia. Others had done more meaningful humanitarian work and much earlier than KP1M without seeking publicity.

The response could be why not the publicity.

Our media's coverage could help to highlight the plight of the people in these assisted areas. Media people that went to Somalia understood the risk and their company should also be at fault for not taking the necessary precautions in war zone areas.

Azeez could have saved the cost of transporting mineral water using a Charlie to Lahad Datu and instead transport it by land from Kota Kinabalu. But that is a relatively petty and rather nitpicking.


What matters is he had extended the hands of Malaysians and touched many hearts of the downtrodden and unfortunate people of the world   [Do read MIK here and Azeez's latest humanitarian work in the Rakhine, Myanmar in Duke of UMNO here]


Azeez was conferred the Honorary Ambassador of Palestine for his humanitarian work.

Mahfuz and many opposition leaders can talk cock in Parliament but how much humanitarian work have they done other than being pulled by the nose by Anwar to participate in street demonstrations?

Now what are we to say?


Azeez may have done his PR well with the media, bloggers, politicians and even some opposition leaders and supoorters. So there is few attack on him but there are still the vociferous ones.

On the question of his qualification, it is not fair to attack Azeez personally because it is not his fault for being under qualified. He did not choose to be born poor and have one of his parent left his family.

Azeez led a tough life. While still in school, he was already working washing dishes at roadside stalls to help his family and pay for his schooling. We can't expect kids in that kind of predicament to be focus on their education.

He started making a living early in life. It is almost common knowledge that he was once a car repossessor, among his many professions.

We are aware that his first big break involved a company in Kg Baru, near the old Bank Bumiputera office at the four-corner junction. One of our old social buddy worked there too.

A former Minister helped him and placed him under his wing. If we are to question the morality in the nature of business of the company, what about the late business of the late Lim Goh Tong and Dr Stanley Ho? Question also the morality of the suave Abdul Razak Baginda's expertise in matters of defense?

Prior to gaining prominence during Pak Lah's era, he was in the used car business. Then he gained political spotlight for his role in "Khairy" era Pemuda UMNO and winning a place in UMNO's Supreme Council.


With his street smart ability to do things, speak and say what listener wants to hear, convincing others, executing errands given to him, solving problems, etc, he gained the confidence of many and no less than Dato Najib and some say his wife also.

Even that someone like Azeez, whose done a lot and not to mention helped other fellow politicians in their work, still face obstacles to rise further.

Rumour has it that his name had been rejected from running for the Baling parliamentary seat for something like three times by Dato Najib. Reports after reports does not give him a chance to win in  PAS stronghold Baling.


In 2008, he had a disastrous outing. We were in Kedah to witness Azeez in his elements. Every political trick and act up his sleave, including escaping an assasination attempt, did not materialise into the right number of votes to win. Dato Najib have every reason to feel Baling is Azeez's black area ... no pun intended.

He persevered and shared his plans to convince Dato Najib that he is worth the risk. Candidate Azeez 2013 will be different from candidate Azeez 2008.

No more adversarial politics with PAS. He instructed his campaign workers that if they see any fallen PAS flags or posters, raise it back. No sabotage and no boo boys. Keep the campaign respectable.

On top of that, Azeez had been "servicing" the area for five years in more way than he serviced Gaza, Rakhine, and many other places of the world.  The Azeez Rempit, that later became Azeez Putra and now Azeez Gaza, created upset to win Baling.


Witness told us the overwhelming reception of voters in Baling to him. Tun Mahathir lent a hand to campaign for him. He had said the wrong thing to the man in the past but after so many meetings for his humanitarian missions, he must have already seek forgiveness.

But is that enough for us to support his appointment for Chairman of LTH? Not enough ... why must it be Azeez?

For Azeez to be Chairman, he must be absolutely above board in his actions, be it humanitarian or welfare or business/investment. The next 6 months he will be closely followed and analysed for every move of his and LTH.


Cousin Dato Ismee Haji Ismail will also feel the same heat. The decision to buy a London property, 151, Buckingham Palace SW1, London must be explained to the public.

Azeez, Ismee and LTH will be taken to task for a rumour going around that a crony of Dato Kalimullah and Tan Sri Nor Mohamed Yakcop by the name of Sheikh Akmal was acting as go between and cavorting with Kuwaitis to skim off from deals to sell properties to Malaysian  institutions.

The property purchases in London by our investment institutions, which PM proudly showed off to the British, worry us. European economy is looking soft.

If true and prices softened, we have been pundek by these mamak. [Read Bigdotcom rather Azeez focused posting here.]. One cautionary word from us is that we do not dare to say that Azeez is cavorting with these mamak although he is one.

Not when Datin Seri Rosmah fired Dato Mumtaz Khan from her household.

LTH is involved in many deals and Azeez cannot be seen to be involved as dealmaker. There are very forensic eyes and ears out there to comb through everything. In this Internet age, there are many voices ready to squell to the media, especially bloggers who are unafraid.


Azeez have served the Board of Directors of LTH for two terms without any controversy. So he knows how things work and the public expectation in LTH. Thus, he must refrain from being "seen as not clean." If possible, Azeez must clean the board from questionable dealmakers like Mrs Zarinah, Dato Azizan.

Our concern is go-getters like Azeez will find it hard to stay away from controversy and more so, with dedicated people finding fault, it will result in the public losing confidence on LTH.

There is also the concern in his ability to manage crisis and complex problems. Will he cope?

Are these cautionary words sufficient for us to have confidence in Azeez?

Still not ...

When we went for Haj in 2011, we had to make an application to enable us be a mahram for the missus and her sister.  While awaiting for our application, we approached LTH's Public Relation for the idea to blog on the Haj. Still it is subject too getting picked to go.

We were not going to pull any strings, neither family or friend. The last we wanted was to deny other more deserving case. Somehow or rather, a friend got wind and spoke to Azeez. It was not our first time to meet Azeez because we've met before to solve certain problem/s.

Luck has it there was such public relation plan and we fit in. Azeez helped to smoothen our application or that was what we were made to believe. He was helping to get a list of old people to go and he said some were even PAS voters.

One thing we insisted to pay for our Haj trip and stay with the marhaen. No special room for media at Iskandariah but together to join the sardine packed tent at Mina.

We managed to be selected in time at the last minute and two days before our missus scheduled flight, we expressed our appreciation to Azeez. His only words were "Ini bahagianabang."

He only asked for us to prayin front of Kaaba for him to achieve his ambition. However, we did not but instead pray for something more than that. Our prayers was for Allah to grant him what is most appropriate for him.


Now these are the dilemma.

We have prayed to leave it to Allah to determine his fate and now an opportunity befalls on him. It is not his fault that he be offered such position. It could be Dato Dr Jamil Khir's recommendation or Dato Najib's request but above all, it is Allah's wishes. Are we to deny him when we had prayed for him and now his chance has come?

Our heart and mind still insist he is the most inappropriate person. The offer is already there but it is now up to Azeez. If he fails or something got exposed with his hands in some cookie jar, he has to ponder the implication to his party. It is a heavy responsibility this young man has to bear.

For someone who regularly visits the holy land to do ibadah, should we give him the benefit of the doubt? Maybe Azeez has turned really for the better and has some sincere plans for LTH. We are still talking maybe because we dare not take that risk.

It seemed he had approached an elderly and respectable person to ask for his opinion of the offer. The elder  said take it. Perhaps the elder was being polite but in his nothern accent, he actually never meant it that way. 

This is where Azeez was said to have worked his charm. He replied, "But sir, I will only accept it if you accept to become my adviser."

The elder agreed. What are we to say now?

A great talent leaves (Part 6): Cover-up and Rising Up

We return to the original mamak in pursuit.

Tan Sri Nor Mohamed Yakcop was seen by a friend having high tea at Chef & Brew, a posh eatery at Plaza Damansara with a group of his kaki. Coincidently, it is also a favoured joint of Khairy and his kaki. All of a sudden, the usually soft spoken Nor Yakcop was heard from far saying, “I am in a lot of trouble already. Don’t you read the blogs?”

It could be an excuse to turn down a request from his friend but maybe he is feeling the heat from discussions on the business dealing of Tabung Haji by his boy, Dato Ismee, the purchase of Vision City by his boy, Dato Sharil Redza at EPF, and many more by the English blogs.

We are far from reaching those current issues but still on his days making losses gambling government’s money in the highly speculative foreign exchange market and committing criminal breach of trusts at Abrar Corporation, Abrar International and Mun Loong.

Interestingly, the mainstream media has been covering up his early disasters during Pak Lah’s days to justify his appointment as Minister. We look into it as we stroll through his days with Pak Lah.

Nor Yakcop was supposed to manage and in this case, using active management to counter the foreign exchange exposure of the country’s reserve. He ended up becoming a punter instead and  ended up making the biggest trading loss in financial market history.

He had to resign from his position as Adviser at Bank Negara Malaysia in 1994. But, this moment in Nor Yakcop’s history was obliterated by mainstream media. Reports only described it as “leaving briefly to join the private sector.”

His position as executive chairman of Mun Loong Bhd, vice-president of Abrar Group International and executive vice-chairman of Abrar Corporation Bhd were only mentioned in passing as though it is part of his long list of achievement in the corporate sector.

That short spell in the private sector was no better than his reckless trading and cover-up of losses at Bank Negara Malaysia. If other rouge traders end up serving time, he should have  been in too for his indiscretions at Bank Negara and CBT with Abrar and Mun Loong.

Keep my past minimal, OK?

With that part of his history covered up, he could rise and highlight his achievements on his return to Bank Negara Malaysia in 2000 as Special Adviser, then appointment as Special Adviser to Prime Minister, and subsequently, as Minister of Finance II and Minister in the Prime Minister’s Department in charge of Economic Planning Unit (EPU).

Notice this flattering cover-up by Utusan Express dated January 8th, 2004, which was in the early part of Pak Lah’s days. Was it really a success by Nor Yakcop for the nation?

Nor Mohamed Yakcop - right man for the job

KUALA LUMPUR Jan 7 - The architect behind the establishment of the ringgit peg against US dollar, which provided financial stability to counter the 1997/98 financial crisis, the new second Finance Minister Tan Sri Nor Mohamed Yakcop is the right man for the job.

He has also been instrumental in drawing up restructuring exercises for companies such as United Engineers Malaysia (UEM) and Malaysia Airlines (MAS) to get corporate Malaysia back on track after the crisis.

[Note: Did he managed to put Corporate Malaysia back on track or it was a quick fix that destroyed the Bumiputera Commercial & Industrial Community (BCIC) and created a new breed of carpetbaggers?]

Now, the 56-year old former Bank Negara Adviser, is also involved in promoting the use of the gold dinar in trade between countries.

He was responsible for the implementation of a number of major projects including the implementation of Islamic banking, Ar-Rahnu (Islamic pawn loans) scheme, setting up of Bilateral Payments mechanism between Bank Negara Malaysia and central banks of South-South countries, setting up of the Securities Commission, Cagamas Bhd and Rating Agency Malaysia Bhd.

[Note: Other than the much needed establishment of new institutions, which had been long discussed, are these really his efforts and was it really sustainable and successful programs?]

A founding member of the Institute of Islamic Understanding (IKIM), he played a significant role in the formulation and implementation of the selective exchange control measures implemented in September 1998.

[Note: Was SCC his idea or that of a local University Professor and modelled from other countries like Chile and China?]

Since taking on the job of Special Economic Adviser to the Prime Minister in May 2000, he has played a major role in a number of corporate restructuring exercises including UEM, Malaysian Resources Corporation Bhd, MAS, Tabung Haji, Johor Corporation, KUB, Langkawi Cable Car project and the Light Rail Transit (LRT) companies (Putra and STAR).

He was also responsible for setting-up Prosper (Projek Usahawan Bumiputera Dalam Bidang Peruncitan) scheme, which aims to increase bumiputera participation in the retail sector.

With several feathers in his cap, including being the architect of Islamic banking and its successful implementation, he was credited for leading a team of advisers in putting in place the very much needed reforms in the corporate and financial sector.

The Association of Banks in Malaysia, in welcoming the appointment, said it was a positive development.

"A thorough-bred central banker, Nor Mohamed has extensive experience in a complex financial environment and a proven track record in managing a financial crisis," its chairman, Dr Rozali Mohamed Ali, said.

When the 1997/98 financial crisis gripped the region and the nation's economy, Nor Mohamed was responsible in advising the then Prime Minister Tun Dr Mahathir Mohamad on the implementation of the controversial capital controls which included the establishment of the ringgit currency peg.

The selective capital controls have proven sceptics wrong when it managed to bring Malaysia out of the crisis earlier than other affected countries which had subscribed to the International Monetary Fund (IMF) rescue formula.

Nor Mohamed was appointed as special adviser on financial affairs to Dr Mahathir, then Prime Minister, in May 2000 and was retained in the current post by Datuk Seri Abdullah Ahmad Badawi due to his wide experience.

Born 56 years ago in Penang, Nor Mohamed had his early education at St Xavier's Institution in Penang before graduating with a B.Econ (Hons) from University of Malaya in 1972 and an M.B.A from the Catholic University of Leuven, Belgium in 1979.

His career in Bank Negara, spanning 26 years from 1968 to 1994, he left briefly to join the private sector only to return in September 1998 as the central bank's special adviser until early 2000.

His involvement in the private sector from 1994 to 2000 included stints as managing director of RHB Research Institute Sdn Bhd, advisor to Jati Discounts Bhd, executive chairman of Mun Loong Bhd, vice-president of Abrar Group International and executive vice-chairman of Abrar Corporation Bhd.

Nor Mohamed is a board member of MAS and Khazanah Nasional and is in the National Economic Action Council (NEAC) executive committee since May 2000.

He is married to Puan Sri Fawziah Mohd Abu Bakar and has three children.
This Pak Lah era report highlighted his involvement in solving the financial crisis that hit the Banks badly from 1998 onward.


Nor Yakcop’s plan was to recapitalise the Banks by getting corporates that was part of the BCIC to repay their loans to the Banks. The troubled Chinese corporations were left untouched.

To do so, Nor Yakcop took the easy way to abuse his position by using Banks and Merchants Banks to harass and seize Bumiputera-controlled corporations.  Those that resisted were investigated with intention to frame with trumped up criminal charges and civil suits by the corporation they once controlled.

In the end, Nor Yakcop nationalised the Bumiputera corporations without giving fair consideration, and using trickery on the owners. It is believed he may have also nationalised UMNO’s investment interest. If only UMNO members knows and are not feudalistic blind loyalists to their leaders, they would have been an up-roar.

Under Dr Mahathir's tight control, he was merely assigned to solve the banking issues arising from the financial crisis of 1998/99. After 2004 general election, Nor Yakcop was empowered to restructure the whole Malaysian corporate landscape, specifically the Bumiputera corporates. 

Although being described as consummate civil servant and central banker, Nor Yakcop is never known to do things proper and systematic, but rather instinctively. His psyche is to beat the stated rules if he can for a short cut to make money. If he has to break the law and get the organisation in trouble later, it does not worry him. At the end, when things go wrong, he has no conscience to cover-up.

It is a recurring trait of Nor Yakcop from his days as foreign exchange trader. He did it again under Pak Lah when he became the powerful de facto Finance Minister and contracts were under his purview.

Nor Yakcop was also in charge of the GLC Transformation Plan in which the disastrous failure is is near to obliterating the BCIC which was worsened by the neo-liberal policies by Dato Najib's inner circle and Advisers.

Me, my sons and my friends ... opps Bumiputera will be rich

His programs for the lower level BCIC like Equinas, Prosper, Teraju, Yayasan Penaraju Pendidikan Bumiputera, Majlis Tindakan Ekonomi Melayu, Teras, etc. are all to hoodwinked Bumiputera as though something is being done.

All the while it is only lip service and not serious effort thus the limited impact.

While, his restructured GLCs continue to exert their influence and advantage in business, GLCs strayed away from the objective of their incorporation to ignore nation building agenda and social responsibilities.

Bloggers like us were questioning the policies generated by Nor Yakcop since it’s inception then, but no one bothered to ponder. The business people think it is positive thinking to ignore moral issues, social agenda and remain focus to pursue the paper with Agong’s head.

Many strange deals were heard. Both Nor Yakcop and his boys were heard to be lining their pockets.

What was he been doing at EPU under Dato Najib’s cabinet when most of economic planning and policy formulation was done by Omar Ong, Ethos Consulting and their favoured friendly consultants with Dato Idris Jala and Pemandu as front?

Did he achieved what he set out to do or was merely hoodwinking others and lining his pocket?

Tan Sri Nor Mohamed Yakcop is the Malaysian Minister in the Prime Minister's Department, in charge of Economic Planning Unit. He was the prior Minister of Finance II, a post he has held since 2004 until 9 April 2009.[1] He is a member of the Executive Committee of the National Economic Advisory Council.

Career

Previously, he served with Bank Negara, the Malaysian central bank, from 1968 to 2000. During his time in Bank Negara, he was responsible for the implementation of a number of major projects, including:
  • the implementation of Islamic banking in Malaysia
  • the setting-up of the bilateral payments mechanism between Bank Negara Malaysia and Central Banks of South-South countries
  • the setting-up of the Rating Agency Malaysia Berhad.

He was also involved in a currency speculation scandal in the early 1990s, where Bank Negara lost up to RM30 billion. No actions had been taken on him as he moved on to hold important government positions.[2]

He was the Special Economic Adviser to former Prime Minister of Malaysia, Tun Dr. Mahathir Mohamad.

In 2002, he was appointed the director of Khazanah Nasional. He played a major role in government-linked companies (GLCs) like United Engineers Malaysia Berhad and Malaysia Airlines.

The transformation of the GLCs is another feather in his cap.

Following the Asian financial crisis, many of the GLCs were mired in debt and rudderless. In retrospect, his solution to their problems was simple.

First, he restored their balance sheets using the Government’s sovereign guarantee when necessary as this guarantee cut down their cost of funds.

Then he got young, bright professionals to manage these GLCs, giving them wide latitude to run these huge corporations but with the proviso that they did not line their own pockets. To ensure that they delivered, he introduced key performance indicators and service contracts. The GLC transformation is now into its third phase – and delivering results.

He was a member of the Dewan Negara, the upper house of the Parliament of Malaysia, for two terms before stepping down to run for the Tasek Gelugor parliamentary constituency in Penang in the Malaysian elections on March 8, 2008.
Wikipedia makes no mention of his short but criminally untrusted stint at Abrar.


Someone really closed enough to Nor Yakcop described him as someone who reads a lot. Thus, he is able to give the impression that he is knowledgeable and has got lots of new ideas. But, the person close to Nor Yakcop said he had nothing to show as success.

Usually, he cheated to make things look good but more worms come out of the woodwork later. It is like his rotten positions left inside the reserve accounts at Bank Negara till the news of the losses  exploded from the earlier announcement of RM6 billion to announce later as RM9 billion. We believe it is RM16 billion.

Like any mamak, he is verbally confident  in public speaking and personal communication. He is able to able to convince or seek sympathy from others.

Some may think he is impressive but his ideas had short-lived effectiveness. His ideas never gave the “wow!” reaction that Dr Mahathir used to give whenever he announced any new measures or initiatives as Prime Minister.

According to Wikipedia, Nor Yakcop was born on August 25, 1947 in Penang, then Malayan Union. He joined Bank Negara as a clerk in 1968 after completing Form 6 at Xavier Institution Penang.

He managed to secure Bank Negara scholarship and immediately entered University of Malaya to later  graduate in 1972.  Naturally, he came back to be an officer and rose up the ranks.  At a certain position, prospective government officers are usually given a chance to pursue their masters. He pursued for a Master’s in Business Administration (MBA) at Leuven, Belgium.

For someone with humbled beginning and given a new lease of life, Noor Yakcop became crooked and greedy. He used his boys to lined his pocket with contracts [Read about Kanari and the Istana contracts here] and to take care of family business interest abroad.

Do not assume that the GLCs foray abroad exist in a vacuum. There are possible links to corruption and power abuse.

And, he used his positions to raise money to support his three sons interest which are like rich man's son to indulge in sportcars. It only means Nor Yakcop must be filty rich to have his sons involved themselves in the sports of motorcar racing. [Read about Brother in Racing here.]

Not only the media is helping to cover-up his disasters, which should have ended his career, his Penangite Pashtun buddy, Dato Kalimullah could be trying to get friends to twist for him as though he was a late bloomer  and rose from the bottom.

A great talent leaves (Part 7): Aides charged for corruption

The one characteristic of Tan Sri Nor Mohamed Yakcop is that he is soft spoken and polite. The man has a sense of humour despite being a man of serious disposition. Many are impressed with his firmness and perceived honesty.

The fact that he resigned from his comfortable position in Bank Negara in 1994, he left with the impression of being accountable and although he broke the rule and was imprudent, the market see him with a certain amount of respect.

Another factor that endears him with his superior is his sense of loyalty and service. Come what may, he had been lucky to get support and protection. 

Although he is perceived as honest then, he has not been so since becoming Minister of Finance 2.

We are skipping the time he was Special Adviser to the Prime Minister first to highlight a point. Nor Yakcop was no more clean and honest as soon as he held that powerful Ministerial position.

Suspicious

On August 2010 posting here, we highlighted about Kanari Sdn Bhd as the company he registered his interest in Abrar in. Kanari represents the suffix to the three "brothers in racing."

Subsequently, when he became MoF 2, he may have rewarded himself contracts, in this case Istana Negara contracts, under a compay called Kejuruteraan Kanari Sdn Bhd.

There is more suspicious self-rewarding deals and contracts but save it for a later Parts.


In Part 3 [read here], we mentioned that:
When Nor Mohd joined Abrar he was offered a chance to own 5% of Mun Loong Bhd. He thought it was a great deal. Since Anwar was the Finance Minister, a RM30 million loan was arranged from Bank of Commerce for Nor Mohd to buy shares in Mun Loong (later Abrar Corp).
In Part 5 [read here], we exposed that there was still an outstanding RM13 million out of that RM30 million loan. He repaid the balance in this manner, below: 
He had funneled the money of a public listed company in which is partly owned by the public, to Abrar Group International Sdn Bhd (AGI) and subsequently to himself to settle the Bank of Commerce loan (today it is CIMB Bank). AGI is the 25% owner of ACB.

That is a criminal breach of trust and breach the statutory and fiduciary duties of a Director of a Company. The Company Act clearly stated that Company Director cannot borrow money from their own company, what more for a public company.
One should be asking how did he get to raise RM30 million when he was merely living off a government servant pay and getting some income to sustain as Director of Rashid Hussein Research and Adviser of Jati Discount House?

Even on a 'bullet repayment' one cannot secure 100% financing. At a high 90% financing, he still need to commit RM3 million. Realistically, he does not have RM3 million. He does not have the "name" to raise money through what they call as name lending.

Where did he get the money to raise money when his only source would be his salary, and perhaps some savings and investments. Unless, he made some money trading foreign exchange. But through whom?

He had many kaki and the name in the market to trade margin account out of Singapore. Many crooked Banks are willing to have his account and give him a margin trading on only 5% or even 2% capital. Banks like UBS or Barclays or Citibank  would want the account of a market mover like Nor Yakcop.

We are not making accusation but the question remain on how he raised the RM30 million. Mind you, the mention of those Banks are not pluck out of thin air.

Political Aide Arrested



If those issue missed the public attention, the arrest of his political secretary, Hasbie Satar in 2010 and charged in court for money laundering by the MACC. Read this opposition news portal report:

Nor Mohamed Yakcop's former aide Hasbie Satar was charged for money laundering at the Sessions Court in Butterworth.

BUTTERWORTH: A minister’s former political aide, Hasbie Satar, 38, has been charged at the Butterworth Sessions Court today with involvement in illegal money laundering amounting to RM2,134,656.

The charge was under Section 4(1) of the Anti Money Laundering and Anti Terorrism Financing Act 2001.

Hasbie, who appeared without a legal counsel, claimed trial before Judge Mohd Zairan Aman, who then fixed the matter for mention on March 14.

The judge also fixed bail at RM60,000 with two surety. Hasbie posted bail.

Hasbie urged the court to lower the bail amount, submitting that his income had dipped following his resignation as political secretary. He said he had to look after his wife and four children.

He added that he had served the government in various capacities under three prime ministers.

Deputy Public Prosecutor Anselm Charles Fernandez handled the prosecution.

Hasbie was alleged to have been in possession of the sum at 4-10 Sri Molek Apartment, Jalan Laksamana in Teluk Air Tawar, Seberang Perai Utara, Penang on Feb 11, 2010.

Hasbie was a former political secretary to Nor Mohamed Yakcop, who was the former second finance minister and now minister in the Prime Minister’s Department.

Nor Mohamed is currently in charge of the Economic Planning Unit.

Sept 25 hearing for Hasbie Satar's money-laundering case

SHAH ALAM: The Sessions court here has set Sept 25, 27 and 28 to hear the case of Hasbie Satar, the former political secretary to Minister in the Prime Minister's Department Tan Sri Nor Mohamed Yakcop.

Hasbie has been charged with 28 counts of money-laundering.

Judge Mohd Fadhir Harun set the date when the case came up for mention before him Tuesday.

Deputy public prosecutor Hazril Harun appeared for the prosecution, while lawyer Y. Sheelan Samuagam represented Hasbie.

On March 20 this year, Hasbie, 39, pleaded not guilty to 28 charges of money laundering involving RM935,000 which was deposited into the bank accounts of 11 individuals, including his family members.

The offences were allegedly committed at several banks and Tabung Haji premises at Salak Tinggi, Bandar Baru Bangi and Putrajaya between Dec 4, 2008 and June 18, 2009.

Hasbie was charged under Section 4(1)(a) of the Anti-Money Laundering and Anti-Terrorism Financing Act 2001 which provides a fine of up to RM5mil or maximum imprisonment for five years or both, if found guilty.

He is also on trial for a similar charge, involving RM2.13mil, at the Butterworth Sessions court in Penang. - Bernama

Several information was missing from the mainstream press but available in the Parliament hansard from Wee Choo Keong's speech in Parliament on March 15, 2011 [read here]. He said:

Telah banyak dilaporkan bahawa semasa MACC menangkap En Hasbie Satar, bekas setiausaha kepada bekas Menteri Kewangan II, YB Tan Sri Nor Yaakob, dengan sekurang-kurangnya wang tunai RM2 juta. Ia juga dikesan mempunyai beberapa kondominium mewah dan mempunyai 47 peti besi di rumahnya.

Kecuali tuduhan AMLA ini benar-benar tidak berkaitan dengan wang tunai juta RM2 yang ditemui di rumah En Hasbie Satar dan beberapa kondominium mewah, orang awam tidak boleh menerima tuduhan di bawah AMLA. 
AMLA bukan undang-undang yang sesuai sebab wang tunai RM2 juta  masih ada dalam pemilikannya. 
Tuduhan dibawah AMLA dalam keadaan ini telah memberikan satu gambaran yang jelas bahawa pihak tertentu “cover up” perkara dan/atau atau untuk melindungi orang tertentu.
The house Hasbie was caught with the money at 4-10 Sri Molek Apartment, Jalan Laksamana in Teluk Air Tawar, Seberang Perai Utara, Penang on Feb 11, 2010 was claimed to be registered under Nor Yakcop's wife name. [Read The Unspinners here]

Hasbie would not have bought  home in Seberang Prai since he is Sarawakian. Nevertheless, talk is  he own a hotel in Kuching on behalf of someone.

The question is why was Nor Yakcop's wife's apartment equipped with 47 safeboxes?

Another Aide Earlier

Before this another of his political secretary, former UMNO Youth Exco Dato Norza Zakaria was also charged for Money Politics. Malaysiakini report below taken from Tok Mummy here:
Money politics: Umno's Norza charged

Umno supreme council member Norza Zakaria was charged this morning in Temerloh magistrate's court in Pahang for alleged involvement in money politics. - Malaysiakini .

He claimed trial to two charges of offering bribes to party delegates to vote for him for the supreme council post in the coming party polls later this month.

Norza, represented by Muhammad Shafee Abdullah, was released on a RM10,000 bail in one surety.

Malaysian Anti-Corruption Commission's head of prosecution Abdul Razak Musa led the prosecution.

Magistrate Ida Rahayu Sharif fixed April 22 to mention the case.

Norza, 43, is alleged to have committed the offences on Jan 20, 2009 at 6.30pm at No 38, Pinggiran Tasik, Taman Bandar Temerloh, in Temerloh.

He is charged with corruptly giving Khadri Musa RM1,500 through Halimi Kamaruzzaman to be distributed to party delegates as inducement to vote for him.

Norza is also charged with corruptly giving RM1,900 to Mohammad Anuar Yunus, also through Halimi Kamaruzzaman, for the same purpose.

The charges are under Section 16 (b)(A) of the Malaysian Anti-Corruption Commission Act 2009 (Act 694) and punishable under Section 24 of the same Act.

Halimi was also charged under the same Act with bribing Khadri and Mohammad Anuar on behalf of Norza.

He claimed trial and was released on a RM10,000 bail.

Both Norza and Halimi can be jailed for up to 20 years and fined not less than five times the amount of the bribe, whichever is higher.

An aide to face charge too

Norza was arrested in January and released on bail pending investigations.

Prior to this, MACC had rounded up 12 party division leaders for allegedly dabbling in money politics. The commission had also queried Norza for more than eight hours in Temerloh.

Norza is the Federal Territory Umno Youth chief. He was a former political secretary to Second Finance Minister Nor Mohamed Yaacop.

He is also a close associate of Umno Youth deputy chief Khairy Jamaluddin and considered to be a member of the prime minister's inner circle.

Norza has never commented on the probe on him but had said that he was assisting MACC in their investigations.

This would be the first big catch of the MACC in its ongoing probe into money politics in Umno.

Halimi, who is a Maran Umno division committee member, had previsouly lodged a police report alleging that he had been tortured by MACC officers to implicate Norza of practising money politics.

On Jan 28, Halimi Kamaruzzaman, 46, claimed that he was assaulted during his four-day remand in Kuantan.

According to him, MACC officers wanted him to confess that Norza was involved in money politics.

It is learnt that he will be charged soon for lodging a false report.

Leaving it to the delegates

Talking to reporters later, Norza said he will not be relinquishing his supreme council post as a result of facing the corruption charges today.

Instead, he said, he would be contesting to retain the post in the coming party polls, adding that he would be leaving his fate to be determined by party delegates.

A teary-eyed Norza also said that he was disappointed with the charges preferred against him. He said that he had contributed a lot to the party.

The emotional Norza, who had to be pacified by his supporters, also said that he would adhere to whatever outcome of the case.

Norza arrived to the court in the morning accompanied by bodyguards and some 30 supporters.
Norza was acquited in 2010 and appeal by MACC to higher court could not overturn the decision.

There was some speculation with regard to the MACC witnesses turned against them in favour of Norza and some strange judicial practises behind the scene. However, an acquital remain an acquital.

His ban in UMNO has been lifted recently. [Read KL Chronicle here].

Link

Norza's case was too small an amount to link to Nor Yakcop and it is within his means. But the case of Hasbie Satar is too closely linked to Nor Yakcop.

If he was charged for money laundering or money he cannot explained account his ownership, then who does the money belong too. And if it had been his, why the heck must he kept it in Penang where his boss's constituency is?

Haviing been caught at Nor Yakcop's wife's apartment could only means that it is meant for the purpose of his boss's Tasek Gelugor constituency.

Will Hasbie speak up? Or he is willing to sacrifice for his boss? If he is willing to, it better be sufficiently rewarding.

These cases mentioned basically shows that Nor Yakcop is tainted.

Forget his soft spoken, loyalty and professionalism. In our view, he is corrupt and there will be many strange institutional dealings under him that stench of corruption can be smelled from afar.

'Lembik' responses to Vatican Envoy

On July 11th, The Malaysian Insider reported Apostolic Nuncio to Malaysia, Archbishop Joseph Marino made a statement in an interview to support the Catholic Church of Malaysia on the use of "Allah" for God in churches.

This attracted several other Muslim organisations and leaders, notably Perkasa and Jati to demand for apology or expulsion of the Archbishop and closing the Embassy. President of the Council of Churches, Bishop Phillip Lok call on Prime Minister, Dato Najib to take a stand against Perkasa and Jati.

In the midst of the exchanges, Minister in the PM's Department for Religious Affair, Dato Dr Jamil Khir's was reported to merely complain on the Archbishop for creating anxiety. He failed to address the right issue.

The issue is not about the use of "Allah" in churches that is still being appealed at the Court of Appeal but interference in our domestic affair and suspicion of dabbling in local politics.

Dato Najib too was evasive and was reported as being rhetorical in his repetition of  Government commitment to Islam and use of Allah. Ramadhan is a month to cleanse ones thought and heart of bad intention.

But recent development does not show he is committed. Dato Najib has bending backward and avoiding controversies to maintain his populist and liberal stance. 

Rhetoric


If Dato Najib is serious in his claim to defend the sanctity of Islam, why then did he recalled back the proposed amendment to a law on the conversion of children's faith by a single parent without mentioning of the next course of action?

It is not about the issue but about Dato Najib losing control over the situation. Dato Nazri Aziz spoke his mind, despite his current position as Minister of Tourism. That agitated the non-Malay component party of BN and non-Muslim BN members of Parliament..

The Government was put in an embarassing position to withdraw the proposed bill. 

Populist


Dato Najib had already been seen as indecisive and has a personal history of making his decision till the last minute. Of late, he is seen to flip flop oftenly.

In this issue, his rather evasive stance may have come about because in his effort to be a populist Prime Minister, he had received audience with the Pope Benedict XVI on July 18, 2011.

That meeting was to lift his profile to the Christians but it was to no avail or it was practically a failure.

Lim Guan Eng reignite the issue on Christmas eve 2012 prior to the 13th General Election and the churches were adamant to allow it to be used nationwide and not merely for the Malay speaking churches for Sabah and Sarawak Pribumi.

The only political option left to BN was to put PAS under pressure from it's grassroots. It may affected BN in the predominantly Christian Chinese in major Sarawak urban seats.

Najib's meeting may have paved the way for a formal foreign relation with the Vatican City but instead of improving relation with Vatican City and local Christians, Vatican's Envoy is the keeping that issue alive for the opposition.

Conspiracy


Put aside conspiracy theories like Freemason and Illuminati that claim link with the Vatican church. Undoubtedly, the Vatican and Archbishop Marino has been putting their hands in domestic politics elsewhere to further their's and other interest.

It should not come as a surprise because Marino was born an American. As someone who hails from Alabama, it is a typical ‘Red-Neck’ and Southern state.
Moreover, Archbishop Marino is not new in the international politics and diplomacy game. In fact, he is a seasoned diplomat and player in the game of international politics.


He was a member of the Vatican delegation sent by Pope John Paul II to Belgrade on April 1, 1999, at the height of the Kosovo conflict. He was also part of a delegation sent to the White House before the 2003 start of the war in Iraq.
Archbishop Marino also served as Apostolic Nuncio to Bangladesh for four years, where domestic politics such as the Chittagong Hill Tracts conflict was part of his interest and agenda.

Of course the usual excuse he is playing ‘the cleric in the mission of peace’ role.
There is also a possibility he could also be part of an international political ring of operatives, acting on behalf for Neo Con Jews and the sinister agenda to rule and control the world, directly and indirectly via proxies.


After all, Pope John Paul II was for a very important and experienced international political personality.
He was undoubtedly an integral part of the Western backed international ring of political operatives which brought Communism down and dismantled the ‘Iron Curtain’.

Archbishop Marino could probably be part of the international political support group in their strategic agenda to undermine and eventually dismantle the Muslim power in favour of the minority. Especially the Malay-Muslims are the most progressive and globally most influential group of Muslims.
It is imperative that the Malay-Muslims are being made subservient to the Anglo-New Con Jewish international agenda in someway or another.


If that was true, then it makes perfect sense why he is supporting the CFM quest, which is strongly supported by Chinese Chauvinists DAPsters and anti Malay politicians such as Lim Guan Eng, Teresa Kok and Nga Kor Ming.
Diplomacy Backfired


Already, a picture of the Archbishop with the widely known Christian Evangelical activist of DAP, Teresa Kok was found on the net. Another strong supporter to this cause would be MCA-owned The Star.

Both parties seemed to have no qualms for other country to meddle in the domestic affair of our country to further their agenda. This is odd because even the official stance of the then Anwar-supporting US Ambassador to Malaysia, John Mallot is  not be seen publicly meddling in the domestic affair of Malaysia.

The Archbishop's timing is perceived to assist the opposition to revive the "Allah" issue few years  ahead of the next Sarawak state election to fire-up anti-government sentiment among Christian in East Malaysia.

This development attracted a cynical comment from journalist supemo and blogger, Dato Abdul Kadir Jasin here. He sort of questioned Dato Najib's tendency to take pride being seen with many world leaders, including US President Obama and the Pope.

He asked, "Now they got what he wished for - the Pope had sent an Ambassador to Malaysia. Now the big task - who is to teach whom and who is to listen to whom?

"Do we teach the Pope's Ambassador about our time tested multi-religious and multicultural background or we allow him to dictate terms to us."

The questions seemed to infer that Dato Najib had not think thoroughly and ponder over possible fallout before making such overture to the Vatican City.

A firm voice standing out from among 'lembik's

It will not be easy on Wisma Putra and look bad on Malaysia internationally to call on the Archbishop to reprimand him. Worse still, it is not good diplomacy to succumb to demand by Muslim NGOs to close the Embassy.

Domestically, it will not make it easier for government relation with the Christians voters.

Given the situation Dato Najib had left the country in, the response from Minister of Foreign Affair, Dato Anifah Aman was indeed commendably strong and to the point.

Malaysia does not welcome foreign interference in 'Allah' issue - Anifah

KUALA LUMPUR: Malaysia does not welcome foreign interference or influence on the usage of the word 'Allah', said Foreign Minister Datuk Seri Anifah Aman.

In a statement today, Anifah said as a sovereign country, such interference would only stoke religious sentiments in the country and would not help in contributing towards ensuring racial and religious stability and harmony in the country.

"The matter (word Allah issue) case is currently being heard at the Court of Appeal and all parties should let the case be determined according to the rule of law of the country," he said.

Vatican City ambassador to Malaysia Archbishop Joseph Marino was reported to have lauded local church's campaign to include the Arabic word 'Allah' to refer to GOD, amongst Christians.

Weak and Indecisive

Building perception as weak and indecisive leader

Like slicing a bologna, the Archbishop would let it off this time but he will not heed the warning and continue to make comments after comments of support for fringe and left wing groups, particularly those for more liberal religious practises for born Muslims.

Evangelism is part of the calling on all Christians but it is against the spirit of Article 11(4) of the Federal Constitution which forbid preaching other religion to Muslims. It is part of the commitment on the part of non-Muslim to the Malay in the Social Contract in exchange for their citizenship.

In the past, a "buka puasa" event organised by a church turn out to be an event to proselytise Muslims aroused outbursts from Muslim groups. In another occasion, DAP had organised a dinner which had foreign pastors operating in Sarawak holding a fellowship for Malaysia to be a Christian state.

If Dato Najib had been silent to the present barrage of insults on Islam in Facebook and Social Media, with the most recent a Chinese couple wishing break of fast with pork, he is likely to be soft and weak to confront the Archbishop should he go head-on into issues sensitive to Muslims.

To a Muslim, it is our responsibility to defend and save the akidah (faith) of another Muslim. If need be, Dato Najib must sacrifice his political popularity and international public relation by being firm and decisive on matters of another Muslim's akidah.

He should be mindful and listen more to the voices and plight of the common people. Less of the Omar Ong and Idris Jala. There is a growing perception on the ground that he is a weak leader, soft in his actions and excessive in his slogans.

The visit to the Pope that culminated into Vatican City establishing diplomatic relation didn't start on the right foot.

Apostolic Nancio to Malaysia, Archbishop Joseph Salvador Marino expressed support to the Malaysian Catholic Church for their position on the "Allah" issue. That created uproar for it is  tantamount to interfering in the domestic affair of Malaysia a country.

Foreign Minister, Dato Anifah Aman issued a strong statement and  the Archbishop met Anifah yesterday to express apology. That should be the end of it but one Tan Sri text us to wonder why must Anifah be the one to issue the statement?

Shouldn't the Archbishop himself be issuing his apology? Why must the leadership kept looking like a fool ....

Vatican envoy sorry for misunderstanding over Allah issue

The Vatican’s envoy to Malaysia today asked Foreign Minister Datuk Seri Anifah Aman to convey his apologies if his comments on the “Allah” issue have caused any misunderstanding and inconvenience.

Archbishop Joseph Marino said he never intended to interfere in the internal affairs of Malaysia.

The archbishop said this in a statement after he was summoned to Wisma Putra this afternoon.

Prior to the meeting today, Anifah had issued a strongly worded statement over the alleged meddling into the “Allah” controversy which he deemed to be Malaysia’s internal affair.

Archbishop Marino, in his first interview last week as the Apostolic Nuncio, the Vatican equivalent to an ambassador, had stirred controversy with his comments on the use of the word “Allah”.

He indicated that the Christian Federation of Malaysia had presented a “logical and acceptable” argument to counter the argument by Muslims that “Allah” was exclusive to Islam.

He stated his support for the stand of the Catholic Church in Malaysia and backed the arguments made by the Christian Federation of Malaysia.

Earlier today Sabah MP Datuk Bung Mokhtar Radin, echoing calls from Malay non-governmental organisations, urged the government to “chase” Archbishop Marino from the country.

He accused the Vatican envoy of disrupting the country’s unity.

Youth and Sports Minister Khairy Jamaluddin also jumped on the bandwagon, almost repeating what Foreign Minister Datuk Seri Anifah Aman had said about the matter.

Khairy, speaking in his capacity as the BN Youth leader, said Wisma Putra should issue a protest note to the archbishop for purportedly supporting the use of the term “Allah” by Christians.

“It’s a national problem which is still being debated. The archbishop (Joseph Marino) is not helping the situation at all. His statement could complicate the situation.”

Muslim groups, led by Jati and Perkasa, even called for the government to close the Vatican office and “chase” Marino out of the country.

In a Press conference earlier today, leaders of both groups said Muslim groups will submit a protest note on Friday to reprimand the envoy for being “insensitive”.

They hope Archbishop Marino will personally receive the protest note at the embassy in Kuala Lumpur after Friday prayers.

The president of Muslim non-governmental organisation NGO Muafakat, Ismail Mina Ahmad, told a Malay daily over the weekend that the envoy was not a very smart person for discussing a domestic Malaysian subject which was still under the purview of the courts. – July 16, 2013.
All these messy bit because someone up there are not thorough in their decision making despite known to wait for all fact and information to come in and make a decision at the last minute.

It is as though they do not have the grasp on issues that the basic facts and background information are not in their mind or they are devoid of driving principles to guide their decision making.


Is someone so overawed to get an audience with the Pope and perhaps leverage on the visit for political gain that they could not see the big picture or on-going international political game? Or is it a case of him being advised but only listen to some myopic little rascal?

That is the case of meeting the Pope.

Over the years, since 2009, the mainstream media have been playing up the news everytime Prime Minister Dato Najib Tun Abdul Razak met US President Barrack Obama.



He first met Obama at a Nuclear Security Summit in Washington on April 12, 2010. The media depicted it as an important significant improvement in relations. It is only the first one-on-one meeting between the Prime Minister of a small country and President of an intrusive superpower.

All the talk of Obama sought further assistance from Malaysia in stemming nuclear proliferation as the greatest threat to world security and Najib expressed that Malaysia only supported nuclear programmes designed for peaceful purposes means nothing.


Then they met again at the ASEAN-APEC leaders at the ASEAN and East Asia Summit in Nusa Dua, Bali, Indonesia on November 18th, 2010.

The media reported Washington's appreciation towards Malaysia's role as a progressive Islamic nation in international affairs. It must mean something to get to hear the appreciation and hope of an American President. 



Later on November 13, 2011 it was only photo op with the host at the APEC Summit in Honalulu, US. Datin Seri get to be pictured with Michelle Obama.

Bernama reported "Prime Minister Datuk Seri Najib Tun Razak held a series of productive meetings prior to the Asia-Pacific Economic Cooperation (APEC) summit which included deepening ties with Russia, raising Malaysia's profile among top American and Apec chief executive officers and most significantly fast-tracking negotiations for an ambitious Trans–Pacific Partnership."

On November 20, 2012, Dato Najib met Obama at the Trans-Pacific Partnership Leaders' Meeting in Phnom Penh.

Najib told the media when he met Obama, he said, "During the meeting, I requested Obama to act in ending the current violence in Gaza and find short-term and medium-term solutions based on the two-state solution (as proposed by the United Nations) as the basis for the conflict resolution."

Obama informed him that morning that he had made several telephone calls last night to stop the violence. Sure ... it is freedom for Palestine now.

Will TPP bring freedom to Malaysia?

Off late, he has been quite cordial. Najib received a surprise call from Obama on May 14 this year to congratulate and acknowledge BN's victory at May 5th General election. It is an affirmation to BN's victory.

He also confirmed his participation in the Global Entrepreneurship Summit in Kuala Lumpur beginning October 11. It will certainly raise Dato Najib and Malaysia's profile but for what?

But, the US president also touched on the TPP. He looked forward towards an early conclusion of the initiative or in common language, he wants it sign fast by October.

Najib called to congratulated Obama for the US's 237th Independence Day on July 5th Malaysian time. They have had 237 years of freedom but we are still at the 56th year.

10 days later and on July 15th, the 18th round of TPP negotiation is on-going in Kota Kinabalu and the Sabahan are clueless as to the presence of PAS and other NGOs protesting.

The negotiation is supposed to conclude by the 25th and signed by October. Heard the dateline is October 25th.

The whole Government machinery is being hyped and primed for Obama's arrival that no one seemed to bother to prepare the 2014 budget which is supposed to be tabled in Spetember or October.




The fear now is that since Dato Dr Jamaluddin Jarjis was appointed Ambassador to the US for 2009 till February 2013, Najib has been seen to hard to please the Americans.

BN seemed be emulating the American with an election campaign like that of an American Presidential election.




Najib was even photographed kissing cats like Obama, Clinton, Dubya Bush, and many other Presidents have pet dogs.

The public worries ...


Najib must have the nation on his mind and people in his heart and not try to please Obama. He must realise that ...


Let's not allow Obama to think that we are a ...

Because we are not, especially the rakyat.

MITI has given their assurances [read here and here]. The rakyat are still worried because Najib only listen and tend to succumb to the view of only those wrong inexperienced people who live in fairy tales and not grounded in reality [read here and here.]

Of late, he has been making many strange decisions and appointments. He allows wrong things to happen and wrong people to get high positions despite BN getting the mandate again to rule and govern the country.

Listen to the more experienced and wiser one. And listen to the rakyat [read here, here and here.]

Bring the issue and discussion on TPPA out in the open. Take it to Parliament. No more mysterious negotiation and secretive on the details behind the public eyes. This affect the country and rakyat.

The Star's BK Siddhu has the latest scoop on the lawsuit of Tan Sri Halim Saad against Tan Sri Nor Mohamed Yakcop as the first party.

There seemed to be an out-of-court settlement in the making. But, who will be paying for the liabilities arising from the fraudulent act of the first party? Some say it is still alleged fraud, but let's be honest to call a fraud as fraud. 

There is such a thing as insurance coverage for professional indemnity. However, it does not and should not apply for actions taken with a clear intention to commit fraud and default on a signed agreement.

For someone whose lost RM16 billion of the nation's money under Bank Negara Malaysia's managed reserve in the past, don't tell us that Khazanah Nasional has to be the insurance company to pay Nor Yakcop's liabilities?

The rakyat will not gives a duck to any excuse in saving a crook even if he is soft spoken, seemed "knowledgeable", and knows a lot of people.

Speculation rife out-of-court settlement being hammered out for Halim Saad's case

PETALING JAYA: Speculation is rife that an out-of-court settlement is being hammered out to conclude the controversial suit filed by Tan Sri Halim Saad against Tan Sri Nor Mohamed Yakcop and two others over allegations that he was forced to sell his stake in Renong/UEM Group to Khazanah Nasional Bhd in 2001.

The settlement figure bandied around, according to sources, is about RM1bil.

However, in his statement of claim filed at the High Court on April 30, Halim is claiming about RM2bil, which includes accumulated interest and tracts of land that he claims were agreed in an deal reached in 2001.

The sources claim the parties involved have met via their intermediaries with one meeting taking place this week. However, this could not be verified as at press time and Halim, when contacted yesterday, declined comment.

If indeed there is an out-of-court settlement, it would follow the route taken to resolve the six-year suit by former Malaysia Airlines (MAS) executive chairman Tan Sri Tajudin Ramli, who had sued brought a suit against Pengurusan Danaharta over the 32% stake shares in MAS.

Halim, who was once the head honcho of the Renong/UEM group, alleged in his statement of claim that he was “fraudulently induced’’ to sell the shares, and not paid what was agreed.

In his suit, he named the Government and Khazanah as second and third defendants respectively, and Nor Mohamed as the first defendant.

The core of the claim is the series of events which led Halim to give up control of Renong and the role played by the then prime minister Tun Dr Mahathir Mohamad and his special economic adviser, Nor Mohamed.

But to counter Halim’s claims, the defendants filed their defence recently, arguing that Halim’s suit should be struck out because it was time-barred.

For that they cited Section 6 of the Limitation Act 1953, whereby a litigant should act within six years once a cause of action arose.

Nor Mohamed in his affidavit filed on July 8, also denied he told Halim that Umno was the owner of the assets. But Halim in his statement of claim contended that the shares were his, but was told that all the assets that Khazanah took over from him belonged to Umno and therefore there was no reason to pay him for the assets.

Halim also alleged he did not receive the agreed amount of RM1.3bil, tracts of land including those in Iskandar Malaysia, and interest in Kualiti Alam, and others as part of an agreement reached in 2011. Instead he claimed he only got RM165mil, of which RM100mil was the first instalment for the put option that was refunded to him, and RM65mil for interest and costs.

Nor Mohamed alleged that during the whole process of the general offer, Halim did not claim the existence of any agreement to compensate him in cash and property.

To recap, the Asian financial crisis of 1997 led to the fall in Renong’s share price. It was then known as the biggest debtor in town. In 1997, UEM announced it was buying a 32.5% stake in Renong but that did not go down well with investors. To appease the market, Halim had in 1998, offered to buy the Renong shares from UEM via a put option worth RM3.2bil.

Halim paid the first RM100mil but could not pay up the second when it was due, which was when Khazanah took over.

Later, Khazanah took UEM private and cancelled the put option. Through UEM and Renong, Halim then had controlled no fewer than six other public-listed companies and also the land which is now being developed as Iskandar.
Khazanah paying?

What is due for Halim from Khazanah is due to him. It does not matter what is the amount. It is only fair that since Government of Malaysia and not Khazanah was the signatory, Government have to pay.

We doubt that the Government will pay for shares already transferred to Khazanah Nasional. It will not be a surprise that Khazanah is the one involved in the legal suit because the Government side kept silent and only Khazanah issued a statement.

Since Nor Yakcop is Deputy Chairman, the rakyat will be concern on who is paying for the legal bills of Nor Yakcop. And, will the discussion be inclusive of his personal liabilities?

If so, and it is expected to be so, it means Khazanah is solving Nor Yakcop's personal liabilities. That can't be.

Even the argument that he was doing it for Government and not to enrich himself does not hold ground because when one signs an employment agreement or job contract, quite sure one is expected to do so in accordance with the rule stipulated from time to time by the superior and in accordance to the law.

There could be things called professional indemnity coverage by insurance companies to cover negligent claim by clients due to error and omission mistake. But this is a case of intentional fraud and default, not error and omission mistake.

For Nor Yakcop to claim defense on the basis of statutory of limitation, it is not a smart move. He is basically trying to get away on technicality and it is basically an admittance of guilt.

Theoretically, Halim can file for a police report for the crime of fraud. Is there statutory limitation for criminal fraud?

Nor Yakcop and Government may buy time by getting friendly police in Jabatan Siasatan Jenayah (JSJ) or Dato Ramli Yusof's old goldmine at Jabatan Siasatan Jenayah Komersial (JSJK) to NFA or KIV the case or "adjustable" Tan Sri Gani Patail may claim as no case.

Even if Halim passed on, we believe his estate can still continue to make claim on the Government and also Nor Yakcop and his Brother in Racing, Kanari Group of Companies, proxies like Hasbie, xxx, yyy, zzz, etc, and some secretly kept nicely in Dubai.

Government default

The meter will be running and Government need to resolve this matter. If not because the Jewish banking world of compounded interest is expensive, the whole world will now know that Nor Yakcop tried to get away on technicality and that is an admittance of guilt.

It means our Government defaulted on a clear cut agreement. Any legal contract involving the Government will be seen as not binding.

Dato Omar Ong and Dato Idris Jala must be scratching their head because in their hurried pace to dupe the nation into believing of their vision of developed Malaysia is to idiotically open up Malaysia, the Government openly act unprofessionally like a 3rd world country to decay on their agreements.

Who is to believe the Government?  

Then on the matter of UMNO asset, Nor Yakcop denied it is UMNO assets but as alleged by Halim, Tun Mahathir said Nor Yakcop told him so.

Halim has a witness and unless, his witness Tan Sri Rashid Manaf can be bought or bribed or threatened albeit in the infamous soft spoken Nor Yakcop way, Nor Yakcop basically lied to Tun Mahathir.

On "Nor Mohamed alleged that during the whole process of the general offer, Halim did not claim the existence of any agreement to compensate him in cash and property", we are still trying to understand this. The agreement is well documented and there are correspondance.

Is Nor Yakcop trying to buy time till he can come up with a better legally credible excuse? Also there is the probability that Nor Yakcop does not have his documents in order and worse still, he does not know what is at stake.

Reckless

Damn what do I care!!!

If one remember the way he siphoned money CBT-wise at Abrar Corporation Berhad, he does it amaterishly in the manner of a reckless foreign exchange trader Nor Yakcop is.  

Main hantam saja!

If that is the case, Halim should ask for more than a RM1 billion settle all deal. Can 0.1% be alright as fee? Just kidding ...

With the appointment of another fraud, namely Emir Mavani as CEO of Felda Global Venture Berhad, and allegedly took commission and kickback, Dato Najib mindset could be in the dangerous, careless and reckless zone of moral hazard.

Even keeping Emir for few months as claim by BK Siddhu here is a dangerous and irresponsible thing to do. Mavani can do what Nick Leeson and Nor Yakcop did. He's even got the wife to attend and asked question in his meeting.

Being a leader, one must know when it is time to be decisive and to be cruel, in order to be kind to the rest.

New Minister in the Prime Minister's Department, Dato Abdul Wahid Omar (AWO to us but DAWO to those not his senior in MRSM) was in parliament yesterday to reply a question on Talent Corporation.

He defended a policy developed by his mentor, Tan Sri Nor Mohamed Yakcop. In his effort to answer, he gave quite few details. Hurrah for a transparent government. But it opened a can of worm which we were going to wait for a latter part of our ongoing series on Nor Yakcop to reveal.

Sorry to say AWO buddy, the pinnacle of Talent Corp success is to bring back the doctorate lying and alleged kickback taking Emir Mavani from Qatar.

In their over zealousness to bring back so-called talents abroad, the Government have placed a fraud in a policy making position in PEMANDU, seconded him as FGV Director with four other organisation wrecking PEMANDU into the FGC hierarchy, put him as CEO-in- waiting and when exposed, insist on appointing him CEO of FGV.

Even school dropout, Mazlan Aliman can digest that and have his field days. It is no more about Tan Sri Isa Samad issue but Dato Najib's.

The problem of Talent Corp has been raised by bloggers before but Najib refused to listen. And he used to say it is no more the time of Government knows everything. Now it is clear that it is to enrich Omar Ong with consultancy fee that Parliament is not allowed to know but rumours has placed it at RM300 million.

RM65m spent to bring back talent  

THE government has spent RM65 million to persuade Malaysians abroad to return and work via its Talent Corporation programmes, including the Returning Expert Programme (REP), said Minister in the Prime Minister's Department Datuk Seri Abdul Wahid Omar.

He told the house yesterday that 2,105 applications were approved until last month under the programme, which was introduced in 2011.

He said most of the applicants were aged 30 and above, with 75 per cent being males.

Wahid said the Chinese made up 60 per cent of the applicants, follwed by Bumiputeras (30 per cent) and Indians and others (10 per cent).

They were mostly from Singapore, the United Kingdom, China, Austria, the United States, United Emirates, Qatar, Saudi Arabia, Hong Kong and Ireland.

On the difference between Brain Gain and TalentCorp, Wahid said REP had been proven to supersede other programmes in terms of attractiveness to persuade local talent to come home and work.

"The cost cannot be calculated directly from the allocations spread over the number of participants as there are many programmes under TalentCorp, but I can assure you that REP has proven to be successful."

As for Zainal Jalil, him we know too well. He was also supposed to return from his Houston posting with Exxon USA, had returned and we met.

Looking at this baby-faced CEO of Talent Corp, one should worry whether he has the experience to read and judge people and talents.

One wonders whether fair skinned mamak Johan Mahmood Merican had brought the right skills into the country or it is just another economics-trained chartered accountantcumMelayu Liberal cumTingkat 4 boys view on public policy and the nation's way forward?

Can we bet that it is mostly Chinese that returned? No .. not being racist because we are just concerned for Bajau, Kadazan, Iban and Orang Hulu in Paris. Bet Idris Jala does not that.

First, I would like to say that this so called brain drain thing is a load of crap.

Are they (consultants and advisers) saying this country got no brain left that we have to spend tones of money to entice back those who had choose other countries as their greener pasture?

Why don't we just spend the money to train those who are still in this country instead.

Are those who works and live overseas much better than those who are in this country?

People have been leaving this country all the while but it has still progressed since Merdeka. In fact Malaysia has been doing well with the loyal talents serving this country since then.

Of course it could be better as things are never perfect, but what is the point of trying to get at things which was never meant to be.

If those who had left wanted to come back, they would do so on their own accord. There is no need to spend money to entice them back.

They should be impressing on GLCs that the criteria in hiring one should be "looking for are individuals who are adaptable, fast learners, quick thinkers and innovators who can deliver results instead of continually focusing on similar work experience or networking as the basis of recruitment."

Making an organisation and a nation developed cannot be achieved instantly by transporting Malaysian working in Mat Salleh organisation abroad. It is possible for gaining technical knowledge but management?

Ever heard of the term "corporate culture" and "working culture"?

Culture needs to be nurtured and it can't be created instantly but based on a shared value over time. It means talent need nurturing.

He wrote in 2010 here that Talent Corp is just another money rip-off scheme by the Mamak gang. In 2012, he elaborated here in response to a jalan-jalanseronok seronok trip by Talent Corp to London.

He also posted here about some overlook or intentionally overlook matters in the over zealousness to bring back "returning experts" that too much exceptional exception given over other Malaysians.

And, he raised something here which DAP Chiew Tong might not raise.

Talent Corp brought back Emir Mavani but allowed to waste the talent of Tan Sri Hasan Merican to Singapore.

Bigdotcom raised a point before that Petronas was a hallmark at developing Malay talent [read here] but what has happened to it since Omar Ong came in with his Chinese reverse discrimination manouvre. [read here.]

He also raised that under Khazanah, they spent a ridiculous RM2 million for educational program for  primary school children for two years to provide luxurious facility and that spoilt these children's educational path.

Khazanah was under the tight hands of one mamak.

Wonder who is the Mamak gang, because Syed himself is born on Friday night and the CEO of Talent Corp is a Mamak Merican too.

Anyway Syed, we have written about one consultant that would surely be  the recipient for this jet set lifestyle at the expense of taxpayers money back in 2010 also.

The consultant was a member of the NEAC, by the name of Datuk Dr Hamzah Kassim. The person heading NEAC was Nor Yakcop's selected man, Tan Sri Amirsham Aziz. [Read here, here and here.]

We were combative on this issue till we eventually meet up with Dato Dr Zambery. There was ceasefire for the sake of saving Perak. Zambery listened and heed the warning.

In his term before this, Prime Minister Dato Najib Tun Abdul Razak kept repeating the words that his Government is no more a Government who knows everything but a Government willing to listen.

It is a great cliche.

He promised to meet us the more serious issue driven and no holds barred bloggers every three or perhaps six months in the early part of his premiership. But till today, he seemed to prefer to meet those "malay medium", to quote someone, for hooray hooray, feel good, thinking they are the greatest blogger and makan-makan.

Maybe it is easier for him to answer the more convince-able bloggers with simple cliche, promises and if everything fail, call for unity to win election.

If he is not listening and refuse to heed the voice of the concerned rakyat, then we may have to eventually be like Dato Ibrahim Ali and Perkasa to be oblivious to UMNO and stick to the real struggle.

This unbelievably stubborn stance for ridiculous policies of developed status at any expense, blind one eye over leakages and compromise politics must not continue.

Bila Melayu sudah meluat, they will be very very hard to pujuk. Not even a GLC each will please them.

Besut bound [up-dated]

Supposed to pen down our view on the Alvin Tan and Vivian Chong affair but just too busy today .... sleeping.

Now, we are Besut bound to catch the pulse of the Ramadhan by-election. Heard it is a rather eerie feeling by-election. Hardly any posters, low turnout for ceramah and requires lots of personal touch and visits.

While there are those that feels that Barisan Nasional can maintain a healthy majority of at least 2,000 and even more, rumours spread by PAS that there could be sabotage just to teach Dato Najib a lesson.

What is the lesson the 'kampong' people of Kuala Besut wish to teach? Most of the allegation by PAS have been explained and it was alleged that they are a bigger culprit. Its Anwar's favourite game of  accuse your enemy for one's own sin.

So happen Anwar's protege in PAS, Dato Husam Musa is the Campaign Director and his protege is the candidate.

PAS candidate is probably an okay local bloke, but beseiged with lingering problems.

A video tape is being repeatedly played of him claiming that he will not take the wakil rakyat allowance except a little for his business and will 'gaji' someone to take care of the place. That is a hanging shuttlecock for a smash.

There is also a problem with the local PAS Muslimah. As the local PAS Branch Treasurer, candidate Azlan@Che Long was helping Husam than supporting local Muslimah's GE candidate. This brought about a campaign boycott by the local PAS Muslimah.

There is also PKR taking revenge for denying Terengganu-born Jingga 13 head, Faris Musa the chance to run at Kemaman. Fariz ran against Dato Najib at Pekan and received credible number of votes against a PM.

Before the General Election, PAS had treated PKR badly in Terengganu that PKR state liaison chief, Azan Ismail was vocal on this mistreatment. It made Anwar fuming with Hadi. When Hadi expressed interest to run against PM at Pekan, he wrote a stinging letter to Hadi warning not to simply take PKR's seat.


But, that could be water under the bridge. There is also a temporary truce. The action will be in the last week prior to casting on 24th. 

Big guns from both sides are crowding the 17,000 constituency. Probably, there will be more campaigners than voters. In that small little area, one can throw a stone from a heli and it is likely to hit a Dato's head, an UMNO Dato' or PAS Dato'.. If lucky, a Tan Sri's. 

As far as the issues in the ceramah and media war, there don't seem to be anything interesting happening with the rural crowd not keen to hear ceramah after terawih prayers.

One will never know. Perhaps there is something to look out amidst the eerrie feeling in Kuala Besut like Galas by-election uncovered a big can of worm in the Kelantan highlands or Bagan Pinang by-election was the turnaround in fortune for BN.

The real action will still be in the next GE where the profile in young voters stands out further. Kuala Besut too has a high young voters profile with the 40 and below is close to 60%.


Like PAS Kelantan relied on returning 'outside voters', both side look forward for their return. Will they return to vote with most have plan to make the long trip home for Hari Raya holiday in two weeks?

Just two months ago, most of the outside voters had undergone the arduous seven hours drive from Kuala Lumpur to vote. Most had enough with politics and it is a turn off to have a by-election two months after a long five years of politicking. If there is a state wide election, the rakyat will be sick to the bone with politics.

Kuala Besut is anticipating a low turnout. So by hook and by crook, both sides need the outside voters.

PAS is heard to have chartered 20 buses to "fly" them in. UMNO is expected to struggle in this department because talk is someone cheated out the allocated home fare during the GE and many outside voters are piss as hell.


On the campaign, PAS is campaigning for a deadlock 16:16 situation for Terengganu. The argument is a well checked Government will be more efficient and sensitive to the rakyat's needs.

The counter argument is that it only cripple the state Government. BN could likely dissolve the state assembly and go for a state "by-election."

On the hand, quarters in PAS is not willing for a "unity Government". It brings back the eerie days of Dato Dr Hassan Ali and Dr Nasharuddin Mat Isa. The Anwarinas controls PAS but the ulamaks is not about to give-in and allow them to dominate.


Strangely, PAS speeches, specifically by Dato Seri Hadi Awang and Husam inferred that PAS does not want to take up the Menteri Besar post.


Husam is the Election Director because Besut is practically Kelantan.

It is said that at one time ago, the Kelantan Sultan lost a bet and gave Besut to the Sultan of Terengganu like the story of P Ramlee's Nujum Pak Belalang. The gamble is over cock fighting and not the three riddles as in the movie.

There is an unwritten intention by certain quarters of PAS to use the by-election to raise the profile of their fighting cock. Thus, they are fighting hard despite Pakatan's internal head count predict a loss of 3,000. 

Husam, which was revealed by Dato Zaid Ibrahim's twitter to be going after PAS Presidency against Terengganuan Hadi. There maybe a lot of sulking and boycotting in Kuala Besut but PAS is not about to start the culture of sabotaging the party in an election.

However, one will never know. The local "kecek" rivalry between Kelantan and Terengganu is legendary. A football local derby between Kelantan and Trengganu is as intense as Manchester United meeting Manchester City.

Imagine the hurt pride of Terengganu to see a Kelantanis to lead the by-election in the state of PAS President. Bako bako ....!


If BN loses and state assembly dissolve, it could also be a blessing.

UMNO could solve the stubborn problem of Menteri Besar Dato Md Said and end his rivalry against his incumbent Dato Idris Jusoh. Md Said had tickered with the candidate list in the last GE to reinforce his position. He ignored local sentiment and it backfired into a 17:15 win.

Will it be 16:16 or back to 17:15?


If there is no happening, we are going to spend time in Pulau Perhentian to fast, sembahyang terawih, and campaign, that is. It's been a while.

Wonder what is the fatwa on scuba diving during fasting. If Tabasco and shisha is haram, probably Council of Edith will say it is allowable.

So, it is not a British doctorate but Irish. On Irish universities, we could easily check-up with our counterparts abroad. We have an Irish paper from University College of Dublic.

But, a news report in Rocky's blog HERE revealed something that does not bring Emir Mavani out of the wood yet on his alleged fake doctorate. No need to check-up then.

A COLLEGE run by foreign businessmen has been accused of offering effectively "worthless" degrees and doctorates from the grounds of a prestigious third-level institution.

The self-styled Warnborough College is charging up to €18,000 in fees for unrecognised qualifications after renting offices at All Hallows College in Drumcondra, Dublin.

Following inquiries from the Irish Independent, All Hallows confirmed it will not be renewing its rental arrangement with Warnborough.

Using a slick website, Warnborough runs a so-called "distance learning" college where students from all over the world are offered course work over the internet.

Until recently the website included a photograph of All Hallows and made references to graduation ceremonies and seminars that were due to take place there.

However, the Irish Independent has established that the courses offered by Warnborough College are not recognised by the Department of Education.

The courses are also not recognised by the Higher Education and Training Awards Council (HETAC) and the National Qualifications Authority of Ireland (NQAI), which described the qualifications on offer as effectively "worthless".

Neither is Warnborough College, which also has offices in Canterbury in Kent, recognised by the UK Department for Innovation, Universities and Skills as an institution with the power to award its own degrees.

Education chiefs are furious Warnborough College has linked itself to All Hallows, whose degrees are validated by Dublin City University.

All Hallows last night said it was concerned about the presence of Warnborough College on its grounds.

It confirmed it would not be renewing its rental agreement with the college.

Since last July, Warnborough College has rented offices at All Hallows. Prior to that, it had offices above a pub in Bray.

But despite this, the head of Warnborough last night said claims it had tried to link itself to All Hallows were "ludicrous".
Back to the issue raised by Bigdog.

Since Emir Mavani is a newbie in the plantation industry, is it the same guy that have been bringing deals to Emir Mavani lately? Who is the guy linked to? Why hard-up to buy this plantation company?

Since Emir Mavani's presence, we've heard of suspicious China deal, grossly overvalued PNG land deal, and now overvalued and non controlling Sabah plantation company. 

Is Tan Sri Isa Samad getting sloppy or there is someone else also? His superior is the Prime Minister and it will fall back on him.

Is Dato Najib aware that Felda is his baby and Felda constituencies are vital BN squares on the political board? The general election was just two months away. Are we not learning from the results?

Do not try to please ourselves with the argument that the voters are too hard with their expectation on us. The opposition seemed to get away with their lies and sins. They fact is BN is the Government and a high expectation is good as target to meet. 

Voters expectation to be clean and "seen to be clean" is not unrealistic.

PAS's Black Ops to awake lethargic Kuala Besut

As usual, UMNO's campaign is boring, predictable and tame.

UMNO's pre-election psywar was on the right note when they managed to get PAS to appoint Dato Husam Musa as Election Director for PAS. By doing so, it brings out the local rivalry of being a Kelantanist district inside Terengganu.

Then, they slowed the pace down. Hardly much flag, no posters till last few days, and not much ceramah.With Ramadan and local constituency is mostly farmers and fisherman, who would like to stay after Terawih prayers for a ceramah?

PAS played it slow too. After all, there is hardly much local issues to play on for PAS.

So they end up cooking up false allegations and using national level issues. The issues played up was so boring that there was back and forth over family support.


BN's Tengku Zaihan whose got a large family held a family gathering in which there was a pledge of support from the family.

PAS quickly rebutted by forwarding an SMS purportedly of some family members pledge to support PAS candidate Che Long. At the same time, PAS had some old timers to remind that Tengku Zaihan's grandfather was a PAS man.

Before going further, PAS claimed that Che Long was an UMNO member that left to join PAS. The reply to that Che Long was accused as an ungrateful Malay. He benefited from UMNO and move on to PAS to secure logging contracts from or for Husam. From there, it was said the relationship flourish economically.

The answer to the PAS membership of Tengku Zaihan's grandfather was that his father is a dedicated  UMNO activist. At the same time, videos came out of former PAS members praising UMNO. Even UMNO can't resist to overused the old ploy and claimed 500 PAS members jump over to UMNO.

Che Long story has another twist too. There is a claim that his grandfather was the man who set-up UMNO in Kuala Besut.

Subsequently, both sides had family members testifying to vote their family member or vote the opposing candidate.

That should gives a feel of how boring the campaign here in the midst of Ramadhan. Husam wanted to turn Anwar's scheduled visit to perk things up. Anwar came to Kuala Besut after supposedly returning from Makkah. Or was it only to Jeddah?


In a public show of unity, Hadi was together on stage. Imagine how uncomfortable that is for Hadi who knows that Anwar actually boycotted him and has things up his sleeve and Anwar knew Hadi is trying to block PAS entry into Terengganu.

UMNO bloggers teased PAS by claiming the night's audience was 50,000. Actually, it was merely 500 for a space prepared for 5,000. It was a let down.

Despite many PKR leaders are seen in public in Kuala Besut by themselves or with PAS leaders, the underlying sentiment is tense between PKR and PAS. This culminated with three PKR potential candidates for last GE filing a lawsuit for insinuating them as pil kuda distributors.  

The real pil kuda distributor, Abdul Rahman Yusof or Rahman botak is not among the three. PKR's Election Director for Terengganu, Yahaya Zakaria start to give macho statement that PAS is afraid of their growing strength. Yeah ... sure.

Yahaya is Rahman botak's man. The timing of the already planned lawsuit by AMK Chef, Shamsul Iskandar is convenient. To whom?


Husam is also not staying put. He is not about to let all this bother him. Winning will raise his profile amongst PAS delegates for the next Muktamar as potential PAS President. He raised the campaign a couple of notches and be damn of local sensitivities.

His black op started today. Everything was employed in the last 24 hours - critical posters, flashmob, false SMS, false posters, mahasiswi campaigners, cybertroopers, false accusations, money politics and you name it.

Surely it had liven up the rather lethargic campaign. [Read Putera Merdeka here on the slanders and The Unspinners here on Black Ops]

While UMNO is only doing personal touching, kissing babies by Wanita campaigners, and motor boys bearing gifts. There will be no ceramah, no risalah, and no hard play. Pok Yeh as they call Dato Idris Jusoh, run a tight ship. No picture get released by "his" cybertroopers without his clearance.

Kuala Besut is sensitive and aggressive campaigning will backfire, he claims. But why is it PAS can do?

They way things are of late, PAS can get away with murder. Not UMNO because there is too many apologists in the leadership.


This afternoon PAS was giving away free petrol for all bikers. Corruption? No it is still acceptable and within EC regulation. Imagine if UMNO had done that like BR1M program for all.

Certainly that is a great ploy to get the youth support. Kuala Besut has a majority of 40 and below.

So far, there is no counter black out seen from UMNO side. But then again, maybe it is not necessary for poor Internet connection Kuala Besut.

So ... how will things stack up?


UMNO's last majority is slightly more than 2,000. One PAS blogger had predicted more than 4,000 majority based on initial poor response to PAS ceramah. There was also a prediction of more than 3,000 from a  PKR insider.

Probably it is a wee bit to much. Only a handful voters wish to return back to Kuala Besut to vote after already returning back two months ago. After voting again, they will have to return back again in two weeks time for Hari Raya.

Turnout could be lower than during GE.

Frankly, we sense political lethargy have set in from the opposition's intense campaigning and ceramah have been going on for the last 10 years.

It means a lower majority is in the offing. A source claim Husam has turned confident and claim he can win back that 2,000 votes and gain enough to edge out BN. Dato Kadir Jasin says here it is not impossible 

Nevertheless, Kadir said he does not have his hands on the pulse of Kuala Besut. As far as the PAS blogger who predicted a win for BN, he saw some positive development for but acknowledged that this is Derih Jusoh territory. Not enough.

Campaign comeback hardly could make it in time to win. So we predict a BN win albeit lower majority.

That lower majority has no implication and relevance. Nothing really changed.. 

TPPA: Problems of trust and delusion

Ah ... body still aching from the late night to morning return trip by road from Kuala Besut to Kuala Lumpur.

So our prediction was wrong but we are not the only one. The lower voter turnout should result in lower majority. In fact, there was a bit of a scare in the late afternoon. Voters from the white areas are not coming out as much as we wanted. 

This "good to be wrong" larger majority indicate that the local based voters are still supporting BN. Perhaps, it indicate that the fenceseaters shifted from PAS to BN. Another possibility is that outside voters could not return to buffer PAS's loss.

BN may have won handsomely but it does not mean the ground is fine. If only they know what transpired in the meeting between Perkasa and PM yesterday. We should have been there but couldn't. It would have been "fun" to add more to the already explosive expression of feedbacks.

TPPA was also touched.

The previous weekend, while in Johor and taking it easy for the first puasa weekend with our parent, we saw two programs in two successive nights discussing the Trans Pacific Partnership Agreement (TPPA).

The interesting one is the Astro Awani program on the following event


It was an open forum between Minister for Internation Trade and Industry (MITI), Dato Mustapha Mohamed and Executive Director of MTEM, Mohd Nizam Mashar.

Nizam raised quite a bit of issues [look-up their points in the website here]. Among the issues he raised was the shroud of secrecy and concern for rising medical cost.

Mustapha's answer can be summarised as "Trust thou Government." The Government will not allow ...
One, TPPA to change our Constitution and law.
Two, the structure of the federation with regard to state power will remain.
Three, our policies will remain. 
 The question back:
Constitution and law remain? 
If so, why negotiate and willing to sign for an EU FTA that is ridiculously stringent to insist on political reform.

State rights maintained? 
Sure... explain Iskandar Malaysia..

Our policy will remain? 
PM's repeated commitment on the Malay policies as as covered by TV3's evening news yesterday but the reality on the ground is different. Did we ever seek the blessing of the Council of Rulers as caretaker for Bumiputera before reducing or taking away any pro Bumiputera policies as enshrined under Article 153 of the Federal Constitution

It was a statement of comfort to play down the strong issues of sovereignty, neo-colonialism and risk to the local economic players by one statesman. [Read it here]

And, Barking Magpie is right in saying here that by signing the TPPA, "the country will be forever sold to big super Multi-National Corporations (MNCs!)"

Mistrust on Government


It is not to discredit able person like Mustapha. His assurance does not address the underlying problem with TPPA. It is the problem of trust.

Before the election, Dato Najib is known to say that he cannot change many things vitally necessary without a mandate of his own. It was an excuse for "business as usual." After getting a mandate of his own, as quiet as a mouse, he placed Tan Sri Nor Mohamed Yakcop as Deputy Chairman and Chairman of Executive Committee of Khazanah.

He should be in charge of the national debate and not others' agendas determining his path. We do not see that happening after the GE/ All he could do is to pose with his cats.

One is not expecting him to take the bull by the horn because his Chinese horoscope is not a Spanish bull but a cat. The least is to not offend his voters.

He did not show his appreciation by addressing issues raised by his dissatisfied voters, but gave 11 Tan Sri to 94% DAP voting Chinese and entertained the demands of non-voters. By right, those that did not vote BN should ask and plead from Lim Kit Siang, Anwar and Hadi (the real power structure).

The TPPA issue is facing resistance because of a growing mistrust in the Government's ability to handle problems. It lies with the people supposed to handle the problems.
His advisers and war room members are mostly power hungry, kaki ampu and opportunistic dimwits.
His cabinet appointments are full of incompetents and liabilities.

Civil servants are mostly filled with self interest red tapers and non convincing competencies. The top man can never retire but kept being continued with extension contracts, or the incompetent ones sent to be Petronas Chairman. 

PMO officers and UMNO officials around Dato Najib are mostly self serving, scheming off  public money, and incompetent morons. They are not telling the PM the real situation on the ground and sugar coating their reports. Najib listen but cannot even control his boys. 

His media team kept using the same old modus operandi to playdown serious issues.
And his social media coordinator tells him that they took charge of 8 out of 10 issues. His "Kelantan kaki bodek dan tikam belakang" blogger assistant refused to face the reality that we failed because the urban area and 4th and 5th channel voters supported opposition..

One example of failed media strategy is when Mustapha said the TPPA is still an on-going discussion. It is only in the 18th round and held in Kota Kinabalu now.

To negotiate up to 18 rounds, it means it is serious business. Thus, the rumour that PM expressed interest to sign the TPPA in a Cabinet meeting but with the caveat that the three condition is met. A caveat means that if anything fails, there is an excuse out.

Delusion


If that rumour is true and Tun Dr Mahathir and most of our sources except one source say it will be sign or President Obama will not visit Malaysia and back Anwar, then we are ducked!

If one bother to read about TPPA, it is about the interest of 'big business'. Since when do 'big business' care about human, other than to exploit human for invisible powers?

Don't talk of stakeholder because big business will only contribute baju raya and duit raya for orphans. To benefit from them, one will have to be economically and socially orphaned.

Big business like the ones generated by our state sponsored capitalism, as described by Prof Dato Mohamed Abu Bakar, benefit faceless institutional shareholders and CEO that earn 2,000 times the basic salary of his clerk like Dato Nazir Razak.

No wonder no PEMANDU people was there at a Public Seminar on 'Inclusive Growth' held by UNDP at Park Royal on July 10th recently.

They should have listened to the presentation by Prof Shamsul Amri of Universiti Kebangsaan Malaysia. It was inspirational and visionary. And, that is what development should also be ... about human.

We have so many inequalities and limiting factors like ethnicity, geography, and historical legacies. These ignore the non-level playing field to claim market economy is the answer. These purveyor of "free trade shall set you free from the tyranny of the world" does not realise that they are collaborating with the devil to send humanity and individual to the poorhouse.

The  utilisation rate of FTA is very low. The utilisation rate of Malaysia-Japan FTA for example is less than 1%. Some companies, especially SMEs choose not to use the FTA because it is costly. The cost of compliance, such as filling up forms and employing staff and consultants are more than the reduced import duty so some choose not to take the "benefit" offered by the FTA.

The backers of "Rakyat didahulukan" does not mention a single thing about the benefit to the rakyat. It is simply because FTAs are only about big business.

Our friend share an inside story that one of the negotiators accidentally blurted to the owner of one small pharmaceutical company that they would rather see the small ones phased out of business. But we must remember that 98% of our business are small business.

We already have a 500 million market in ASEAN, which our companies are still struggling to take advantage of. We have the so-called 1 billion market in the FTA with China and another 1 billion market with India. We have FTA with Australia and New Zealand and Chile. We are already a member of WTO, which has 159 countries and all these countries provide market reduced tariff and market access to our products.

Thus, what is the deal these masturbators are promoting TPPA in terms of market access that include Australia, Brunei, Canada, Chile, Malaysia, Mexico, New Zealand, Peru, Singapore, the United States (U.S.), Vietnam and Japan?

The notion of liberalisation is not real. It is very romantic but not real. See ... it is like masturbation. Alvin and Vivian is not in the same room with you, if you are into that kind of sick sex.

For example, in the ASEAN Economic Community, we are still far away from achieving the real liberalisation. The Singaporean and Brunei are not really in favour of liberalisation when it comes to opening their market. The American 50 States are also not really in favour of liberalisation.

As one pro TPPA businessman said, the Malaysia-EU FTA negotiation is not about wanting Malaysia in. He is of the opinion that TPPA is not just about business but encircling China. Recently China applied to join TPPA and now US do not want.

Who is really sincere about free trade when the idea behind it superpower countries like US imposing their will to get big business product in but not others' products into their country. Whilst, the developing countries are resisting and wants to negotiate endlessly.

Let's not kid ourselves about free trade with the US. The politics of protectionism and trade at Congress is beyond just JJ to handle. The Capitol Hill will mutilate the TPPA agreement. They could ask USTR and the President to renegotiate terms in the US favour even after the signing.

This is what happened to Korea because of beef and Peru. The American actually went to Peru to draft the Peruvian labour law!

Sinking Suaram to the ocean abyss

The question is why now when the submarine issue has already been debunked and Suaram has lost their momentum despite attempt to resurrect the submarine purchase issue.

Better late than never, the New Straits Times released today an exclusive on Jasbir Singh Chahl. His name was being bandied about by SUARAM in their biggest lie to claim that the French court had subpoena him.

There was no such subpoena. Investigation is still on-going. And, there is no charges filed against anyone yet.

SUARAM needed to make that lie to deceive the public into thinking there is progress in court and it is not a lie as accused by government. It was a ploy for public support and donation.

At a time when SUARAM is trying to do another gimmick to announce the lawyer to the late PI Bala, Americk Sidhu will appear at a tribunal in Paris, Jasbir appeared in public today. Perhaps there is no such tribunal.

The essence of his revelation is that the accounts are audited. This should sink Suaram into the ocean abyss, which is way below the ocean floor.

Torpedoing the myth

IN 1984, an insurance agent from Baltimore, Maryland, published the fictitious story of a Russian submarine commander who tried to defect to the United States in his state-of-the-art Typhoon-class nuclear submarine.

The Hunt for Red October drew inspiration from a real-life account of the 1975 mutiny aboard the Russian destroyer Storozhevoy and became Tom Clancy’s first international bestseller with its tale of intrigue, skullduggery and deception. Then US president Ronald Reagan called it “a great yarn”.

Closer to home, the Scorpene saga has taken many twists and turns. In 2010, Malaysian human rights non-governmental organization Suaram lodged a complaint in the French courts, claiming that French naval firm DCNS had paid RM452 million as a bribe to Malaysian officials to obtain the contract.

The allegations of massive kickbacks and payoffs in the RM4.2 billion deal for the two Perdana Menteri-class diesel powered fast-attack boats have been topped only by the lurid accusations that Mongolian model Altantuya Shaariibuu was murdered because she allegedly knew too much and wanted a ‘mere’ US$500,000 cut from the deal.

Over the years, a fascinating conspiracy theory had been woven around this episode and gained traction, linking the submarine deal with Altantuya’s murder. Hardly surprising since it had all the ingredients of a Hollywood techno-thriller — stories of alleged corruption, deceit, greed, sex and murder.

In April, reports in the Spanish and French mainstream media questioned Suaram’s almost fanatical obsession with the case, with one even suggesting that the French legal system was being taken for a ride to serve a greater political end.

Last Friday, Suaram held a fundraising dinner in Petaling Jaya to raise money for its activities, in which fresh allegations were made into the case. After months of trying, the New Straits Times secured an exclusive interview with the central figure in the deal.

It certainly wasn’t a cakewalk — this man guards his privacy jealously and with a passion. As the architect of the Scorpene submarine deal, the last seven years have taken their toll on Jasbir Singh Chahl.

Before this meeting, Chahl had steadfastly refused to make statements regarding this case, worried that he might be accused of perverting the course of justice. Throughout, he had been in constant communication with the French authorities and investigators and has voluminous evidence to back his claim, despite assertions by the opposition to the contrary.

As he places the teacup on the fine china saucer in his home in the heart of Kuala Lumpur with a finesse that betrays his English education and upbringing, Chahl pauses for a moment and draws a deep breath.

“I am willing to swear on my holy book, the Guru Granth Sahib, that I did not know this person, that she was never part of the team, had never met her, that she was never in France during the entire time we were there trying to close the deal and only knew about her when I read the papers in 2006 that they had found her body.”

One of the myths that has been “accepted” as gospel was that Altantuya had acted as a translator for Abdul Razak Baginda, who had helped Chahl broker the deal. Negotiations began in 2000 and were concluded in 2002.

If Altantuya was indeed Razak Baginda’s interpreter, she should have been present at all the meetings from 2000. And yet, in official French documents that were made available to the NST, the French police have stated categorically that Altantuya never entered France from 1999 to 2006, the year she died.

Incidentally, all these meetings were held in France with some in Malaysia. And they were all in English.

“This is not what I am saying, you understand. This is what the French authorities, the French police and the French judicial inquiry are saying.”

According to Razak’s Baginda’s evidence in court, he only met Altantuya in late 2004. The Scorpene deal was concluded in 2002.

Another fissure in the opposition’s argument seems to hinge on its so-called ‘understanding’ of Gallic pride and centres around the way DCNS conducts its business around the globe. It assumes that just because DCNS is French, the negotiations would have to be in French when the fact is that the French defence industry does deals all over the world in English.

Add to that, the French team was initially led by an Englishman, Martin Hill, who was himself, also fluent in French. So, if indeed the team needed an interpreter, it didn’t have to look very far, and certainly not in Mongolia, of all places.

In his deposition to the French authorities in 2010, former DCNS marketing manager for Malaysia and Singapore at the time, Fredric Faura, told investigators that there was no need for an interpreter since negotiations were in English and Malaysians were fluent in the language.

“You ask me why the blogs have gone around calling this girl Razak’s interpreter. You should direct that question to the blogs.”

Firing another shot across the bow, Chahl wonders why no one has stopped to question the credibility of the opposition that had readily admitted to doctoring a photograph to show Altantuya with Prime Minister Datuk Seri Najib Razak and Razak Baginda, purportedly in a Paris restaurant.

“This whole affair was a personal matter between Razak Baginda and Altantuya. His dealings with her had nothing to do with the Scorpene deal. It’s unfortunate that it coincided with our timeline (the submarine deal). Razak Baginda was the only common denominator in this. He was the only link, and a tenuous one, at best.”



Who is Jasbir Singh Chahl?

JASBIR Singh Chahl cut his teeth in the defence and oil and gas industry at a very early age. He was twentysomething, in London, and working with a Middle Eastern defence and construction company putting together multi-billion dollar deals. The relationships he forged with defence contractors in Europe and the rest of the world put him in good stead when he came home in 1981.

From 1996 to 1998, Chahl worked with Thomson-CSF International (M) Sdn Bhd, the wholly owned Malaysian subsidiary of France's Thomson-CSF (now Thales), on the Royal Malaysian Navy's Offshore Patrol Vessels (OPV) project, the Crotale man-portable SHORAD (shortrange air defence) system, and other projects of interest to Thomson-CSF and its subsidiaries.

Chahl's relationship with Thomson-CSF was further enhanced by his development of strategies and provision of inputs that led to the submission to the Malaysian Government of other defence-related projects. It was while working on these projects that he was told by Thales that it wished to focus on the sale of submarines to Malaysia.

This was something Thales had been pushing for more than a decade but had not been unable to make much progress. Thales felt that the timing for a concerted effort was now right — their various discourses with the RMN had led them to this conclusion.

They then requested him to analyse, evaluate and to develop a proposal to supply submarines to Malaysia, which culminated in the Scorpene purchase.



‘Everything was audited’

One of the major issues in the Scorpene submarine deal has to do with the word “commission”.

Specifically, the Euro115 million (RM452 million) that was paid to Perimekar Sdn Bhd, the company in charge of the logistics and the training of the officers and men of the Royal Malaysian Navy’s Submarine Force. And Jasbir Singh Chahl has a big problem with that.

“The amount is actually a service management fee,” says Chahl, exasperation and irritation creeping into his voice.

That the detractors have managed to turn it into a simplistic argument and package it as an example of unfettered greed; that it had succeeded, to a certain extent, in painting a picture that the monies were paid to grease the palms of government officials and corporations, makes Chahl’s stomach turn.

For the record, Perimekar, which is an audited company, is owned by KS Ombak Laut Sdn Bhd, the pension fund of the Armed Forces, LTAT, and by the industrial company, Boustead. Both of them are also audited.

The fees covered project management and project integration services, coordinating the involvement of Malaysian companies in the industrial participation programme in the provision of services during the construction phase and to monitor the performance of these firms, helping the main contractor comply with all local laws and procedures relating to the execution of the contract, coordinating and monitoring the training of RMN personnel in compliance with the main contract and in accordance with Malaysian Government and RMN expectations, and providing monthly reports on all of the above.

The biggest chunk of the fees went to the provision of accommodation and all the necessary services for the training of RMN personnel and their families in Brest, France, and Spain, for a period of six years, inclusive of health insurance premiums and per diem allowances of a minimum of Euro50 per person.

Other costs include their return travel fares to Malaysia three times a year. In all, 145 RMN personnel, including 49 officers and dependents were covered by this.

“We’ve been made out to look like profiteers who just sat back and collected when in actual fact, there was a lot of hard, tangible work, that was done,” Chahl says.

For the record, Perimekar’s profit after tax was RM105,111,191.

“The commercial offer was attractive because of the superior industrial participation programme that we put together. The countertrade and offset programme that we proposed as part of the overall proposal also swung the odds in our favour.

“Based on the strength and commercial superiority of the proposal, we didn’t have to lobby anyone to influence the commercial evaluation process. There was no need to.

“The Scorpene was the best nonnuclear powered-submarine that we, as a nation, could have selected.”

Dubious BN campaign procurement

On June 1st, 2013, about a month after the general election in the midst of fuming UMNO members and bloggers with the management and campaign for the general election, The Unspinners provoke his readers with a posting on a rumour of campaign fund being swindled involving the War Room, NCT, and UMNO headquarter. [read here].

An anonymous commentator by the name of HAMBA ALLAH YANG PRIHATIN DAN ANTI RASUAH verified and disclosed more details on the alleged swindling by high level people in Dato Najib's circle of trust in the party and also his Prime Minister's Department outfit.

Subsequently, The Unspinners made the comment into a dedicated posting [read here]. Bigdog and Sabahkini published it too. [read here and here.]

Since then, nothing is heard until a document surface yesterday.

An envelope was found in our mail-box and it contain a copy of a document. There is a note that tells us to reveal the document and many more will surface should we be harmed.

For precaution, we will not bother to pick-up unknown numbers. In fact, we never do. Response in the mainstream press, especially Utusan Malaysia. Most UMNO members sure wish to get to the bottom of this.

That is the very reason we are revealing it. Who cares about civil lawsuit?

In this document, Zeal Hitech made a purchase order to Utusan Malaysia to print and deliver 6 million copies of BN Manifesto for the 2013 General Election. The cost is RM6,250,000 - RM6 million for pamphlet at RM1 per copy and RM250,000 for Utusan Malaysia to make the delivery.

There is ref. no. ZEAL/ADMIN/P-ORDER/2013-0391 dated March 13th, 2013. The signatories of this Purchase Order is Managing Director, Azman Awaluddin and HR Manager, Zaima Hj Yusoff. 

This is puzzling because why would UMNO or BN purchase Manifesto through a third party? Why should UMNO use a third party to give a printing contract to Utusan Printcorp Sd Bhd, a subsidiary of Utusan Malaysia Berhad and in turn, Utusan is owned by UMNO.

If a third party is used, is there additional cost involved and how much did the third party benefit from this "atas angin" business?

Without adding any value, Zeal Hi-Tech would have made money out of nothing. The reason being, Zeal Hi-Tech is not in the business of printing or publication but IT business. It is not even in the business of services like desktop publishing.

Tetapi apa yang terjadi, syarikat tempat saya kerja ini di handpicked directly oleh Dato’ Raof dan kuncu-kuncunya seperti Dr. Zuraidi Ishak dan Sdra Nor Azwan Aziz dari Ibu Pejabat UMNO dan menyerahkan kontrak percetakan manifesto BN ini kepada ZEAL HITECH SOLUTION SDN. BHD.

Bukan setakat itu sahaja, Dato Khalid mantan ketua pengarang Utusan Melayu yang sekarang ini merupakan pengarah Kumpulan Komunikasi Nasional atau NCT yang bertanggung jawab sepenuhnya dalam hal ehwal media Perdana Menteri juga telah terlibat sama merencanakan pemberian kontrak ini kepada ZEAL HITECH SOLUTION SDN. BHD. Dan di pejabat PM pula Dato’ Sri Farid Ridwan juga berperanan menyakinkan pihak-pihak yang terlibat dalam sandiwara ini. Barang tentu, Utusan akan mempercayai kata-kata mereka ini yang semuanya berada rapat di inner circle PM dan apa yang mereka kata, pastinya pihak UTUSAN mempercayainya sebagai kata-kata PM.

Maka terjadilah sandiwara buku manifesto BN ini.

Saya hanya menyedari perkara ini kerana baru baru ini saya diminta oleh bos saya untuk menyiapkan tutntutan sebanyak hampir RM 90 juta kerana kerja-kerja mencetak manifesto BN untuk PRU13 lalu. Setahu saya, syarikat kami tidak ada lessen percetakan yang diluluskan oleh KDN.

ZEAL HITECH SOLUTION SDN. BHD. menuntut sebanyak RM12.83/naskah x 7 juta naskah yang dicetak.

Sedangkan, apa yang dibayar kepada Utusan hanyalah RM1.17/naskah x 7 juta naskah yang hanya berjumlah tidak sampai pun RM10 juta. Seperkara lagi, berapalah sangat gaji sebagai pengurus atau pengarah bahagian di ibu pejabat UMNO sehinggakan konco-konco Dato’ Raof ini berupaya membeli rumah tunai dan renovate rumah mereka dengan jumlah tiga kali ganda harga rumah berkenaan. Sila dapatkan maklumat mengenai rumah Dr. Ruzaidi Isyak dan Nor Azwan Ali. Apa kah mereka-mereka ini tidak tertakluk dengan perintah pengistiharaan harta.

Soalan saya,

1. Kenapa ZEAL HITECH SOLUTION SDN. BHD mendapat kontrak tersebut tanpa pun ada lesen percetakan seperti yang ditetapkan oleh KDN?

2. Mengapa Utusan tidak dapat kontrak berkenaan secara direct dari UMNO?

3. Siapa sebenarnya di belakang ZEAL HITECH SOLUTION SDN. BHD sehingga berlaku pengkhianatan terhadap Perdana Menteri ke tahap ini?

4. Siapa yang mendapat habuan lebihan RM80 juta itu Ini satu pengkhianatan terhadap YAB Perdana Menteri. Mereka yang sangat-sangat dipercayai sudah menjadi “harapkan pagar, pagar makan padi’.

Ini mesti dihapuskan kerana mereka semua ini adalah gunting dalam lipatan dan musuh dalam selimut. Surat ini dihantar dengan hasrat supaya satu siasatan oleh SPRM dilakukan dan Tan Sri juga mesti melaporkan hal ini kepada YAB PM. There are differences in the details between the volume ordered, and price charged by Zeal Hitech to Utusan Malaysia. It is left to MACC to investigate.

From what we know, the BN Manifesto was initially conceived by a committee of Phds and Professors headed by Dato Dr Ahmad Zahid Hamidi some two years ago. It was too long and had 40 pages of deliberations.

Then there is a second round vetting by a group of people and had it slashed to six pages.

Zahid is no more involved.


National Communication Team (NST) came in to redo it again. It is heard that Dato Dr Jamaluddin Jarjis or JJ came into the picture upon his return from Washington. He had an unofficial role as PM's Director of Operation for the Election..

JJ has presence in UMNO, War Room and NCT. He was also assisting PM to untangle difficult knots.

The commentator revealed names which are likely to be involved in the decisions to order and pay for the BN Manifesto.

There are names like Dato Raof who is UMNO Executive Secretary. He would have been involved in the paper work.

There is Dato Khalid Mohamed, who is Chairman of NCT and former Utusan Chief Editor,

We were told by friends in Utusan that he is very miserly with spending and could be the one to negotiate with Utusan to bring the price per copy down from the alleged RM1.17 to RM1.04.

According to the comment, Khalid has his eye wide open and is involved in dishing out the contract.

Former TV3 CEO during the time of Pak Lah and known to be a kaki ampu of the late Tun Hendon, Dato Farid Reduan is responsible to convince those inside the PM Department.

Over the Kuala Besut by-election, the talk among UMNO members was that this former CEO of TV3 was responsible for the merchandising the red, light green, and yellow colored T shirts emulating Royalti Minyak, anti Lynas and Bersih colors with the hope that voters will get confused. He ordered for millions.

One UMNO campaigner involved in merchandising had bargained for T shirt with a manufacturer from RM7 per T shirt down to RM5. During bargaining, the supplier told him that Farid ordered for his multi colored T shirts at RM7 per T shirt without bargaining.

We do not know of Azman Awaluddin and his mistress Jacqueline but it seems to be an open secret among fournalist that Azman is one of two former journalists so determine to be instant multi-millionaires.

Another one is in Perak.

It is not wrong to make money but it is wrong to swindle money and over charge. And it is wrong to be in business with an outfit one is working with. It is a conflict of interest.

Azman is heard to be working NCT and helped set it up together Khalid and with Osman Razak who was recently awarded Tan Sri. Osman Razak is in the War Room and former PM Department's Research. He conceive the idea to apply the concept of War Room to direct election.

Who decided to order via Zeal Hitech and agreed to the price?

Is it Osman Razak?

Or Khalid and Azman?

Or JJ who wants to be referred to for all decisions made, be it by NCT, or UMNO head office or everyone else?  If you do not entertain him, he will incessantly call you like a psycopath or make sure his man get to you by hook or by crook.

Or Raof?

He is living quite a lifestyle with rumours of a second wife at the Puteri Condominium behind The Mall across Seri Pacific Hotel, and red Lamborghini parked there.

Bloggers picking on Alies Nor will get nasty call from Raof. Is Alies Nor involved?

Let's not leave out Omar Ong because the talk along the The Mall is that he is not merely known as an Ethos Consultant and former McKinsey but does Western Union money transfer service using briefcase to deliver for an off-court settlement.

The money trail is easy and should be a piece of cake for MACC.

Of course, charging in court is at Tan Sri Gani Patail's personal discretion. Lawyers claim he boasted that there is no clever policeman and MACC investigator.

TPPA's shroud of secrecy

MITI Minister, Dato Mustapha Mohamed denied MITI is keeping secrets. He said we cannot reveal to details of the negotiation and negotiating plans. .

And, he gave assurance that we will hold on to three principles to uphold constitution and law, maintain the distinction between federal and state power, and no change in our policies.

There is no basis to keep secrets at least from the stakeholders because allow it for public scrutiny and willing to be rejected at state level.

Our worry is the someone knowledgeable and eloquent on this subject told us that the Chief Negotiator, Dato Dr Rebecca Fatima Sta Maria told them that after going through 17 rounds of negotiation, "It has been a good learning experience for them."

Secret deal

The claim that there is no secrecy is hard to swallow.

However, we take pity with Tok Pa. Dato Dr Jamaluddin Jarjis was the person who "Shake it up, baby" with President Obama. JJ then convince PM and an alleged secret deal was made with Obama.

Unfortunately, it is Tok Pa that end up doing the "Twist and shout" because he was instructed by PM to "Come on and work it out."

It looks as though JJ memandai-mandai but it is Tok Pa that end up having to explain at a MITI Open Day on Thursday August 1st beginning at 9 AM at Martrade Jalan Duta. To wake up in the morning? Sigh ... 

JJ was so smitten with Obama that we had a BN campaign run like a US Presidential election. We are no more campaigning and promoting BN but asking the people to love the PM.

Unfortunately, PM only ran in Pekan and not whole of Malaysia. That is the underlying reason a debate between Najib and Anwar is not relevant. For all you know, it is not Anwar that will be the choice for PR's PM. 

China factor



All the world could see in TPPA is that it is another version of the pre-World War II Japanese call for Co-Prosperity. That later end up them coming to invade Malaya, Sabah and Sarawak.

This time it is not the Japanese but a geo-global game by the American to use trade to contain China. However, it is sugar-coated as economic diplomacy by Vice President, Joe Biden recently in a speech at Georgetown University. Since when do these cowboys use diplomacy?

China has applied to be the 12th member of the TPPA but one will not expect an answer till there is something consummated in the Bilateral Investment Treaty between China and US.


There is a dateline on negotiation. To join the currently 11 nation TPP after it is signed, one will have to agree "hook, line and sinker" to the terms without any room to negotiate.

Nevertheless, what is the use of signing the TPPA if China is not included?


China is our second biggest trading partner and putting aside Singapore, which is merely an entreport, China is practically our main trading partner.

Eventually, it will be our biggest trading partner in the future. They are making big investment in Malaysia including in RAPID and tunnel project in Penang.

But the Americans do not want them, thus it is not advantageous on Malaysia.   

End of trade?


Will it mean that it is the end of trade if we do not sign it?

Our question to one commentator, who strongly argues on the ground of trades, is it really a lost cause?

One honest feedback from one patriotic successful entrepreneur is that Malaysia is competitive, thus we can trade even without TPPA.

It is consistent with what we had written before as in that most of the other trade agreements are not utilised and our exporters hardly bothered to involve the highly documentation requirement of exporting under trade agreements.

We do not know who the commentator is but that comments we got came from a trade "expert", seasoned and patriotic entrepreneurs, and none are Tingkat 4 or PEMANDU-types..

The same trade expert believe that fair trade terms cannot be reached.


Sadly, the commentator was not focused on TPPA and got astrayed in his debate with other commentators to complain for Malaysia's trailing development to Singapore.

Should have focus on TPPA because his argument is usual and rather myopic. It will eventually zero in on the  corrupt and inefficient UMNO/BN government of more than 50 years. Underlying it is racism and stereotyping Malays as corrupt and do not know how to govern.

It can be countered by saying non Malay also do not know how to govern well because some of the TPPA negotiators from MITI are non Malays. That is certainly not fair.

It will also not be fair to say that non Malay are not patriotic because too small numbers join police, soldiers. and civil servant but instead rather be illegal porn VCD sellers and easily angered street fighters and gangsters. 

Malaysia did not become developed in the mold of Singapore's city urban state because of many other  equally relevant factors.

This issue will be laid to rest and no comments entertained. Let us focus on TPPA.

Nation Building



TPPA will affect the whole nation.

It is not just Malay and their argument for subsidy and help. Though valid concern because Malays represent 60% of Malaysian population, thus issue affecting 60% of the nation need to be dealt with. It can't be left to Omar Ong's orang putih consultant, PEMANDU and Bangsar young ciku staff.

Few Chinese-based trade association, FMM and Chinese businessman wanted to see TPPA through but on the insidious selfish intention of denying any form of Malay special rights and affirmative action.

They should realise that the Chinese that benefit are only the 'big business' ones. Furthermore, TPPA is meant to benefit the MNCs, particularly the Americans.

Some 60% of Chinese SMEs are merely secondary product which depended on MNCs. These manufacturing outfits hardly create products of significance, develop markets, trained and developed human capital, and apply or develop new technologies of significance.

Despite plans laid out in the Industrial Master Plan (last being 2005-2015), such businesses remained labor intensive and rely on imported labours thus creating social problems. Yet the Chinese via DAP themselves complain.


For the Malays, Iban, KDM, Bajau, Orang Asli, Indians and remaining unselfish Chinese, together with other SME businesses, they will be severely affected by these selfish quick money businessmen.
 
Under TPPA, we will lose our sovereignty as a nation because MNCs can sue the government for policies meant to benefit and protect it's national interest. That will involve Melayu, Iban. Kadazan, Murut, Cina, India, etc.

For the interest of MNCs, Malaysia has to succumb to their whims and fancies through their barking dog, the Honalulu-born black boy.

It is not even for the benefit of the American people but international outfit more financially powerful than governments. The invisible stakeholders are only concern with power and increasing shareholders value.

We will not be able to put law and policies to build and develop the nation. And we will not be able to address the stumbling blocks to the progress of our economy, social, political, education, spiritual,etc. It is these invisible hands that determine our law. We are basically re-colonised!

In the Dark


The strange observation of TPPA and our negotiators are that they are keeping it all from the public. No one realised that Malaysia have been involved in the negotiation till the current 18th round is held in Kota Kinablu albeit secretly too.

In the past when Malaysia was involved in negotiations on GATT, Urugyay Round, AFTA, WTO, DOha and Kyoto, stakeholders views are sought after. Feedbacks are seek and compiled. Malaysia goes to the negotiations well prepared.

Still learning?
Thus, we do not say such things as "It was a good learning experiance." It means the Government had sent novices to negotiate!

When Malaysia was negotiating with the American for FTA, there were some 50 issues that was settled. That time, FMM, wholesomely agreed.

TPPA is worse yet they agree. WTF is Paul Low doing inside cabinet?

Another strange aspect of the secrecy is that there is a request to keep the negotiation and it's details under lid. The suspicion is that it is an instruction from Obama and JJ agreed.

In the US, it is not quite a secret but other countries must maintain secrecy. New Zealanders complained. Australians complained. Bet many others countries are complaining too.

Even that Global Research article here revealed 130 members of the American Congress demanded more transparency on the US Trade representative.

Tun Dr Mahathir told few parties meeting him recently that not only the the public is not allowed to know what was agreed during negotiations, they are not allowed to know 5 years after the agreement was signed. Is that not strange enough?

Out of public view the Obama administration is negotiating the Trans-Pacific Partnership agreement, a US-led free trade deal with several Pacific Rim countries. Six hundred US corporate advisers have had input, but so far the text hasn’t been shared with the public or media.

The level of secrecy is unprecedented. During discussions paramilitary teams guard the premises, helicopters loom overhead, and there’s a near-total media blackout on the subject. US Senator Ron Wyden, who chairs the congressional committee with jurisdiction over TPP agreement, was denied access to the negotiation texts.

In a floor statement to Congress Wyden said, “The majority of Congress is being kept in the dark as to the substance of the TPP negotiations, while representatives of US corporations — like Halliburton, Chevron, Comcast and the Motion Picture Association of America — are being consulted and made privy to details of the agreement.”

The deal would give multinational corporations unprecedented rights to demand taxpayer compensation for policies they think will undermine their expected future profits — straight from the treasuries of participating nations. It would push Big Pharma’s agenda in the developing world — longer monopoly controls on drugs, drastically limiting access to affordable generic meds that people need.

The TPP would undermine food safety by limiting labeling and forcing countries like the US to import food that fails to meet its national safety standards,  and ban Buy America or Buy Local preferences.

The proposed legislation on intellectual property will have enormous impacts, including Internet termination for households, businesses, and organizations as an accepted penalty for copyright infringement.

Nations who sign on to the deal would essentially submit themselves to oppressive IP restrictions designed by Hollywood, severely limiting their ability to digitally exchange information on sites like YouTube, where streaming videos are considered copyrightable.

“Broader copyright and intellectual property rights demands by the US would lock up the Internet, stifle research and increase education costs, by extending existing generous copyright from 70 years to 120 years, and even making it a criminal offense to temporarily store files on a computer without authorization. The US, a net exporter of digital information, would be the only party to benefit from this,” said Patricia Ranald, convener of the Australian Fair Trade and Investment Network.

It only shows to proof that TPPA is not for the common people's benefit and prosperity but secret deals for the big business MNCs to continue to leech on the masses. 


Najib ... please reconsider. Get your ears on the ground or TPPA can be a political tombstone. There is no such thing as no choice. The human minds knows better what to do and way to move forward.

MITI Open Day ploy for TPPA

Sometimes our politicians and government officials will meet certain groups for dialogues but content of the discussion is not made known. At times, it is requested to be kept a secret using the guise of closed door meeting.

When public pressure mounts on the Government, the Minister will say we have been engaging people. Most likely he or she will throw names to say we have talked with so and so NGOs. Even so and so have been deliberated to.

It is an old trick of governing that one can see it repeatedly happening in the British TV comedy doing a satire on government in "Yes Minister" and "Yes Prime Minister."

Continuing where we left off yesterday on "TPPA's shroud of secrecy", MITI Open Day on Thursday tomorrow looks to be such repeated ploy. The session is scheduled from 9 AM to 1 PM at Martrade building.

From what we gathered, the Minister will be speaking for about 30 minutes and then split to 9 different sessions.

His Excellency

His Excellency Dato Dr Jamaluddin Jarjis will have one special session entitled "Why I fall in love with Obama so much when he was the first person to congratulate PM for victory in the last general election, thus, we must sign the TPPA and it means a lot to my future career that Obama come to Malaysia in October?"

Just kidding and being cynical there.

Nevertheless, if you are critical on government and JJ is less than excellent in giving an answer but refuse to admit he is wrong, he will offer you to join Obama School of Political Campaign in Chicago.

His signature and recommendation carry much weight in White House. Why do you expect him to enter White House with a kris by his side in his expert required to fold Pahang samping? Folding Pahang samping is an industry in Pahang with so much Datokship being given out.

The Secret Service will not allow for it if JJ is not a close buddy and had his security clearance. Most important, Obama find his kris as no threat 

Take that offer to Chicago but get zonked all night till late morning at the many legendary Blues and Jazz joints in the South side. It means you do not have to bother to wake up and hear the Obama crap applied to Parliamentary democrasy system.

Public relation ploy

Part of the Obama technique involves handling a situation when government is accused of being secretive.

They will then alert the mainstream press to answer it this way. As far as the pro-BN cybertropper, they will just copy the script verbatim as long as some of them get paid.

Don't blame them for being mercenary because they have been used and their dedication not appreciated. More so, when there is so many talks of those in charge of bloggers skim a thick slab off the top.

If none gets anything and they do not get anything, they do not mind. How do they feel after dedicating oneself when someone admitted to the RM70 million bill to a third party for the BN Manifesto under the excuse of development cost?

How much does it cost to maintain say 10 Phd holders to prepare a manifesto over say three months? Then pay a couple of guys to be locked in a hotel room over a weekend to summarised it. Finally a committee of paid employee to give it a JJ or KM touch.

Hope the losing team of non-practising theoretician, ineffective social media operators and some wise guys pretending to be social media experts that is holed up a couple of days in a lab will finally find a winning formula. Sincerely hope they could learn the ropes fast .

Those at these labs will realise that not much information, understanding and dialogue can get done by having nine break-up session?

Miti: Why gov't cannot reveal the TPPA

The federal government is unable to disclose the details of negotiations over the much questioned Trans-Pacific Partnership Agreement (TPPA) because it has to ‘respect the position and views of other countries’ involved.

The countries are Australia, Brunei, Canada, Chile, Malaysia, Mexico, New Zealand, Peru, Singapore, the US and Vietnam.

International Trade and Industry Ministry (Miti) chief negotiator J Jayasiri (right) said the most important aspect of the negotiations is that the government will ensure the agreement will benefit the nation on the whole.

"That is why we need to conduct a cost-benefit analysis. It is our responsibility to negotiate the best deal for Malaysia," he told a forum on the ‘Impact of the TPPA’, organised by the Consumers Association of Penang (CAP) on Saturday.

"The government will decide whether it serves the national interest before signing it," he said.

"I am a civil servant and need to work within the current system.(I cannot reveal the text of the negotiations) unless the cabinet gives (me) a different directive.”

However, Jayasiri revealed that 20 questions on the TPPA will be raised during the new parliamentary session which starts today, and that Miti will provide the answers.

"The negotiation is also about my children and (our) future, (so) definitely, I (would) want to get the best deal for Malaysia,” he noted.

The next round of negotiations will be held from July 15-25, with Japan expected to participate for the first time.

Jayasiri also said Miti is not the only agency involved in the negotiations.

"Participation in the negotiations does not necessarily mean we will sign the agreement. The government will ensure that it is beneficial to the country and rakyat.

"It is not a zero-sum game, where you will not get everything that is good and other countries lose in other aspects. Many chapters have been discussed but those are references to the technical aspects, like use of terms and so on. Nothing has been agreed until everything is agreed.”

Furthermore, not all of the issues in the negotiations are being raised by the US, as other countries too have their own agenda, he pointed out.

The TPPA does not only touch on the opening of markets but on cooperation in terms of capacity building, he said.

"Sometimes, over-protection can result in local industries becoming too comfortable until they lose competitiveness," he added.

‘Reasons to reject TPPA’

CAP president SM Mohamed Idris gave five reasons why the TPPA must be rejected, including the requirement for all governments to maintain "secrecy on the negotiating texts until four years after the deal is signed".

Idris said another reason is that the investment chapter effectively empowers foreign corporations to "ignore and override" the domestic judicial, legal and parliamentary systems.

"Other provisions could greatly restrict the government's ability to balance the protection of public interest, health, the environment and human rights against the private interest of corporations," he told participants.

"Access to affordable, life-saving medicines for millions of people is under threat as the TPPA would provide higher protections for the patents and clincial data of big pharmaceutical companies.

"This would make it harder for generic companies to produce affordable generic medicines, as well as delay and restrict access to the public.”

Idris (left) said that, if the duration of copyright and patent is extended as the US has reportedly proposed - according to leaked texts - affordable access to information and knowledge would be harmed.

There would be negative impacts on the research and education sectors, he said.

"Reducing tariffs on farms and manufactured products may result in many people losing their jobs and livelihoods due to the resulting influx of cheaper imported goods putting our local companies out of business,” he added.

Other than MiTi, organisations that sent speakers to the forum were the Malaysian Aids Council, EcoKnights, Majlis Tindakan Ekonomi Melayu, Third World Network, and Jaringan Rakyat Tertindas.

Pakatan Rakyat MPs have called for a parliamentary select committee on the issue, although the coalition has said it will not oppose the TPPA if the terms were "fair".
We take cognizance that this is a Malaysiakini report and the reporter is a nut case. Since it came from an activist website, EcoKnights and hopefully they are not some basket case NGO like the ever oppose Singapore-based batu ronsen Third World Network, we will take it in good faith till something crops up.

It worries us and the future of our off spring and nation when at best Jeyasari can only say unable to disclose the details of negotiations to ‘respect the position and views of other countries’ involved.

Oh boy! Is he saying the interest of US and other nations is more important than the peoples' right to know? If not all, at least the stakeholders!

Government assurance

He said the government will ensure the agreement will benefit the nation on the whole. The key  operative word is "government will ensure."

But, the government did not ensure the public is safe from hardcore animal-criminals by abolishing Emergency Ordinance at will and that let loose 2,600 criminals.

Murder is happening everyday now.

The politicians both government and opposition played politics to the hilt without consideration for the safety of the public. Now that murder is happening daily, they are only playing bkame and defend game.

Hopefully government could ensure on the TPPA because the the Chief Negotiator and his two other mates, including Jeyasiri does not give us much assurance with TPPA being only a "good learning experience."

When will the learning stop and real work begin?

Will it be like enacting another set of law after one have simply abolish a couple of laws and rebranding it like a pussy cat law?

TPPA: Litigation and Power of Government

The MITI Open Day on TPPA will be held this morning beginning at 9 AM. at Martrade Building.

There have been many concerns raised and MITI should set the record straight because this country does not belong to only government official and politicians but more the people. There is no such thing as being more concern for other countries.

The one major concern in the back of every red blooded patriotic Malaysian is sovereignty.

The not so patriotic ones do not care. They leave the country and Talentcorp stupidly paid taxpayers money to entice them back with preferential salary over others willing to do service to the nation at already accepted payscale. .

When the currency rogues attacked us the purpose was to gain control over our economy. We resisted that because we were still free then. But after we sign the TPP we will be bound hand and foot. No more capital control. We will be colonised again. President Sukarno was right about neo-colonialism.
Those patriotic Malaysian should be concern when the power of government to do what is necessarily good for the people and nation. As far as those money driven greedy businessman with silo mindset that do not bother about the interest of the nation, ignore their oinking and barking.

U.S. Company Threatens Peru with Free Trade Lawsuit

(IPS) - The U.S. mining and metallurgical company Doe Run has once again challenged the Peruvian government. The Renco Group, of which it is a subsidiary, notified the government of its plans to start an international arbitration process, invoking the free trade agreement between this South American country and the United States.

The U.S.-based holding company said the arbitration will be filed in 90 days if no agreement is reached. What is behind this ultimatum?

In ads published Jan. 5 in newspapers in Lima, the Renco Group said it was turning to the mechanisms provided for by the trade promotion agreement because it had received "unfair treatment" at the hands of the Peruvian government and had not been given "protection and security" as an investor, as required by the treaty.

Doe Run began to run the large multi-metal smelter in the central Peruvian highlands city of La Oroya, known as one of the most polluted places on earth, after the plant was privatised and acquired by the Missouri-based firm in 1997.

When it won the concession to operate the plant, Doe Run promised to complete an environmental improvement programme, known by its acronym PAMA, within 10 years. But the Peruvian state also assumed a commitment to clean the soil in and around the town, because the factory, which was built in 1922 by the Cerro de Pasco Corporation, a U.S. firm, was taken over by the state-run Centromin Peru in 1974.

Doe Run now claims that Activos Mineros, the state-run firm that took over Centromin's responsibilities, has refused to clean up the soil in La Oroya, and "has refused to accept responsibility for the legal action brought by the citizens living in and near the town of La Oroya who claim various injuries resulting from alleged lead exposure and environmental contamination" from the smelter complex.

"But it is Doe Run that has failed to fully implement PAMA and has continued to pollute in La Oroya," former deputy minister of mines María Chappuis told IPS. "This communiqué is as if they were telling the government: we pollute and you clean up."

Chappuis resigned from her post in December 2004 to protest an extension of the PAMA deadline that the government granted to Doe Run.

The former official complained that the company wants the government to pay for any damages that a U.S. court could order for the families of more than 100 children with lead poisoning in La Oroya.

In late 2010, a court in St. Louis, Missouri, where Doe Run's corporate offices are based, ruled that 11 lawsuits filed against the Renco Group and Doe Run by a group of citizens from La Oroya could go ahead in that venue. The plaintiffs are suing over injuries from lead exposure and environmental pollution caused by the smelter.

If the court rules in favour of the plaintiffs, the company will have to pay reparations to the families of the children.

Doe Run committed itself, through PAMA, to reaching a target of 95 percent of children under six in La Oroya with a lead level below 10 micrograms of lead per decilitre of blood (mcg/dl), regarded by the World Health Organisation as the maximum safe limit.

But Peru's Health Ministry found that 99 percent of children under six in La Oroya had lead poisoning.

Doe Run also promised to build three sulphuric acid plants for its lead, zinc and copper processing operations. But the copper circuit plant, the most crucial, has not been completed.

As of mid-2009, Doe Run had failed to fulfil 20 percent of the PAMA programme. And since then, no progress has been made, because the company was temporarily shut down in June 2009 after declaring bankruptcy, despite soaring metals prices.

It then missed the July 2010 deadline set by the government of Alan García for proving that it had the necessary financing to restart operations and complete an environmental cleanup.

"The 90 day deadline (that Doe Run gave Peruvian authorities) sounds suspicious," said Chappuis. "What it is trying to do is provide enough time for the emergence of someone who yields to its pressure, as happened before, especially now, during an election year." General elections are due in April.

The former official was referring to a letter sent in October 2007 by then prime minister Jorge del Castillo (2006-2008) to then U.S. ambassador to Peru Michael McKinley, asking the State Department to intervene in a lawsuit that had recently been brought in Missouri against Doe Run Resources Corporation.

In the letter, Del Castillo asked the U.S. government to contact the Department of Justice and the St. Louis court, in order to avoid "setting a disturbing precedent for investors in both countries, which would undermine legal security."

In response to criticism, the former prime minister said he had sent the message "to avoid controversy in the face of the approval of the free trade agreement with the United States," which went into effect in early 2009.

If the international arbitration proceeding goes ahead, the Renco Group would become the first company to turn to the mechanisms for that purpose created by the free trade agreement.

"The Peruvian government must not make another mistake, and has to act cautiously," said economist José de Echave of CooperAcción, a Peruvian NGO working for development.

In response to a query by IPS, the Ministry of Energy and Mines said "The state will only pronounce itself on this matter through the legal routes."

Activos Mineros, for its part, published an insert in a local magazine, stating that it had planned to invest 35 million dollars in a cleanup plan between 2007 and 2015, and that so far 4.8 million dollars have been spent to carry out a study on soil remediation and urban cleanup actions.

IPS was also informed that Activos Mineros has already calculated how much Doe Run would have to pay Peru for the remediation, because it was reported that the contract establishes that if the company that took over the smelter did not have better environmental performance than Centromin, it would have to assume part of the costs.

"If in 2004 the company had not received an extension of the deadline for completing PAMA, the firm would not have invoked the free trade agreement, which did not enter into effect until five years later," de Echave said.

He also questioned claims that "a court like ICSID (International Centre for Settlement of Investment Disputes) has environmental sensibility, when its rulings tend to go in favour of investors."

De Echave pointed out that since the start of the negotiations of the free trade agreement, a number of organisations warned that the chapter on investment made too many concessions. "And today we're seeing the consequences," he said.
This basically cripples the power of authorities to safeguard the interest of the people and nation.

Governing is bounded by agreements and the final determinant is the court. It means the power as government has been shifted to the courts.

Decisions are made not for the interest of nation and rakyat but based on legal precedents, interest of few over many and arguments of lawyers. Lawyers arguments is seldom not for truth but the interest of their paymasters. They have no qualms to conveniently keep facts that is not favourable to their client at the expense of nation and rakyat.

And, the public think they are ladies and gentlemen in black.

As pointed out by Dr Mahathir, Government will not be allowed to solve it's "domestic problem" because the MNCs "don’t care."

When TPPA is signed, the country will not be doing trade.

Instead, as pointed out privately by a reknown former Federal judge, it will open up "thousands and thousands of litigation which will take years to reach decisions or settlements."

The government will be with faced with a bottleneck of international legal cases that usually takes 3 to 5 years to settle. Time will be spent addressing legal issues that there will be no time to do business and benefit from TPPA.


The problem lies with the reality that Malaysian at the apex of power and trade tend to have a colonised mind and get overawed with orang putih. In the case of Dato Dr Jamaluddin Jarjis, he is overawed with a mixed black American.

We refuse to listen from our own people but rely on foreign consultants with their fixed template to solve all solutions.

The proposed Transatlantic Trade and Investment Partnership (TTIP) between the EU and the US will open the floodgate to multi-million Euro lawsuits from corporations challenging democratic policies to protect the environment and public health, argues a new briefing by Corporate Europe Observatory and the Transnational Institute.

"A transatlantic corporate bill of rights" analyses leaked proposals for so-called investor-state dispute settlement under the proposed EU-US deal and reveals a determined lobby campaign from industry lobby groups and law firms to grant unprecedented rights to corporations to sue governments for legislation and regulations that interfere with their profits.

The proposal, which has come to light in leaked versions of the EU’s draft negotiating mandate for the transatlantic negotiations1, would enable US companies investing in Europe to skirt European courts and directly challenge EU governments at offshore tribunals. EU companies investing abroad would have the same privilege in the US.

Such far-reaching investor rights would bring a corporate litigation boom – that has so far mainly affected developing countries – to the US and Europe. Investor-state disputes have risen thirteen-fold from 38 cases in 1996 to 514 cases in 20122, often involving millions of dollars and regularly undermining democratic policies. In both Uruguay and Australia, US-based tobacco giant Philip Morris has sued over health warnings on cigarette packets; Swedish energy multinational Vattenfall is seeking $3.7bn from Germany following a democratic decision to phase out nuclear energy; and US-company Lone Pine is suing Canada for US$250 million over a moratorium on controversial shale gas extraction (fracking) in Quebec....
The Singapore-based Third World Network also has the same concern despite Singapore being one of the early founding members of TPPA. 

Return back to Dr Mahathir's posting as he reminded that we have lost out in several bilateral agreements because of our inability to negotiate. Our negotiator views the TPPA negotiation as "a good learning experience."
